ZONING ADMINISTRATOR: Michael Strange STAFF MEMBER: Jane Madera MINUTES: The September 21, October 5 and 12, 1994 minutes were continued. ITEM 1: ADMINISTRATIVE REVIEW NO.94-6 Applicant/ Mike Kaizoji Seacliff Partners 520 Broadway, Suite 100 Santa Monica, CA 90401 Request: To permit a sales office and model home complex (4 models) for Tract 14891, The Hamptons, pursuant to Section 9730.22 of the Huntington Beach Ordinance Code. Location: 1 Livingston (The Hamptons) Jane Madera, staff planner, stated that this was an application to permit a sales office and model home complex for Tract 14891, The Hamptons. Staff presented a site plan of the project located north of Garfield Avenue between Goldenwest and Edwards Streets. Staff stated that twelve (12) parking spaces and adequate directional signage will be provided on the site. Staff stated that the Fire Department is recommending two (2) emergency vehicle access points prior to any combustible construction. Staff recommended approval with findings and conditions. The applicant, Mike Kaizoji, was present and concurred with staff s recommendation. ADMINISTRATIVE REVIEW NO. 94-6 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated September 26, 1994 shall be the conceptually approved layout. 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing sets submitted for plancheck. 4. All utilities shall be installed prior to occupancy. The sales office shall be handicap accessible. 6. The office use shall be discontinued within thirty (30) days following sale of the last unit. A cash bond of one thousand dollars (11,100) shall be posted with the City for the sales office and for each model home ($5,000 total). 7. No sales office or model shall be converted or expanded into a general business office for the contractor or developer. 8. A fire extinguisher is required for the sales trailer. Type and installation to comply with Fire Department standards. 9. Service roads and fire lanes, as determined by the Fire Department, shall be posted and marked. 10. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 11. An all-weather road from Garfield and Saddleback, with an access to the sales office and model home complex, and fire hydrants shall be in place and operational prior to Certificate of Occupancy. 12. An approved secondary access will be required for construction of the model homes. The secondary access can be accomplished by either providing the emergency access through the Brindle property as approved for Tract 14891, or, because the model homes are adjacent to Saddleback, by providing the emergency access from Quarterhorse Lane. ZA Minutes 10/19/94 2 13. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 14. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. INFORMATION ON SPECIFIC CODE REQUIREMENTS The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Administrative Review 94-6 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. ITEM 2: USE PERMIT NO.94-59 Applicant: Jim Ross 9 Bearpaw, #9C Irvine, CA 92714 Request: To permit a 662 square foot second story room addition to an existing two story home with non -conforming setbacks pursuant to Section 9652 (c) of the Huntington Beach Ordinance Code. Location: 1838 Lake Street Jane Madera, staff planner, stated that this was a request to permit a 662 square foot second story room addition to an existing two story home with non conforming setbacks. Staff presented site plans of the project and stated that the proposed construction would be consistent with other similarly remodeled homes within the tract. Staff recommended approval with findings and conditions. THE PUBLIC HEARING WAS OPENED. William Kerry, property owner, was present and concurred with staffs recommendation. There were no other persons to speak for or against this request. THE PUBLIC HEARING WAS CLOSED. ZA Minutes 10/19/94 3 USE PERMIT NO. 94-59 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL -USE PERMIT NO. 94-59: 1. Use Permit No. 94-59 for the establishment of the 662 square foot room addition to a home with non -conforming side yard setbacks will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The room addition is compatible with four (4) similar previously approved second story additions in the same neighborhood. The addition will not encroach any further into the sideyard setback than the existing structure and no windows are proposed on the north building wall which is closest to the adjacent neighbor. b. Property and improvements in the vicinity of such use or building. 2. The granting of Use Permit No. 94-59 will not adversely affect the General Plan of the City of Huntington Beach. The single family room addition is consistent with the goals and objectives of the Medium Density Residential Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL -USE PERMIT NO. 94-59: The site plan, floor plans, and elevations received and dated October 4, 1994 shall be the conceptually approved layout with the following modifications: a. The elevations shall be dimensioned from rear property line. b. No portion of the room addition (including eaves) shall project into the side yard setback any further than the existing home. The site plan shall be revised to depict compliance on the north side of the addition. 2. A revised site plan shall be submitted depicting the modifications described above. 3. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. ITEM 3: USE PERMIT NO.94-69 Applicant: Howard Spunt Associates, Inc. 14407 Gilmore Street, Suite 203 Van Nuys, CA 91401 Request: To permit a 3, 249 square foot building addition, new parking layout, and landscaping to an existing retail shopping center. Location: 16672 Beach Boulevard Staff planner, Jane Madera, stated that this was request to permit a 3,249 square foot building addition to an existing retail shopping center. Staff informed the Zoning Administrator that one (1) telephone call from an adjacent residential property owner was received prior to the hearing. The caller identified problems with early morning truck delivery noise and prior restrictions on all tracks traveling on Terry Drive. Staff reported that no evidence of any condition of approval restricting truck traffic on Terry Drive was found. Staff recommended approval with findings and conditions. THE PUBLIC HEARING WAS OPENED. Howard Spunt, applicant, was present and stated that he felt the shopping center management did an excellent job and that Stroud's corporate policy is to conduct deliveries through the front door. He asked for clarification of the reciprocal access requirements and concurred with staff s recommendation. ZA Minutes 10/19/94 5 William and Jeaine Bogle adjacent property owners, were present and cited noise complaints with early morning truck deliveries, traffic on Terry, and car alarm/stereo installation at the rear of Good Guys. There were no other persons present to speak for or against this request. THE PUBLIC HEARING WAS CLOSED. USE PERMIT NO. 94-69 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL -USE PERMIT NO. 94-69: 1. Use Permit No. 94-69 for the establishment, maintenance and operation of the 3,249 square foot addition to Stroud's will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. With the conditions of approval imposed, Stroud's loading/unloading shall be prohibited between the hours of 8:00 p.m. and 7:00 a.m., Monday -Saturday. All loading/unloading activities shall be prohibited on Sundays and Federal holidays. b. Property and improvements in the vicinity of such use or building. The retail store expansion is proposed in a commercial shopping center and will be provided with code required parking, landscaping, trash enclosures, circulation, etc. 2. The granting of Use Permit No. 94-69 will not adversely affect the General Plan of the City of Huntington Beach. The 3,249 square foot addition is consistent with the goals and objectives of the General Commercial Land Use designation of the General Plan which permits and encourages this type of commercial development. SPECIAL CONDITIONS OF APPROVAL -USE PERMIT NO. 94-69: 1. The site plan, floor plans, and elevations received and dated September 23, 1994 shall be the conceptually approved layout with the following modifications: a. The site plan shall depict all property improvements including driveway locations, parking, and landscape planters on the property to the south. Reciprocal access and parking easement shall be shown on the site plan to line up with existing drive aisles at the property to the south. b. The site plan shall depict a future location for reciprocal access and parking easement to the north. ZA Minutes 10/19/94 6 2. A revised site plan shall be submitted depicting the modifications described above. 3. Deliveries, loading, and unloading activity for Stroud's shall be permitted only during the following hours: Monday -Saturday, 7:00 a.m. - 8:00 p.m. Deliveries, loading and unloading shall be prohibited on Sundays and Federal holidays. 4. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 5. Prior to issuance of building permits, the following plans and items shall be submitted and/or completed by the applicant: a. Revised site plan per Condition No. 1. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. c. The subject property shall enter into irrevocable reciprocal driveway and parking easement(s) between the subject site and adjacent properties to the south. A copy of the legal instrument shall be approved by the City Attorney as to form and content and, when approved, shall be recorded in the Office of the County Recorder. A copy shall be filed with the Department of Community Development prior to occupancy. d. The subject property shall make an irrevocable offer to grant reciprocal driveway and parking easement to the property to the north. A copy shall be filed with the Department of Community Development prior to occupancy. e. All applicable Public Works fees shall be paid prior to issuance of building permits. 6. Installation of required landscaping and irrigation systems shall be completed prior to final inspection/within twelve (12) months. 7. The applicant/owner shall be responsible for payment of Traffic Impact fees prior to issuance of a Certificate of Occupancy and/or final building permit approval. 8. Special architectural treatment shall be provided on all building walls. Such treatment is subject to approval by the Department of Community Development. ZA Minutes 10/19/94 7 9. Fire Department Requirements: a. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations. b. Service roads and fire lanes, as determined by the Fire Department, shall be posted and marked. c. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 10. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers. 11. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 12. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 4. Landscaping shall comply with Section 9607 of the Huntington Beach Ordinance Code. 5. New parking shall comply with Article 960 Off -Street Parking and Landscaping (including striping detail). 6. The Zoning Administrator reserves the right to revoke Use Permit 94-69 if any violation of these conditions of the Huntington Beach Ordinance Code occurs.
