MINUTES: The July 27, 1994 minutes were approved.
ITEM 1: WAIVER OF PARCEL MAP NO. 94-150
Applicant: Jeff C. Johnson
730 14th. Street
Huntington Beach, CA 92648
Request: Waiver of Parcel Map No. 94-110 which includes the consolidation of two (2) lots
into one (1) lot pursuant to Section 9920.1 of the Huntington Beach Ordinance
Code.
Location: 730 14th. Street
Jane Madera, Staff Planner reported that this application was a request for a Tentative Parcel
Waiver located on Fourteenth Street. Staff reported that in order to approve a Waiver of Parcel
Map that all improvements must be in place and that everything was done. Staff recommended
approval of this project. Staff reported that the applicant submitted a letter in lieu of his presence
at the meeting, which stated that he received a copy of the Notice of Filing Status letter and
suggested Conditions of Approval and that he concurs.

There were no persons present to speak for or against this request.
THE PUBLIC HEARING WAS CLOSED.
WAIVER OF PARCEL MAP NO.94-150 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS FOR APPROVAL. HE
STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE
APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR
DAYS.
FINDINGS FOR APPROVAL FOR WAIVER:
The proposed consolidation of two (2) lots into one for residential use complies with the
requirements as to area, improvement and design, flood and water drainage control,
appropriate and approved public roads, sewer and water facilities, environmental
protection, and other requirements of Article 992 of the Ordinance Code.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR
ANY PURPOSE:
Prior to recordation of this parcel map, the surveyor/engineer preparing the map shall tie
the boundary of the map into the Horizontal Control System established by the County
Surveyor in a manner described in Sections 7-9-330 and 7-9-337 of the Orange County
Subdivision Code and Orange County Subdivision Manual, Sub article 18.
2. Prior to recordation of this parcel map, the surveyor/engineer preparing the map shall
submit to the County Surveyor a digital -graphics file of said map in a manner described in
Sections 7-9-330 and 7-9-337 of the Orange County Subdivision Code and Orange
County Subdivision Manual, Sub article 18.
A plat map shall be filed with and approved by the Department of Public Works and
recorded with the Orange County Recorder. A copy of the recorded plat map shall be
filed with the Department of Community Development.
4. The applicant shall record a Certificate of Compliance, a "Covenant to hold properties as
one parcel" and the approved plat map with the Orange County Recorder's Office. A copy
of the recorded covenant shall be filed with the Department of Community Development
prior to final inspection/issuance of Certificate of Occupancy.
It is recommended that you immediately pursue completion of the Conditions of Approval and
address all requirements of the Huntington Beach Ordinance Code in order to expedite the
processing of your total application.
ITEM 2: USE PERMIT NO. 94-58 (TEMPORARY OUTDOOR EVENT)
Applicant: Alfred Chiantaretto

Request: To permit a twenty-one (21) day temporary event with two canopies from
August 12 through September 1, 1994 pursuant to Section 9730.64 of the
Huntington Beach Ordinance Code.
Location: 16661 Beach Boulevard
Jane Madera, Staff Planner reported that this application was a request for a temporary outdoor
event for the Hyundai car dealership on Beach Blvd. They are requesting two canopies along
Beach Blvd. as a promotion. This event begins August 12 through September 1, 1994. Staff
informed applicant that they did receive this request in time to process. Staff stated that they
were directed by other departments to accept the application and process. Staff stated that the
applicant agreed to write a letter stating they would remove the canopies if this item is appealed.
Staff also stated that as of this time the letter has not been received. Staff recommended approval
with findings and conditions.

THE PUBLIC HEARING WAS CLOSED
USE PERMIT NO.94-58 (TEMPORARY OUTDOOR EVENT) WAS APPROVED BY
THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND
CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE
ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING
COMMISSION WITHIN TEN (10) CALENDAR DAYS.
FINDINGS FOR APPROVAL:
1. Use Permit No. 94-58 for the twenty-one (21) day temporary outdoor event will not be
detrimental to:
a. The general welfare of persons residing or working in the vicinity. The two (2), 400
square foot canopies will not affect the privacy of any residences in the area and will
not block any entrances to existing businesses in the area.
b. Property and improvements in the vicinity of such use of building. The use of
canopies is temporary in nature and will not alter any existing improvements in the
vicinity.
2. The granting of Use Permit No. 94-58 will not adversely affect the General Plan of the
City of Huntington Beach.

SPECIAL CONDITIONS OF APPROVAL:
1. The site plan received and dated July 26, 1994 shall be the conceptually approved layout.
2. Prior to the construction of the canopies, the applicant shall submit a letter stating their
knowledge that the event will begin prior to expiration of the appeal period. The applicant
shall agree that the canopies will be removed immediately, at their own expense, if this
approval action is appealed to the Planning Commission.
3. Fire access lanes shall be maintained. If fire lane violations occur and the services of the
Fire Department are required, the applicant will be liable for expenses incurred.
4. Fire access lanes shall be a minimum width of twenty-four (24) feet.
5. The applicant shall obtain all necessary Fire Department permits and comply with all
provisions of Article 32 of the Uniform Fire Code.
6. This approval shall include necessary permits for temporary signs.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The event shall comply with all applicable provisions of the Ordinance Codes, Building
Division and Fire Department.
2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and
standards.
The Zoning Administrator reserves the right to revoke Use Permit No. 94-58 if any
violations of these conditions or the Huntington Beach Ordinance Code occurs.
4. The applicant shall submit all future temporary outdoor event applications a minimum of
ninety (90) days prior to the event. Failure to provide adequate notice may result in denial
of the request.
ITEM 3: CONDITIONAL EXCEPTION (VARIANCE) NO.94-22

Request: To permit a 207 square foot garage addition with a three (3) foot interigr
side yard addition in lieu of a five (5) foot required setback and an eight (8)
foot wide parking space in lieu of a required nine (9) foot width pursuant
to Sections 9110.7 (a) and 9601.5 of the Huntington Beach Ordinance
Code, respectively.

Jane Madera, Staff Planner reported that this application was a request for a variance at an
existing residence single family drive. Staff presented a site plan of the project, which is to add an
additional garage space to the existing two (2) car garage. This new addition encroaches into the
required five (5) foot setback, leaving only a three (3) foot setback. Along with this request the
applicants is asking for a reduced stall size for a car of eight (8) feet in lieu of nine (9) feet.. Staff
reported that in order to grant a conditional exception a land related hardship must be found in
association with the request. Staff reported that such a hardship was not found to grant this
request. Staff recommended denial of this project.
THE PUBLIC HEARING WAS OPENED
The applicant, David Balthazor was present and reported that when he went to the Building
Department to ask for this variance he stated the Building Department said that there would not
be a problem with a three (3) foot setback. He also stated that when he went to the Planning
Counter and showed them the plans they did not mention anything about a land related hardship.
He also stated that if he would have been informed that this may not have been approved that he
would not have pursued this request.
Mike Strange, Zoning Administrator stated that he could not approve this request and that the
applicant should have been informed by staff of the unlikeness of this being approved.
There were no other persons present to speak for or against this request.
THE PUBLIC HEARING WAS CLOSED
CONDITIONAL EXCEPTION (VARIANCE) NO. 94-22 WAS DENIED BY THE
ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS FOR DENIAL. HE
STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE
APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR
DAYS.
FINDINGS FOR DENIAL - CONDITIONAL EXCEPTION NO. 94-22:
The granting of Conditional Exception No. 94-22 will constitute a grant of special
privilege inconsistent upon other properties in the vicinity and under an identical zone
classification. There are no other properties in the vicinity with the same size and shape
characteristics of the subject property that have received variances for side yard setbacks.
2. Because there are no special circumstances applicable to the subject property, including
size, shape, topography, location or surroundings, the strict application of the Zoning
Ordinance is not found to deprive the subject property of privileges enjoyed by other

properties in the vicinity and under identical zone classifications. The subject property is a -
standard 6,000 square foot lot with 60 feet of street frontage and contains no unique
physical characteristics that precludes construction in compliance with the zoning code.
3. The granting of Conditional Exception No. 94-22 is not necessary in order to preserve the
enjoyment of one or more substantial property rights. The subject property has sufficient
area to construct a storage addition and maintain the proper setbacks.
4. The granting of Conditional Exception No. 94-22 will be materially detrimental to the
public welfare, or injurious to property in the same zone classifications. The
encroachment into the sideyard setback has the potential to infringe upon the privacy of
the adjacent property.
5. The granting of Conditional Exception No. 94-22 will adversely affect the General Plan of
the City of Huntington Beach.
