PUBLIC HEARING ITEMS B-1 CODE AMENDMENT NO. 91-10/TITLE 25 and TITLE 21 (BASE DISTRICTS) - DRAFT ZONING AND SUBDIVISION ORDINANCE REWRITE (CONTINUED WITH PUBLIC HEARING OPEN FROM THE JULY 20, 1993 PLANNING COMMISSION MEETING): APPLICANT: City of Huntington Beach, Department of Community Development LOCATION: City-wide This is the third public hearing in a series of public hearings on the draft Zoning and Subdivision Ordinance. Title 25, Subdivisions, and Chapters 212, 213, 214, 215, of Title 21, Base Districts, will be the subject of this portion of the draft Zoning and Subdivision Ordinance. Titles 20, General Provisions, and 24, Administration, and Environmental Assessment No. 91-32 were approved July 7, 1993; Title 22, Overlay Districts, was approved July 30, 1993; and Title 25, Subdivisions, was continued to this meeting. STAFF RECOMMENDATION: Staff recommends the Planning Commission approve Title 25 and Chapters 212, 213, 214, 215 of Title 21 of the draft Zoning and Subdivision Ordinance, recommend their adoption to the City Council, and continue Code Amendment No. 91-10 with the public hearing open to August 17, 1993. The project will also include 56 parking spaces. The library will provide services to both the school and to the general public. STAFF RECOMMENDATION: Staff is recommending approval of Negative Declaration No. 93-11 and Conditional Use Permit No. 93-9 with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Jan Halversen; City of Huntington Beach Library, gave a brief description of the request, and stated she was available to answer any questions the Commission may have. Ernest Van Roon, applicant, stated he was available to answer any questions the Commission may have. The location, site layout, and design of the proposed 1,920 square foot branch library properly adapts the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. The location, access and parking are properly designed to accommodate the new library facility at the school. 2. The combination and relationship of one proposed uses to another on site are properly integrated. The inclusion of a fence to separate and protect the parking lot from the school uses of the site furthers this integrated relationship. .3. The access to and parking for the proposed school and library does not create an undue traffic problem. Adequate parking is provided and access to the site is properly addressed. CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 93-9: 1. The site plan, floor plans, and elevations received and dated April 20,- 1993 shall be the conceptually approve layout for the library building and adjacent parking area with the following modification: a. A minimum 42 inch high fence shall be noted on the plan and constructed around the perimeter of the new parking lot area. PC Minutes - 8/3/93 -4- (7389d) E 2. Prior to submittal for building permits, the applicant/owner shall complete the following: a. Elevations shall depict colors and building materials proposed. b. All rooftop mechanical equipment shall be screened from any view. Said screening shall be architecturally compatible with the building in terms of materials and colors. If screening is not designed specifically into the building, a rooftop mechanical equipment plan must be submitted showing screening and must be approved. c. If outdoor lighting is included, high-pressure sodium vapor lamps or similar energy savings lamps shall be used. All outside lighting shall be directed to prevent "spillage" onto adjacent properties and shall be noted on the site plan and elevations. d. The site plan shall include (or reference page) all conditions of approval imposed on the project printed verbatim. 3. Prior to issuance of building permits, the applicant/owner shall complete the following: a. Submit copy of the revised site plan, floor plans and elevations pursuant to Condition No. 1 for review and approval and inclusion in the entitlement file. b. A grading plan shall be submitted to the Department of Public Works for review and it must be approved (by issuance of a grading permit). A plan for silt control for all water runoff from the property during construction and initial operation of the project may be required if deemed necessary by the Director of Public Works. c. All applicable Public Works fees shall be paid. 4. Fire Department Requirements are as follows: a. On -site fire hydrants shall be provided in number and at locations specified by the Fire Department. b. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances, and standards. 5. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. PC Minutes - 8/3/93 -5- (7389d) 6. Prior to final building permit approval or issuance of a Certificate of Occupancy, the following shall be completed: a. The applicant shall restripe the parking lot so that it conforms to provisions of Article 960 of the Huntington Beach Ordinance Code. b. All improvements (including landscaping) to the property shall be completed in accordance with the approved plans and conditions of approval specified herein. c. Compliance with all conditions of approval specified herein_ shall be accomplished. d. The developer will be responsible for the payment of the Traffic Impact Fees at the time of final inspection. 7. The Planning Commission reserves the right to revoke Conditional Use Permit No. 93-9 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. 8. Conditional Use Permit No. 93-9 shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction shall be prohibited Sundays and Federal holidays. B-3 CONDITIONAL USE PERMIT NO. 92-33: APPLICANT: Great American Learning Center LOCATION: 18052 Lisa Lane (south of Talbert, east of Beach Boulevard) Conditional Use Permit No. 92-33 is a request to establish a daycare/preschool for 70 children at an existing public school site pursuant to Section 9634.3 of the Huntington Beach Ordinance Code. The proposed daycare/preschool meets all the code requirements for a day care center including adequate indoor and outdoor play area, security fencing and adequate parking. The center is compatible with the surrounding residential neighborhood. PC Minutes - 8/3/93 -6- (7389d) STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve Conditional Use Permit No. 92-33 with findings and suggested conditions of approval. A discussion ensued among the Commissioner's and staff regarding the use of vacant school sites and the uses that are compatible in them. THE PUBLIC HEARING WAS OPENED. Byron Conway, applicant, gave a brief description of the request, and stated he was available to answer any questions the Commission may have. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. The Commission stated concern over the fact the pre-school is currently in operation, and this was brought to their attention by a Code Enforcement issue. They requested staff to work with the school district to ensure they are aware of the procedures and policies of the City's zoning requirements. A MOTION WAS MADE BY GORMAN, SECOND BY DETTLOFF, TO APPROVE CONDITIONAL USE PERMIT NO. 92-33, WITH FINDINGS AND MODIFIED CONDITIONS OF APPROVAL, BY THE FOLLOWING VOTE: AYES: Bourguignon, Biddle, Richardson, Dettloff, Gorman, Inglee NOES: None ABSENT: Cook ABSTAIN: None MOTION PASSED FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO 92-33: 1. The proposed preschool is consistent with the goals and objectives of the City's General Plan and Land Use Map designation of low density residential which allows for preschools and day care centers. 2. The location, site layout, and design of the proposed day care/preschool properly adapts the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. The preschool is proposed at an existing school site. 3. The combination and relationship of one proposed to another on a site are properly integrated. The school previously served 450-500 school children and the proposed day care/preschool is compatible with the Community Facilities - Education overlay on this property. The access to and parking for the proposed day care/preschool does not create an undue traffic problem because the day care/preschool can be provided with parking as well as adequate ingress/egress. CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 92-36: 1. The site plan, floor plans, and elevations received and dated June 7, 1993 shall be the conceptually approved layout. 2. The applicant shall post signs in the parking lot to designate a minimum of five (5) parking spaces for loading and unloading of preschool clients only. 3. The applicant shall submit a copy of the Orange County Social Services license within 30 days of Planning Commission approval. 4. The applicant shall obtain a business license and certificate of occupancy within 30 days of Planning Commission approval. 5. The use shall conform to the following: a. Children attending the day care preschool center shall be restricted to designated play areas only, unless supervised by an adult. b. The day care/preschool center shall comply with all applicable requirements of Chapter 8.40, Noise Control of the Municipal Code. c. Enrollment shall be limited to a maximum of 70 children. 6. Fire Department requirements are as follows: a. A fire alarm system shall be installed to comply with Huntington Beach Fire Department and Uniform Fire Code Standards. Shop drawings shall be submitted to and approved by the Fire Department prior to installation. b. Fire extinguishers shall be installed and located in areas to comply with Huntington Beach Fire Code Standards. c. Storage and janitor room construction shall comply with Uniform Building Code requirements for E-3 occupancy. (One hour construction with 3/4 hour doors). d. Provide safe dispersal area for all persons located in an area so that no person (child) is closer than 50 feet from the building. 7. The Planning Commission reserves the right to revoke Conditional Use Permit No. 93-33 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. This conditional use permit shall not become effective for any purpose until an "Acceptance of Conditions" form has been properly signed and notarized by the applicant and returned to the Planning Division; and until the ten day appeal period has elapsed. 9. Conditional Use Permit No. 93-33 shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. B-4 SPECIAL SIGN PERMIT NO. 93-6: APPLICANT: Swain Sign Inc./Tire Station-' LOCATION: 16171 Beach Boulevard (southwest corner of Beach Boulevard at Stark Avenue) Special Sign Permit No. 93-6 is a request by Swain Sign, Inc. representing Tire Station for a 14'-6" high freestanding sign with 54 square feet of sign area in addition to existing wall signage. The Ordinance Code allows corner sites with less than 400 feet of frontage either wall signs or a freestanding sign. The freestanding sign is requested to replace an existing 30 feet high non -conforming freestanding sign. STAFF RECOMMENDATION: The Design Review Board evaluated the request and is recommending a modified sign which is maximum ten (10) feet, six (6) inches in height. Staff is recommending approval of the freestanding sign based upon the Design Review Board's modifications. THE PUBLIC HEARING WAS OPENED. Mario Diaz, Store Manager, gave a brief description of the request. Terie Righettini, representing applicant, explained their request for the height of the sign. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. The Commission asked staff why the Design Review Board had removed the company logo from the sign. Staff stated that Huntington Beach Sign Code does not permit logos on the this sign, and also the lettering was too small which would be difficult to read and possibly cause traffic hazards. Strict compliance with Article 961 will result in substantial economic hardship to the applicant because an existing pole sign is to be removed which is necessary for identification of the site. 2. There are unusual site or building characteristics that preclude Tire Station from yielding adequate signage from the provisions of the sign code. The existing bank building on the northwest corner of Beach and Stark blocks the view of the wall signs requiring that the site have both wall and a freestanding sign. 3. Due to the fact that there are special site or building conditions applicable to the site, although wall signage exist already, approval of additional signage for a 14' -6" high, 54 square foot freestanding sign is necessary to enjoy sign provisions enjoyed by surrounding properties. 4. Additional signage for this site would not constitute an aesthetic impact to the site and surrounding properties. 5. The proposed 14' -6" foot high, 54 square foot freestanding sign will not adversely affect other signs in the area. 6. The proposed 14' -6" foot high, 54 square foot freestanding sign will be compatible with signage in the surrounding area. 7. The proposed freestanding sign will not obstruct pedestrian or vehicular traffic vision. CONDITIONS OF APPROVAL - SPECIAL SIGN PERMIT NO. 93-6: 1. The site plan dated July 7, 1993 shall be the conceptually approve site plan with the following modifications: a. The building address number shall appear along the bottom of the sign. b. A planter area with eight (8) inch high curbing shall be provided around the base of the sign. PC Minutes - 8/3/93 -10- (7389d) 1 1 2. Removal of the existing pole sign is required within 30 days of date of approval of this entitlement. 3. The Planning Commission reserves the right to rescind this special sign permit approval in the event of any violation of the terms of the applicable zoning laws. Any such decision shall be preceded by notice to the applicant and a public hearing and shall be based on specific findings. C. CONSENT CALENDAR C-1 GENERAL PLAN CONFORMANCE NO. 93-9: APPLICANT: City of Huntington Beach, Department of Public Works LOCATION: Huntington Street (north of Main Street) General Plan Conformance No. 93-9 is a request to determine if the vacation of two (2) parcels generally located within the Huntington Street right-of-way approximately 300 feet north of Main Street is in conformance with the General Plan. The vacation of the right-of-way will allow the parcels to be returned to the adjoining property owners. This request is being processed as a result of preliminary Subdivision Committee Review comments on Tentative Tract Map No. 14662. STAFF RECOMMENDATION: Planning staff recommends that the Planning Commission find the street vacation in conformance with the General Plan. This recommendation is based upon the fact that the vacation is consistent with the goals and policies of the Land Use, Circulation and Housing Elements of the General Plan. Land Use: Encourage the rational use of land and other natural resources. The City has allowed development over Huntington Street further to the north and determined that the use of the remainder of this section of Huntington Street for public street right-of-way is no longer needed and may be vacated to the adjacent property owners for residential and landscape buffer purposes with the condition that the new Huntington Street terminus be designed to comply with Fire Department standards. 2. Land Use: To provide and maintain a quality living environmental so that members of all economic, social and ethnic groups may reside in areas of the City. Vacating these sections of Huntington Street to the adjacent property owners allows the areas now in the street to be utilized for residential development and, therefore, will contribute toward an increase in housing units available in the City. 3. Housing: To assure the adequate provision of sites for housing, the City of Huntington Beach shall identify and evaluate potential housing sites located with convenient access to arterial highways, public transportation, schools, parks, and recreational facilities shipping areas and employment opportunities. The subject sections of Huntington Street are located with convenient access to shopping and employment. Vacating this portion of Huntington Street to adjacent property owners will allow surplus property presently reserved for street development to be utilized for residential development and, therefore, will contribute toward an increase in housing units available in the City. 4. Circulation: Provide a transportation system that is consistent with efforts to minimize adverse environmental and aesthetic effects. The subject parcels are located within the existing street rights -of -way but are not necessary to provide efficient circulation to the area. Vacation of the parcels will maintain adequate emergency access and turn around space; the street vacation will also allow for provision of an additional landscape buffer between the existing condominium complex and future development to the west, which is considered aesthetically desirable. D. NON-PUBLIC HEARING ITEMS D-1 CONDITIONAL USE PERMIT NO. 83-16 - EXTENSION OF TIME: APPLICANT; Church of the Coastal and, Larry C. Knutsen, Administrative Pastor LOCATION: 7641 Talbert Avenue (north side of Talbert Avenue approximately 1,200 feet west of Beach Boulevard) PC Minutes - 8/3/93 -12- (7389d) 1 r__ Conditional Use Permit No. 83-16 was approved by the City Council on appeal on September 6, 1983 with a five (5) year limitation. A five (5) year extension of time was granted by the Planning Commission on March 7, 1989. The applicant is requesting and additional extension of time to continue the existing church at 7641 Talbert Avenue. STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve a five (5) year extension of time for Conditional Use Permit No. 83-16 with findings and suggested conditions of approval.
