ZONING ADMINISTRATOR: STAFF MEMBER: MINUTES: Michael Strange Jane Madera The June 1, 1994 Minutes were approved. The June 8, 1994, Minutes were continued. ITEM 1: USE PERMIT NO.94-37 A & B (Temporary Outdoor Event) Continued from June 1, 1994 Zoning Administrator Meeting Applicant: Aaron Pai Huntington Surf and Sport 300 Pacific Coast Highway, #104 Huntington Beach, CA 92648 Request: To permit several temporary outdoor events for an official "U.S. Open of Surfing" booth July 28-31 and August 2-7, 1994; and sidewalk sales of clothing and merchandise on November 25-27 and December 17-24, 1994 pursuant to Section 9730.64 of the Huntington Beach Ordinance Code. Location: 300 Pacific Coast Highway, #104 (Pierside Pavilion) Jane Madera, Staff Planner reported that this application was a request for two temporary outdoor events. The first event is for a U.S. "Open of Surfing" booth July 28-31 and August 2-7, 1994 and will be set up in front of the fountain at Pierside Pavillion. The second event is for sidewalk sales for clothing and merchandise on November 25-27 and December 17-24, 1994 and will be set up behind the fountain. Staff recommended approval with findings and conditions. THE PUBLIC HEARING WAS OPENED. The applicant's representative, Dick Harlow was present and concurred with staff s recommendation. He stated, however, that the applicant would prefer to have these events broken into two actions to allow the "U.S. Open of Surfing Booth" to be set-up behind the fountain in case the preferred location in front of the fountain is appealed. Mr. Harlow stated that athe regular clothing and merchandise booth in November and December would be behind the fountain. Staff concurred with the applicant's request to approve the events by two separate actions. There were no other persons present to speak for or against this request. THE PUBLIC HEARING WAS CLOSED. USE PERMIT NO.94-37 A & B (Temporary Outdoor Event) WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS FOR DENIAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL: 1. Use Permit No. 94-37 A and B for several temporary outdoor events will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The location of the temporary outdoor sales events are not in the vicinity of any residences and the tables and booths associated with the event will not block entrances or accessibility to other businesses in Pierside Pavilion. b. Property and improvements in the vicinity of such use of building. All improvements necessary for the temporary events are already in place and will not require alteration as a result of this project. 2. The granting of Use Permit No. 94-37 A and B will not adversely affect the General Plan of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated June 3, 1994 shall be the conceptually approved layout. 2. The two actions "A' and `B" described above shall not be interpreted to mean the applicant may have two (2) official "U.S. Open of Surfing" booths. The applicant may display one booth either in front of or behind the fountain. The only intent of dividing the motions of this action into two (2) parts was to permit the applicant to display the booth behind the fountain in July and August should the requested sales in front of the fountain be appealed to the Planning Commission. 3. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. ZA Minutes 6/15/94 2 4. Fire access lanes shall be a minimum width of twenty-four (24) feet. 5. This action shall include necessary permits for temporary signs. 6. No sales of merchandise shall occur to people in vehicles or in the public right-of-way. 7. Merchandise display racks, tables, booths, or anything associated with the event including people in line waiting for autographs may not encroach within the public right-of-way. 8. Merchandise sales in front of the fountain shall be limited to official "U.S. Open of Surfing" items only. 9. Merchandise racks, display booths, and/or autograph tables for all events shall be draped or covered in an aesthetically pleasing manner. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The event shall comply with all applicable provisions of the Ordinance Codes, Building Division and Fire Department. 2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 94-37 if any violations of these conditions or the Huntington Beach Ordinance Code occurs. 4. The applicant shall submit all future temporary outdoor event applications a minimum of ninety (90) days prior to the event. Failure to provide adequate notice may result in denial of the request. ITEM 2: USE PERMIT NO. 94-45 (Temporary Outdoor Event) Applicant: Kristen Lawrence Sport Chalet 16242 Beach Boulevard Huntington Beach, CA 92647 Request: To permit several temporary outdoor events for merchandise sales in the parking lot at Sport Chalet on the following dates: July 2-4; July 9-10; August 6-7; August 13-14; and September 3-5, 1994 pursuant to Section 9730.64 of the Huntington Beach Ordinance Code. Location: 16242 Beach Boulevard ZA Minutes 6/15/94 3 Jane Madera, Staff Planner reported that this application was a request for a temporary outdoor event for outside sales and display of merchandise located at the Sport Chalet at Beach and Stark on the above described dates. The applicant listed some additional sale dates on the application submittal that could not be scheduled on time and therefore was not part of the request. Staff recommended approval with findings and conditions. THE PUBLIC HEARING WAS OPENED There were no persons present to speak for or against this request. THE PUBLIC HEARING WAS CLOSED USE PERMIT NO.94-45 (Temporary Outdoor Event) WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL: 1. Use Permit No. 94-45 for a temporary outdoor event for merchandise sales in the parking lot of Sport Chalet will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The outdoor parking lot sales will be conducted from 10:00 a.m. - 6:00 p.m. and therefore will not be an impact to the neighboring residential units to the east. b. Property and improvements in the vicinity of such use of building. No additional improvements to the site are necessary for the temporary parking lot sales events. 2. The granting of Use Permit No. 94-45 will not adversely affect the General Plan of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated May 27, 1994 shall be the conceptually approved layout. 2. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 3. Fire access lanes shall be a minimum width of twenty-four (24) feet. 4. The applicant shall obtain all necessary Fire Department permits and comply with all provisions of Article 32 of the Uniform Fire Code. ZA Minutes 6/15/94 4 6. This action shall include necessary permits for temporary signs. 7. The proposed canopy shall be of fire retardant material. Proof of Certification shall be submitted to the Fire Department for approval prior to the tent's installation on the site. 8. The proposed canopy shall be secured against collapsing to the satisfaction of the Fire Department. 9. "No Smoking" signs shall be posted in conspicuous locations. 10. Fire extinguishers shall be provided in number and locations specified by the Fire Department. 11. Stand by personnel shall be on site to safeguard premises. 12. An overnight security guard shall be provided to protect merchandise left overnight. The Huntington Beach Police Department shall be notified 24 hours prior to the event. ITEM 3• USE PERMIT NO.94-48 (Temporary Outdoor Event) Applicant: Mark Haver Huntington Furnishing Mart 7227 Edinger Avenue Huntington Beach, CA 92647 ZA Minutes 6/15/94 5 Request: To permit a seven (7) day temporary outdoor event for furniture sales at Huntington Furnishings Mart on June 29-July 5, 1994 pursuant to Section 9730.64 of the Huntington Beach Ordinance Code. Location: 7227 Edinger Avenue Jane Madera, Staff Planner reported that this application was a request for a temporary outdoor event located at Huntington Furnishings Mart on Edinger. The application is for a large canopy in the middle of parking lot to display furniture. The dates for this event are June 29 to July 5, 1994. Staff reported that the applicant is proposing to have a security guard posted since the merchandise will be left out overnight. Staff recommended approval with findings and conditions. THE PUBLIC HEARING WAS OPENED The applicant's representative, Irwin Greenberg was present and stated that this would be a sale that would be beneficial to the area. Mr. Greenberg concurred with staffs recommendation. There were no other persons present to speak for or against this request. THE PUBLIC HEARING WAS CLOSED USE PERMIT NO.94-48 (Temporary Outdoor Event) WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL: Use Permit No. 94-48 for the seven (7) day temporary outdoor event for furniture sales will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. Furniture sales in the parking lot will not block entrances or accessability to other businesses in the center and ample parking will be provided. In addition, there are no residences within the vicinity. b. Property and improvements in the vicinity of such use of building. Security personnel will be present to protect merchandise left out overnight and the event is temporary in nature. 2. ZA Minutes 6/15/94 7 ITEM 4: USE PERMIT NO. 94-19 Applicant: Rudolph Simone 10621 Victory Blvd. North Hollywood, CA 91606 Request: USE PERMIT: To permit the demolition of one (1) single family dwelling, one (1) duplex, and two (2) garages and permit the installation of a surface parking lot for a non -conforming mortuary (Pierce Brother's) pursuant to Section 9220 of the Huntington Beach Ordinance Code. Location: 627 Main Street Jane Madera, Staff Planner reported that this application was a request for a use permit for Pierce Bros. Mortuary on Main Street. Staff presented a rendering for the proposed project. Staff reported that the use permit was necessary because this area is zoned Cl, Neighborhood Commercial, and a mortuary is not listed as a permitted use in a C1 zone. Staff stated that the mortuary is a non -conforming use because of the use itself, the setbacks along the street, and the lot size. Staff reported that the buildings to be demolished are located within a designated historical resources area. The structures have been examined by a member of the historical resources board and have been determined to have no historical value. The applicant's proposal includes two different parking layouts. The first plan is to stripe the parking lot in a normal fashion for everyday use. The second plan would utilize parking controls to stack vehicles in the lot for funeral processions. Staff recommended approval with findings and conditions. THE PUBLIC HEARING WAS OPENED The applicant, Rudolph Simone was present and stated that either Police Officers or mortuary personnel would be present to control traffic and direct parking during the funeral processions. Mr. Simone concurred with stars recommendation. There were no other persons present to speak for or against this request. THE PUBLIC HEARING WAS CLOSED USE PERMIT NO.94-19 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. LI ZA Minutes 6/15/94 8 FINDINGS FOR APPROVAL -USE PERMIT NO. 94=19'. 1. Use Permit 94-19 to permit the demolition of one (1) single family dwelling, one (1) duplex, and two (2) garages for the installation of a surface parking lot for a non- conforming mortuary will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The parking lot will be constructed adjacent to existing residential units. However, the mortuary using the parking lot will operate during regular daytime business hours and will not impact residents in the area. The new parking lot will provide parking adjacent to the building and will alleviate use of an existing lot across Main Street. The new lot will decrease public safety hazards as less people will need to cross Main Street to access the building. b. Property and improvements in the vicinity of such use or building. Although the structures proposed for demolition are located within a historical resources project area, the buildings have been reviewed by a member of the Historical Resources Board and approved for demolition as they have no significant historical value. 2. The granting of Use Permit No. 94-19 will not adversely affect the General Plan of the City of Huntington Beach. The surface parking lot construction is consistent with the goals and objectives of the Neighborhood Comercial Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: The site plan, floor plans, and elevations received and dated May 10, 1994 shall be the conceptually approved layout. 2. The parking lot shall be striped in accordance with Article 960, Off-street Parking and Landscaping, Huntington Beach Ordinance Code. 3. The parking lot may be used in the alternative stacked vehicle parking layout as depicted on the site plan as long as a minimum of two (2) personnel (police officers or mortuary staff) are present to direct ingress and egress to the site before and after each funeral procession service. 4. Prior to issuance of building permits, the following plans and items shall be submitted and/or completed by the applicant: a. Applicant shall file a parcel map consolidating the five (5) subject parcels into one (1) parcel. Said map shall be recorded with the County of Orange Recorder prior to the final inspection and a copy of the recorded map submitted to the Department of Community Development for inclusion in the entitlement file. ZA Minutes 6/15/94 9 b. A Landscape Construction Set submitted to Public Works Department. The landscape construction set shall include a landscape plan prepared and signed by a State Licensed Landscape Architect which includes all proposed/existing plant materials (location, type, size, quantity), irrigation plan, grading plan and approved site plan, and copy of conditions of approval. The landscape plan shall be in conformance with Section 9607 of the Huntington Beach Ordinance Code. The set must be complete and approved by both Community Development and Public Works Departments prior to issuance of building permits. Public Works Requirements: a. 2 1/2 feet of dedication required off of alley. b. A landscape and grading plan shall be submitted for review and approval prior to issuance of building permits. C. A Parcel Map shall be required for the purpose of consolidating five lots into one parcel. d. The existing driveway on 7th Street adjacent to the proposed parking lot, shall be removed and replaced to code. e. The proposed driveway on Main Street shall be of radius type construction. f. Repair existing damaged curb on both 7th Street and Main Street. 6. Fire Department Requirements: a. Demolition of buildings shall comply with Article 87 of the Uniform Fire Code. 7. Installation of required landscaping and irrigation systems shall be completed prior to final inspection. S. The applicant/owner shall be responsible for payment of Traffic Impact fees prior to issuance of a Certificate of Occupancy and/or final building permit approval. 9. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 10. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 12. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing sets submitted for plancheck. INFORMATION ON SPECIFIC CODE REQUIREMENTS The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. The applicant shall obtain the necessary permits for demolition from the South Coast Air Quality Management District. 4. The Zoning Administrator reserves the right to revoke Use Permit No. 94-19 if any violation of these conditions of the Huntington Beach Ordinance Code occurs.
