MINUTES: The Minutes of the February 9, 16 and 23, 1994,
Zoning Administrator Meetings were continued.
ITEM 1: USE PERMIT NO.94-10
Applicant: Paul Gardikas
91 Nightingale Drive
Aliso Viejo, CA 92656
Request: To permit the operation of a seasonal strawberry sales lot for more than 31
days (March 15, 1994 through July 31, 1994).
Location: 5141 Warner (northwest corner of Warner Avenue and Roosevelt Lane)
Jane Madera, Staff Planner reported that this application was a request to permit the operation of
a seasonal strawberry sales lot from March 15, through July 31, 1994. Staff recommended that
the driveway and parking area be surfaced for dust control. Staff recommended approval with
findings and conditions.
The applicant Paul Gardikas was present and concurred with staff s recommendation.
There were no other persons present to speak for or against this request.
USE PERMIT NO.94-10 WAS APPROVED BY THE ZONING ADMINISTRATOR
WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE
STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE
APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR
DAYS.
FINDINGS FOR APPROVAL -USE PERMIT NO.94-10:
1. Use Permit No. 94-10 for the establishment, maintenance and operation of the seasonal
strawberry sales lot will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity. The site will
maintain an adequate ten (10) foot setback between the property lines and the
parking and/or temporary stand. All parking will be provided on -site and the
driveway and parking area will be surfaced as a dust control measure.
b. Property and improvements in the vicinity of such use or building. The seasonal
sales lot is temporary in nature and will be compatible with surrounding uses in
the area.
2. The granting of Use Permit No. 94-10 will not adversely affect the General Plan of the
City of Huntington Beach. The seasonal strawberry sales lot is consistent with the goals
and objectives of the General Commercial Land Use designation of the General Plan.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan received and dated February 4, 1994 shall be the conceptually approved
layout with the following modifications:
a. Depict a minimum 10 foot setback from property lines to structure and parking
area.
b. Depict a minimum of 10 parking stalls, nine (9) feet wide by nineteen (19) feet
deep, with a minimum twenty-six (26) foot back-up space.
2. A revised site plan shall be submitted depicting the modifications described above.
3. The Zoning Administrator shall be notified in writing if any changes in building height,
floor area, setbacks, building elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the Zoning Administrator has
reviewed and approved the proposed changes. The Zoning Administrator reserves the
right to require that an amendment to the original entitlement be processed if the
proposed changes are of a substantial nature.
4. Conditions of approval shall be printed verbatim on the cover sheet of all working
drawing sets submitted for plancheck.
5. The temporary use shall be limited to retail sales of strawberries only. No other produce
or merchandise shall be sold from the stand. Hours of operation shall be limited from
9:00 a.m. to 7:30 p.m.

6. The driveway entrance and parking area shall be surfaced to provide dust control.
Method of surfacing shall be subject to Fire Department; Public Works, and Community
Development Department approval.
7. The applicant shall submit a cash bond in the amount of Five Hundred Dollars ($500.00)
to insure clean-up of the site after the use.
8. The applicant's request shall include necessary permits for temporary signs which meet
the code requirements for temporary sign permits.
9. Fire Department Requirements:
a. The site address shall be clearly posted in a conspicuous manner at the site.
b. One 2A-10BC fire extinguisher shall be provided at the site.
INFORMATION ON SPECIFIC CODE REQUIREMENTS
1. The development shall comply with all applicable provisions of the Ordinance Code,
Building Division, and Fire Department.
2. The Zoning Administrator reserves the right to revoke Use Permit No. 94-10 if any
violation of these conditions of the Huntington Beach Ordinance Code occurs.
ITEM 2: USE PERMIT NO.94-6 (TEMPORARY OUTDOOR EVENT)
Applicant: Emilia Ramirez

Request: To permit the Certified Farmer's Market to operate at the location
described below for twenty-one (21) days (Fridays) commencing March
18, 1994 between the hours of 2:00 p.m. to 6:00 p.m. pursuant to Section
9730.64 of the Huntington Beach Ordinance Code.
Location: 321 Main Street (Southwest corner of Main Street and Orange Avenue)
Jane Madera, Staff Planner reported that this is a request to permit the Certified Farmer's Market
for twenty-one (21) days (Fridays) commencing March 18, 1994 between the hours of 200 p.m.
to 6:00 p.m. She stated that this application for a temporary outdoor event was approved last

year in the same location. She stated that the Police Watch Commander in the downtown area
requested that the applicant provide trash receptacles at the site. Staff recommended approval
with findings and conditions.
THE PUBLIC HEARING WAS OPENED.
The applicant, Emilia Ramirez was present and concurred with staff s recommendation.
Keith Bohr, Redevelopment Agency, was present and concurred with staffs recommendation.
Mike Strange, Zoning Administrator, questioned staff regarding the types of items permitted for
sale.
Ms. Ramirez and Mr. Bohr clarified that the Farm Bureau only permitted "direct grown" items to
be sold and allowed three or four related items such as bread, eggs or flowers to be part of the
market.
No other persons were present to speak for or against this request.
THE PUBLIC HEARING WAS CLOSED.
Mike Strange, Zoning Administrator stated that he wanted the project conditioned to coincide
with the Farm Bureau guidelines regarding produce and related items.
USE PERMIT NO.94-6 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED
THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE
APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR
DAYS.
FINDINGS FOR APPROVAL:
1. The temporary outdoor event for a Certified Farmers Market for twenty-one (21)
consecutive Friday afternoons commencing on March 18, 1994 will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity. The proposed
market will not obstruct circulation or impact access to existing businesses.
Furthermore, motorists will be directed to park in the Main Promenade parking
structure with validation by vendors.
b. Property and improvements in the vicinity of such use of building. The proposed
market is a temporary use on an existing parking lot. The applicant is responsible for
clean up after each event.

2. The granting of Use Permit No. 94-6 for a limited time Farmers Market will not
adversely affect the Mixed Use Land Use designation of the General Plan of the City of
Huntington Beach.
SPECIAL CONDITIONS OF APPROVAL:
1. The revised site plan received and dated January 25, 1994 shall be the conceptually
approved layout.
2. Fire access lanes shall be maintained. If fire lane violations occur and the services of the
Fire Department are required, the applicant will be liable for expenses incurred.
3. Fire access lanes shall be a minimum width of (20) twenty feet.
4. The applicant shall obtain all necessary Fire Department permits and comply with all
provisions of Article 32 of the Uniform Fire Code.
5. The applicant's request shall include necessary permits for temporary signs, however no
signs shall be permitted in any landscaping and shall be displayed only on the days of the
event.
6. Vehicles, barriers, equipment, or customer lines shall not encroach into the public right-
of-way (street, alley, sidewalks).
7. The applicant shall coordinate with the Community Services and Economic Development
Departments to establish a validation system for customer parking in the Main
Promenade parking structure.
8. The applicant shall file a cash bond in the amount of Five Hundred Dollars ($500.00) to
insure clean-up of the site after each event.
9. Signs shall be posted directing motorists to the Main Promenade parking structure on the
200 block of Main Street.
10. The entire market operation (includes set-up and break -down shall be limited to 11:00
a.m. to 9:00 p.m. on Fridays only.
11. Fire extinguishers shall be provided in number and locations specified by the Fire
Department.
12. Storage of any items related to the Farmers Market shall be prohibited during the week.
13. Sale of items shall be in accordance with the Farmers Market Guidelines and shall be
limited to directly grown items and permitted for four (4) related food/produce items.

INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The event shall comply with all applicable provisions of the Ordinance Codes, Building
Division and Fire Department.
2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances
and standards.
3. The Zoning Administrator reserves the right to revoke Use Permit No. 94-6 if any
violations of these conditions or the Huntington Beach Ordinance Code occurs.
