ZONING ADMINISTRATOR: Mike Strange STAFF MEMBERS: MINUTES• ITEM 1: USE PERMIT NO. 93-19 Wayne Carvalho Jane Madera The Minutes of June 30, 1993 Zoning Administrator Meetings were approved. Applicant: Bill Kaufmann Andover Companies 2485 Huntington Drive, Suite 5 San Marino, CA 91108 Request: To permit the construction of a 253 unit apartment complex at the Wintersburg School site pursuant to Section 9120.1(c) of the Huntington Beach Ordinance Code. Location: 17100 Goldenwest Street Wayne Carvalho, Staff Planner, reported that the request was to permit the construction of a 253 unit apartment complex at the Wintersburg School site. Staff recommended that the item be referred to the Planning Commission Meeting of August 3, 1993 with expanded public notification due to the size and issues involved with the project. THE PUBLIC HEARING WAS OPENED. There were no persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 93-19 WAS REFERRED TO THE PLANNING COMMISSION MEETING OF AUGUST 3, 1993 BY THE ZONING ADMINISTRATOR. ITEM 2: USE PERMIT NO. 93-48 (TEMPORARY OUTDOOR EVENT) Applicant: Della Chadwell/Huntington Beach Mall 7777 Edinger Ave., #300 Huntington Beach, CA 92647 Request: To permit a temporary outdoor event for a 3 on 3 basketball tournament in the parking lot of Huntington Beach Mall on July 17 and 18 pursuant to Section 9730.64 of the Huntington Beach Ordinance Code. Location: 7777 Edinger Avenue (near former Barker Bros.) Jane Madera, Staff Planner, reported that the request was for a 3 on 3 basketball tournament on July 17 and 18. Staff recommended approval with findings and the standard conditions of approval. There were no persons present to speak for or against the request. USE PERMIT NO. 93-48 (TEMPORARY OUTDOOR EVENT) WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TWO CALENDAR (2) DAYS. FINDINGS FOR APPROVAL: 1. The temporary outdoor event for the three on three basketball tournament at the Huntington Beach Mall will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. Safe and adequate on -site circulation will be maintained throughout the site. b. Property and improvements in the vicinity of such use or building. The event will be held in the rear parking lot of Huntington Beach Mall. 2. The granting of Use Permit No. 93-48 will not adversely affect the General Plan of the City of Huntington Beach which allows commercial events of this type. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated June 23, 1993 shall be the conceptually approved layout. ZA Minutes - 7/7/93 -2- (7181d) 1 2. A minimum 24 foot wide fire access lanes shall be maintained to the North side of former Barker Bros. when emergency units respond from the West. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 3. A detailed site plan shall be submitted to the Huntington Beach Fire Department for approval (show table locations, tents, barriers, etc.). 4. The applicant shall obtain all necessary Fire Department permits and comply with all provisions of Article 32 of the Uniform Fire Code. 5. The applicant's request shall include necessary permits for temporary signs. 6. Fire extinguishers shall be provided in number and locations specified by the Fire Department. 7. A minimum of two (2) exits shall be provided and maintained. 8. Stand by personnel shall be on site to safeguard premises. INFORMATION OF SPECIFIC CODE REQUIREMENTS: 1. The event shall comply with all applicable provisions of the Ordinance Codes, Building Division and Fire Department. 2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 93-48 if any violations of these conditions or the Huntington Beach Ordinance Code occurs. 4. The applicant shall submit all future temporary outdoor event applications a minimum of thirty (30) days prior to the event. Failure to provide adequate notice shall result in denial of the request. ITEM 3: USE PERMIT NO. 93-45 Applicant: Monique Von Lutzow 10202 Cutty Sark -Drive Huntington Beach, CA 92646 ZA Minutes - 7/7/93 -3- (7181d) Request: To permit a two foot (2') wood extension to an existing six foot (6') high block wall along the rear property line pursuant to Section 9771(1) of the Huntington Beach Ordinance Code. Location: 10202 Cutty Sark Drive Wayne Carvalho, Staff Planner, reported that the request was to permit an existing two foot cedar wood extension on to an existing six foot high block wall which was the result of a code enforcement violation. Staff advised that one call was received in opposition to the request. Staff concluded by recommending denial based on incompatibality with the surrounding neighborhood. THE PUBLIC HEARING WAS OPENING. Monique Von Lutzow, the applicant, was present. She advised that the wall is on the property line and the fence borders on the condominium walkway which leads to Adams Street. She said the extension was to provide added privacy, reduce items which are thrown over the fence and eliminate people provoking her dogs. Dorothy Van Wyk, 10203 Halburn Drive, was present and spoke in opposition to the request. She said her property is directly behind the applicants and advised that the walkway is not a public walkway. She said the walkway is used only by the residents who live along the walkway. She said she was opposed to the extension because the wall severely reduces light coming into her home. Mary Armini, 10209 Holburn Drive, was present and spoke in opposition to the request. She said the entire back row of the condominiums are senior citizens and no one else uses the walkway. She said senior's are not throwing things over the fence or provoking Ms. Von Lutzow's dogs. Ruth Martin, 19802 Ascot Circle, was present and spoke in opposition to the request. She said if the City allows the Von Lutzow's to add on to their fence then other people will want to to the same. Don Connors, 10174 Ascot Circle, was present and spoke in opposition to the request. He advised that most of the residents of the condominiums are elderly and do not use the walkway. He disagreed with the applicant's statement that the two foot extension would prevent objects from being thrown over the fence. Monique Von Lutzow, the applicant, advised that she was unaware that the fence was not allowed per City Code and would take up the matter with the fence contractor. She submitted signatures of residents who supported the fence extension. There were no other persons present to speak for or against the request and the public hearing was closed. 7 L ZA Minutes - 7/7/93 -4- (7181d) USE PERMIT NO. 93-45 WAS DENIED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR DENIAL -USE PERMIT NO 93-45: 1. The establishment, maintenance and operation of the two foot (2') wood extension over a six foot (6') high block wall will be detrimental to: a. The general welfare of persons residing or working in the vicinity. The wood extension is detrimental to surrounding properties as the fence restricts sunlight into the adjacent townhomes. b. Property and improvements in the vicinity of such use or building. The wood extension is not compatible with the existing wall nor with the surrounding properties. 2. The granting of Use Permit No. 93-45 will adversely affect the General Plan of the City of Huntington Beach., The wood extension is not consistent with the goals and objectives of the Low Density Residential Land Use designation of the General Plan. USE PERMIT NO, 93-39 Applicant: Lettie M. Davis 607 llth Street Huntington Beach, CA 92648 Request: To permit the construction of a six (6) foot high masonry wall along the front property line including a three foot retainer pursuant to Section 9771(1) of the Huntington Beach Ordinance Code. Location: 202 6th Street Wayne Carvalho, Staff Planner, reported that the request was to permit the construction of a six (6) foot high masonry wall along the front property line including a three foot retaining wall. Staff recommended stepping back the six foot masonry wall three feet and concluded°by recommending approval with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Lettie Davis, the applicant, was present and said if the wall were stepped back three feet they would not have any front or side yard. She said that their home was on the corner and the wall was needed for protection and privacy. Mike Strange, Zoning Administrator, said he would approve the wall with openings on the front wall and pilaster construction and be reviewed and approved by the Design Review Board. USE PERMIT NO. 93-39 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL -USE PERMIT NO 93-39: 1. The construction and maintenance of the six foot high masonry wall will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. With the conditions imposed, the proposed wall will reduce any impacts to existing views. b. Property and improvements in the vicinity of such use or building. The proposed wall will conform with the minimum site angle visibility requirements. 2. The granting of Use Permit No. 93-39 will not adversely affect the General Plan of the City of Huntington Beach. The six foot high masonry wall along the front property line is consistent with the goals and objectives of the Mixed Use Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated June 7, 1993 shall be the conceptually approved layout with the following modifications: a. The proposed solid wall along the front property line shall be of pilaster construction compatible with the existing residence. 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing sets submitted for plancheck. ZA Minutes - 7/7/93 -6- (7181d) 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 5. The proposed wall shall be architecturally compatible with existing structures and shall be reviewed and approved by the Design Review Board. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 93-39 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 5: USE PERMIT NO. 93-34 Applicant: Cash and Associates 5772 Bolsa Ave. Huntington Beach, CA 92647 Request: To permit the construction of a new 2,600 square foot pump enclosure building, construction of approximately 450 lineal feet of 6' high retaining wall, relocation of existing flouride tanks and installation of two (2) 4,000 gallon propane tanks pursuant to Sections 9510.0(c) and 9771(1) of the Huntington Beach Ordinance Code. Location: 19051 Huntington Street Wayne Carvalho, Staff Planner, reported that the request for a new 2,600 square foot pump building, construction of approximately 450 lineal feet of 6' high retaining wall, relocation of existing flouride tanks and installation of two (2) 4,000 gallon propane tanks was a City project. Staff recommended approval with findings and the standard conditions of approval. THE PUBLIC HEARING WAS OPENED. Representatives from Cash & Associates were present who concurred with the suggested conditions of approval. There were no other persons present to speak for or against the request and the public hearing was closed. ZA Minutes - 7/7/93 -7- (7181d) USE PERMIT NO. 93-34 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL -USE PERMIT NO 93-34: 1. The establishment, maintenance and operation of the proposed pump enclosure building, retaining wall, relocated fluoride tanks, and new propane tanks will not be detrimental to the general welfare of persons residing or working in -the vicinity nor property and improvements in the vicinity of such use or building. The proposed improvements will not impact surrounding properties or property values. 2. The granting of Use Permit No. 93-34 will not adversely affect the General Plan of the City of Huntington Beach. The proposed new pump enclosure building and other improvements are consistent with the goals and objectives of the General Industrial Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated May 25, 1993 shall be the conceptually approved layout. 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. Service roads and fire lanes, as determined by the Fire Department, shall be posted and marked. Fire access lanes shall be maintained.
