1993 Zoning Administrator Meetings
were continued.

Request: To add a retail auto dealer's license to an existing
pawn (jewelry and loan) shop. The request includes
designation of one parking space area to meet CA DMV
requirements as well as amending the hours of operation
to 10:00 a.m. to 8:00 p.m.
Location: 17855 Beach Blvd.
Jane Madera, Staff Planner, reported that the request was to add a
retail auto dealer's license to an existing pawn shop. Staff
advised that the item had been continued from the July 28, 1993
Zoning Administrator Meeting. Staff concluded by recommending
approval of the request and identifying special conditions of
approval that no vehicles were to be stored on -site, all storage
off -site must take place only in locations approved for automobile
storage and all fire lanes must be maintained.
THE PUBLIC HEARING WAS OPENED.
Mr. Wesselink, the applicant, submitted signatures of adjacent
business owners in support of the request.
There were no other persons present to speak for or against the
request and the public hearing was closed.
USE PERMIT NO. 93-51 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL -USE PERMIT NO 93-51:
1. The establishment, maintenance and operation of the retail auto
dealer's license and expansion of the hours of operation for
the jewelry and loan shop will not be detrimental to:
a. The general welfare of persons residing or working in
the vicinity. All vehicles offered for sale or lease
in conjunction with the jewelry and loan shop will be
stored off -site in an approved location. The site is
adequately buffered from adjacent residential
properties.
b. Property and improvements in the vicinity of such use
or building. The existing building and improvements
will not be altered as a result of this action.
2. The granting of Use Permit No. 93-51 will not adversely affect
the General Plan of the City of Huntington Beach. The retail
auto dealer's license and expansion of hours for the jewelry
and loan pawnbroker is consistent with the goals and objectives
of the General Commercial Land Use designation of the General
Plan.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
June 28, 1993 shall be the conceptually approved layout.
2. There shall be no outside storage of vehicles (including
boats), vehicle parts, equipment or trailers and there shall be
no repair of vehicles or boats permitted on -site.
3. All storage of vehicles shall occur off -site and only in
legally permitted vehicle storage locations meeting all storage
and occupancy requirements of the Uniform Building Code.
4. The use shall comply with all conditions of approval previously
imposed under Use Permit No. 91-29 with the exception of
Condition of Approval No. 5. Conditional Approval No. 5 of Use
Permit No. 91-29 shall be amended to read:
"Hours of operation shall be restricted to 9:00 a.m. to
8:00 p.m. daily."

5. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
6. Fire Department Requirements:
a. Fire access lanes and access to fire hydrants shall be
maintained. If fire lane violations occur and the services
of the Fire Department are required, the applicant will be
liable for expenses incurred.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The applicant shall obtain the necessary permits from the South
Coast Air Quality Management District.
4. The Zoning Administrator reserves the right to revoke
Use Permit No. 93-51 if any violation of these conditions or
the Huntington Beach Ordinance Code occurs.
ITEM 2: USE PERMIT NO. 93-37
Applicant: Pete Van Bysteren-
Beachview Mobile Community

Huntington Beach, CA 92649
Request: To permit the establishment of a Manager's Unit within
the existing Beachview Mobile Community pursuant to
Section 9141 of the Huntington Beach Ordinance Code.
Location: 17261 Gothard Street #21-A
Wayne Carvalho, Staff Planner, reported that the request was
continued from the July 28, 1993 Zoning Administrator's meeting.
Staff advised that the manager's unit had been approved for a six
(6) month period in 1986 and that the unit has been at the present
location since.
Staff concluded by recommending approval with findings and suggested
conditions of approval.

Pete Van Bysteren, the applicant, was present and spoke in support
of the request.
There were no other persons present to speak for or against the
request and the public hearing was closed.
USE PERMIT NO. 93-37 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN

manager's unit is consistent with the goals and objectives of
the General Plan.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
June 1, 1993 shall be the conceptually approved layout.
2. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
3. Conditions of approval shall be printed verbatim on the cover
sheet of all working drawing sets submitted for plancheck.
4. Building permits shall be obtained for the mobile home within
45 days; final building permit approval shall be completed
within 45 days from issuance of permit.

COASTAL DEVELOPMENT PERMIT NO 93-9/USE PERMIT NO, 93-26
CONDITIONAL EXCEPTION NO. 93-30
Applicant: Jerry Yates

Request: To permit the remodel and 2,500 square foot three (3)
story addition to an existing two (2) story residence
pursuant to Sections 9110.4(c) and 989.5.2 of the
Huntington Beach Ordinance Code. The request includes
a variance for an enclosed tower structure pursuant to
Section 9110.4(c) of the Huntington Beach Ordinance
Code.
Location: 4052 Diablo Circle
Wayne Carvalho, Staff Planner, reported that the request was
continued from the July 28, 1993 Zoning Administrator Meeting.
Staff advised that a letter was received from Mel Miller, President,
HHPOA which indicated that the variance will not comply with the
Association's CC&R's. Staff indicated that the tower structure was
actually a secondary emergency access from the third story which is
required by the Uniform Building Code. Staff also indicated that
the stairway would lead from one balcony to another.
Staff concluded by recommending approval with findings and suggested
conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Jerry Yates, applicant, was present and advised that there would be
no living area in -the proposed tower.
Staff noted that there were several calls in opposition to the
request.

Howard Banzett, 16851 Edgewater Lane, was present and spoke in
opposition to the request due to the third story addition.
William Reeder, 4062 Diablo, was present and spoke in opposition to
the height for the chimneys.
There were no other persons present to speak for or against the
request and the public hearing was closed.
COASTAL DEVELOPMENT PERMIT NO. 93-9/USE PERMIT NO.
93-26/CONDITIONAL EXCEPTION NO. 93-30 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
(10) WORKING DAYS AND ANOTHER TEN (10) WORKING DAYS TO THE COASTAL
COMMISSION.
FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO 93-9:
1. Coastal Development Permit No. 93-9 to permit the remodel and
2,500 square foot, three (3) story addition to an existing
two-story single family residence in the coastal zone conforms
with the plans, policies, requirements and standards of The
Coastal Element of the General Plana The proposed three (3)
story addition will not impact public views and does not affect
public access.
2. Coastal Development Permit No. 93-9 is consistent with the CZ
suffix zoning requirements, the R1 Zoning District, as well as
other provisions of the Huntington Beach Ordinance Code
applicable to the property except for the variance (Conditional
Exception No. 93-30) for the three-story enclosed stairway
element which deviates from Section 9110.4(c) of the Huntington
Beach Ordinance Code.
3. At the time of occupancy, the proposed remodel and 2,500 square
foot three (3) story addition to an existing two-story single
family residence will be provided with infrastructure in a
manner that is consistent with the Coastal Element of the
General Plan. All infrastructure currently exist to the site.
4. The proposed remodel and three (3) story addition to an
existing two story single family residence conforms with the
public access and public recreation policies of Chapter 3 of
the California Coastal Act.
FINDINGS FOR APPROVAL -USE PERMIT NO 93-26:
1. Use Permit No. 93-26 for a 2,500 square foot, three (3) story
addition to an existing two-story single family residence will
not be detrimental to:

a. The general welfare of persons residing or working in
the vicinity. The proposed three (3) story addition
conforms with all city codes except for the variance
granted under Conditional Exception No. 93-30.
b. Property and improvements in the vicinity of such use
or building. All improvements currently exist to the
site. The improvements to the site will not be
altered as a result of this action.
2. The granting of Use Permit No. 93-26 will not adversely affect
the General Plan of the City of Huntington Beach. The 2,500
square foot addition is consistent with the goals and
objectives of the Low Density Residential Land Use designation
of the General Plan.
FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION NO, 93-30:
1. The granting of Conditional Exception No. 93-30 for reduction
in upper story setbacks for the enclosed stairway will not
constitute a grant of special privilege inconsistent upon other
properties in the vicinity and under an identical zone
classification. There are other three (3) story homes in the
immediate vicinity and within the harbor area. The tower
structure will maintain an eight foot (81) rear yard setback;
minimum rear setback for the structures on subject property is
five feet (5').
2. Because of special circumstances applicable to the subject
property, including surroundings, the strict application of the
Zoning Ordinance is found to deprive the subject property of
privileges enjoyed by other properties in the vicinity and
under identical zone classifications. The subject property is
a waterfront lot located in the vicinity of other three (3)
story dwellings. Furthermore, the enclosed stairway (tower)
will provide secondary emergency access from the third floor to
conform with Uniform Building Code standards.
3. The granting of Conditional Exception No. 93-30 is necessary
in order to preserve the enjoyment of one or more substantial
property rights. The granting of Conditional Exception No.
93-30 will permit a 2,500 square foot, three (3) story addition.
4. The granting of Conditional Exception No. 93-30 will not be
materially detrimental to the public welfare, or injurious to
property in the same zone classifications. The location, site
layout, and design of the proposed tower structure properly
adapts to adjacent structures and uses in a harmonious manner.
5. The granting of Conditional Exception No. 93-30 will not
adversely affect the General Plan of the City of Huntington
Beach. The 2,500 square foot addition is consistent with the
Low Density Land Use designation of the General Plan.

6. Approval of Conditional Exception (Variance) No. 93-30 for a
reduction in upper story setbacks for a third story enclosed
stairway will result in no modification to the requirements of
the Coastal Land Use Plan.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
July 29, 1993 shall be the conceptually approved layout.
2. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
3. All proposed dock and ramp improvements shall require separate
permits for the improvements located within the public
waterways.
4.
All proposed cantilevered deck improvements require separate
permits for the improvements.
5.
All building spoils, such as unusable lumber,
wire, pipe, and
other surplus or unusable material, shall be
disposed of at an
off -site facility equipped to handle them.
6.
Proposed structures shall be architecturally
compatible with
existing structures.
7.
Water service shall be upgraded to include a
two inch (2")
water meter and back -flow device pursuant to
Public Works
standards.
8.
Automatic sprinkler systems will be installed
throughout to
comply with Huntington Beach Fire Department
and Uniform
Building Code standards.
9.
Smoke detectors shall be installed to comply
with Uniform
Building Code requirements.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The applicant shall pay all applicable Public Works fees.

ITEM 4: COASTAL DEVELOPMENT PERMIT NO. 93-13
Applicant: Milton Dardis

Request: To permit the construction of a 499 square foot
addition to an existing single story, single family
dwelling pursuant to Section 989.5.2 of the
Huntington Beach Ordinance Code.
Location: 22052 Capistrano
Jane Madera, Staff Planner, reported that the request for a 499
square foot addition meets the Coastal Zone and Flood Plain Code
requirements for construction and recommended approval with findings
and suggested conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Jeff Dahl, representing the applicant, was present and concurred
with the suggested conditions of approval.
There were no other persons present to speak for or against the
request and the public hearing was closed.

ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
