MINUTES: The Minutes of the May 11 and 18, 1994 Zoning
Administrator were approved and the minutes of June 15,
1994, Zoning Administrator meeting were continued.
ITEM 1: USE PERMIT 93-38 (One Year Extension Of Time)
Applicant: Gregory A. Parker

Request: To permit a one (1) year extension of time for an application previously
approved for a concession offering catamaran sailing trips from Peter's
Landing in Huntington Harbour pursuant to Section 9811.2.4 of the
HBOC.
Location: 16370 Pacific Coast Highway
Jane Madera, Staff Planner reported that this application was a request for a one year extension of
time for a previously approved concession offering catamaran sailing trips located at Peter's
Landing in Huntington Harbour. Staff reported that the applicant had been working diligently to
secure permits from the Public Utilities Commission, the Coastal Commission, the City of Avalon,
and various other agencies. The applicant needs the extra time to finalize the process and
complete the project. Staff recommended approval of this extension of time with an additional
condition to subject the project to traffic impact fees.
The applicant, Gregory Parker was present and stated the Traffic Impact Fee had already been
conditioned on the original approval.
Mike Strange, Zoning Administrator responded by explaining this was necessary for the vehicle
trips generated by this project and if it had already been conditioned, staff would not repeat it.
There were no other persons present to speak for or against this request.
USE PERMIT 93-38 (One Year Extension Of Time) WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION
WITHIN TEN (10) CALENDAR DAYS.
SPECIAL CONDITIONS OF APPROVAL:
All previous conditions of approval of Use Permit No. 93-38 shall remain in effect.
2. Use Permit No. 93-38 shall expire on July 26, 1995 unless an extension of time is granted
by the Zoning Administrator. A request for an extension shall be received by the
Department of Community Development at least 30 days prior to expiration.
ITEM 2: USE PERMIT NO.94-40 (TemAorary Outdoor Event
Applicant: City of Huntington Beach

Request: To permit a temporary two (2) day outdoor event for The Great American Race in
the parking lot at Huntington Beach Mall on June18-19, 1994 pursuant to Section
9730.64 of the Huntington Beach Ordinance Code.
Location: 7777 Edinger
Jane Madera, Staff Planner reported that this application was a request for a temporary outdoor
event for the Great American Race in which antique cars will drive throughout the city streets,
ending up at the Huntington Beach Mall. The hours for display of vehicles and the parking lot
rally is 9:00 a.m. to 4:00 p.m. Staff recommended approval with findings and conditions.
The applicant's representative, Diane Baker, was present and concurred with staffs
recommendation.
There were no other persons present to speak for or against this request.

USE PERMIT NO.94-40 (Temporary Outdoor Event) WAS APPROVED BY THE
ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND
CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE
ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING
COMMISSION WITHIN TEN (10) CALENDAR DAYS.
FINDINGS FOR APPROVAL:
1. Use Permit No. 94-40 for the temporary outdoor event will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity. The event will take
place in a remote area of the Huntington Beach Mall parking lot so as not to interfere
with other businesses in the vicinity.
b. Property and improvements in the vicinity of such use of building. The event is
temporary in nature and adequate access for emergency response teams will be
maintained at all times.
2. The granting of Use Permit No. 94-40 will not adversely affect the General Plan of the
City of Huntington Beach.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan received and dated May 17, 1994 shall be the conceptually approved layout.
2. Fire access lanes shall be maintained. If fire lane violations occur and the services of the
Fire Department are required, the applicant will be liable for expenses incurred.
3. Fire access lanes shall be a minimum width of twenty-four (24) feet.
4. The action shall include necessary permits for temporary signs.
5. The applicant shall provide restroom facilities and trash receptacles throughout the site.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The event shall comply with all applicable provisions of the Ordinance Codes, Building
Division and Fire Department.
2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and
standards.
3. The Zoning Administrator reserves the right to revoke Use Permit No. 94-40 if any
violations of these conditions or the Huntington Beach Ordinance Code occurs.

4. The applicant shall submit all future temporary outdoor event applications a minimum of
ninety (90) days prior to the event. Failure to provide adequate notice may result in denial
of the request.
ITEM 3: USE PERMIT NO.94-43
Applicant: Wayne Ford
Ford Landscape and Spa Co. Inc.

Request: To permit a five (5) foot tall masonry wall within ten (10) feet of the front
property line (maximum forty-two inches in height or fifteen foot setback
required) pursuant to Section 9771 (1) of the Huntington Beach Ordinance
Code.
Location: 16336 Niantic Circle
Jane Madera, Staff Planner reported that this application was a request for a use permit for a five
(5) foot tall masonry wall within the front property line to include a privacy wall ten (10) feet
from the property line. The wall will be setback far enough to meet the ten (10) foot by ten(10)
foot visibility requirement for traffic safety and visibility. Staff recommended approval with
findings and conditions.
THE PUBLIC HEARING WAS OPENED
Frank Munoz, property owner was present and concurred with staffs recommendation.
The applicant, Wayne Ford was present and concurred with staff s recommendation.
There were no other persons present to speak for or against this request.
THE PUBLIC HEARING WAS CLOSED
USE PERMIT NO.94-43 WAS APPROVED BY THE ZONING ADMINISTRATOR
WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE
STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE
APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR
DAYS.

FINDINGS FOR APPROVAL -USE PERMIT NO. 94-43
1. Use Permit No. 94-43 for the establishment of a five (5) foot tall wall with a ten (10) foot
setback from the front property line (15 foot setback required) will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity. The wall is set
back far enough from the intersection of the driveway and sidewalk to afford clear
visibility of pedestrians, bicycles, and vehicular traffic for vehicles backing out of
the driveway. In addition, the wall will provide a private courtyard area for the
residents.
b. Property and improvements in the vicinity of such use or building. The wall will be
consistent with other walls within the front yard setback in the neighborhood.
2. The granting of Use Permit No. 94- 43 will not adversely affect the General Plan of the
City of Huntington Beach. The five (5) foot tall wall within the front setback is consistent
with the goals and objectives of the Low Density Residential Land Use designation of the
General Plan.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated April 4, 1994 shall be the
conceptually approved layout with the following modifications.
2. The color of the wall shall always remain consistent with the color of the house.
3. The landscaping in front of the wall shall be permanently maintained in a neat and clean
manner.
4. The Zoning Administrator shall be notified in writing if any changes in building height,
floor area, setbacks, building elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the Zoning Administrator has
reviewed and approved the proposed changes. The Zoning Administrator reserves the
right to require that an amendment to the original entitlement be processed if the proposed
changes are of a substantial nature.
5. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing
sets submitted for plancheck.
INFORMATION ON SPECIFIC CODE REQUIREMENTS
