ZONING ADMINISTRATOR: Mike Strange STAFF MEMBERS: Wayne Carvalho MINUTES: The Minutes of July 7, 1993 Zoning Administrator Meetings were approved. ITEM 1: COASTAL DEVELOPMENT PERMIT NO. 93-8/USE PERMIT NO. 93-24/NEGATIVE DECLARATION NO. 93-10 Applicant/ Richard B. Armstrong Property Owner: 745 Blackhawk Circle Vista, CA 92083 Request: To reactivate an existing oil well at the location described below for an indefinite period. Location: 806 Pacific Coast Highway Coastal Status: APPEALABLE Wayne Carvalho, Staff Planner, reported that the request was to reactivate an existing oil well which had been inactive for a number of years. Staff said the well was never abandoned and a provision in the zoning code allows reactivation. Staff concluded by recommending approval with suggested findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Richard Armstrong, the applicant, was present and concurred with the staff report. There were no other persons present to speak for or against the request and the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 93-8/USE PERMIT NO. 93-24/NEGATIVE DECLARATION WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) WORKING DAYS AND ANOTHER TEN (10) WORKING DAYS TO THE COASTAL COMMISSION. FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO, 93-8: 1. The request to permit the reactivation of an existing oil well conforms with the plans, policies, requirements and standards of The Coastal Element of the General Plan. The proposed oil well will not impact public views or access. ' 2. Coastal Development Permit No. 93-8 is consistent with the CZ suffix zoning requirements, the Downtown Specific Plan, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. The proposed development will conform with all applicable City codes. 3. At the time of operation, proposed oil well will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. All infrastructure currently exist to the site. 4. The proposed activation of the existing oil well conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. FINDINGS FOR APPROVAL -USE PERMIT NO 93-24: 1. The maintenance and operation of the reactivated oil well will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. With the conditions imposed, the operation will not impact the existing businesses and residences. b. Property and improvements in the vicinity of such use or building. All improvements currently exist to the site as there is an oil well currently operating at the site. 2. The granting of Use Permit No. 93-24 will not adversely affect the General Plan of the City of Huntington Beach. The reactivation of the oil well is consistent with the goals and objectives of the Visitor Serving Commercial Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated April 7, 1993 shall be the conceptually approved layout. 1 ZA Minutes - 7/19/93 -2- (7206d) 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 4. The proposed wall shall be architecturally compatible with existing wall. 5. All trees to be removed shall be relocated within the front landscape planter. 6. Construction shall be limited to Monday -Friday, 7:00 a.m. - 5:00 p.m. and shall be prohibited on Saturdays, Sundays and Holidays. 7. The double gate shall be protected by removable 4" posts per Fire Department Requirements. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall pay all applicable Public Works fees. 4. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 93-8 and Use Permit No. 93-24 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 2: USE PERMIT NO. 93-35 Applicant: Dr. Joseph A. Giacopelli 17791 Beach Boulevard Huntington Beach, CA 92647 Property Mr. & Mrs. Robert Taube Owner: 2622 Circle Drive Newport Beach, CA 92663 ZA Minutes - 7/19/93 -3- (7206d) Request: To permit the remodel of building which includes building and new parking 9220.1 of the Huntington Location: 17827 Beach Boulevard an existing commercial the demolition of an accessory lot layout pursuant to Section Beach Ordinance Code. Wayne Carvalho, Staff Planner, reported that the request was to remodel a portion of an existing building and demolish portions of the rear building and front building. Staff said that a modified site plan submitted by the applicant meets parking and landscaping requirements. Staff advised that the Design Review Board had reviewed the request and recommended approval. Staff concluded by recommending approval with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Ken Gould, representing the applicant, was present. He advised that up to $275,000 was budgeted for the proposed improvements. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 93-35 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL -USE PERMIT NO 93-35: 1. The establishment, maintenance and operation of the proposed medical building will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The proposed use is compatible with the surrounding uses and will not impact adjacent residences or businesses. b. Property and improvements in the vicinity of such use or building with the conditions imposed. The applicant will provide the necessary street and landscaping improvements to comply with City requirements. 2. The granting of Use Permit No. 93-35 will not adversely affect the General Plan of the City of Huntington Beach. The proposed remodeled medical building is consistent with the goals and objectives of the General Commercial Land Use designation of the General Plan. C 1 ZA Minutes - 7/19/93 -4- (7206d) SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated May 26, 1993 shall be the conceptually approved layout with the following modifications: a. One additional space shall be provided along the rear of the building, for a total of 34 off-street spaces. b. The landscape planter on the corner shall be modified to provide additional back-up area for the proposed handicap parking space. 2. A revised site plan shall be submitted depicting the modifications described above. 3. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 4. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing sets submitted for plancheck. 5. Prior to issuance of building permits, the following plans and items shall be submitted and/or completed by the applicant: a. Four (4) sets of landscape and irrigation plans to the Department of Community Development and Public Works for review and approval. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. c. The subject property shall enter into irrevocable reciprocal driveway and parking easement(s) between the subject site and adjacent property. A copy of the legal instrument shall be approved by the City Attorney as to form and content and, when approved, shall be recorded in the Office of the County Recorder. A copy shall be filed with the Department of Community Development prior to occupancy. d. A grading plan shall be submitted to the Department of Public Works for review and approval. ZA Minutes - 7/19/93 -5- (7206d) 6. Fire Department Requirements: a. Fire extinguishers shall be provided in number and at locations specified by the Fire Department. b. Address numbers shall comply with City Specification #428. Numbers for the building shall be sized a minimum 6" with a brush stroke of 1-1/2 inches, with individual units having minimum 4" numbers with a brush stroke of 1/2". c. Medical Gas Systems shall be installed and stored to comply with Fire Code Article 74, Division-ll. d. Corridors over 20 feet must provide exits. 7. _ Maximum separation between building wall and property line shall not exceed two inches (2")-. 8. Applicant shall pursue CalTrans approval for driveway modifications on Beach Boulevard. 9. The applicant shall remove and replace the existing driveway, sidewalk and six feet of paving on Beach Blvd. 10. The applicant shall remove and replace existing curb, gutter, sidewalk and paving to centerline of Ronald Road, adjacent to project per Public Works standards. 11. The applicant shall remove and replace one-half of existing alley adjacent to project per Public Works standards. 12. The applicant shall remove the driveway approach on Ronald Road and shall replace with a minimum twenty-seven foot (27') wide driveway with radius type construction. 13. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 14. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 15. All signs shall be brought into compliance with the Huntington Beach Ordinance Code prior to issuance of a Certificate of Occupancy. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. ZA Minutes - 7/19/93 -6- (7206d) 1 L 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 4. All applicable Public Works fees shall be paid prior to issuance of building permits. 5. "The applicant/owner shall be responsible for payment of Traffic Impact fees prior to issuance of a Certificate of Occupancy and/or final building permit approval." 6. Prior to issuance of Certificate of Occupancy the applicant shall restripe the parking lot so that it conforms to provisions of Article 960 of the Huntington Beach Ordinance Code. 7. The Zoning Administrator reserves the right to revoke Use Permit No. 93-35 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 3: USE PERMIT NO. 93-38 Applicant: Greg Parker, AIA Sail Catalina 5200 Warner Ave., Suite 201 Huntington Beach, CA 92649 Request: To permit the conceptual approval for establishment of a concession offering catamaran sailing trips pursuant to Section 9241(a) of the Huntington Beach Ordinance Code. The request includes the construction of a 64 square foot kiosk on an existing platform located in the plaza area. Location: 16400 Pacific Coast Highway Wayne Carvalho, Staff Planner, reported that the request was to permit the establishment of a concession offering catamaran sailing trips. Staff advised that the City could conceptually approve the request; however, the Coastal Commission had jurisdiction over final approval. Staff stated that there was an excess of parking and concluded by recommending conceptual approval. THE PUBLIC HEARING WAS OPENED. Greg Parker, the applicant, was present and advised that the proposed service would power over to Catalina in the morning and sail back in the afternoon. USE PERMIT NO. 93-38 WAS CONCEPTUALLY APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL (IN CONCEPT) -USE PERMIT NO 93-38: 1. The establishment, maintenance and operation of the Sail Catalina business will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The proposed business will not impact surrounding residences and business owners. b. Property and improvements in the vicinity of such use or building. The proposed business will be located within the existing plaza area with launching from the end of "D" dock which will reduce impacts to surrounding businesses. 2. The granting of Use Permit No. 93-38 will not adversely affect the General Plan of the City of Huntington Beach. The Sail Catalina business is consistent with the goals and objectives of the Visitor Serving Commercial Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated June 1, 1993 shall be the conceptually approved layout. 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing sets submitted for plancheck. 4. The applicant shall obtain all necessary approvals (permits, licenses, etc.) from the California Coastal Commission, City of Avalon, Public Utilities Commission and U. S. Coast Guard. 5. The proposed kiosk shall be architecturally compatible with existing buildings. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. All applicable Public Works fees shall be paid prior to issuance of building permits. 4. Munoz 9971 Kings Canyon Drive Huntington Beach, CA 92646 Request: To permit an existing six foot (6') high block wall to remain within 7' 7" of the front property line pursuant to Section 9771(1) of the Huntington Beach Ordinance Code. Location: 9971 Kings Canyon Drive Wayne Carvalho, Staff Planner, reported that the request was to permit an existing six foot (6') high block wall fence to remain within 7' 7" of the front property line. Staff advised that the request complies with the required corner cut off and did not present a site angle problem. Staff concluded by recommending approval with findings and suggested conditions of approval. ZA Minutes - 7/19/93 -9- (7206d) THE PUBLIC HEARING WAS OPENED. USE PERMIT NO. 93-46 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. THE ZONING ADMINISTRATOR ADVISED THE APPLICANT TO OBTAIN PERMITS WITHIN 45 DAYS AND 45 DAYS TO OBTAIN FINAL. FINDINGS FOR APPROVAL -USE PERMIT NO 93-46: 1. The establishment, maintenance and operation of the six foot (61) high brick wall will not be detrimental to: - a. The general welfare of persons residing or working in the vicinity. The fence is not located within the required site angle visibility area and will not pose a hazard to pedestrians and vehicles. b. Property and improvements in the vicinity of such use or building. The wall is compatible with the existing residence and surrounding properties. 2. The granting of Use Permit No. 93-46 will not adversely affect the General Plan of the City of Huntington Beach. The six foot (61) high brick wall is consistent with the goals and objectives of the Low Density Residential Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated June 17, 1993 shall be the conceptually approved layout. 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing sets submitted for plancheck. 4. Building permits shall be obtained within 45 days from the date of this approval; final building inspection shall be completed within 45 days from issuance of building permit.
