B. PUBLIC HEARING ITEMS
B-1 CODE AMENDMENT NO. 92-5/DOWNTOWN SPECIFIC PLAN CODE
AMENDMENT/"VILLAGE CONCEPT" AND DOWNTOWN PARKING MASTER PLAN
(CONTINUED WITH PUBLIC HEARING OPEN FROM THE JUNE 8, 1993 `
PLANNING COMMISSION MEETING):
APPLICANT: City of Huntington Beach
LOCATION: An area bounded by Goldenwest Street, Pacific
Coast Highway, Beach Boulevard and Sixth Street.
On June 8, 1993, the Planning Commission continued Code Amendment
No. 92-5 in order to hold one (1) more public hearing on the
Downtown Specific Plan. The attached Downtown Specific Plan has
been revised to reflect the changes made by the Commission at their
June 8, 1993 meeting.
STAFF RECOMMENDATION:
Staff recommends that the Planning Commission approve the Downtown
Specific Plan Code Amendment/"Village Concept" and Downtown Parking
Master Plan and recommend adoption to the City Council.
THE PUBLIC HEARING WAS OPENED.
Gus Zisakis, 611-6th Street, spoke in regards to District 6. He
feels that live entertainment in this area is detrimental to the
area.
Lorretta Wolfe, 411-6th Street, spoke in regard to the Parking
Master Plan. She was concerned with the future impacts of
inadequate parking.
Jerry Buchanan, 20451 Craimer Lane, Huntington Beach School
District, stated the District's concern with the school facilities
language proposed for the Downtown Specific Plan. The District
requested a joint waiver of fees with the Board of Trustees and the
need for higher fees for affordable housing.
Susan Zisakis, spoke against live entertainment in District 6.
Bob Bolen, 1818 Pine Street,_ stated his concern with future parking
being inadequate.
Richard Harlow, 211 Main Street, encouraged adoption of incentives
for affordable housing provisions. He also stated that a provision
to provide parking should be sought if the parking plan does not
work.

Discussion ensued among the Commissioners regarding live
entertainment in District 6. The majority of the Commission did not
wish to remove live entertainment from District 6. The Commission
also discussed the School Districts proposed language, and again the
majority of the Commission felt the current language was adequate.

The Commission discussed the Downtown Master Parking Plan and
decided to recommend adoption to the City Council with the following
stipulations:
1. Prior to the Downtown Parking Master Plan becoming
operational, the Redevelopment Agency/City must identify and
acquire two (2) sites, one (1) in Area 1 and one (1) in Area 2
for future parking opportunities.
2. The following recommendations in the Downtown Parking Master
Plan shall be implemented:
a. Require the mandatory purchase of annual parking passes
for all employees at the time of business license renewal.
b. Increase the parking meter fee from $.25 per hour to $1.00
per hour for all downtown meters with a two (2) hour
maximum stay.
c. Maximize the amount of on -street parking spaces to
diagonal and reduce the number of parallel spaces.
d. Require residential parking passes for the non commercial
districts in the downtown area.
e. Require on -site parking for all projects one-half (1/2)
block or greater in size.
f. Require that any parking in -lieu fees be full cost
recovery based on the parking requirement for specific
uses. However, allow that these fees be paid over an
amortization period.
g. Require valet parking once the maximum buildout of
restaurant activity has been obtained.

h. Designate two (2) additional parking facility locations:
i. Include an option for an additional parking structure in the
Main -Pier Phase II project area, Block 104.
j. Include a surface parking facility at the north end, between
Sixth Street and Pecan Avenue, adjacent to Lake Street.
k. Require designated employee parking areas in the remote
portions of all parking facilities.
1. Eliminate all free public parking locations in the downtown.
m. Improve the signage for parking facilities.
n. Commercial projects greater than 10,000 square feet in size
shall be required to submit a parking management plan
consistent with the Downtown Parking Master Plan.
o. Require valet and/or remote parking for special event and
activities.
p. Conduct annual parking analysis to forecast when actual
number of spaces available requires new parking resources.
q. Investigate use of shared beach parking to accommodate after
6:00 PM peak hour uses, e.g. restaurant, theaters, and /or
employee.

On June 15, 1993, the Planning Commission was presented with a brief
overview of the draft Zoning and Subdivision Ordinance. Discussion
between the Planning Commission focused on the appropriate approach
to review the complex document. The Planning Commission continued
action on the draft Zoning and Subdivision Ordinance and directed
staff to publish a public hearing notice outlining the schedule of
hearing dates. The first public hearing begins with Title 20,
General Provisions, and Title 24, Administration.
STAFF RECOMMENDATION:
Staff recommends the Planning Commission approve Code Amendment No.
91-10 (Titles 20 and 24) and Negative Declaration No. 91-32
recommend their adoption to the City Council, and continue the
public hearing series to July 20, 1993.

Discussion between staff and the Commission ensued regarding the
Zoning Administrator taking on additional hearings, making it harder
for the public to be present. Staff explained that there is ample
notification to the public at the Zoning Administrator level, and
currently they receive only 1% of complaints about the times.

B-3 ZONE CHANGE NO. 92-3/NEGATIVE DECLARATION NO. 92-34:
APPLICANT-: Jack H. Ellsworth
LOCATION: 309 and 311 - 17th Street
Zone Change No. 92-3 is a request to redesignate and rezone a 0.13
net acre (5,875 square foot) site, located 100 feet north of Olive
Avenue on the west side of 17th Street, from a residential zone,
Townlot Specific Plan, Section B to C2 (Community Business).
The site is surrounded on three (3) sides with property zoned and
used for residential purposes. In addition, the General Plan
designates the surrounding property on all four (4) sides of the
subject site as Medium Density Residential. The two (2), 25 foot
wide lots are not suitable for commercial development because they
do not meet the minimum lot size and lot width requirements, they
would have difficulty providing adequate parking and landscaping,
and commercial development does not constitute the best use of the
two (2) subject parcels.
STAFF RECOMMENDATION:
Staff recommends that the Planning Commission approve Negative
Declaration No. 92-34 with one (1) mitigation measure and deny Zone
Change No. 92-3 because of incompatibility with the adjacent
residential uses.
THE PUBLIC HEARING WAS OPENED.
Jack Ellsworth, applicant, submitted correspondence from adjacent
business and photographs to the Commission. Mr. Ellsworth -gave a
brief history of the property from 1967 and the urged the Commission
to approve the request.
Russell Smith, PO Box 357, Seal Beach, spoke in support of the
request. He is seeking to purchase the property to build his
business.
Holly Rice, 306-18th Street, spoke in opposition to the request.
She was concerned with commercial being in residential areas and the
traffic it produces.

Clifford Bonner, 308-18th Street, spoke in opposition to the request
due to the truck traffic commercial will bring.

The Commission discussed their concern of approving a zone change
prior to seeing a plan for the building. The also discussed change

FINDINGS FOR APPROVAL - ZONE CHANGE NO. 92-3:
1. The proposed zone change from TLSP-B (Townlot Specific Plan
Section B) to OP (Office Professional) does conform with the
General Commercial Land Use Element of the General Plan.
2. The proposed zone change from TLSP-B (Townlot Specific Plan
Section B) to OP (Office Professional) is consistent with the
commercial properties to the south as well as the surrounding
residential land uses. A C2 (General Commercial) zone on the
subject property would not be compatible with the surrounding
land uses.

B-4 CONDITIONAL EXCEPTION (VARIANCE) NO. 93-23:
APPLICANT: City of Huntington Beach, Department of Public
Works
LOCATION: 1 Main Street (Huntington Beach Municipal Pier)
Conditional Exception (Variance) No. 93-23 is a request to permit
the height of the two-story pierhead restaurant to be 30 feet from
the surface of the pier to the midpoint of the roof line with 45
feet to the peak of the roof in -lieu of the code required 25 feet to
the midpoint and 35 feet to the highest peak. A variance is
required to allow the restaurant to exceed the maximum building
height. The Planning Commission and the City Council approved a
conditional use permit and a coastal development permit for
construction of all five (5) pier buildings in 1992.
STAFF RECOMMENDATION:
Staff recommends approval of the request because it is necessary to
place utilities above the pier deck for easier access and protection
from storm damage. This design results in a raised floor and
ultimatel a greater building height. In addition, the applicant
proposes to place the mechanical equipment within the roof volume
for a more aesthetically pleasing project.
THE PUBLIC HEARING WAS OPENED.
Doug Cavanavoh, 110 Newport Center Drive, Newport Beach, explained
that the designs were a product of the Pier Design Committee. Mr.
Cavanavoh gave a brief history and urged the Commission to approve
the request.

Conditional Use Permit No. 93-12 is a request to replace an existing
roof mounted antenna array for PacTel Cellular with a 50 foot tall
monopole and antennas at an existing retail shopping center.
STAFF RECOMMENDATION:
Staff recommends that the Planning Commission approve Conditional
Use Permit No. 93-12 with findings and suggested conditions of
approval.

FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 93-12:
1. The location and design of the proposed monopole and antennas
are compatible with existing streets, driveways, and other
adjacent structures and uses.
2. The granting of a conditional use permit to modify the existing
cellular facility will not adversely affect the General Plan of
the City of Huntington Beach.
3. The proposed use will not affect access to and parking on the
site because the facility is unmanned, and does not block
parking stalls or accessways.
4. The proposed modification to the existing cellular facility will
not be detrimental to the general health, welfare, safety and
convenience of persons working or residing in the vicinity, nor
detrimental or injurious to the value of property or
improvements.
CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 93-12:
1. The site plan, floor plans and elevations received and dated
May 11, 1993 shall be the conceptually approved layout.
2. Modification or placement of additional antennas on the site
shall require approval by the Planning Commission.
3. The applicant shall meet all applicable local, State and Federal
Fire Codes, Ordinances, and standards.
4.-The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
5. The Planning Commission reserves the right to revoke this
conditional use permit if any violation of these conditions or
the Huntington Beach Ordinance Code occurs.
6. This conditional use permit shall become null and void unless
exercised within one (1) year of the date of final approval, or
such extension of time as may be granted by the Planning
Commission pursuant to a written request submitted to the
Planning Department a minimum 30 days prior to the expiration
date.
B-6 CONDITIONAL USE PERMIT NO. 93-15:
APPLICANT: The Planning Consortium
LOCATION: 1905 Main Street (adjacent to the athletic field
and bus parking lot at the Huntington Beach Union
High School campus)

Conditional Use Permit No. 93-15 is a request to permit an existing
cellular communication facility with a 60 foot tall monopole and an
approximately 485 square foot equipment building and to allow a 30
foot extension to the height of the monopole. The facility is
located on the Huntington Beach Union High School campus adjacent to
the athletic fields and bus parking lot. The facility is and will
continue to be an unmanned facility with maintenance activities
occurring once every four (4) to six (6) weeks.
STAFF RECOMMENDATION:
Staff recommends that Planning Commission approve Conditional Use
Permit No. 93-15 with findings and suggested conditions of approval.

FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 93-15:
1. The establishment, maintenance and operation of a 107 foot
monopole with antennas for a cellular phone facility will not be
detrimental to the general welfare of persons residing or
working in the vicinity, nor to property and improvements in the
vicinity. In addition, the cellular phone facility will not
generate noise, traffic or other impacts which would be
detrimental to surrounding campus uses.
2. The 107 foot high monopole with antennas for a cellular phone
facility is consistent with the goals and objectives of the
City's General Plan and Land Use Map.
3. The operation of the 107 foot monopole will provide for more
efficient cellular communication for the downtown Huntington
Beach area by increasing signal strength and coverage and by
preventing the need for installation of three (3) additional
cell sites.

CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 93-15:
1. The site plan, floor plans and elevations received and dated
June 28, 1993 shall be the approved layout.
2. Placement of additional antennas on the site shall require
approval by the Planning Commission.
3. The Planning Commission reserves the right to revoke this
conditional use permit if any violation of the conditions or the
Huntington Beach Ordinance Code occurs.
CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State and Federal
Fire Codes, Ordinances and Standards.
B-7 APPEAL OF THE ZONING ADMINISTRATOR'S APPROVAL OF USE PERMIT
NO. 93-31•
APPLICANT: Emil G. Varona
LOCATION: 300 Pacific Coast Highway, Suite 101A (Pierside
Pavilion)
Use Permit No. 93-31 was conditionally approved by the Zoning
Administrator on June 9, 1993 permitting the establishment of a
newsstand at the Pierside Pavilion located at 300 Pacific Coast
Highway. The action taken by the Zoning Administrator required the
modification of the applicant's proposal, allowing only one (1)
outside newsstand. The approved newsstand was required to be
recessed into the side of the north wall, adjacent to the entry of
the lobby.
On June 18, 1993, Use Permit No. 93-31 was appealed by Planning
Commissioner Debbie Cook based on reasons that the proposal should
be further discussed at the Planning Commission level. Commissioner
Cook believes the existing newsstand is an acceptable use for
downtown; however, should be designed to be compatible with the
adjacent businesses and uses.
STAFF RECOMMENDATION:
Staff recommends that the Planning Commission deny the appeal and
approve Use Permit No. 93-31 as modified by staff with findings and
conditions of approval.

LOCATION: 5141 Warner Avenue (Meadowlark)
The applicant is requesting a one (1) year extension of time for
Conditional Use Permit No. 90-45, Conditional Exception (Variance)
No. 91-31, Meadowlark Master Plan and Tentative Parcel Map No.
90-268.
The applications were originally approved by the Planning Commission
on February 5, 1991. The Planning Commission then granted a six (6)
month extension of time for the above entitlements on October 6,
1992 which expires on August 5, 1993. Based on the reasons outlined
in the applicant's letter dated June 8, 1993 (see Attachment No. 1)
the applicant is once again requesting a second extension of time.
STAFF RECOMMENDATION:
Staff recommends that the Planning Commission approve a one (1) year
extension of time to August 5, 1994.

American Golf Corporation tournament. Counsel said it would
not under guidelines that he outlined.
Commissioner Biddle - disclosed that during their break that
evening he had received a note from Gus Zisakis. He read the
note into the record.
