The Minutes of the October 20, 1993 Zoning
Administrator Meeting were approved.
ITEM 1• USE PERMIT NO 93-81(TEMPORARY OUTDOOR EVENT)
Applicant: Sergio Avila
8082 Adams Ave.
Huntington Beach, CA 92646
Request: To permit an inflatable balloon on the roof of the El Ranchito
restaurant for twenty-one (21) days (November 14 - December 5,
1993) pursuant to Section 9730.64 of the Huntington Beach
Ordinance Code.
Location: 8082 Adams Ave.
Jane Madera, Staff Planner, reported that the request for a temporary inflatable balloon
for twenty-one (21) days was proposed to advertise the grand opening of the El Ranchito
Restaurant. Staff recommended approval with findings and the standard conditions of
approval.
THE PUBLIC HEARING WAS OPENED.
Sergio Avila, the applicant, was present and concurred with the conditions of approval.
There were no other persons present to speak for or against the request and the public
hearing was closed.
USE PERMIT NO. 93-81 (TEMPORARY OUTDOOR EVENT) WAS APPROVED
BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS
AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION
TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE
PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS.
FINDINGS FOR APPROVAL:
1. Use Permit No. 93-81 for a twenty-one (21) day temporary outdoor event at El
Ranchito restaurant will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity. The large
inflatable balloon will not create an undue traffic or pedestrian visibility
hazard and will not project over the public right-of-way.
b. Property and improvements in the vicinity of such use of building. The event
is temporary in nature and the existing improvements in the area will not be
altered as a result of this action.
2. The granting of Use Permit No. 93-81 will not adversely affect the General Plan
Land Use Designation of General Commercial of the City of Huntington Beach.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan received and dated October 10, 1993 shall be the conceptually
approved layout.
2. The applicant's request shall include necessary permits for temporary signs.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The event shall comply with all applicable provisions of the Ordinance Codes,
Building Division and Fire Department.
2. The applicant shall meet all applicable local, State and Federal Fire Codes,
Ordinances and standards.
3. The Zoning Administrator reserves the right to revoke Use Permit No. 93-81 if
any violations of these conditions or the Huntington Beach Ordinance Code
occurs.
4. The applicant shall submit all future temporary outdoor event applications a
minimum of thirty (30) days prior to the event. Failure to provide adequate notice
shall result in denial of the request.

ITEM 2• TENTATIVE PARCEL MAP NO.93-169
Applicant: Peninsula Pump Corporation

Huntington Beach, CA 92647
Request: To consolidate two (2) lots into one (1) lot pursuant to Section 9930 of
the Huntington Beach Ordinance Code.
Location: 7511 Warner Avenue _
Jane Madera, Staff Planner, reported that the request was to consolidate two lots into one
lot was for purposes of light industrial. Staff said that the consolidation, if approved,
would be in compliance with the size and shape of property necessary for light industrial.
Staff advised that all vehicular access rights to Warner Avenue be released and
relinquished to the City and a portion of Lyndon Street and a corner radius would be
dedicated to City standards. Staff concluded by recommending approval with findings
and suggested conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Dave Chapman, representing the applicant, was present and concurred with the suggested
conditions of approval.
There were no other persons present to speak for or against the request and the public
hearing was closed.
TENTATIVE PARCEL MAP NO.93-169 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS
OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION
WITHIN TEN (10) CALENDAR DAYS.
FINDINGS FOR APPROVAL - TENTATIVE PARCEL MAP 93-169:
1. The proposed consolidation of two (2) lots into one (1) lot for purposes of Light
Industrial use is in compliance with the size and shape of property necessary for that
type of development.
2. The General Plan has set forth provisions for this type of land use as well as setting
forth objectives or implementation of this type of use.

3. The property was previously studied for this intensity of land use at the time the
land use designation for Light Industrial was placed on the subject properly. In
addition, sites with less than one (1) net acre are not required to demonstrate
consistency between the Zoning and General Plan designation.
4. The size, depth, frontage, street width and other design and improvement features of
the proposed lot consolidation are proposed to be constructed in compliance with
standards plans and specifications on file with the City as well as in compliance
with the State Map Act and supplemental City Subdivision Ordinance.
CONDITIONS OF APPROVAL:
TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR
ANY PURPOSE.
Tentative Parcel Map No. 93-169 received by the Department of Community Development
on August 17, 1993 shall be the approved layout (with the amendments as noted thereon):
a. Six (6) feet off Lyndon Street and a twenty-nine (29) foot radius at the corner of
Lyndon Street and Warner Avenue shall be dedicated to City standards.
2. A revised tentative parcel map per Condition of Approval No. 1 shall be submitted for
inclusion in the Community Development Department file.
3. A parcel map shall be filed with and approved by the Department of Public Works and
recorded with the Orange County Recorder. A copy of the recorded parcel map shall be
filed with the Community Development Department.
4. All utilities shall be installed underground at the time said parcel(s)is/are developed.
All vehicular access rights to Warner Avenue shall be released and relinquished to the City
of Huntington Beach.
6. The engineer or surveyor preparing the parcel map shall tie the boundary of the map into
the Horizontal Control System established by the County Surveyor in a manner described
in Sections 7-9-330 and 7-0-337 of the Orange County Subdivision Code and Orange
County Subdivision Manual, Subarticle 18.
7. The engineer or surveyor preparing the parcel map shall submit to the County Surveyor a
digital -graphics file of said map in a manner described in Sections 7-9-330 and 7-9-337 of
the Orange County Subdivision Manual, Sub article 1.8.

ITEM 3• COASTAL DEVELOPMENT PERMIT NO, 93-19/DESIGN REVIEW
BOARD NO.93-17
Applicant: Purchases -Rose - SRI

Request: To remove and replace one (1) existing 600 square foot public
restroom facility with a new 1,000 square foot public restroom
facility.
Location: 21551 Pacific Coast Highway
Jane Madera, Staff Planner, reported that the request was to remove and replace an
existing restroom facility in the south beach area. Staff indicated that the project would
include lockers, telephones and sinks at each end of the facility. Staff advised that the
request had been heard by the Design Review Board who had recommended approval of
the building colors, materials and elevations. Staff concluded by recommending approval
with findings and suggested conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Jim Pickle, representing the applicant, was present. He advised that the angle of the
proposed doors of the structure would eliminate view into the water closet area form the
public beach.
Jim Engle, Community Services Department, advised that a staff task force composed of
representatives from all City Departments had reviewed and supported the request.
There were no other persons present to speak for or against the request and the public
hearing was closed.
COASTAL DEVELOPMENT PERMIT NO.93-19/DESIGN REVIEW BOARD
NO.93-17 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE
FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED
THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE
APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) WORKING
DAYS AND ANOTHER TEN (10) WORKING DAYS TO THE COASTAL
COMMISSION.

FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO -19:
1. The request to permit the removal and reconstruction of a 1,000 square foot public
restroom facility conforms with the plans, policies, requirements and standards of
the Coastal Element of the General Plan. The proposed 1,000 square foot public
restroom facility will not impact public views or access.
2. Coastal Development Permit No. 93-19 is consistent with the CZ suffix zoning
requirements, the Downtown Specific Plan - District 11 - Floodplain, as well as
other provisions of the Huntington Beach Ordinance Code applicable to the
property. The proposed development will conform with all applicable City codes.
3. At the time of occupancy, the proposed removal and reconstruction of a 1,000
square foot public restroom facility will be provided with infrastructure in a
manner that is consistent with the Coastal Element of the General Plan. All
infrastructure currently exists to the site.
4. The proposed removal and reconstruction of a 1,000 square foot public restroom
facility conforms with the public access and public recreation policies of Chapter
3 of the California Coastal Act.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated September 1, 1993
shall be the conceptually approved layout.
2. The Zoning Administrator shall be notified in writing if any changes in building
height, floor area, setbacks, building elevations or open space are proposed as a
result of the plan check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed changes. The
Zoning Administrator reserves the right to require that an amendment to the
original entitlement be processed if the proposed changes are of a substantial
nature.
3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or
unusable material, shall be disposed of at an off -site facility equipped to handle
them.
4. Low -volume heads shall be used on all spigots and water faucets.
5. All building colors and materials as approved by Design Review Board action on
October 21, 1993 shall be included on building wall elevations prior to submittal
for building permits.

6. The Fire Department requirements are:
a. Provide a portable fire extinguisher for combustible storage in lockers.
7. The project shall comply with all applicable provisions of Article 940 -
Floodplain Suffix, for construction within Flood Zone AE, Base Flood Elevation

8. Prior to issuance of building permits, the following plans shall be submitted
and/or completed by the applicant:
a. One set of landscape and irrigation plans to the Department of Community
Development and Public Works for review and approval. The landscape
construction set shall include a landscape plan prepared and signed by a
State licensed Landscape Architect which includes all proposed/existing
plant materials (location, type, size, quantity) and a copy of the conditions
of approval.
9. All trees removed as a result of this project shall be replaced at a 2:1 ratio with
trees similar to the existing trees regarding size and type.
INFORMATION OF SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of the Ordinance
Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and Federal Fire Codes,
Ordinances, and standards.
3. The Zoning Administrator reserves -the right to revoke Coastal Development
Permit No. 93-19 and Design Review Board No. 93-17 if any violation of these
conditions of the Huntington Beach Ordinance Code occurs.
ITEM 4: USE PERMIT NO.93-172
Applicant: The Salvation Army

Santa Ana, CA 92704
Request: To permit a second eight (8) foot by twenty (20) foot trailer for
additional storage and distribution center for the Salvation Army at
the Oakview Community Center.
Location: 11271 Oak Lane

Jane Madera, Staff Planner, reported that a trailer was approved on the subject site in
1989. The new request was for an additional trailer to be used for storage. Staff said that
request was reviewed by other City Departments and their comments were included in the
suggested conditions of approval. Staff concluded by recommending approval with
findings and suggested conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Karl Wiebe, representing the applicant, was present and concurred with the suggested
conditions of approval.
There were no other persons present to speak for or against the request and the public
hearing was closed.
USE PERMIT NO.93-72 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS
OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION
WITHIN TEN (10) CALENDAR DAYS.
FINDINGS FOR APPROVAL -USE PERMIT NO, 93-72:
1. Use Permit No. 93-72 for the establishment, maintenance and operation of the
Salvation Army storage trailer will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity. The
trailer will be identical to the existing trailer on -site and with the
conditions imposed will be subject to staff review at the end of a three (3)
year period.
b. Property and improvements in the vicinity of such use or building. The
subject trailer will not alter or affect the existing improvements in the area.
2. The granting of Use Permit No. 93-72 will not adversely affect the General Plan
of the City of Huntington Beach. The Salvation Army trailer is consistent with
the goals and objectives of the Medium Density Residential Land Use designation
of the General Plan.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated September 14, 1993
shall be the conceptually approved layout.

2. The structure must comply with all applicable Building Division code
requirements if it remains on site longer than six (6) months.
3. The Zoning Administrator shall be notified in writing if any changes in building
height, floor area, setbacks, or building elevations are proposed as a result of the
plan check process. Building permits shall not be issued until the Zoning
Administrator has reviewed and approved the proposed changes. The Zoning
Administrator reserves the right to require that an amendment to the original
entitlement be processed if the proposed changes are of a substantial nature.
4. Conditions of approval shall be printed verbatim on the cover sheet of all working
drawing sets submitted for plancheck.
5. Fire Department Requirements:
a. One (1) 2a-IOBC fire extinguisher shall be provided at the subject trailer.
6. There shall be no outside storage of any materials associated with the Salvation
Army operation.
7. The proposed trailer shall be architecturally identical with the existing trailer.
INFORMATION ON SPECIFIC CODE REQUIREMENTS
1. The development shall comply with all applicable provisions of the Ordinance
Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and Federal Fire Codes,
Ordinances, and standards.
3. A review of the use by the Community Development Department staff shall be
conducted within three (3) years of the date of this approval to verify compliance
with all conditions of approval and applicable Articles of the Huntington Beach
Ordinance Code. If, at that time, there is a violation of these conditions or code
sections, Use Permit No. 93-72 shall be brought before the Zoning Administrator
for a public hearing and may become null and void.
4. The Zoning Administrator reserves the right to revoke Use Permit No. 93-72 if
any violation of these conditions of the Huntington Beach Ordinance Code
occurs.

ITEM 5: USE PERMIT NO 93-83
Applicant: Seacliff Partners

Request: To permit a six (6) foot high masonry block wall over a three (3)
foot retaining wall along a portion of the subject property for a
maximum of nine (9) feet in height in lieu of a maximum six (6)
feet pursuant to Section 9771(1) of the Huntington Beach
Ordinance Code.
Location: 6782 Sicily Drive
Jane Madera, Staff Planner, reported that the request was to permit an existing six foot
high wall over a four foot retaining wall to remain. Staff advised that the property to the
south has a pool and is at a lower grade and the wall on this property is only five feet
high. Staff concluded by recommending approval with findings and suggested conditions
of approval.
THE PUBLIC HEARING WAS OPENED.
Richard Hagee, representing the applicant, was present and concurred with the conditions
of approval.
Carmen Ness, 19821 Scenic Bay Lane, was present and spoke in support of the request.
Jeff Metzel, representing the Home Owners Association, was present and spoke in
support of the request. He said that similar requests would be necessary as the oil islands
are developed.
There were no other persons present to speak for or against the request and the public
hearing was closed.
USE PERMIT NO.93-83 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS
OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION
WITHIN TEN (10) CALENDAR DAYS.
FINDINGS FOR APPROVAL -USE PERMIT NO 9 -83:
Use Permit No. 93-83 to permit an existing six (6) foot high masonry block wall
over a three (3) foot retaining wall along a portion of the subject property will not
be detrimental to:

a. The general welfare of persons residing or working in the vicinity. The
taller wall allows for increased privacy between the subject properties.
b. Property and improvements in the vicinity of such use or building. The
retaining wall protects a differential in grade between the two properties.
The differential in grade allows for proper drainage of the lot and tract to
the public street.
2. The granting of Use Permit No. 93-83 will not adversely affect the General Plan
of the City of Huntington Beach. The six (6) foot high masonry block wall over a
three (3) foot retaining wall along a portion of the subject property is consistent
with the goals and objectives of the Low Density Residential Land Use
designation of the General Plan. -
SPECIAL CONDITIONS OF APPROVAL USE PERMIT NO 93-83:
The site plan and elevations received and dated October 25, 1993 shall be the
conceptually approved layout.
2. The portion of the block wall which is located adjacent to the pool area of the
adjacent property owner to the east (the entire length of the block wall excepting
the southerly twenty (20) feet) shall not be modified without review and approval
by the Zoning Administrator of the City of Huntington Beach. The southerly
twenty (20) feet of the wall may be modified or lowered to a minimum of forty-
two (42) inches in height subject to the review and approval of the Zoning
Administrator. Thirty (30) inches of wrought iron may be installed above the 42
inch high wall and must be compatible with the existing walls.
3. The space between the new wall and the existing wall located to the east shall be
covered or filled subject to the requirements of the City Engineer and the Building
Division.
4. The conditions of approval for Use Permit No. 93-83 shall be recorded with the
Orange County Recorder's office for Lot 9 of Tract 14042 within 45 days from
date of approval. After recordation, a copy of the recorded document for Lot 9 of
Tract 14042 shall be submitted to the Community Development Department for
the file.
5. The Zoning Administrator shall be notified in writing if any changes in wall
height, setbacks, or wall elevations are proposed as a result of the plan check
process. Building permits shall not be issued until the Zoning Administrator has
reviewed and approved the proposed changes. The Zoning Administrator reserves
the right to require that an amendment to the original entitlement be processed if
the proposed changes are of a substantial nature.

6. Conditions of approval shall be printed verbatim on the cover sheet of all working
drawing sets submitted for plan check.
7. The applicant shall sign and notarize an Acceptance of Conditions form and return
to the Community Development Department by November 30, 1993 for inclusion
in the file.
INFORMATION ON SPECIFIC CODE REQUIREMENTS
1. The development shall comply with all applicable provisions of the Ordinance
Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and Federal Fire Codes,
Ordinances, and standards.
3. The Zoning Administrator reserves the right to revoke Use Permit No. 93-83 if
any violation of these conditions of the Huntington Beach Ordinance Code
occurs.
