ZONING ADMINISTRATOR: Michael Strange STAFF MEMBER: Wayne Carvalho MINUTES: The August 3, 10 and 17, 1994 minutes were continued. ITEM 1: SITE PLAN AMENDMENT NO. 94-1 Applicant/ Kevin Becker Kaiser Foundation Health Plan, Inc. 393 E. Walnut Street Pasadena, CA 91188 Request: To permit the reconfiguration of existing driveways at the Kaiser Permanente health care facility pursuant to Section 9811.4 of the Huntington Beach Ordinance Code. Location: 18081 Beach Boulevard THE PUBLIC HEARING WAS OPENED. Wayne Carvalho, staff planner, reported that this request was to reconfigure the entry driveways on Beach Boulevard at the Kaiser Permanente Medical Center. Staff recommended that a reciprocal driveway be provided to the north shopping center. Staff stated that this request included a deceleration lane that does not meet Cal Trans standards, however, Cal Trans has agreed to review and approve it as submitted. Staff stated that the applicant will provide a thirty foot wide driveway on the south side instead of a twenty-five feet driveway as shown on site plan. Staff also recommended that the applicant close the north driveway and extend the landscaping across this area. Staff also stated that the applicant be required to file a bond to replace the curb and gutter. Staff reported that the applicant also requested that gates be installed at the reciprocal driveway during non -operating hours. Staff recommended approval with findings and conditions. THE PUBLIC HEARING WAS OPENED. Kevin Becker, applicant, was present and concurred with staff recommendation. There were no other persons present to speak for or against this request. THE PUBLIC HEARING WAS CLOSED. SITE PLAN AMENDMENT NO. 94-1 (CONTINUED FROM AUGUST 17, 1994 ZONING ADMINISTRATOR MEETING) WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL -SITE PLAN AMENDMENT NO. 94-1: 1. The revision which includes the reconfiguration of the two (2) existing driveways into a thirty (30) foot wide, two (2) way driveway on the south side, and an emergency fire lane on the north side does not constitute a substantial change. 2. The use of the property as a health care facility will remain the same. The revision allowing the driveway reconfiguration will result in an improved project by providing better circulation to and from Beach Boulevard. 4. The revision complies with all applicable provisions of the Huntington Beach Ordinance Code. CONDITIONS OF APPROVAL -SITE PLAN AMENDMENT NO. 94-1: 1. The site plan received and dated July 20, 1994 shall be the conceptually approved layout with the following modifications: a. A 26 foot wide reciprocal driveway shall be provided between the subject property and the northerly property. The driveway shall be located behind the first row of parking stalls along Beach Boulevard as "red -lined" on the approved plans. 2. A revised site plan shall be submitted depicting the modifications described above. 3. The Zoning Administrator shall be notified in writing if any changes in the site plan are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 4. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing sets submitted for plancheck. 5. A copy of the legal instrument shall be approved by the City Attorney as to form and content and, when approved, shall be recorded in the Office of the County Recorder. A copy shall be filed with the Department of Community Development prior to issuance of building permits. 6. Prior to issuance of building permits, the property owner shall sign, notarize, and record with the County Recorder a "Letter of Agreement" assuring that the closure of the existing northerly driveway off Beach Boulevard be removed upon construction of the reciprocal driveway. The agreement shall include the installation of new curb, gutter, sidewalk and landscaping at the property owner's expense. 7. Applicant shall pursue CalTrans approval of a 30 foot wide radius type driveway on Beach Boulevard. 8. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 9. If additional lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. INFORMATION ON SPECIFIC CODE REQUIREMENTS 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. All applicable Public Works fees shall be paid prior to issuance of building permits. 4. The Zoning Administrator reserves the right to revoke Site Plan Amendment No. 94-1 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. ITEM 2: TENTATIVE PARCEL MAP NO.94-134 Applicant: Frank Mirjahangir 18281 Gothard Street, Suite 202 Huntington Beach, CA 92648 Request: To subdivide one (1) parcel of land into two (2) parcels for residential purposes pursuant to Section 9930 of the Huntington Beach Ordinance Code. Location: 514 13th Street ZA Minutes 8/24/94 3 Wayne Carvalho, staff planner, reported that this application was a request to subdivide one, fifty (50) foot wide parcel into two, twenty-five (25) foot wide parcels for single family residential purposes. Staff recommended approval with findings and conditions. Frank Mir ahangir, applicant, was present and requested that the existing structure be allowed to remain on the property until the permits are taken out. Staff commented that demolition permits could be obtained before the map is finaled. There were no other persons present to speak for or against this request. THE PUBLIC HEARING WAS CLOSED. TENTATIVE PARCEL MAP NO. 94-134 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED - THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL: 1. Use Permit No. 94-65 for a one (1) day temporary outdoor event which includes an antique car show and swap meet will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. Parking for the antique car show and swap meet will be available in the adjacent city parking structure. The event will operate on Saturday, August 27, 1994 from 8:00 a.m. to 4:00 p.m. so not to disrupt adjacent residents. b. Property and improvements in the vicinity of such use of building. The event is temporary in nature (one day only); no existing improvements will be altered as a result of the event. 2. The granting of Use Permit No. 94-65 will not adversely affect the Mixed Use General Plan Land Use Designation of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated August 10, 1994 shall be the conceptually approved layout. 2. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. ZA Minutes 8/24/94 4 3. Fire access lanes shall be a minimum width of twenty-four (24) feet. The public alley shall remain free from obstructions in the event emergency access is required. 4. A detailed site plan shall be submitted to the Huntington Beach Fire Department for approval (show table locations, tents, barriers, etc.) 5. The applicant shall obtain all necessary Fire Department permits and comply with all provisions of Article 32 of the Uniform Fire Code. 6. This approval shall include necessary permits for temporary signs. 7. The applicant shall obtain clearance from the Public Liability Claims Coordinator, Administrative Services Department, and/or shall provide a Certificate of Insurance and Hold Harmless Agreement to be executed at least five (5) days prior to the event. 8. Following the event, the applicant shall be responsible for removal of all trash and debris from the property. Failure to clean-up the site will result in a charge to the applicant for expenses incurred. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The event shall comply with all applicable provisions of the Ordinance Codes, Building Division and Fire Department. 2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 94-65 if any violations of these conditions or the Huntington Beach Ordinance Code occurs. 4. The applicant shall submit all future temporary outdoor event applications a minimum of ninety (90) days prior to the event. Failure to provide adequate notice may result in denial of the request. ITEM 3: CONDITIONAL EXCEPTION (VARIANCE) NO.94-14 Applicant: Doug Martin 17041 Twain Lane Huntington Beach, CA 92649 Request: To permit a second floor bedroom addition over an existing detached garage and allow 51.7% site coverage in -lieu of the maximum 50% site coverage permitted pursuant to Section 9230.5 of the Huntington Beach Ordinance Code. Location: 203 Adams Avenue ZA Minutes 8/24/94 Wayne Carvalho, staff planner, reported that the request was for a four (4) foot wide corridor in lieu of the required seven (7) foot wide corridor. Star reported that the applicant would provide the necessary open space with a seven (7) foot wide corridor. Staff stated they would not be able to support the variance request as there are no special circumstances to warrant the exception. THE PUBLIC HEARING WAS OPENED. The applicant, Doug Martin, was present and stated that he would provide a seven (7) foot corridor, eliminate the outside stairway so there would be no access from the first floor to the second floor, and request an exception to site coverage. Ted Stopnik, a resident of the neighborhood, spoke in favor of this request. There were no other persons present to speak for or against this request. THE PUBLIC HEARING WAS CLOSED. CONDITIONAL EXCEPTION (VARIANCE) NO. 94-14 WAS CONTINUED TO THE SEPTEMBER 7, 1994 ZONING ADMINISTRATOR MEETING TO RE -ADVERTISE A VARIANCE TO SITE COVERAGE.
