ZONING ADMINISTRATOR: STAFF MEMBERS: MINUTES: ITEM 1• USE PERMIT NO. 93-53 Applicant: Jeff Bergsma Mike Strange Wayne Carvalho, Jane Madera The Dynamic Duo The Minutes of July 21, 1993 Zoning Administrator Meetings were continued. 215 Main Street "A" Huntington Beach, CA 92648 Request: To permit the expansion of Powerhouse Gym into a 750 square foot second floor tenant space. The additional exercise space is intended as an aerobics room. Location: 200 Main Street, Suite 205 Jane Maderam Staff Planner, reported that the request was to permit the expansion of the Powrhouse Gym. Staff stated that parking for the use had been met because the site was previously analyzed under the general retail parking requirements. Staff concluded by recommending approval with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. There were no persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 93-53 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL -USE PERMIT NO 93-53: 1. The establishment, maintenance and operation of the expansion to a health and fitness gym will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The suite is surrounded by commercial uses and is a continuation of the existing gym on the first floor. The use will comply with Chapter 8.40, Noise, of the Huntington Beach Ordinance Code. b. Property and improvements in the vicinity of such use or building. The structure was constructed and intended for commercial use. The expansion of the health and fitness gym is appropriate in this vicinity. 2. The granting of Use Permit No. 93-53 will not adversely affect the General Plan of the City of Huntington Beach. The expansion of the health and fitness gym is consistent with the goals and objectives of the Mixed Use Land Use designation of the General Plan, which permits commercial development of this nature. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated June 29, 1993 shall be the conceptually approved layout with the following modifications: a. The aerobics room shall have a minimum of two (2) exits. 2. A revised site plan shall be submitted depicting the modifications described above. 3. The use shall comply with Chapter 8.40. Noise of the Huntington Beach Ordinance Code. 4. The applicant shall be aware that if specific noise and vibration resulting from the use impacts the adjacent business owners, then the applicant/business owner shall be responsible to mitigate the impacts to a level acceptable by the Community Development Department staff. All mitigation measures shall be at the expense of the applicant. ZA Minutes - 7/28/93 -2- (7307d) 1 5. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 6. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing sets submitted for plancheck. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 93-53 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 2: USE PERMIT NO. 93-51 Applicant: Paul J. Wesselink 17855 Beach Blvd. Huntington Beach, CA 92649 Request: To add a retail auto dealer's license to an existing pawn (jewelry and loan) shop. The request includes designation of one parking space area to meet CA DMV requirements as well as amending the hours of operation to 10:00 a.m. to 8:00 p.m. Location: 17855 Beach Blvd. Jane Madera, Staff Planner, reported that a problem occurred with mail out of the public hearing notices. Staff suggested that the item be continued to the August 4, 1993 Zoning Administrator Meeting to allow time for the hearing notices to be resent. THE PUBLIC HEARING WAS OPENED. There were no persons present to speak for or against the request and the public hearing was continued open. USE PERMIT NO. 93-51 WAS CONTINUED TO THE ZONING ADMINISTRATOR MEETING OF AUGUST 4, 1993 BY THE ZONING ADMINISTRATOR. ZA Minutes - 7/28/93 -3- (7307d) ITEM 3: COASTAL DEVELOPMENT PERMIT NO. 93-9/USE_PERMIT NO. 93-2 Applicant: Jerry Yates 5937 Naples Plaza Long Beach, CA 90803 Request: To permit the remodel and 2,500 square foot three (3) story addition to an existing two (2) story residence pursuant to Sections 9110.4(c) and 989.5.2 of the Huntington Beach Ordinance Code. The request includes a variance for an enclosed tower structure pursuant to Section 9110.4(c) of the Huntington Beach Ordinance Code. Location: 4052 Diablo Circle Wayne Carvalho, Staff Planner, suggested that the project be continued to the August 4, 1993 Zoning Administrator Meeting to allow staff time to re -advertise the public hearing to include a conditional exception (variance) request for reduction in upper story setbacks. THE PUBLIC HEARING WAS OPENED. There were no persons present to speak for or against the request and the public hearing was continued open. COASTAL DEVELOPMENT PERMIT NO. 93-9/USE PERMIT NO. 93-26 WAS CONTINUED TO THE AUGUST 4, 1993 ZONING ADMINISTRATOR MEETING BY THE ZONING ADMINISTRATOR. ITEM 4: USE PERMIT NO 93-37 Applicant: Pete Van Bysteren Beachview Mobile Community 17621 Gothard Street Huntington Beach, CA 92649 Request: To permit the establishment of a Manager's Unit within the existing Beachview Mobile Community pursuant to Section 9141 of the Huntington Beach Ordinance Code. Location: 17261 Gothard Street #21-A , Wayne Carvalho, Staff Planner, suggested that the project be continued to the August 4, 1993 Zoning Administrator Meeting to allow staff time to re -advertise the public hearing to include language on the nonconformity of the Mobilehome Park.
