PUBLIC HEARING ITEMS B-1 CODE AMENDMENT NO. 91-10 - DRAFT ZONING AND SUBDIVISION ORDINANCE (CONTINUED WITH PUBLIC HEARING OPEN FROM THE OCTOBER 5, 1993 PLANNING COMMISSION MEETING): APPLICANT: City of Huntington Beach LOCATION: City Wide On June 15, 1993, the Planning Commission opened the public hearing on the draft Zoning and Subdivision Ordinance. After an overview presentation, the Planning Commission continued action on the draft Zoning and Subdivision Ordinance and directed staff to publish a notice of public hearing outlining the schedule of hearing dates. Tonight's public hearing concludes the series. STAFF RECOMMENDATION: Staff recommends the Planning Commission approve Chapter 233 of Title 23 of the draft Zoning and Subdivision Ordinance, recommend its adoption to the City Council. Commissioner Bourguignon stated that he would be abstaining from voting on this item, because of his lack of knowledge for this particular code section. THE PUBLIC HEARING WAS OPENED. Karen McFaul, stated her belief that staff could not possible get all signs amortized. She felt that the approval of sign permits should be brought down to the Director or Zoning Administrator level. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. The Commission discussed the option of approving this code while ongoing meetings with the sign committee occur, and relaying any further recommendations to the City Council. Staff stated that would be feasible. A MOTION WAS MADE BY COOK, SECOND BY RICHARDSON, TO APPROVE CHAPTER 233 OF TITLE 23 OF THE DRAFT ZONING AND SUBDIVISION ORDINANCE AND RECOMMEND ITS ADOPTION TO THE CITY COUNCIL WITH SIGN CODE COMMITTEES RECOMMENDATIONS, BY THE FOLLOWING VOTE: AYES: Cook, Biddle, Richardson, Dettloff, Gorman, Inglee NOES: None ABSENT: None ABSTAIN: Bourguignon MOTION PASSED B-2 CONDITIONAL USE PERMIT NO. 93-28: APPLICANT: Rodney Couch LOCATION: 20111 Brookhurst Street (southwest corner at Adams Avenue, Target Center) Conditional Use Permit No. 93-28 is a request by Market Broiler to establish a seafood restaurant with alcohol sales in the former Love's Restaurant site in the Target Center located at the southwest corner of Brookhurst Street and Adams Avenue. Staff has analyzed the request and feels that the use will be compatible with surrounding residential and commercial uses. STAFF RECOMMENDATION: The proposed use will not create parking, circulation or access problems. Staff supports the applicant's request. Murray Greer, 19412 Pompano Lane, gave a brief background/history of the restaurant and stated he was available if the Commission had any questions. The proposed restaurant with alcohol sales in an existing building will be compatible with surrounding existing residential and commercial uses. 2. The proposed restaurant with alcohol sales in an existing building will not create undue parking, circulation or access problems. The restaurant is part of a shopping center which was originally constructed with code required parking and access. 3. The request to establish the restaurant with alcohol sales in an existing building is consistent with the City's General Plan and the designation of General Commercial. CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 93-28: 1. The site plan, floor plan and elevation received and dated October 7, 1993 shall be the conceptually approved layout. 2. The hours of operation shall be limited to: Sunday - Thursday 11:00 a.m. - 10:00 p.m. Friday - Saturday 11:00 a.m. - 11:00 p.m. 3. Prior to sale of alcoholic beverages, a copy of the Alcoholic Beverage Control (ABC) Board license, along with any special conditions imposed by ABC, shall be submitted to the Department of Community Development. Any conditions that are more restrictive than those set forth in this approval shall be adhered to. PC Minutes - 10/19/93 -3- (7482d) 4. Live entertainment shall not be permitted. 5. Comply with all required City requirements by the Fire Department, Public Works Department and the Community Development Department. 6. This conditional use permit shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. 7. The Planning Commission reserves the right to revoke this conditional use permit if any violation of these conditions or Huntington Beach Ordinance Code occurs. B-3 CONDITIONAL USE PERMIT NO. 93-36: APPLICANT: Nextel LOCATION: 1905 Main Street (adjacent to the athletic field on the Huntington Beach Union High School campus) Conditional Use Permit No. 93-36 is a request to permit an existing digital mobile radio communication facility with a 70 foot tall monopole and a 200 square foot equipment building. The facility is located on the Huntington Beach Union High School campus adjacent to the athletic fields and bus parking lot. The facility is and will continue to be an unmanned facility with maintenance activities occurring on a bi-monthly basis. STAFF RECOMMENDATION: Staff recommends that Planning Commission approve Conditional Use Permit No. 93-36 with findings and suggested conditions of approval. The Commission asked staff if there was a maximum number of antennas allowed within this area. Staff stated there was no maximum. THE PUBLIC HEARING WAS OPENED. The establishment, maintenance and operation of an 85' tall digital mobile radio facility consisting of a 70 foot monopole with 15' antennas will not be detrimental to the general welfare of persons residing or working in the vicinity, nor to property and improvements in the vicinity. In addition, the digital mobile radio facility will not generate noise, traffic or other impacts which would be detrimental to surrounding campus uses. 2. The 85' tall digital mobile radio facility consisting of a 70 foot monopole with 15' antennas is consistent with the goals and objectives of the City's General Plan and Land Use Map. 3. The operation of the 85' tall digital mobile radio facility consisting of a 70 foot monopole with 15' antennas will provide for more efficient mobile radio communication for the Huntington Beach area by improving capacity and performance of the existing system and reducing the number of required sites. CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 93-36: 1. The site plan, floor plans and elevations received and dated September 1, 1993 shall be the approved layout. 2. The Fire Department requires that a fire extinguisher be located in the equipment building. 3. Prior to issuance of building permits, the applicant shall complete the following: a. The Public Works Department requires that two 36" boxed trees be planted for every tree removed. The applicants shall submit a landscape plan, approved by the school district, detailing the location of the trees. The landscape plan must be submitted to and approved by the Department of Community Development and Public Works. 4. Conditional Use Permit No. 93-36 shall become null and void unless the project receives building permits within 60 days of the date of final approval. PC Minutes - 10/19/93 -5- (7482d) 5. The Planning Commission reserves the right to revoke this conditional use permit if any violation of the conditions or the Huntington Beach Ordinance Code occurs. CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and Standards. B-4 SPECIAL SIGN PERMIT NO. 93-10: APPLICANT: San Pedro Electric Sign Company LOCATION: 20951 Brookhurst Street Special Sign Permit No. 93-10 is a request to change a sign panel on an existing non -conforming sign structure at 20951 Brookhurst Street. The subject site is located at the northwest corner of Atlanta Avenue and Brookhurst Street within the professional office complex. STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve the request as modified by staff because it will provide necessary visibility to the site without adversely impacting surrounding properties and will not encourage future requests for deviations from the sign code (i.e., special sign permit requests) to install additional sign panels on the structure. THE PUBLIC HEARING WAS OPENED. Roger De Young, 355 Bristol, Costa Mesa, property owner, requested that the upper space of the sign be kept for a future tenant. Karen McFaul, San Pedro Electric Signs, 701 Lakme, Wilmington, applicant, gave a brief description of the project and stated she was available to answer any questions. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. The Commission discussed with staff the upper portion of the sign and whether it should be allowed to remain for a future tenant. Strict compliance with Article 961 will result in a substantial economic hardship to the business. 2. Due to the height and location of perimeter fencing of the adjoining residential tract (Tract No. 7019) to the north of the project site, the site does not have adequate visibility from Brookhurst Street (southbound); the 13 foot tall sign is necessary for adequate exposure of the site. 3. The 36.25 square foot sign panel with an optional 15 square foot second tenant panel on a 13' high freestanding sign will not adversely affect other signs in the area, as there are no other signs in the immediate project vicinity that the sign will obstruct or conflict with. The 36.25 square foot sign panel with an optional 15 square foot tenant panel on a 13' high freestanding sign at 20951 Brookhurst Street will not be detrimental to property located in the vicinity of such sign; and will be compatible with the surrounding area, due to the colors and limited copy on the panel. 5. The 36.25 square foot sign panel with an optional 15 square foot tenant panel on a 13' high freestanding sign will not obstruct vehicular traffic vision since left -turn egress from the adjoining driveway is prohibited by the existing raise median on Brookhurst Street. 6. The 36.25 square foot sign panel with an optional 15 square foot tenant panel on a 13' high freestanding sign will not obstruct pedestrian traffic vision from the adjoining driveway. 7. The sign in conjunction with existing wall signs on the property does not exceed the maximum wall sign square footage allowed for the building and is not considered to be excessive. CONDITIONS OF APPROVAL - SPECIAL SIGN PERMIT NO 93-10: 1. The site plan and sign elevation received and dated September 8, 1993 shall be the conceptually approved layout with the following modifications: a. Maximum sign height shall be 13 feet, removing the existing open area above the proposed sign panel. b. The height of landscaping at the base of the sign shall be reduced to consist of ground cover to improve pedestrian traffic visibility from the adjoining driveway. c. Signage shall be limited to 36.25 square feet for the "Star Real Estate" sign or ground floor tenant. An additional panel may be added for a second tenant not to exceed 15 square feet (total sign area shall not exceed 51.25 square feet). 2. Prior to issuance of building permit for the proposed freestanding sign, as modified, the applicant shall obtain a permit or provide evidence of a permit issued for the five (5) existing awning signs identified on the site plan and elevation received and dated September 22, 1993. 3. Any alteration of the sign approved -herein shall be subject to approval by the Planning Commission. 4. The Planning Commission reserves the right to revoke Special Sign No. 93-10 if any violations of the conditions or the Huntington Beach ordinance Code occur. Any such decision shall be preceded by notice to the applicant and a public hearing and shall be based upon specific findings. 5. Special Sign Permit No. 93-10 shall not become effective for any purpose until the ten (10) day appeal period has closed and an "Acceptance of Conditions" form has been signed by the applicant, notarized and returned to the Planning Division. Special Sign Permit No. 93-10 shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Planning Commission, pursuant to a written request submitted (with the appropriate processing fee in effect at the time) to the Planning Department a minimum 30 days prior to the expiration date. PLANNING COMMISSION ITEMS/INQUIRIES Commissioner Richardson - read Resolution No. 1487 into the record in appreciation of outgoing Commissioner Ken Bourguignon. Commissioner Bourguignon - stated that it was not his will to resign and he had not officially done so. He stated that he would be leaving the Commission with regrets. Commission Gorman - restated events of the Santa Ana River Bridge Crossing meeting conducted by the County of Orange. F. COMMUNITY DEVELOPMENT ITEMS Staff requested the Chairman to appoint a new Commissioner to the Design Review Board. Commissioner Inglee was appointed, with Commissioner Dettloff as the alternate. G .
