ZONING ADMINISTRATOR: Michael Strange STAFF MEMBER: Jane Madera MINUTES: The Minutes of the July 20, 1994 Zoning Administrator were approved. ITEM 1: USE PERMIT 94-52/DESIGN REVIEW BOARD NO. 94-19 Applicant: Robert Hakimianpour 900 Westport Boulevard Los Angeles, CA 90024 Request: To permit the construction of a 881 square foot children's playground in front of an existing Burger King Restaurant pursuant to Section 9220.1 (c)R of the Huntington Beach Ordinance Code. Location: 16331 Beach Boulevard Jane Madera, Staff Planner reported that this application was a request for the addition of an 881 square foot playground in front of an existing Burger King restaurant. Staff presented a site plan depicting the project and reported that the playground is proposed in front of the building on Beach Blvd. Staff reviewed the plan for compliance with parking, signage, landscaping, setbacks, parking stall size and drive aisle width. Staff reported this project requires approval by the Design Review Board and recommended a couple of special conditions with the project. Staff reported that there is an existing monument sign along Beach Blvd. that is quite large and it is not currently allowed by code. Staff recommended that this sign be replaced by a sign in compliance with code requirements and that the area between the proposed playland and Beach Blvd. be entirely landscaped. Staff recommended approval with findings and conditions. THE PUBLIC HEARING WAS OPENED The applicant's representative, Bhal Kauthekan was present and expressed concern with the existing signage having to be replaced. He also requested that a rear entrance be relocated to facilitate seating in the restaurant. Staff responded that the revised rear entrance would be acceptable. Mike Strange asked staff if they would require the applicant to remove the existing sign in a specific amount of time. Staff responded that the suggested condition would reuire the sign to be removed prior to final building inspection. Bhal Kauthekan responded that he would inform the property owners that all the conditions of the project were approved. There were no other persons present to speak for or against this request. THE PUBLIC HEARING WAS CLOSED USE PERMIT 94-52/DESIGN REVIEW BOARD NO.94-19 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS FOR AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL -USE PERMIT NO. 94-52: 1. Use Permit 94-52 for the establishment, maintenance and operation of the 881 square foot outdoor children's playground will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The outdoor playground at Burger King will be compatible with adjacent commercial properties and residential units to the west. The playground will be located on the east side of the existing building as far away from the residential property as possible. The parking and landscaping will be redesigned to maintain compliance with code requirements. b. Property and improvements in the vicinity of such use or building. With the conditions of approval imposed, the project will include upgrades to landscaping, parking, and the existing non -conforming signs will be removed and replaced with new signage. The upgrades will not alter existing improvements in the area. 2. The granting of Use Permit No. 94-52 will not adversely affect the General Plan of the City of Huntington Beach. The 881 square foot children's playground is consistent with the goals and objectives of the General Commercial Land Use designation of the General Plan which permits and promotes commercial activity along Beach Boulevard. ZA Minutes 7/27/94 2 SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated July 14, 1994 shall be the conceptually approved layout with the following modifications: a. The area between the east edge of the proposed playground and the property line along Beach Blvd. shall be permanently landscaped with a proper irrigation system. 2. A revised site plan shall be submitted depicting the modifications described above. 3. Prior to issuance of building permits, the following plans and items shall be submitted and/or completed by the applicant: a. A Landscape Construction Set submitted to the Public Works Department. The landscape construction set shall include a landscape plan prepared and signed by a State Licensed Landscape Architect which includes all proposed/existing plant materials (location, type, size, quantity), irrigation plan, grading plan and approved site plan, and copy of conditions of approval. The landscape plan shall be in conformance with Section 9607 of the Huntington Beach Ordinance Code. The set must be complete and approved by both Community Development and Public Works departments prior to issuance of building permits. b. The subject property shall offer irrevocable reciprocal driveway and parking easement(s) between the subject site and the adjacent property to the south The easement shall be defined as a twenty-four foot wide strip along the south property line. A copy of the legal instrument shall be approved by the City Attorney as to form and content and, when approved, shall be recorded in the Office of the County Recorder. A copy shall be filed with the Department of Community Development prior to occupancy. C. The project's proposed colors and materials shall be reviewed and approved by the Design Review Board. d. Plans to amend the major identification signs shall be submitted. The sign shall be removed or altered to comply with Article 961 of the Huntington Beach Ordinance Code prior to final inspection. 4. Installation of required landscaping and irrigation systems shall be completed prior to final inspection. The applicant shall restripe the parking lot so that it conforms to provisions of Article 960 of the Huntington Beach Ordinance Code prior to final inspection. ZA Minutes 7/27/94 6. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 7. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing sets submitted for plancheck. INFORMATION ON SPECIFIC CODE REQUIREMENTS 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit 94-52 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. ITEM 2: SITE PLAN AMENDMENT NO.94-1 Applicant: Kevin Becker Kaiser Foundation Health Plan, Inc. 393 E. Walnut Street Pasadena, CA 91188 Request: To permit the reconfiguration of existing driveways at the Kaiser Permanente health care facility pursuant to Section 9811.4 of the Huntington Beach Ordinance Code. Location: 18081 Beach Boulevard Jane Madera, Staff Planner reported that the applicant requested a continuance of this application. There were no other persons present to speak for or against this request. SITE PLAN AMENDMENT NO.94-1 WAS CONTINUED BY THE ZONING ADMINISTRATOR TO THE AUGUST 10, 1994 ZONING ADMINISTRATOR MEETING. I. ZA Minutes 7/27/94 4 ITEM 3: USE PERMIT 94-51 Applicant: Jeff Silvers 3565 Courtside Circle Huntington Beach, CA 92649 Request: To permit the establishment of a minor automotive repair business, specializing in limousine service, at an existing industrial center pursuant to Section 9510.01 (b) (4) of the Huntington Beach Ordinance Code. Location: 15000 Bolsa Chica Street, Unit A Jane Madera, Staff Planner reported that this application was a request to establish a minor automobile repair business for limousines in an area zoned MI -A. Staff presented a site plan of the project. There are presently three tenants in the building. This request is for a fourth tenant to occupy this building be in conjunction with a wholesdale limousine business in the same building. Staff reported that the main issue was parking requirements as auto repair requires parking based on a 1/200 square feet ratio. Staff reported that 41 parking stalls are required on the site, and there are currently 46 spaces. Staff reported, however, that a portion of the parking stalls need to be re -striped as they are faded. Staff recommended approval with findings and approval. THE PUBLIC HEARING WAS OPENED The applicant, Jeff Silvers was present and asked about the traffic impact fees, and concurred with staff recommendation. Jane Madera explained what these fees were, and that the proposed business would be analyzed to determine if it generated addtional traffic trips beyond what currently exists at the site. There were no other persons present to speak for or against this request. THE PUBLIC HEARING WAS CLOSED USE PERMIT 94-51 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. The proposed minor automotive repair business specializing in limousine service will be compatible with the wholesale limousine broker occupying the adjacent space and other industrial businesses within the building adjacent areas. The business will not effect any existing residential units as there are none in the immediate vicinity. b. Property and improvements in the vicinity of such use or building. The proposed use is compatible with other existing businesses and will not alter existing improvements in the area. 2. The granting of Use Permit No. 94-51 will not adversely affect the General Plan of the City of Huntington Beach. The minor automotive repair business is consistent with the goals and objectives of the General Industrial Land Use designation of the General Plan which permits and promotes industrial businesses of this type in the area. SPECIAL CONDITIONS OF APPROVAL -USE PERMIT NO. 94-51: 1. The site plan, floor plans, and elevations received and dated July 19, 1994 shall be the conceptually approved layout. 2. The entire parking lot shall be re -striped in conformance with requirements of Article 960 - Off Street Parking and Landscaping. All striping shall be completed prior to issuance of Certificate of Occupancy. 3. The business shall be limited to providing minor automotive repair only and shall be limited to occupying 2,112 square feet of space as identified on the floor plan. 4. The applicant/owner shall be responsible for payment of Traffic Impact fees prior to issuance of a Certificate of Occupancy and/or final building permit approval. 5. Fire Department Requirements: a. Use of this occupancy shall be limited to the exchange of mechanical parts only and shall not allow welding or use of flammable liquids. b. Fire extinguishers shall be installed as required in the Huntington Beach Fire Code. 6. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers. 7. All repair work shall be conducted wholly within the building. ZA Minutes 7/27/94 6 8. The Zoning Administrator shall be notified in writing if any changes in building exterior, floor area or parking are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 4. Automotive service and related businesses within industrial centers are required to provide a minimum of five (5) parking spaces per tenant. Additional parking may be required depending on the square footage occupied by the business. Parking shall comply with Article 960 of the Huntington Beach Ordinance Code. 5. The Zoning Administrator reserves the right to revoke Use Permit 94-51 if any violation of these conditions of the Huntington Beach Ordinance Code occurs.
