ITEM 1 • COASTAL DEVELOPMENT PERMIT NO.93-10 NEGATIVE DECLARATION NO.93-14 Applicant: UNOCAL 1201 W. 5th Street P. O. Box 7600, Rm. 522 Los Angeles, CA 90051 Request: To install approximately 3,500 lineal feet of eight (8) inch underground natural gas pipeline along the street segment described below. The new pipeline will interconnect UNOCAL's existing pipeline located on Warner Ave. approximately 3,200 feet east of Pacific Coast Highway, with the City of Long Beach Gas Department's system located at the intersection of Bolsa Chica Street and Los Patos Avenue. The project includes construction of a block wall enclosure (25' X 30') south of the intersection of Warner and Los Patos Avenues for the pipeline metering facility. Wayne Carvalho, Staff Planner, reported that the project was reviewed by the Environmental Assessment Committee. The Committee recommended a mitigated Negative Declaratixon be filed. Staff indicated that a letter from the Environmental Board was received after the comment period. The Board recommended suggested conditions relative to the height of the metering facility enclosure and starting time at 8:00 AM. Staff recommended that the start time be consistent with the Ordinance Code which is 7:00 AM. Staff concluded by recommending approval with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Ray Jackson, representing the applicant, was present and concurred with staff s recommendation. There were no other persons present to speak for or against the request and the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO.93-10 AND NEGATIVE DECLARATION NO.93-14 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS AND ANOTHER TEN (10) WORKING DAYS TO THE COASTAL COMMISSION FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO.93-10: 1. The request to permit the installation of 3,500 lineal feet of 8" underground natural gas pipeline conforms with the plans, policies, requirements and standards of the Coastal Element of the General Plan. The proposed Coastal Development Permit No. 93-10 will not impact public views or access. 2. Coastal Development Permit No. 93-10 is consistent with the CZ suffix zoning requirements, the RI Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. The proposed development will conform with all applicable City codes. 3. The proposed gas pipeline installation is consistent with the Coastal Element of the General Plan. The proposed gas pipeline installation conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. SPECIAL CONDITIONS OF APPROVAL: 1. The site plans, and elevations received and dated September 16, 1993 shall be the conceptually approved layout. 2. The Zoning Administrator shall be notified in writing if any changes are proposed as a result of the plan check process. Construction shall not commence until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. The applicant shall provide a minimum twenty foot (20') wide drive at all times for fire emergency access. 4. The pipeline installation shall comply with all Public Works standards. ZA Minutes - 9/22/93 -2- 5. All surplus soil and unused materials (including asphalt) shall be disposed of at an off -site facility equipped to accommodate them. 6. During pipe installation and trench excavation, the applicant shall control fugitive dust be regular watering of soil piles and exposed dirt. 7. During pipeline installation the applicant shall: a. Use low sulfur fuel (.05% by weight) for construction equipment. b. Phase and schedule construction activities to avoid high ozone days (first stage smog alerts). C. Discontinue installation activities during second stage smog alerts. d. Maintain equipment engines in proper tune. 8. Equipment used in installing pipeline shall be equipped with double mufflers. 9. Construction activities shall be limited to Monday - Friday 7:00 a.m. - 5:00 p.m. Construction is prohibited on Saturdays, Sundays and Federal Holidays. 10. Prior to installation of the pipeline, the applicant shall submit an emergency response plan for approval by the Fire Department. 11. Prior to installation of pipeline, the applicant shall submit a construction plan for approval by the City's Traffic Division. 12. Trenches shall not be left open. Trenches which have not been back -filled at the end of the day shall be covered with plates. 13. Prior to initiation of trenching activity, the applicant shall contact all utility companies which have lines within the subject rights -of -way of trenching activities. 14. A professional archeologist shall be retained to monitor any earth moving activities in areas other than under existing streets/street improvements. 15. Prior to pipeline installation, the applicant shall submit payment of the mitigation monitoring fee in the amount of $250.00. INFORMATION OF SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. ZA Minutes - 9/22/93 -3- 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 93-10 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. ITEM 2• USE PERMIT NO.93-52 Applicant: Cambro Manufacturing Company 7601 Clay Avenue Huntington Beach, CA 92647 Request: To permit the conversion of 81,617 square feet of warehouse space into manufacturing use, to install a storage silo, and to comply with the requirements of the Transportation Demand Management Ordinance. The request also includes a parking management plan to demonstrate efficient use of parking on -site. Location: 7601 Clay Avenue Jane Madera, Staff Planner, reported that the the parking requirements are different for manufacturing and warehouse. She stated that Cambro Manufacturing had provided a parking management plan which demonstrates with the 24 hour operation, parking is sufficient. Staff advised that one letter was received in opposition to the request referencing odors, parking problems and noise. Staff indicated that the new manufacturing building has no doors or windows that face residential so that noise and odors should be contained within the building. Staff recommended approval with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Steve Thomson, representing the applicant, advised that no additional building would be added except for the silo. He said the new facility would not generate more noise. Juan Lopez, 19222 Huntington Street, was present and spoke in opposition to the request. He said the main problem is noise from the compressors that come on at 6:30 AM. He said that their home sometimes vibrates from the compressors. He said another concern was that odors may increase with increased manufacturing and also there was a problem with employees parking on Clay. ZA Minutes - 9/22/93 -4- Steve Thomson responded that Cambro had always been a good neighbor and worked with Mr. Lopez in the past to resolve problems. He also said that they would not beadding any additional compressors. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO.93-52 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. 1. Use Permit No. 93-52 for the establishment, maintenance and operation of the conversion of 81,617 square feet of warehouse to manufacturing, construction of a new storage silo, implementation of the Transportation Demand Management Ordinance, and provision of a parking management plan will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. All manufacturing activities will take place entirely within the building. In addition, noise can be maintained at acceptable levels as there are no openings in the walls of the buildings facing residential properties. The Parking Management Plan demonstrates that sufficient parking (303 spaces) is provided on -site for Cambro's peak employee shift (275 employees). Furthermore, the parking demand can be reduced by Cambro's carpooling incentive program and compliance with South Coast Air Quality Management District's alternate transportation mode requirements. b. Property and improvements in the vicinity of such use or building. The new manufacturing use will take place entirely within existing buildings. The existing improvements in the area will not be altered as a result of this action. 2. The granting of Use Permit No. 93-52 will not adversely affect the General Plan of the City of Huntington Beach. The warehouse to manufacturing conversion, construction of a new storage silo, implementation of the Transportation Demand Management Ordinance, and provision of a parking management plan are consistent with the goals and objectives of the General Industrial Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated August 30, 1993 shall be the conceptually approved layout with the following modifications: ZA Minutes - 9/22/93 -5- a. The summary legend shall be revised to indicate 21,500 square feet of building C to remain warehouse. 2. A revised site plan shall be submitted depicting the modifications described above. 3. An annual review of the use and operation, particularly the parking management plan, shall be conducted by the Zoning Administrator in a public hearing forum. Should the annual review demonstrate a deficiency in parking on -site, or when the number of employees on the largest shift exceeds the 303 on -site parking spaces, the applicant shall be responsible for provision of additional parking. The parking may be provided either at an off -site location with complimentary shuttle service, construction of additional parking at existing buildings on -site, construction of a parking structure, or any other method subject to review and approval by the Zoning Administrator. 4. All construction improvements required under the Transportation Demand Management Ordinance shall be in place and functional no more than two (2) years from the date of final approval action on Use Permit No. 93-52. 5. All aspects of the twenty-four (24) hour manufacturing use shall comply with the provisions of the City of Huntington Beach Noise Control Code which limits the acceptable decibel levels at the site and at any adjacent residential property. 6. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 7. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing sets submitted for plan check. 8. Prior to issuance of building permits, the following plans and items shall be submitted and/or completed by the applicant: a. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 9 Fire Department Requirements: a. Automatic sprinkler systems will be installed throughout to comply with Huntington Beach Fire Department and Uniform Building Code Standards. ZA Minutes - 9/22/93 -6- Shop drawings for new and modified systems will be submitted to and approved by the Fire Department prior to installation. b. A Class III wet standpipe system (combination) will be installed to comply with Huntington Beach Fire Department and Uniform Building Code Standards. Shop drawings will be submitted to and approved by the Fire Department prior to installation. C. A fire alarm system will be installed to comply with Huntington Beach Fire Department and Uniform Fire Code Standards. Shop drawings will be submitted to and approved by the Fire Department prior to installation. The system will provide the following: • water flow, valve tamper • 24 hour supervision • Annunciation • Audible Alarms d. Fire extinguishers will be installed and located in areas to comply with Huntington Beach Fire Code Standards. e. Security gates will be designed to comply with City Specification #403. Gate off Huntington Street needs reevaluation to be fully operational for emergency access. f. Installation or removal of underground flammable or combustible liquid storage tanks will comply with Orange County Environmental Health and Huntington Beach Fire Department requirements. g. Fire access roads will be provided in compliance with the Huntington Beach Fire Code and City Specification #401. Include the circulation plan and dimensions of all access roads (24' or 27' fire lanes, turnarounds and 17' by 45' radius turns.) h. Building uses and remodeled area must comply with the Uniform Building Code. i. All Hazardous Material storage, handling and use must comply with Article 80 of the Uniform Fire Code. 10. Proposed structures shall be architecturally compatible with existing structures. INFORMATION ON SPECIFIC CODE REQUIREMENTS ZA Minutes - 9/22/93 -7- 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 4. Development shall meet all local and State regulations regarding installation and operation of all underground storage tanks. 5. The Zoning Administrator reserves the right to revoke Use Permit No. 93-52 if any violation of these conditions of the Huntington Beach Ordinance Code occurs.
