MINUTES: The Minutes of November 24 and December 1,
1993 Zoning Administrators Meeting were
approved.
ITEM 1: USE PERMIT NO.93-60 (Revised)
Applicant: Southern California Restaurant Enterprises

Lakewood, Ca 90712
Request: To permit a revision to Condition of Approval No. 6 of Use Permit No.
93-60. The applicant is requesting to eliminate the condition for
irrevocable driveway and parking easements in conjunction with
construction of a new 880 square foot drive-thru restaurant with outdoor
seating.
Location: 10001 Adams Avenue
Jane Madera, Staff Planner, reported the Zoning Administrator approved Use Permit No.
93-60 with conditions. Staff indicated that Condition of Approval No. 6 requires
driveway and parking easements with the adjacent property owner without conditioning
the project approval on the adjacent property owner's acceptance of the offer. She said
the applicant was proposing a revision to Condition No. 6 to offer driveway and parking
easements to the adjacent property owner. Staff concluded by recommending approval
with findings and suggested conditions of approval. Staff stated that the offer of
driveway and parking easements can be supported with the construction of a driveway to
the project from Adams Avenue. Staff also supported the project with a provision that
the applicant submit a bond for 150 percent of the cost to remove the said driveway and
replace with curbing, landscaping and parking as depicted on the previously approved
plan.
THE PUBLIC HEARING WAS OPENED.
Dave Bartlett, the applicant, was present and concurred with the suggested conditions of
approval.
There were'no other persons present to speak for or against the request and the public
hearing was closed.
USE PERMIT NO.93-60 (Revised) WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS
OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION
WITHIN TEN (10) CALENDAR DAYS.
FINDINGS FOR APPROVAL -USE PERMIT NO.93-600:
1. Amending Condition of Approval No. 3 of Use Permit No. 93-60 to allow the
applicant to offer irrevocable driveway access agreements between the subject
property and adjacent properties instead of requiring the full implementation of
the easements at this time will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity. The
project has been redesigned to add one driveway entrance from Adams
Avenue. The project will still provide adequate access and circulation
around the site and the property owner will pursue reciprocal access
agreements with the adjacent property owner.
b. Property and improvements in the vicinity of such use or building.
Circulation into and around the site will still be adequately maintained
with the offer of irrevocable driveway and access agreements.
2. The granting of Use Permit No. 93-60 will not adversely affect the General Plan
of the City of Huntington Beach. The offer of irrevocable driveway and access
agreements in conjunction with the drive-thru restaurant is consistent with the
goals and objectives of the General Commercial Land Use designation of the
General Plan.
CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated November 19, 1993
shall be the conceptually approved layout.

2. Prior to issuance of building permits, the property owner shall submit a bond
equal in amount to 150% of the cost to remove the proposed driveway on Adams
Avenue and reconstruct landscaping, parking and curbing as depicted on Plan A
approved by the Zoning Administrator on September 29, 1993.
3. The applicant shall submit an estimate of the cost of the driveway removal and
site reconstruction. The estimate shall be prepared by a licensed contractor.
4. Condition of Approval No. 6 of Use Permit No. 93-60 shall be amended to read as
follows:
"Prior to issuance of building permits, the property owner shall irrevocably
offer reciprocal driveway and access rights to and from the subject site and
adjacent properties. A copy of the legal instrument shall be approved by the
City Attorney as to form and content and, when approved, shall be recorded in
the Office of the County Recorder. A copy shall be filed with the Department
of Community Development prior to occupancy."
5. All other conditions previously approved under Use Permit No. 93-60 on
September 29, 1993 shall remain in effect.
INFORMATION ON SPECIFIC CODE REQUIREMENTS
1. The Zoning Administrator reserves the right to revoke Use Permit No. 93-60 if
any violation of these conditions of the Huntington Beach Ordinance Code
occurs.
