ITEM 1• USE PERMIT NO 93-73 (TEMPORARY OUTDOOR EVENT) Applicant: Mr. Ks Karaoke/Robert Kajima 300 Pacific Coast Highway, Suite 112 Huntington Beach, CA 92648 Request: To permit a one (1) day Temporary Outdoor Event (October 7, 1993) to include live entertainment in the Pierside Pavillion courtyard between the hours of 5:00 - 7:00 p.m. pursuant to Section 9730.64 of the Huntington Beach Ordinance Code. Location: 300 Pacific Coast Highway Jane Madera, Staff Planner, reported that the request was for a one day temporary outdoor event on October 7, 1993 to mark the opening of Mr. Ks Karaoke. Staff recommended if speakers were used, they be positioned to face away from the adjacent residential. Staff concluded by recommending approval with findings and suggested conditions of approval. Jason Fortner, representing the applicant, was present and concurred with the suggested conditions of approval. There were no other persons present to speak for or against the request. USE PERMIT NO.93-73 (TEMPORARY OUTDOOR EVENT) WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TWO (2) CALENDAR DAYS. 1. Use Permit No. 93-73 for a temporary outdoor event on October 7, 1993 will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The event will be for two (2) hours only. Loudspeakers will be oriented away from the adjacent residential property and the event will cease at 7:00 p.m. b. Property and improvements in the vicinity of such use of building. This action will not alter the existing improvements in this area. 2. The granting of Use Permit No. 93-73 will not adversely affect the General Plan of the City of Huntington Beach. The event is temporary. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated September 20, 1993 shall be the conceptually approved layout. 2. The applicant shall obtain all necessary Fire Department permits and comply with all provisions of Article 32 of the Uniform Fire Code. 3. The applicant's request shall include necessary permits and temporary signs. 4. Stand by personnel shall be on site to safeguard premises. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The event shall comply with all applicable provisions of the Ordinance Codes, Building Division and Fire Department. 2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 93-73 if any violations of these conditions or the Huntington Beach Ordinance Code , occurs. ZA Minutes - 10/6/93 -2- 4. The applicant shall submit all future temporary outdoor event applications a minimum of thirty (30) days prior to the event. Failure to provide adequate notice shall result in denial of the request. ITEM 2• WAIVER OF PARCEL MAP NO.93-172 Applicant: Mike Hoskinson 829 Main Street Huntington Beach, CA 92648 Request: Waiver of Final Parcel Map No. 93-172 which includes the consolidation of two (2) lots into one (1) lot pursuant to Section 9920.1 of the Huntington Beach Ordinance Code. Location: 829 Main Street Jane Madera, Staff Planner, reported that the request was for a waiver of Final Parcel Map No. 93-172. She advised that the tentative parcel map was approved by the Zoning Administrator on September 29, 1993. Staff said that the Department of Public Works reviewed the request and recommended approval. Staff concluded by recommending approval with findings and suggested conditions of approval. Mike Hoskinson, the applicant, was present and concurred with the conditions of approval. There were no other persons present to speak for or against the request. WAIVER OF PARCEL MAP NO.93-172 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL FOR WAIVER: The proposed consolidation of two (2) lots into one for residential use complies with the requirements as to area, improvement and design, flood and water drainage control, appropriate and approved public roads, sewer and water facilities, environmental protection, and other requirements of Article 992 of the Ordinance Code. ZA Minutes - 10/6/93 -3- CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. A plat map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. A copy of the recorded plat map shall be filed with the Department of Community Development. 2. The applicant shall record a Certificate of Compliance, a "Covenant to hold properties as one parcel" and the approved plat map with the Orange County Recorder's Office. A copy of the recorded covenant shall be filed with the Department of Community Development prior to final inspection/issuance of Certificate of Occupancy. ITEM 3: USE PERMIT NO.93-75 Applicant: Jefrey Immediato 600 Narcissus Corona Del Mar, CA 92625 Request: To operate a haunted house amusement attraction in a vacant commercial building for a chairty event and the press on October 13, 1993; a dress rehearsal on October 14, 1993 and for the general public from October 15-31, 1993. Location: 7777 Edinger Avenue (Former Barker Bros. Building) Jane Madera, Staff Planner, reported that the request was for a temporary event for a haunted house amusement attraction. Staff advised that the first floor of the building would be used for the haunted house and the second floor would be for concessions and for private parties. Staff indicated that the request includes search lights; however, these are not allowed in the City. Staff said that there would be entertainers outside who would also serve as security personnel. Staff reviewed the suggested conditions of approval which included conditions requested by Police and Fire Departments. Staff concluded by recommending approval with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED Jefrey Immediato, the applicant, was present. Mr. Immediato requested that tracker lights be allowed in lieu of the search lights. He said that the tracker lights only go one hundred feet into the atmosphere. He concurred with all the other suggested conditions of approval. ZA Minutes - 10/6/93 -4- Della Chadwell, manager for the Huntington Center, was present and supported the request. The Zoning Administrator said he would confer with the Planning Director to determine if tracker lights would be allowed. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO.93-75 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL -USE PERMIT NO.93-75: 1. Use Permit No. 93-75 for the establishment, maintenance and operation of the temporary haunted house amusement attraction, dress rehearsal, and charity event will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The event is temporary in nature, adequate parking, and event security will be provided, and there are no residential units within the vicinity. In addition, the peak hours of operation occur when the majority of the surrounding businesses are closed. b. Property and improvements in the vicinity of such use or building. The event is temporary in nature and the existing property improvements in the area will not be altered as a result of this action. 2. The granting of Use Permit No. 93-75 will not adversely affect the General Plan of the City of Huntington Beach. The temporary haunted house amusement attraction is consistent with the goals and objectives of the General Commercial Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated September 22, 1993 shall be the conceptually approved layout. ZA Minutes - 10/6/93 -5- 2. The hours of operation for the "House of Terror" shall be limited to the following: Day Sunday - Thursday Friday - Saturday Hours 6:00 p.m. -11:00 p.m. 3:00 p.m. - 1:00 a.m. 3. The applicant shall be responsible for providing the following minimum personnel for security both inside and outside the building in the following manner: Day Sunday - Thursday Friday - Saturday Friday - Saturday Hours 6:00 p.m. - 11:00 p.m. 3:00 p.m. - 7:30 p.m. 7:30 p.m. - 1:00 a.m. Total Security Staff 15 15 30 4. All patrons entering the building shall be required to pass through metal detectors. 5. No members of the general public/patrons entering the building may be dressed in Halloween costumes. 6. Sale of alcoholic beverages shall be limited to the second floor concession area only. No outside sale of alcohol shall be permitted. All consumption of alcoholic beverages shall take place in a clearly defined separate cordoned off area. 7. Alcohol sales shall be limited to a maximum of two (2) drinks per person during hours when the concession floor is open to the public. There shall be no maximum limit during times when the concession floor is rented privately for corporate events. 8. The applicant shall be responsible for posting a minimum of one sign at the entrance warning patrons of the graphic adult nature of the "House of Terror" event. The warning sign shall include language specifically targeting parents and their children. 1 ZA Minutes - 10/6/93 -6- 1 9. The Police Department conditions of approval shall be as follows: a. The applicant shall be responsible for payment of $7,610.00 to the City of Huntington Beach to reimburse the City for necessary Police Department personnel for the following days and hours: Day_ Date Personnel Time Period Total Hours Fri. 10-15 4 officers 1900-0100 20 hrs. Total estimated hours - 165 Estimated cost per hour per officer - $44.00 Estimated cost per hr. per sergeant - $50.00 Total estimated cost-$7,610.00 b. Payment of $7,610.00 shall be received no later than October 23, 1993. C. All portions of the $7,610.00 not used by the Police Department for security of this event shall be reimbursed to the applicant. 10. The Fire Department conditions of approval shall be as follows: a. The applicant shall submit a detailed floor plan of the building showing all exits, aisle ways and widths, and positioning of security personnel during occupied hours. b. The maximum occupant load shall be as follows: 1. First floor - maximum 850 persons. 2. Second floor - maximum 360 persons. C. All exits shall have posted signs with six inch letters and will be illuminated per Uniform Building Code 3314(b). In addition, all exit pathways shall be identified with photo luminescent markers showing direction of exits per Uniform Building Code 3314(c). ZA Minutes - 10/6/93 -7- d. An emergency back-up power supply will be provided in case of power failure. This source shall be inspected and approved by a city electrical inspector prior to occupancy per Uniform Building Code 3313(b). e. Proof that all decorative materials are fire resistive shall be provided prior to occupancy per Uniform Fire Code 25.103. f. The building shall be provided with a clearly audible public address system prior to occupancy. g. Smoking will not be permitted throughout the entire building per Uniform Fire Code 11.502. h. A five year certification of the building automatic fire sprinkler system shall be provided prior to occupancy. i. All security and tour guides must be briefed on emergency procedures. j. Fire Department stand-by personnel may be required at all times during occupancy per Uniform Fire Code 25.117. k. A Fire Department permit will be required prior to occupancy. 11. The Zoning Administrator shall be notified in writing if any changes in any aspect of the event such as hours or outside uses are proposed as a result of the plan check process. The building shall not be occupied until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 12. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing sets submitted for plancheck. 13. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. INFORMATION ON SPECIFIC CODE REQUIREMENTS The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. ZA Minutes - 10/6/93 -8- 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 4. The Zoning Administrator reserves the right to revoke Use Permit No. 93-75 if any violation of these conditions of the Huntington Beach Ordinance Code occurs.
