ITEM 1• USE PERMIT NO 93-101(1EMPORARY OUTDOOR EVENT) Applicant: Mel Berkley 19316 Beach Blvd. Huntington Beach, CA 92646 Request: To permit a large inflatable balloon on the roof of Al Unser's Auto Care for twenty-one (21) consecutive Saturdays commencing January 29, 1994 and ending June 18, 1994 pursuant to Section 973.64 of the Huntington Beach Ordinance Code. Location: 19300 Beach Jane Madera, Staff Planner reported that the applicant was proposing use of a large inflatable balloon on the roof of Al Unser's Auto Care for twenty-one (21) consecutive Saturdays. Staff recommended approval based on the hours of 7:00 a.m. to 9:00 p.m. Also that the balloon will not project over the public right-of-way or any property line. If there is any violation of the aforementioned, this would be handled by the Code Enforcement staff and the applicant's permit would be revoked. There were no persons present to speak for or against this request. USE PERMIT NO. 93-101 (TEMPORARY OUTDOOR EVENT) WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL: 1. The temporary outdoor event (large inflatable balloon) will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. With the conditions of approval imposed, the balloon will not fly over any public right- of-way or property line and therefore will not cause a vehicular or pedestrian safety hazard. b. Property and improvements in the vicinity of such use of building. The event is temporary in nature and no improvements will be altered as a result of this action. 2. The granting of Use Permit No. 93-101 (Temporary Outdoor Event) will not adversely affect the General Plan of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated December 23, 1993 shall be the conceptually approved layout. 2. The balloon shall be firmly secured so as no to project over any property line or over the public right-of-way. 3. The balloon shall be flown on Saturdays only. Installation shall take place no earlier than 7:00 a.m. and shall be removed no later than 8:00 p.m. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The event shall comply with all applicable provisions of the Ordinance Codes, Building Division and Fire Department. 2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 93-101 if any violations of these conditions or the Huntington Beach Ordinance Code occurs. ZA Minutes - 1/12/94 -2- 4. The applicant shall submit all future temporary outdoor event applications a minimum of thirty (30) days prior to the event. Failure to provide adequate notice shall result in denial of the request. ITEM 2• LOT LINE ADJUSTMENT NO.93-3 Applicant: Rick Wallace 28836 Via De Luna Laguna Niguel, CA 92668 Request: To permit a Lot Line Adjustment for an area between Lot 19 (single family residential lot) and Lot "F" (equestrian trail) of Tract 13439 pursuant to Section 9811.3.1 of the Huntington Beach Ordinance Code. Location: 18752 Jockey Circle Jane Madera, Staff Planner, reported the applicant was proposing a lot line adjustment on Jockey Circle within the Ellis-Goldenwest Specific Plan. The request is to relocate the line of the equestrian trail ten feet southeast, which gives the residential property more land usable for the backyard area and reduces the size of the equestrian trail around this area. This project was part of an original tract map approval and conditional use permit approval which was reviewed by the Planning Commission. In order to amend this open space equestrian trail, increase the size of this lot and change this trail, which links up to other public trails within this area, a site plan amendment to the original Planning Commission action would be required. Staff recommended this item be referred to the Planning Commission subject to the applicant submitting a site plan amendment with a notification to all property owners and homeowners associations within a 300' radius of the tract boundaries. The issues that will arise with the review of that site plan amendment are a reduction of the public open space through the equestrian trail, as well as the proper radius turns around that corner for access of maintenance vehicles to the trail itself. The applicant, Rick Wallace, was present and referred to the previous approval of the Planning Commission of another parcel map request. He stated that all these requests were previously approved by the Planning Commission but were never filed with the County. Mike Strange, Zoning Administrator, questioned what the exhibit was that the Applicant presented. The applicant, Rick Wallace, stated this exhibit was part of the previous action by the Planning Commission. ZA Minutes - 1/12/94 -3- Mike Strange commented that this document did not address the clipped corners of the present request and stated that if this request was included in the previous Planning Commission action the present request would not be necessary. The applicant stated that he could not understand if this was previously approved by the Planning Commission why this could not be approved as presented. Jane Madera, Staff Planner, reiterated to the applicant that this configuration was never recorded. She also stated that the focus of staffs recommendation is that the Planning Commission should see the amendment to what they originally approved, and secondarily, if this amendment would accommodate vehicle maintenance around this corner. Mike Strange stated that this action should be re -reviewed by the Planning Commission primarily because of the impacting of the trail system as this was not addressed in the previous action. He stated that the Planning Commission approved the conditional use permit on this tract with a certain configuration and now that configuration is being changed. Because there is an amendment to something they approved, they should be reviewing it with a site plan amendment application and a public hearing. There were no other persons present to speak for or against the request and the public hearing was closed. LOT LINE ADJUSTMENT WAS REFERRED TO THE FIRST AVAILABLE PLANNING COMMISSION MEETING PENDING THE APPLICANT'S SUBMITTAL OF A SITE PLAN AMENDMENT APPLICATION. ITEM 3: ADMINISTRATIVE REVIEW NO.93-5/TENTATIVE PARCEL MAP NO.93-213 Applicant: Loft Development 5622 Research Drive Huntington Beach, CA 92649 Request: To permit the construction of a new 9,250 square foot industrial building pursuant to Section 9510.01(s) of the Huntington Beach Ordinance Code. The request also includes consolidation of two (2) parcels into one (1) parcel pursuant to Section 9930.1 of the Huntington Beach Ordinance Code. Location: 5502 Buckingham ZA Minutes - 1/12/94 -4- Jane Madera, Staff Planner, reported that this is a request to construct a new 9,250 square foot industrial building at the corner of Buckingham and Graham. This request also includes the consolidation of two parcels into one so the building will not span a legal property line. The site plan was presented and is unique in that there is an existing parking, vehicle, and pedestrian access easement on the property. The applicant is desiring to take advantage of this easement and provide three spaces of parking within this easement for the proposed use, which is two warehouse suites. Parking has been calculated on a 1 per 1,000 ratio which is standard for warehouses. Staff recommended that a covenant be placed on the entire structure that it remain warehouse in perpetuity and never be used as a manufacturing facility so that the parking will always meet the requirements for warehouse. If this is changed the applicant would have to apply for a new administrative review application to establish a new use in this building. Staff also recommended some kind of corner treatment to be changed to make the bulding aesthetically pleasing. Ed Bonnani, developer, speaking for the applicant agreed to put layer of windows or something similar to improve the appearance of the building. Mr. Loft, the applicant also stated that the plans included use of a large amount of glass and recessed windows will be used in the construction. He also stated that he requested the developer use similar architecture as the surrounding buildings in the area. No other persons spoke for or against the request and the public hearing was closed. ADMINISTRATIVE REVIEW NO.93-5/TENTATIVE PARCEL MAP NO.93-213 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL TENTATIVE PARCEL MAP NO 93-213 1. The proposed consolidation of two (2) parcels for purposes of general industrial use is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives or implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for M1-A-20,000 - Restricted Manafacturing allowing general industrial buildings was placed on the subject property. ZA Minutes - 1/12/94 -5- 4. The size, depth, frontage, street width and other design and improvement features of the proposed lot consolidation are proposed to be constructed in compliance with standards plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL TENTATIVE PARCEL MAP NO, 93-213: TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE. Tentative Parcel Map No. 93-213 received by the Department of Community Development on December 2, 1993 shall be the approved layout. 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. A copy of the recorded parcel map shall be filed with the Department of Community Development. 3. Prior to recordation of this parcel map, the surveyor/engineer preparing the map shall tie the boundary of the map into the Horizontal Control System established by the County Surveyor in a manner described in Sections 7-9- 330 and 7-9-337 of the Orange County Subdivision Code and Orange County Subdivision Manual, Sub article 18. 4. Prior to recordation of this parcel map, the surveyor/engineer preparing the map shall submit to the County Surveyor a digital -graphics file of said map in a manner described in Sections 7-9-330 and 7-9-337 of the Orange County Subdivision Manual, Sub article 18. 5. All vehicular access rights to Graham Street shall be released and relinquished to the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan and floor plan received and dated January 3, 1994, and the tentative parcel map received and dated December 2, 1993, shall be the conceptually approved layout. The building elevations received and dated November 18, 1993 shall be the conceptually approved layout with the following modifications: a. A second row of glass window treatment shall be incorporated into the north west corner of the building. The additional windows shall be located directly above the existing proposed windows and shall be of the same number, size, and materials. ZA Minutes - 1/12/94 -6- G 2. A revised elevation shall be submitted depicting the modifications described above. 3. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 4. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing sets submitted for plancheck. 5. Prior to issuance of building permits, the following plans and items shall be submitted and/or completed by the applicant: a. The applicant/property owner shall submit a covenant restricting all uses of the proposed 9,250 square foot industrial building to warehouse and ancillary office use. The covenant shall be recorded at the County of Orange Recorder's Office and a copy of the recorded document submitted to the Community Development Department for inclusion in the file. The covenant and its restrictions shall run with the land. b. One set of landscape and irrigation plans to the Public Works Department for review and approval. The landscape construction set shall include a landscape plan prepared and signed by a State Licensed Landscape Architect which includes all proposed/existing plant materials (location, type, size, quantity), irrigation plan, grading plan and approved site plan, and copy of conditions of approval. The landscape plan shall be in conformance with Section 9607 of the Huntington Beach Ordinance Code. The set must be complete and approved by both Community Development and Public Works prior to issuance of building permits. C. The applicant shall record Tentative Parcel Map 93-213 with the Orange County Recorder and a copy of the recorded map filed with the Department of Community Development prior to final inspection or occupancy. d. Submit a precise grading plan to Public Works Department. 6. Installation of required landscaping and irrigation systems shall be completed prior to final inspection/within twelve (12) months. ZA Minutes - 1/12/94 -7- VA 8. 13. Public Works Department requirements: a. A precise grading plan shall be submitted to the Public Works Department for review and approval prior to the issuance of a building permit. b. All fees shall be paid prior to the issuance of building permits. C. The applicant/owner shall be responsible for payment of Traffic Impact fees prior to issuance of a Certificate of Occupancy and/or final building permit approval. Fire Department Requirements: a. Automatic sprinkler systems will be installed throughout to comply with Huntington Beach Fire Department and Uniform Building Code Standards. Shop drawings will be submitted to and approved by the Fire Department prior to installation. b. A fire alarm system will be installed to comply with Huntington Beach Fire Department and Uniform Fire Code Standards. Shop drawings will be submitted to and approved by the Fire Department prior to installation. The system will provide the following: • Waterflow, valve tamper and trouble detection • 24 hour supervision • Smoke detectors • Audible Alarms C. Fire extinguishers will be installed and located in areas to comply with Huntington beach Fire Code Standards. d. Address numbers will be installed to comply with City Specification #428. The size of the numbers will be the following: The number for the building will be sized a minimum of ten (10) inches with a brush stroke of one and one-half (1 1/2) inches. e. Exit signs and exit path markings will be provided in compliance with the Huntington Beach Fire Code and Title 24 of the California Administrative Code. Maximum separation between building wall and property line shall not exceed two inches (2"). ZA Minutes - 1/12/94 -8- 14. Driveway approaches shall be a minimum of twenty-seven feet (27) in width and shall be of radius type construction. 15. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers. 16. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 17. Natural Gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 18. Low -volume heads shall be used on all spigots and water faucets. 19. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. INFORMATION ON SPECIFIC CODE REQUIREMENTS 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 4. Development shall meet all local and State regulations regarding installation and operation of all underground storage tanks. 5. The Zoning Administrator reserves the right to revoke Administrative Review 93- 5 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. ITEM 4: USE PERMIT NO.93-82/COASTAL DEVELOPMENT PERMIT NO. 93-22 Applicant: Charles A. Beck 1224-D Village Way Santa Ana, CA 92705 ZA Minutes-1/12/94 -9- Request: To permit a 400 square foot third story addition to an existing two story townhome pursuant to Sections 9110.4(c) and 989.5.3(b) of the Huntington Beach Ordinance Code. Location: 3448 Windspun Drive Jane Madera, Staff Planner, reported that this request is to add a third story living area to an existing two story townhome in the Huntington Harbor area. A pop-up is being proposed on the roof with a third story addition up above, which will not change the ridge line. Jane stated the first item to be completed is to amend the request to read an approximatly 400 square foot lot addition instead of a 276 square foot lot addition. A similar project was approved in this area on Montego, which was the same floor plan, setting a precedence in this area to add a third story. Also, the rest of the project complies with the code requirements for open space, site coverage, etc. Staff recommended approved of this project based on the aforementioned. The applicants, Chris Gilman and Ann Pollack, were present and agreed with staff s recommendation. There were no other persons present to speak for or against this project. Mike Strange, Zoning Administrator questioned if we had a letter from the Homeowners Association and verified that this was approved by them. He reiterated that the square footage be changed from 276 feet to 400 square feet on the notice of action. No other persons spoke for or against the request and the public hearing was closed. USE PERMIT NO.93-82/COASTAL DEVELOPMENT PERMIT NO.93-22 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) WORKING DAYS AND ANOTHER TEN (10) WORKING DAYS TO COASTAL COMMISSION. FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO.93-22: 1. The request to permit the remodel and 400 square foot third story addition to an existing two-story single family residence conforms with the plans, policies, requirements and standards of the Coastal Element of the General Plan. The proposed third story addition will not impact public views or access. 2. Coastal Development Permit No. 93-22 is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the ZA Minutes - 1/12/94 -10- Huntington Beach Ordinance Code applicable to the property. The proposed development will conform with all applicable City codes. 3. At the time of occupancy, the proposed remodel and addition to an existing two- story single family residence will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. All infrastructure currently exist to the site. 4. The proposed remodel and third story addition addition to an existing two story single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. FINDINGS FOR APPROVAL - USE PERMIT NO.93-82: 1. The establishment, maintenance and operation of the 400 square foot third story addition will not have a detrimental effect on the general health, safety, or welfare or privacy of surrounding residents, or on surrounding property values. 2. The location, site plan and building design will be harmonious and compatible with the streets, driveways, property lines, and surrounding neighborhood. 3. The granting of Use Permit No. 93-82 will not adversely affect the General Plan of the City of Huntington Beach. The proposed third story addition is consistent with the goals and objectives of the Low Density Residential Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated October 21, 1993 shall be the conceptually approved layout. 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. All proposed dock and ramp improvements shall require separate permits for the improvements located within the public waterways. 4. All proposed cantilevered deck improvements require separate permits for the improvements. ZA Minutes - 1/12/94 -11- 5. All building spoils, such as` unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 6. Proposed structures shall be architecturally compatible with existing structures. INFORMATION OF SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 93-22 and Use Permit No. 93-82 if any violation of these conditions of the Huntington Beach Ordinance Code occurs.
