ZONING ADMINISTRATOR: STAFF MEMBER: MINUTES: SCHEDULED ITEMS: Michael Strange Jane Madera The Minutes of the April 6 and 13, 1994 Zoning Administrator Meetings were continued. ITEM 1: USE PERMIT NO.94-28 (TEMPORARY OUTDOOR EVENT) Applicant: K and M, Inc. - Scott Benedict 2437 Cerand Avenue - Suite 159 Ventura, CA 93003 Property Owner: Huntington Beach Mall - Macerich Co. 7777 Edinger #300 Huntington Beach, CA 92647 Request: To permit a temporary outdoor event, Circus Vargas, in the parking lot at Huntington Beach Mall, from May 9 through 15, 1994 pursuant to Section 9730.64 of the Huntington Beach Ordinance Code. Location: 7777 Edinger Avenue Jane Madera, Staff Planner reported that this application was a request for a use permit for a temporary outdoor event at the Huntington Center Mall. Staff presented two site plans which depicted the Circus Vargas event. The event is proposed May 9 through May 15, 1994 at 4:30 p.m. and 7:30 p.m. On the weekends there will also be a 12:30 p.m. show. The location will be in the parking lot by the former Barker Bros. building, and will include a tent, restrooms and food vending booths. Fire Department, Police Department, a representative from the electrical division of the Building Department and staff recommended approval of this event with several conditions of approval. The first condition is for traffic circulation and access, which would include blocking off a portion of the easterly parking lot to facilitate access to the event at one entrance on Edinger and for directory signage for the circus pointing to this entrance. Staff reported that the mall has designated specific parking spaces for this event. Staff also recommended signage for the event on Center Drive. Another recommendation is for eight security personnel on the site at all times, some of which will direct traffic and other to perform security function. In addition, the mall will also have their regular security personnel within the area. Another recommendation is that access to the rear of Circuit City be blocked to facilitate circulation while still permitting customers at that location. Mike Strange questioned if there was ample time between shows for traffic circulation. Also he questioned the number of attendance at each event. Staff responded that the seating capacity was 2,400 in the tent. Past events have been attended by approximately 1,500 people. THE PUBLIC HEARING WAS OPENED The applicant, Rolanda Kaiser was present and responded that the shows were each two (2) hours in length which would be adequate time for access for traffic circulation between shows. Applicant also stated that no alcohol would be served at this event, that it is a family type of show and they have never had any security problems. Applicant also stated that there would not be any exotic animals at this event except for dogs. Applicant also stated that they were working closely with the mall and that they did not anticipate any problems. Applicant concurred with staffs recommendation. Staff also stated that the applicant was supplying a twenty-four hour emergency telephone number to the Police Department. There were no other persons present to speak for or against this request. THE PUBLIC HEARING WAS CLOSED USE PERMIT NO.92-28 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS FOR DENIAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL: 1. The Use Permit No. 94-28 for seven (7) day temporary outdoor event, Circus Vargas will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. With the conditions of approval imposed, the event will be maintained, secured, and controlled in an appropriate manner with directional signage, traffic control, and security personnel. The Huntington Beach Mall will also participate in control of the area with the ZA Minutes 4/20/94 2 regularly scheduled mall security. There will be ample time between shows (one hour) for circulation and exiting and entering the parking lot. b. Property and improvements in the vicinity of such use of building. The event is temporary in nature and will not alter the existing property and improvements in the vicinity. 2. The granting of Use Permit No. 94-28 will not adversely affect the General Commercial General Plan Land Use Designation of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated March 25, 1994 shall be the conceptually approved layout. 2. The applicant shall post entryway and directional signage at the second driveway entrance on Edinger Avenue from Beach Boulevard. and at the driveway entrance on Center Avenue. No public access to the circus shall be offered behind the Circuit City and Barker Bros. buildings. The first driveway entrance to the mall parking lot on Edinger from Beach Boulevard shall be closed a minimum of one hour before each event and must be opened one hour after the last event of the day. 3. The applicant shall provide personnel to direct traffic flow into and out of the site from one hour before each show to one hour after each show. 4. Eight (8) uniformed, identifiable security personnel shall be on site to safeguard premises and the applicant shall provide a 24 hour emergency phone number to the Police Department. 5. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 6. Fire access lanes shall be a minimum with of (24) twenty-four feet. 7. The applicant shall obtain all necessary Fire Department permits and comply with all provisions of Article 32 of the Uniform Fire Code. 8. All parking shall be a minimum of sixty (60) feet from the proposed tent. 9. The proposed tent shall be of fire retardant material. Proof of Certification shall be submitted to the Fire Department for approval prior to the tent's installation on the site. ZA Minutes 4/20/94 3 10. The proposed tent shall be secured against collapsing to the satisfaction of the Fire Department. 11. Fourteen (14), 2A/1OBC Fire extinguishers shall be provided in locations specified by the Fire Department. 12. Exit ways and signs shall comply with Article 32 of the Huntington Beach Fire Code. 13. The applicant's request shall include necessary permits for temporary signs, however, no signs shall be located in the public right-of-way. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The event shall comply with all applicable provisions of the Ordinance Codes, Building Division and Fire Department. 2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 94-28 if any violations of these conditions or the Huntington Beach Ordinance Code occurs. 4. It is recommended that the applicant submit all future temporary outdoor event applications a minimum of ninety (90) days prior to the event. Failure to provide adequate notice may result in denial of the request. ITEM 2: USE PERMIT NO.94-15 Applicant: H.O.W. Hall, Inc., A Non -Profit Corp. P. O. Box 6267 Huntington Beach, CA 92645 Property Owner: Bob CT Chang DBA: Beach Garfield Plaza 238 S. Atlantic Blvd. Alhambra, CA 91801 Request: To establish a 2,200 square foot personal enrichment service (12-step Recovery Program) in an existing retail commercial shopping center pursuant to Section 9220.1(c) of the Huntington Beach Ordinance Code. Location: 19142 Beach Blvd., Suites Z and AA ZA Minutes 4/20/94 4 Jane Madera, Staff Planner reported that this application was to establish a personal enrichment service. This is a 12-step recovery program and will offer classes and meeting rooms for these types of groups. Typically this will be for Alcoholics Anonymous, however there will be other 12-step groups meeting in this space. Staff presented a site plan which showed the entire area of the project. Staff also presented a floor plan, showing the improvements to be made in this space. The service will offer two (2) separate meeting rooms, however, the applicant is willing to restrict meeting times in these rooms to offset parking. Staff also commented that this center was built with a surplus of parking spaces. Staff stated that after reviewing the parking requirements, it was discovered that even using both of the meeting rooms at the same time, the available parking is sufficient. Staff also felt that the use is compatible with the other uses in the surrounding area and will serve a good public need. Staff recommended approval with findings and conditions. THE PUBLIC HEARING WAS OPENED The applicant, Guy Fuller, was present and concurred with staffs recommendation. He also shared briefly the history of H.O.W. Hall. The treasurer of H.O.W. Hall, Chip Allen was present and stated that they were interested in providing a meeting place for all the 12-step programs. There were no other persons present to speak for or against this request. THE PUBLIC HEARING WAS CLOSED USE PERMIT NO.94-15 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS FOR DENIAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL -USE PERMIT NO. 94-15: Use Permit No. 94-15 for the establishment, maintenance and operation of the 2,200 square foot personal enrichment service (12-step Recovery Program) will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The shopping center site provides adequate parking for the assembly use in accordance with the Huntington Beach Ordinance Code standards. b. Property and improvements in the vicinity of such use or building. All required infrastructure and improvements are currently available to the site and will not be altered as a result of this action. 2. The granting of Use Permit No. 94-15 will not adversely affect the General Plan of the City of Huntington Beach. The 2,200 square foot personal enrichment service is ZA Minutes 4/20/94 consistent with the goals and objectives of the General Commercial Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: The site plan and floor plan received and dated March 25, 1994 shall be the conceptually approved layout. 2. The personal enrichment service shall be confined to operation only in the assembly areas depicted on the floor plan described above. Other uses of the suites such as lockers, literature display, restrooms, offices, and break room shall also be permitted as shown on the floor plan. 3. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 4. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing sets submitted for plancheck. INFORMATION ON SPECIFIC CODE REQUIREMENTS The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 94-15 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. ITEM 3: USE PERMIT NO. 94-16 Applicant/ Sai-Hau Chu Property Owner: 1926 Pine Street Huntington Beach, CA 92648 J ZA Minutes 4/20/94 6 Request: To permit an existing five (5) foot, six (6) inch tall combination masonry and wrought iron fence to remain within three (3) feet of the front property line (minimum 15 foot setback required) pursuant to Section 9771(1) of the Huntington Beach Ordinance Code. Location: 1926 Pine Street Jane Madera, Staff Planner reported that this application was for a use permit for an existing wall within the front setback exceeding the required height limit. This is an existing low planter wall with a wrought iron fence above it located within the three (3) feet of the front property line. Staff reported that this request is a result of a code enforcement violation, directing the applicant to apply for a use permit for the wall or remove the wall. Staff stated that this structure was compatible with the existing house and neighborhood. Staff recommended approval of this use permit with conditions and findings. Staff also stated that there were five (5) letters written in support of this wall. THE PUBLIC HEARING WAS OPENED The applicant, Sai-Hau Chu was present and concurred with staffs recommendation and expressed his willingness to acquire a use permit for this request. There were no other persons present to speak for or against this request. THE PUBLIC HEARING WAS CLOSED USE PERMIT NO.94-16 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS FOR DENIAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL -USE PERMIT NO. 94-16: Use Permit No. 94-16 the establishment and maintenance of the existing five (5) foot, six (6) inch high masonry and wrought iron fence within the front yard setback will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The masonry and wrought iron fence is compatible with the existing house and other surrounding homes in the area. The fence is approximately 80% see -through with landscape planters in front which softens the look of the structure located in the setback. b. Property and improvements in the vicinity of such use or building. The fence within the front yard setback will not alter the existing property or improvements in the vicinity. ZA Minutes 4/20/94 7 2. The granting of Use Permit No. 94-16 will not adversely affect the General Plan of the City of Huntington Beach. The five (5) foot six (6) inch tall wall three feet from the front property line is consistent with the goals and objectives of the Medium Density Residential Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: The site plan, floor plans, and elevations received and dated February 15, 1994 shall be the conceptually approved layout. 2. The color of the wall shall always remain consistent with the color of the house. 3. The landscaping in the low planters at the front property line shall permanently be maintained in a neat and clean manner. 4. No additional solid material shall be placed between the wrought iron other than landscaping. The applicant shall apply for a building permit for the existing wall within 30 days of this action and have it finaled by the Building Department within 90 days of this action. 6. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 7.
