ITEM 1: USE PERMIT NO.93-87 ('TEMPORARY OUTDOOR EVENT) Applicant: Flowers A L'Amour 7211 Warner Ave. #C Huntington Beach, CA 92647 Request: To permit a one (1) day temporary outdoor event for a grand opening on December 3, 1993, from 6:30 - 9:30 p.m., pursuant to Section 9730.64 of the Huntington Beach Ordinance Code. Location: 7211 Warner Ave., #C Jane Madera, Staff Planner, reported that the request was for a one day grand opening sale for the flower shop at the Southeast corner of Goldenwest and Warner. Staff advised that the proposal includes outdoor tables and chairs and a musician playing low key music. Staff concluded by recommending approval with findings and suggested conditions of approval. Rudolpho Jinez Jr., representing the applicant, was present and concurred with the suggested conditions of approval. There were no other persons present to speak for or against the request. USE PERMIT NO.93-87 (TEMPORARY OUTDOOR EVENT) WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TWO (2) CALENDAR DAYS. FINDINGS FOR APPROVAL: 1. Use Permit No. 93-87 for a one (1) day temporary outdoor grand opening event with one (1) musician will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The outdoor event will not impede access to existing business in the center and will maintain access for emergency personnel. b. Property and improvements in the vicinity of such use of building. The existing improvements in the area will not be altered as a result of this action because the event is temporary in nature. 2. The granting of Use Permit No. 93-87 will not adversely affect the General Commercial Land Use designation of the General Plan of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated November 3, 1993 shall be the conceptually approved layout. 2. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 3. The applicant shall obtain all necessary Fire Department permits and comply with all provisions of Article 32 of the Uniform Fire Code. 4. The applicant's request shall include necessary permits for temporary signs. 5. A minimum of two (2) exits shall be provided and maintained. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The event shall comply with all applicable provisions of the Ordinance Codes, Building Division and Fire Department. ZA Minutes - 11/24/93 -2- 2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 93-87 if any violations of these conditions or the Huntington Beach Ordinance Code occurs. 4. The applicant shall submit all future temporary outdoor event applications a minimum of thirty (30) days prior to the event. Failure to provide adequate notice shall result in denial of the request. ITEM 2: USE PERMIT NO, 93-84 (TEMPORARY OUTDOOR EVENT) Applicant: Everett H. McKinney P. O. Box 15877 2002 E. McFadden Ave., Suite 250 Santa Ana, CA 92705 Request: To permit a three (3) day temporary outdoor book sale, with tent, from November 30 - December 2, 1993 pursuant to Section 9730.64 of the Huntington Beach Ordinance Code. Location: 7092 Edinger Avenue Jane Madera, Staff Planner reported that the request is for a temporary outdoor event located at the southeast corner of Goldenwest and Edinger for a book sale with a tent for the Oceanview High School Band. Staff concluded by recommending approval with findings and the standard conditions of approval. Mr. McKinney, the applicant, was present and advised that the proposed event was to raise money for new uniforms for the band. There were no other persons present to speak for or against the request. USE PERMIT NO.93-84 (TEMPORARY OUTDOOR EVENT) WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TWO (2) CALENDAR DAYS. ZA Minutes - 11/24/93 -3- FINDINGS FOR APPROVAL: 1. The event will take place in a commercial parking lot and will not impede access to existing businesses in the center and will provide access for emergency personnel. b. Property and improvements in the vicinity of such use of building. The existing improvements in the area will not be altered as a result of this action. The event is temporary in nature. 2. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 3. The applicant shall obtain a Fire Department permit. 4. The applicant's request shall include necessary permits for temporary signs. 5. The entire tent shall be of flame retardant material. An approved certification shall be submitted when applying for the permit per Uniform Fire Code Section 32.1 OF. 6. The proposed tent shall be secured against collapsing to the satisfaction of the Fire Department. 7. "No Smoking" signs shall be posted in conspicuous locations. 8. Three - 2a-10-bc fire extinguishers shall be provided in the tent at all times per Uniform Fire Code Section 32.109. 9. A minimum of two (2) exits shall be provided and maintained. ITEM 3: TENTATIVE PARCEL MAP NO.93-203 Applicant: Gerald E. Sparks 6100 Warner Avenue, Suite 200 Huntington Beach, CA 92647 Request: To subdivide one (1) parcel of land into two (2) parcels pursuant to Section 9930 of the Huntington Beach Ordinance Code. Location: 6100 Warner Avenue (South east corner of Warner Avenue and Springdale Street) Jane Madera, Staff Planner, reported that the request was to subdivide one existing parcel into two parcels. Staff recommended a condition of approval for reciprocal parking and driveway agreements between the two parcels. After the subdivision, parcel two will only have four parking spaces; therefore, it will be dependent on the parking in the center to meet the parking code requirements. Staff concluded by recommending approval with findings and suggested conditions of approval. The Public Hearing was opened. Don Baker, representing the applicant, was present. He agreed to the suggested conditions of approval; however, stated that the City's parking code requirements were too stringent. TENTATIVE PARCEL MAP NO.93-203 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL: 1. The proposed subdivision of one (1) parcel into two (2) parcels for purposes of General Commercial use is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives or implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for General Commercial allowing retail commercial buildings was placed on the subject property. 4. The size, depth, frontage, street width and other design and improvement features of the proposed subdivision are constructed in compliance with standards plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL: TO BE COMPLETED PRIOR TO INTENSIFICATION OF USE OR RECORDATION OF SAID PARCEL(S): 1. Tentative Parcel Map No. 93-203 received by the Department of Community Development on October 15, 1993 shall be the approved layout (with the amendments as noted thereon). 2. Prior to final recordation of the parcel map, the subject property shall enter into irrevocable reciprocal driveway and parking easements between Parcel 1 and Parcel 2. A copy of the legal instrument shall be approved by the City Attorney as to form and content, and when approved, shall be recorded in the Office of the County Recorder. A copy shall be filed with the Department of Community Development prior to occupancy. ZA Minutes - 11/24/93 -6- J 3. This irrevocable easement shall identify the minimum number of parking spaces on Parcel 1 for Parcel 2 use to comply with parking requirement of the Huntington Beach Ordinance Code. 4. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. A copy of the recorded parcel map shall be filed with the Department of Community Development. 5. Prior to plan check submittal for final map approval, the applicant shall provide an area analysis and set -back justification of the building per Chapter 5 of the Uniform Building code to show that the building will remain in compliance after the new property lines are recorded. Any other method of justification after review by the Building Division shall be acceptable.
