MINUT'ES: The Minutes of the May 11 and 18, 1994 Zoning
Administrator meeting were continued.
ITEM 1: USE PERMIT NO.94-39 (Temporary Outdoor Event)
Applicant: Mohammed Memon

Huntington Beach, CA 92648
Request: To permit a two (2) day temporary outdoor event featuring live music in the Electric Chair
parking lot in conjunction with Pierfest on August 20-21, 1994 pursuant to Section 9730.64
of the Huntington Beach Ordinance Code.
Location: 410 Main Street
Jane Madera, Staff Planner reported that this application was a request for a temporary outdoor
event in the parking lot of the Electric Chair, located on the corner of Main and Orange in
downtown Huntington Beach. Staff presented photographs and a site plan. This request is for
seven bands to play from 12:00 noon to 5:00 p.m. in conjunction with Pierfest Street Fair. Staff
reported numerous responses from other departments were received regarding this request. Staff
listed several specific suggested conditions of approval regarding provisions for security
personnel, restroom facilities, payment of a bond to cover City services in response to the event,
and prohibition of alcohol use. Staff recommended approval with findings and conditions.
Mike Strange questioned how many people were expected at this event.
The applicant's representative, Pat Bushman was present and stated that several hundred people
would be attending.
THE PUBLIC HEARING WAS OPENED
The applicant's representative, Pat Bushman stated that they were willing to comply in any way
they could to prevent any problems with this event. The applicant also stated her concern that
this group of people was being singled out as perhaps possibly causing some problems.
The applicant, Mohammed Memon questioned the facility coverage.
Downtown resident, Diane Easterling presented a letter from another downtown resident, Faye
Ogden, expressing concern about loudness of the bands at this event. Ms. Easterling expressed
her concerns with this use permit being granted in a mixed use zone. She also commented that
the $1,000 bond was not sufficient to cover possible police activity for this event.
Staff stated the amount of the bond was recommended by Community Services and concurred
upon by the Police Department.
Roy Richardson, Planning Commissioner asked what was the definition of uniformed security
guard.
Staff responded that the applicant would not be required to hire a private security company but
that they must provide someone who is identifiable as security personnel, either by a T-shirt or
jacket or some other commonly recognizable uniform.
Mike Strange, Zoning Administrator requested Lt. Feurstein of the Police Department to
comment.
Lt. Feurstein, Police Department stated that this event caused quite a bit of controversy and stated
that the Police Department was originally against this event based upon what they heard about last
year's bands. The problem was disturbances in the area but not specifically coming from the
project site. There were reports of profanity from the band, misuse of alcohol, etc., however,
there were no documented Police calls or responses and therefore the Police Department could
not recommend against the event. He also reported that the applicant stated in a letter to the
Police Department that they would take of these issues with more control over the event. He also
stated that based upon the applicant's willingness to control possible problems at the event, the
Police Department approved this request. Lt. Fuerstein warned the applicant that many of
residents in the Downtown area are against this event taking place and that they may complain
about the noise at the event and possible repercussions could occur.
Pat Bushman stated that they did not have any problems with this event last year and reiterated
that she felt that this group of people was being singled out.
Mohammed Memon also stated that at last year's event other bands which were sponsored by the
City were playing louder than their bands. He also stated that if any profanity occurred at this
event that they would stop the event and dismiss the band at that point.
There were no other persons present to speak for or against this request.

USE PERMIT NO.94-39 (Temporary Outdoor Event) WAS APPROVED BY THE
ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND
CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE
ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING
COMMISSION WITHIN TEN (10) CALENDAR DAYS.
FINDINGS FOR APPROVAL:
1. Use Permit No. 94-39 for a two (2) day temporary outdoor event featuring live music in
the Electric Chair parking lot will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity. With the conditions
of approval imposed, the live music will be played from 12:00 noon to 5:00 p.m. only,
four (4) restore facilities will be provided, four (4) uniformed, identifiable security
guards will be present from one hour before the event to one hour after the event, two
(2) employees will be on -site for trash pick-up in the area, the applicant shall post a
$1,000 bond to cover the cost of any Police or Fire Department personnel service
incurred as a result of the event, and no alcohol will be permitted on -site.
b. Property and improvements in the vicinity of such use of building. The applicant's
security personnel will be responsible for maintaining crowd control and the live music
will last from 12:00 noon to 1:00 p.m. only.
2. The granting of Use Permit No. 94-39 will not adversely affect the General Plan of the
City of Huntington Beach.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan received and dated May 12, 1994 shall be the conceptually approved layout.
2. The applicant shall provide four (4) uniformed, identifiable security guards who will be on -
duty from one hour before the event (11:00 a.m.) to one hour after the event (6:00 p.m.).
3. The applicant shall provide two (2) employees who will pick up trash in the area of the
event, including city streets, sidewalks, and the surrounding neighborhood.
4. A temporary Alcoholic Beverage Control license shall not be issued and no alcoholic
beverages will be sold or permitted within the event.
5. The applicant shall post a $1,000 bond to pay for any and all use of City services caused
by this event. These services shall include but not be limited to the Police Department,
and the Fire Department. The bond shall be submitted a minimum of eight (8) working
days prior to the event and shall be subject to final approval of the City Treasurer.

6. The applicant shall provide four (4) total restore facilities either in the form of Port -A -
Potties in the parking lot or within the building where they are readily accessible to the
public.
7. The applicant shall provide a minimum of four (4) trash receptacles within the parking lot
and shall empty the trash into authorized bins.
8. The event shall be limited to 12:00 noon to 5:00 p.m. only.
9. The applicant shall adhere to all the self-imposed conditions as described in the written
narrative submitted to the City on May 12, 1994.
10. Fire access lanes shall be maintained. If fire lane violations occur and the services of the
Fire Department are required, the applicant will be liable for expenses incurred.
11. The applicant's request shall include necessary permits for temporary signs.
INFORMATION ON SPECIFIC CODE REOUIREMENTS:
The event shall comply with all applicable provisions of the Ordinance Codes, Building
Division and Fire Department.
2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and
standards.
The Zoning Administrator reserves the right to revoke Use Permit No. 94-39 if any
violations of these conditions or the Huntington Beach Ordinance Code occurs.
4. The applicant shall submit all future temporary outdoor event applications a minimum of
ninety (90) days prior to the event. Failure to provide adequate notice may result in denial
of the request.
ITEM 2: USE PERMIT NO.94-37 (Temporary Outdoor Event)
Applicant: Aaron Pai
Huntington Surf and Sport

Request: To permit several temporary outdoor events for an official U.S. "Open of Surfing" booth July
28-31 and August 2-7, 1994; and sidewalk sales of clothing and merchandise on November
25-27 and December 17-24, 1994 pursuant to Section 9730.64 of the Huntington Beach
Ordinance Code.

Location: 300 Pacific Coast Highway, #104 (Pierside Pavilion)
Jane Madera, Staff Planner reported that this application was a request for a temporary outdoor
event at Huntington Surf and Sport. The application was originally for July 27 through August 7,
1994 and the applicant had recently submitted a revised request with additional outdoor event
dates. The staff reported that the applicant has requested a continuance to allow time to advertise
for the additional events. Staff recommended approval of the continuance.

THE PUBLIC HEARING WAS CLOSED
USE PERMIT NO.94-37 (Temporary Outdoor Event) WAS CONTINUED TO THE
JUNE 15, 1994 ZONING ADMINISTRATOR MEETING.
ITEM 3: USE PERMIT NO.94-36 (Temporary Outdoor Event)
Applicant: Jack's Surfboards
101 Main Street
Huntington Beach, CA 92648
Request: To permit several temporary outdoor events for sidewalk sales of clothing and
merchandise at Jack's Surfboards on the following dates: July 2-4; September 2-4;
November 25-27; and December 17-24, 1994 pursuant to Section 9730.64 of the
Huntington Beach Ordinance Code.
Location: 101 Main Street
Jane Madera, Staff Planner reported that this application was a request for a temporary outdoor
event at Jack's Surfboards in the Downtown Area. Staff stated that some of the dates listed in the
applicant's application were already past and would not be part of the Zoning Administrator's
action. The request is to provide two outdoor tables in front of store for T-shirt and merchandise
sales. Staff recommended approval with findings and conditions.
THE PUBLIC HEARING WAS OPENED
The applicant, Mr. Abdelmuti was present and stated that the dates submitted were to coincide
with the OP Pro Event, however he did not know the exact dates of this event. He also stated
that he would not use any more dates for this temporary outdoor event.

Diane Easterling, Downtown resident was present and questioned the location and number of
tables being used. She was concerned with the swap meet atmosphere in the Downtown area
with the outdoor sales. She also asked what would be repercussions would the applicant face for
events in December with upcoming ordinance changes in the Downtown area.
Mike Strange, Zoning Administrator responded that the action that he would take today would be
binding because the ordinance has not been acted upon as yet. He also stated that the applicant
may submit a written request for additional dates coresponding withthe OP Pro and Pierfest and
another hearing will be held.
Staff corrected the dates in the aganda and stated the dates for December were to be for
December 17-18, 24.
There were no other persons present to speak for or against this request.

USE PERMIT NO.94-36 (Temporary Outdoor Event) WAS APPROVED BY THE
ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND
CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE
ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING
COMMISSION WITHIN TEN (10) CALENDAR DAYS.

1. Use Permit No. 94-36 for several temporary outdoor events for sidewalk sales of clothing
and merchandise will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity. There will be no
additional noise generated by the event and the sale tables will not block any entrances
to existing businesses in the vicinity. Furthermore, adequate circulation for pedestrian
traffic will be maintained between the sale tables and the curb edge during the events.
b. Property and improvements in the vicinity of such use of building. The uses are
temporary in nature and the sales event will not interfere with any improvements in the
area.
2. The granting of Use Permit No. 94-36 will not adversely affect the General Plan of the
City of Huntington Beach.
