ITEM 1 • CONDITIONAL EXCEPTION NO.92-48 (ONE YEAR EXTENSION OF TI Applicant: John E. Shanks 410 Lake Street, #302 Huntington Beach, CA 92648 Request: To permit a one (1) year extension of time for a new 3,100 square foot two (2) story residence with reduced exterior sideyard setbacks for the garage and upperstory. Location: 1235 Alabama Street Jane Madera, Staff Planner reported that the applicant was requesting a one year extension of time for an application reviewed by the Zoning Administrator one year ago for construction of a new single family dwelling. The variance associated with this construction was for a reduced exterior side yard setbacks for garage and the upper story. The property is located at the corner of Alabama and Memphis Street, and the reason for variance was that the property owner had to dedicate a 20 foot comer radius on Alabama, which precluded any access from Alabama Street. The applicant converted the plans from wood framing to a lightweight metal framing in conjunction with comments from the Plan Check Division. No other comments from other departments have been received on this project. Staff recommended approval of this request with all other conditions of approval to remain in effect. Applicant, John Shanks was present and concurred with Staff s recommendation. THE PUBLIC HEARING WAS OPENED. The applicants, Jack and Dori Vance were present and reiterated the plans for their front yard pool and proposed wall. The applicant commented the plans need to be submitted to their architectural committee for approval. Mike Strange, Zoning Administrator proposed a 7 1/2 foot setback with a ten (10) foot setback at the corner of the driveway and the wall allowing for visibility of vehicles and pedestrians. Jane Madera, staff planner, stated that the plans will be revised to show a 7 1/2 foot setback, a ten (10) foot corner cut-off and two brick pilasters on either end of the wall. The brick pilasters will have no minimum dimension, but the entire wall will have a brick cap to match existing planters. There were no other persons present to speak for or against this request. THE PUBLIC HEARING WAS CLOSED. USE PERMIT NO.93-91 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL -USE PERMIT NO 93-91: 1. Use Permit No. 93-91 to permit the construction of a six (6) foot tall solid masonry wall within the required front yard setback (7 feet, 6 inches in lieu of minimum 15 feet) will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. A ten (10) foot corner cut-off between the driveway and the six (6) foot tall wall will be maintained and will not pose a hazard to pedestrians and vehicles. b. Property and improvements in the vicinity of such use or building. The wall will be setback 7 feet 6 inches from the front property line. Brick pilasters and a brick cap will be incorporated into the wall to make it architecturally compatible with the existing brick planters and brick detail in the driveway. The wall will provide privacy and necessary security for the applicant's proposed pool. 2. The granting of Use Permit No. 93-91 will not adversely affect the General Plan of the City of Huntington Beach. The 6 foot tall wall within the front yard ZA Minutes - 1/19/94 -3- 1 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 93-91 if any violation of these conditions of the Huntington Beach Ordinance Code occurs.
