ZONING ADMINISTRATOR: Michael Strange STAFF MEMBER: REVIEW OF MINUTES: Jane Madera April 27, May 4, 1994 Approved May 11, 1994 Continued ITEM 1: USE PERMIT NO.94-38 (Temporary Outdoor Event) Applicant: Della Chadwell 7777 Edinger Ave., #300 Huntington Beach, CA 92647 Request: To permit a two (2) day parking lot sale at Huntington Beach Mall on May 28-29, 1994 pursuant to Section 9630.64 of the Huntington Beach Code. Location: 7777 Edinger (Huntington Beach Mall) Jane Madera, Staff Planner reported that this application was a request for a two (2) day temporary outdoor event for a parking lot sale for Montgomery Ward for excess merchandise. This event is proposed for Saturday, May 28 and Sunday May 29. The merchandise, which includes furniture, major appliances, electronics, bikes, exercise equipment, clothing, bedding, linens and housewares, will be left out overnight and the applicant is proposing a security guard to watch over the merchandise. The sale area will take up approximately 28 parking stalls however, sufficient parking for the event and other businesses is availale in the remainder of the mall parking lot. Staff reported that they feel this use is compatible with the Huntington Beach Mall and recommended approval with findings and conditions. There were no persons present to speak for or against this request. USE PERMIT NO.94-38 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS FOR DENIAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL - USE PERMIT NO. 94-38 (TEMPORARY OUTDOOR EVENT 1. Use Permit No. 94-38 for a two (2) day temporary outdoor event will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The two (2) day parking lot sale will not block any existing entrances to the Huntington Beach Mall and will not conflict with any other businesses in the area. b. Property and improvements in the vicinity of such use of building. The temporary two (2) day parking lot sale will not alter any existing improvements in the area. 2. The granting of Use Permit No. 94-3 8 will not adversely affect the General Plan of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: The site plan received and dated May 5, 1994 shall be the conceptually approved layout. 2. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 3. Fire access lanes shall be a minimum with of (20) twenty feet. 4. A detailed site plan shall be submitted to the Huntington Beach Fire Department for approval (show table locations, tents, barriers, etc.) The applicant shall obtain all n: cessary Fire Department permits and comply with all provisions of Article 32 of the Uniform Fire Code. 6. The applicant's request shall include necessary permits for temporary signs. 7. Fire extinguishers shall be provided in number and locations specified by the Fire Department. 8. Stand by personnel shall be on site to safeguard premises. 9. An overnight security guard shall be provided to protect merchandise left overnight. The Huntington Beach Police Department shall be notified 24 hours prior to the event. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The event shall comply with all applicable provisions of the Ordinance Codes, Building Division and Fire Department. ZA Minutes 5/18/94 2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 94-38 if any violations of these conditions or the Huntington Beach Ordinance Code occurs. 4. The applicant shall submit all future temporary outdoor event applications a minimum of ninety (90) days prior to the event. Failure to provide adequate notice may result in denial of the request. ITEM 2: USE PERMIT NO.94-21/CONDITIONAL EXCEPTION (VARIANCE) NO.94-17 Applicant: Elliott Associates 16421 Wimbledon Huntington Beach, CA 92649 Request: To add one (1) additional mobilehome space to an existing mobile home park pursuant to Section 9141 of the Huntington Beach Ordinance Code. The request includes a variance to provide 350 square feet of private open space in lieu of common recreational open space and to eliminate the required recreational vehicle storage area pursuant to Sections 9144 and 9149(c) of the Huntington Beach Ordinance Code. Location: 6241 Warner Avenue (Sea Aira Mobile Home Estates) Jane Madera, Staff Planner reported that this application was a request for a use permit for one additional tenant space at an existing mobilehome park located on Springdale and Warner. In 1986, a use permit was acted upon by the Zoning Administrator for five (5) additional mobilehome spaces and one (1) additional caretaker's unit. The project was approved at that time in a modified version. The original request was for seven (7) mobilehome spaces and one caretaker's unit. At that time the applicant received a variance to provide private recreational area upon each additional space rather than adding to the common recreational area since they did not have the opportunity to add additional common recreation area. The code requirement is 200 square feet of common recreational area per mobilehome space. The caretaker's unit was also denied at that time because there was no additional parking proposed. An additional space was denied because there is a requirement within the Ordinance Code that each mobilehome park provide an area set aside for recreational vehicle and boat storage. The four (4) spaces were approved with an area conditioned to be left open for recreational vehicle and boat storage. The request today is to add a space and includes a variance to provide private recreational area on the lot rather than to add to the common recreational area as well as a variance to delete the required set aside area for recreational vehicle and boat parking. Staff recommended denial of this request because of the importance of providing the area for recreational vehicle and boat storage to the tenants of the mobilehome park. The applicant did not propose an alternative area or parking of the oversize vehicles. ZA Minutes 5/18/94 THE PUBLIC HEARING WAS OPENED The property owner, Gene Pica was present and stated that the space they are requesting at one time had an old garage on it. He also stated this garage was infested with termites and they tore it down in January of this year, and so was never used for RV's. He also stated that the occupants who have RV's find a place to park outside of the park. He stated he felt that preserving this space for RV parking would cause problems since it was not sufficient for all members of the mobilehome park. Bert Elliot, applicant was present and stated that it appears that there is no specific ratio of RV parking spaces per number of mobilehome units. He stated they have 123 lots in this park and that they could park three or four vehicles maximum in this space. He also reiterated the problem with not having sufficient space for all members of the mobilehome park to park their RV's. There were no other persons present to speak for or against this request. THE PUBLIC HEARING WAS CLOSED USE PERMIT NO.94-21/CONDITIONAL EXCEPTION (VARIANCE) NO. 94-17 WAS DENIED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADIVIINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR DENIAL -USE PERMIT NO. 94-21: Use Permit 94-21 for the establishment, maintenance and operation of the one (1) additional mobilehome space to an existing mobilehome park will be detrimental to: a. The general welfare of persons residing or working in the vicinity. The additional space entirely eliminates the required set -aside area for parking of recreational vehicles and boats to the detriment of the residents of Sea Aira Mobile Home Estates. The variance request to eliminate the recreational vehicle parking area in conjunction with Use Permit No. 94-21 was not approved by the Zoning Administrator. b. Property and improvements in the vicinity of such use or building. The addition of the mobile home space which eliminates the recreational vehicle storage area will force residents to utilize on -street parking or secure off -site storage facilities. 2. The granting of Use Permit No. 94-21 will not adversely affect the General Plan of the City of Huntington Beach. The additional mobilehome space is not consistent with the goals and objectives of the Residential Medium Density Land Use designation of the General Plan. ZA Minutes 5/18/94 4 FINDINGS FOR DENIAL - CONDITIONAL EXCEPTION (VARIANCE) NO 94-17: 1. The granting of Conditional Exception No. 94-21 will constitute a grant of special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. Other mobile home parks in the City of Huntington Beach are required to provide the recreational vehicle parking area. 2. Because there are no special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the Zoning Ordinance is not found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. The property is an adequate sized lot with no unique special circumstances to merit the elimination o the recreational vehicle parking area. In 1986, the property owner received approval to add five (5) additional mobilehome spaces in the park. While four (4) of those spaces were permitted in oversize vehicle parking areas the project was conditioned to require parking to remain open in the area that the applicant now proposes to eliminate. 3. The granting of Conditional Exception No. 94-17 is not necessary in order to preserve the enjoyment of one or more substantial property rights. The mobilehome park is already fully developed with 132 mobilehome spaces and received prior approval for variances to add five (5) additional spaces with private open space in lieu of common recreational area. 4. The granting of Conditional Exception No. 94-17 will be materially detrimental to the public welfare, or injurious to property in the same zone classifications. The elimination of the recreational vehicle parking area would be a detriment to the residents of the Sea Aira Mobilehome Estates as they do not have the opportunity to park their vehicles within their own lots. Other traditional single family dwelling owners can park oversize vehicles on their own driveways. 5. The granting of Conditional Exception No. 94-17 will adversely affect the General Plan of the City of Huntington Beach.
