MINUTES: The Minutes of the February 2, 9 and 16, 1994,
Zoning Administrator Meetings were continued.
ITEM 1: USE PERMIT NO.94-4 (TEMPORARY OUTDOOR EVENT)
Applicant: Phil Garnett

Request: To permit a three (3) day temporary outdoor event book sale, with a tent,
on March 2, 3 and 4, 1994 pursuant to Section 9730.64 of the Huntington
Beach Ordinance Code.
Location: 15902 Springdale
Jane Madera, Staff Planner reported that this application was a request for a Temporary Outdoor
Event at the corner of Springdale and Edinger. A similar request was approved in August of last
year for this applicant. Staff recommended approval with findings and conditions.
The applicant's representative Ron Buyse was present and concurred with staff s
recommendation.
There were no other persons present to speak for or against this request.
USE PERMIT NO.94-4 (TEMPORARY OUTDOOR EVENT) WAS APPROVED BY
THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND
CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE
ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING
COMMISSION WITHIN TEN (10) CALENDAR DAYS.
FINDINGS FOR APPROVAL:
1. The temporary outdoor event will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity. The three (3)
day book sale will not impact on -site circulation nor access to existing businesses.
b. Property and improvements in the vicinity of such use of building. The event is a
temporary use.
2. The granting of Use Permit No. 93-25 will not adversely affect the General Commercial
Land Use designation of the General Plan of the City of Huntington Beach which
allows temporary outdoor events of this nature..
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan received and dated January 25, 1994 shall be the conceptually approved
layout.
2. Fire access lanes shall be maintained. If fire lane violations occur and the services of
the Fire Department are required, the applicant will be liable for expenses incurred.
3. Fire access lanes shall be a minimum with of (20) twenty feet.
4. A detailed site plan shall be submitted to the Huntington Beach Fire Department for
approval (show table locations, tents, barriers, etc.)
5. The applicant shall obtain all necessary Fire Department permits and comply with all
provisions of Article 32 of the Uniform Fire Code.
6. The applicant's request shall include necessary permits for temporary signs.
7. The proposed tent shall be of fire retardant material. Proof of Certification shall be
submitted to the Fire Department for approval prior to the tent's installation on the site.
8. The proposed tent shall be secured against collapsing to the satisfaction of the Fire
Department.
9. "No Smoking" signs shall be posted in conspicuous locations.
10. Fire extinguishers shall be provided in number and locations specified by the Fire
Department.
11. A minimum of two (2) exits shall be provided and maintained.

12. Stand by personnel shall be on site to safeguard premises.
13. An overnight security guard shall be provided to protect merchandise left overnight.
The Huntington Beach Police Department shall be notified 24 hours prior to the event.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The event shall comply with all applicable provisions of the Ordinance Codes, Building
Division and Fire Department.
2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances
and standards.
3. The Zoning Administrator reserves the right to revoke Use Permit No. 93-25 if any
violations of these conditions or the Huntington Beach Ordinance Code occurs.
4. The applicant shall submit all future temporary outdoor event applications a minimum
of thirty (30) days prior to the event. Failure to provide adequate notice shall result in
denial of the request.

Request: To permit a temporary outdoor event for several sidewalk sales at
Loehmann's Five Points Center pursuant to Section 9730.64 of the
Huntington Beach Ordinance Code. The events are proposed for March
11-12; April 8-9; May 13-14; June 10-11; July 8-9; August 12-13;
September 9-10; November 11-12; October 7-8; and December 8-10,
1994.
Location: 18501-18691 Main Street
Jane Madera, Staff Planner reported that this is a request for a temporary outdoor event for
twenty-one (21) days which is a series of different weekends for sidewalk sales at Loehmarm s
Five Points Center. A similar request last year was approved. Staff recommended approval with
finding and conditions.
THE PUBLIC HEARING WAS OPENED.
The applicant, Sandra Lamperts, was present and concurred with staff s recommendation.
No other persons were present to speak for or against this request.
THE PUBLIC HEARING WAS CLOSED.
USE PERMIT NO.94-13 WAS APPROVED BY THE ZONING ADMINISTRATOR
WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE
STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE

Land Use designation of the General Plan of the City of Huntington Beach which
allows temporary outdoor events of this nature.

ITEM 3: USE PERMIT NO.94-1

Request: To permit the establishment of Thrifty Driving School pursuant to Section
9220.1(c)P of the Huntington Beach Ordinance Code.
Location: 15041 Edwards Street
Jane Madera, Staff Planner reported that the applicant is requesting the establishment of Thirfty
Driving School for under aged and non -licensed drivers. The classes will be held on Saturdays
only. The use is defined as a personal enrichment service, which requires 1 parking space for
every 35 square feet of instructional area. The applicant's floor plan identifies a one hundred
square foot classrom to stay in conformance with parking standards. Staff recommended
approval of the project with findings and conditions.

The applicant nor anyone was present to speak for or against the project.
THE PUBLIC HEARING WAS CLOSED.
USE PERMIT NO.94-1 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED
THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE
APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR
DAYS.
FINDINGS FOR APPROVAL -USE PERMIT NO.94-1:
The establishment, maintenance and operation of the driving school use will not be
detrimental to:
a. The general welfare of persons residing or working in the vicinity. Classes will
be held on Saturdays from 9:00 a.m. to 4:00 p.m. for students who do not yet
drive. The operation involves classroom instruction only; no on -site driving
instruction is included in the request. Therefore, use of the commercial building
will not be detrimental to people residing or working in the area.
b. Property and improvements in the vicinity of such use or building. The majority
of students will be dropped off and picked up at the site because they do not yet
have their driving licenses. Therefore, impacts to on -site parking at the shopping
center is anticipated to be negligible.
2. The granting of Use Permit No. 94-1 will not adversely affect the General Plan of the
City of Huntington Beach. The personal enrichment driving school is consistent with the
goals and objectives of the General Commercial Land Use designation of the General
Plan.

SPECIAL CONDITIONS OF APPROVAL:
1. The site plan and floor plans received and dated February 4, 1994 shall be the
conceptually approved layout.
2. Classroom instruction area shall be limited to a maximum of 100 square feet in area. Any
additional classroom area will require additional parking to be provided.
3. The Zoning Administrator shall be notified in writing if any changes in floor area or
parking are proposed as a result of the plan check process. Building permits shall not be
issued until the Zoning Administrator has reviewed and approved the proposed changes.
The Zoning Administrator reserves the right to require that an amendment to the original
entitlement be processed if the proposed changes are of a substantial nature.
4. Conditions of approval shall be printed verbatim on the cover sheet of all working
drawing sets submitted for plancheck.
1. The development shall comply with all applicable provisions of the Ordinance Code,
Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances,
and standards.
3. The Zoning Administrator reserves the right to revoke Use Permit 94-1 if any violation of
these conditions or the Huntington Beach Ordinance Code occurs.
