ZONING ADMINISTRATOR: Michael Strange STAFF MEMBER: Jane Madera, Lois Paller MINUTES: Approved September 21 and October 5, 1994 minutes Continued October 12 and 19, 1994 minutes ITEM 1: USE PERMIT NO.94-79 (TEMPORARY OUTDOOR EVENT) Applicant: Della Chadwell Pat Rogers 7777 Edinger Avenue #300 Huntington Beach, CA 92647 Request: To permit a temporary three (3) day carnival in the parking lot at Huntington Beach Mall on November 11-13, 1994 pursuant to Section 9730.64 of the Huntington Beach Ordinance Code. Location: 7777 Edinger Avenue Jane Madera, staff planner, stated that this was a request to permit a temporary three (3) day carnival in the parking lot at Huntington Beach Mall. The request has been reviewed and approved by both Fire and Police Departments who stated that proper access for emergency response vehicles shall be maintained throughout the carnival. Staff recommended approval with findings and conditions. The applicant, Pat Rogers, was present and concurred with staffs recommendation. USE PERMIT NO. 94-79 (TEMPORARY OUTDOOR EVENT) WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL - USE PERMIT NO. 94-61 (TEMPORARY OUTDOOR EVENT): Use Permit No. 94-79 for a three (3) day temporary outdoor event will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The three (3) day carnival will not block any existing entrances to the Huntington Beach Mall and will not conflict with any other businesses in the area. b. Property and improvements in the vicinity of such use of building. The temporary three (3) day parking lot sale will not alter any existing improvements in the area and will maintain necessary fire lane for emergency response vehicles. 2. The granting of Use Permit No. 94-79 will not adversely affect the General Plan of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated October 12, 1994 shall be the conceptually approved layout. 2. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 3. Fire access lanes shall be a minimum width of twenty-four (24) feet. 4. A detailed site plan shall be submitted to the Huntington Beach Fire Department for approval (show table locations, tents, barriers, etc.) 5. The applicant shall obtain all necessary Fire Department permits and comply with all provisions of Article 32 of the Uniform Fire Code. 6. The applicant's request shall include necessary permits for temporary signs. 7. Fire extinguishers shall be provided in number and locations specified by the Fire Department. 8. Stand by personnel shall be on site to safeguard premises. 9. An overnight security guard shall be provided to protect carnival equipment left overnight. The Huntington Beach Police Department shall be notified 24 hours prior to the event. ZA Minutes 10/26/94 2 INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The event shall comply with all applicable provisions of the Ordinance Codes, Building Division and Fire Department. 2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 94-61 if any violations of these conditions or the Huntington Beach Ordinance Code occurs. 4. The applicant shall submit all future temporary outdoor event applications a minimum of ninety (90) days prior to the event. Failure to provide adequate notice shall result in denial of the request. ITEM 2: ADMINISTRATIVE REVIEW NO.94-7 Applicant: Richard Calvert 15541 Commerce Lane, Suite C Huntington Beach, CA 92649 Request: To permit 35% of an industrial building to be converted to office space in conjunction with a new parking layout and consolidation of two existing driveways along Commerce Lane and creating a new driveway on McFadden Avenue pursuant to Section 9510.01(a) of the Huntington Beach Ordinance Code. Location: 5582 McFadden Avenue (southwest corner at McFadden Avenue) Jane Madera, staff planner, stated that staff supported the request to permit 35% of an industrial building to be converted to office space so that the adjacent paint manufacturer, Resource Coatings, and property owner of both properties, could expand their operation. The new parking layout and consolidation of two driveways along Commerce Lane with an access easement across the southern property line ensures that adequate parking will be provided for both properties. Staff presented a site plan of the project and stated that both Public Works, Traffic Engineering and Planning recommended denial of a new driveway on McFadden. All vehicular access rights along McFadden were previously vacated to the city under Tract 7070. Staff recommended approval with findings and conditions. Richard Calvert, applicant, was present and concurred with staiTs recommendation. Ed Laird, owner of Resource Coatings, was present and described the business operation and need for expansion. He also stated that the driveway access on McFadden was important for improved circulation around the site. Paul McMarin was also present and reiterated the need for a new driveway on McFadden Avenue. ZA Minutes 10/26/94 3 ADMINISTRATIVE REVIEW NO, 94-7 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. SPECIAL CONDITIONS OF APPROVAL: The site plan, floor plans, and elevations received and dated September 28, 1994 shall be the conceptually approved layout with the following modifications: a. Revise the site plan and remove the proposed driveway on McFadden Avenue. 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing sets submitted for plancheck. 4. Prior to issuance of building permits, the following plans and items shall be submitted and/or completed by the applicant: a. One set of landscape and irrigation plans to the Public Works Department for review and approval. The landscape construction set shall include a landscape plan prepared and signed by a State Licensed Landscape Architect which includes all proposed/existing plant materials (location, type, size, quantity), irrigation plan, grading plan and approved site plan, and copy of conditions of approval. The landscape plan shall be in conformance with Section 9607 of the Huntington Beach Ordinance Code. The set must be complete and approved by both Community Development and Public Works prior to issuance of building permits. b. The applicant shall submit an irrevocable reciprocal ingress, egress, and parking easement for the entire length of the southern property line between the subject property and the adjacent property to the south. A copy of the legal instrument shall be approved by the City Attorney as to form and content and, when approved, shall be recorded in the office of the County Recorder. A copy shall be filed -with the Department of Community Development prior to occupancy. 5. Fire Department Requirements: a. Fire extinguishers will be installed and located in areas to comply with Huntington Beach Fire Code Standards. ZA Minutes 10/26/94 4 6. Driveway approach on Commerce shall be a minimum of twenty-seven feet (27) in width and shall be of radius type construction. 7. Public Works Requirements: a. Remove and replace existing driveways on the south side of the subject property and the north side of the adjacent property. b. Construct new curb, gutter and sidewalk at driveway removal locations. C. Construct new driveways per standard plan 209. d. Remove curb, gutter and sidewalk at new driveway locations. e. All work within public right-of-way shall be done by a state licensed contractor. 8. There shall be no outside storage of paint equipment, vehicles, vehicle parts, or trailers. 9. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 10. Natural Gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 11. 12. Low -volume heads shall be used on all spigots and water faucets. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 13. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 14. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. INFORMATION ON SPECIFIC CODE REQUIREMENTS The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Administrative Review 94-4 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. ZA Minutes 10/26/94 1 ITEM 3: CONDITIONAL EXCEPTION (VARIANCE) NO.94-28 Applicant: Larry Lawrence 34244 Via Santa Rosa Capistrano Beach, CA 92624 Request: To permit a forty-two (42) space parking reduction (84 parking spaces required, 42 parking spaces provided) in conjunction with establishing a Goodwill retail business pursuant to Section 9602.2 (R) of the Huntington Beach Ordinance Code. Location: 19431 Beach Boulevard Jane Madera, staff planner, stated that this request was to permit a forty-two (42) space parking reduction in conjunction with establishing a Goodwill retail business at a former furniture store. Staff presented a site plan of the project. Staff reported that in order to support the parking reduction, the applicant made a survey of another Goodwill business in Santa Ana. The square footage is similar in size to the present project and the parking count conducted at the other location indicated that the maximum parking requirements at any one point was thirty-eight (38) cars. Staff stated that this business could be accommodated with the forty-two (42) parking spaces and recommended conditions requiring reciprocal access and parking agreements with the adjacent hotel property. Staff recommended several unique conditions of approval regarding signage and operations. Staff recommended approval with findings and conditions. THE PUBLIC HEARING WAS OPENED. The applicant, Larry Lawrence, was present and concurred with stars recommendation. Victoria Lane, business owner of the tire store to the north, was present and stated her concern with the parking situation and questioned the meaning of reciprocal access. THE PUBLIC HEARING WAS CLOSED. Mike Strange, Zoning Administrator, requested that a registered traffic engineer conduct a traffic study to be reviewed by the Public Works Department. Mr. Strange continued this item for two weeks. CONDITIONAL EXCEPTION (VARIANCE) NO. 94-28 WAS CONTINUED TO THE NOVEMBER 9, 1994 ZONING ADMINISTRATOR MEETING. ZA Minutes 10/26/94 6 ITEM 4: USE PERMIT NO. 94-66 Applicant: Lorenzo Reyes Boston Chicken 17853 Santiago Blvd., #107-174 Villa Park, CA 92667 Request: To permit the construction of a 2,918 square foot Boston Chicken restaurant pursuant to Section 9220.1(c) of the Huntington Beach Ordinance Code. Location: 16972 Goldenwest Street Jane Madera, staff planner, reported that this was request for construction of a 2,918 square foot Boston Chicken restaurant. Staff presented a site plan of the project and stated that the site was a former gas station that has been completely demolished. Staff reported that landscaping and parking requirements are met and that the use was compatible with other food and retail users in the vicinity. Staff stated that the existing reciprocal access agreements would have to be modified to accommodate the new building layout and that five(5) additional feet for the driveway to the rear of the site would have to be provided along the north property line. Staff recommended approval with findings and conditions. THE PUBLIC HEARING WAS OPENED. The applicant, Lorenzo Reyes, was present and concurred with staff s recommendation. There were no other persons present to speak for or against this project. THE PUBLIC HEARING WAS CLOSED. USE PERMIT NO. 94-66 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL -USE PERMIT NO. 94-66: 1. Use Permit No. 94-66 for the establishment, maintenance and operation of the 2,918 square foot restaurant will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The project will provide all the code required parking and landscaping on -site and is not located in the vicinity of any residential units. The new restaurant is consistent with other retail businesses in the area. ZA Minutes 10/26/94 7 b. Property and improvements in the vicinity of such use or building. With the conditions of approval imposed, the existing reciprocal access easement agreements around the site will be amended to maintain access after establishment of the new use of the property and to insure a proper 25 foot wide drive aisle along the north property line. 2. The granting of Use Permit No. 94-66 will not adversely affect the General Plan of the City of Huntington Beach. The 2,918 square foot restaurant is consistent with the goals and objectives of the General Commercial Land Use designation of the General Plan which promotes and encourages this type of development. SPECIAL CONDITIONS OF APPROVAL -USE PERMIT NO. 94-66: The site plan, floor plans, and elevations received and dated August 29, 1994 shall be the conceptually approved layout. 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing sets submitted for plancheck. 4. Within 45 days of this approval action ((by December 12, 1994), the applicant shall file a parcel map consolidating all lots on the subject parcel. Said map shall be recorded with the County of Orange Recorder prior to issuance of a Certificate of Occupancy and a copy of the recorded map submitted to the Department of Community Development for inclusion in the entitlement file. 5. Prior to issuance of building permits, the following plans and items shall be submitted and/or completed by the applicant: a. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. b. A Landscape Construction Set submitted to the Public Works Department. The landscape construction set shall include a landscape plan prepared and signed by a State Licensed Landscape Architect which includes all proposed/existing plant materials (location, type, size, quantity), irrigation plan, grading plan and approved site plan, and copy of conditions of approval. The landscape plan shall be in conformance with Section 9607 of the Huntington Beach Ordinance Code. The ZA Minutes 10/26/94 8 set must be complete and approved by both Community Development and Public Works departments prior to issuance of building permits. C. The applicant shall amend existing irrevocable reciprocal driveway and parking easement(s) between the subject site and adjacent properties so that no improvements necessary for development of the subject site, such as, parking, landscaping, trash enclosures, etc. are included in the easement area. In addition, the easement shall depict the driveway on the north property line to the rear of the site as a full 25 feet in width. A copy of the legal instrument shall be approved by the City Attorney as to form and content and, when approved, shall be recorded in the Office of the County Recorder. A copy shall be filed with the Department of Community Development prior to occupancy. d. All applicable Public Works fees shall be paid prior to issuance of building permits. e. All utility apparatuses such as but not limited to backflow devices and Edison transformers, shall be prohibited in the front yard and exterior side yards unless properly screened by approved landscaping or any other method approved by the Director of Planning. All such apparatuses shall be depicted on the site plan prior to issuance of building permits. f. A grading plan shall be submitted to Public Works Department. g. For purposes of future "right turn only lane", the developer shall execute an irrevocable offer to dedicate a strip of land twelve feet wide along Warner Avenue and curving along a thirty-two radius northwesterly joining the existing Goldenwest Street right-of-way. h. Submit a completed Federal Emergency Management Agency Elevation Certificate. 6. Installation of required landscaping and irrigation systems shall be completed prior to final inspection. 7. The applicant/owner shall be responsible for payment of Traffic Impact fees prior to issuance of a Certificate of Occupancy and/or final building permit approval. 8. Fire Department Requirements: a. NOTE ON PLANS - Fire extinguishers will be installed and located in areas to comply with Huntington Beach Fire Code Standards. b. NOTE ON PLANS - Fire lanes will be designated and posted to comply with City Specification 9415. ZA Minutes 10/26/94 9 c. NOTE ON PLANS - Address numbers will be installed to comply with City Specification #428. The size of the numbers will be the following: • The number for the building will be sized a minimum of six (6) inches with a brush stroke of one and one-half (1-1/2) inches. d. NOTE ON PLANS -Installation or removal of underground flammable or combustible liquid storage tanks will comply with Orange County Environmental Health and Huntington Beach Fire Department requirements. e. SHOW ON PLANS - Fire access roads will be provided in compliance with the Huntington Beach Fire Code and City Specification #401. Include the circulation plan and dimensions of all access roads (24' or 27' fire lanes, turnarounds and 17' by 45' radius turns.) f. NOTE ON PLANS - Exit signs and exit path markings will be provided in compliance with the Huntington Beach Fire Code and Title 24 of the California Administrative Code. g. NOTE ON PLANS - The project will comply with all provisions of the Huntington Beach Fire Code and City Specification #422 and #431 for the abandonment of oil wells and site restoration. h. NOTE ON PLANS - The project will comply with all provisions of Huntington Beach Municipal Code Title 17.04.085 and City Specification #429 for new construction within the methane gas overlay districts. 9. Public Works Requirements: a. The developer shall submit a plan, showing water system improvements in accordance with applicable Uniform Plumbing Code, City Ordinances, Public Works standards and Water Division design criteria. These plans shall be approved, prior to any construction, by the Public Works Water Division. b. The proposed building shall have a separate 2" domestic water service per standard plan nos.' 603B and 609. c. All backflow devices shall be painted to match the surrounding aesthetics. The markings, indicating the size, model number and serial number shall be permanently affixed to the body of the backflow device and must remain visible after painting. d. The water system shall be designed and installed per the City of Huntington Beach Water Division's design criteria, standards plans and specifications. e. The developer shall use "drought tolerant" plants and turf for all landscaping. ZA Minutes 10/26/94 10 f. The developer shall utilize the existing 1 1/2" water service as an irrigation service, and shall reconstruct the existing meter assembly, including the meter box, to conform to current standard plan 603A. Backflow protection is required per Water Division Standard Plan 609. g. Remove the southerly driveway along Goldenwest Street and construct curb, gutter and sidewalk. h. Remove the existing westerly driveway along Warner Avenue and construct curb, gutter and sidewalk. i. Remove and replace the existing easterly driveway on Warner Avenue with a radius type per Public Works Standard Plan No. 211A & B. j. Remove and replace the northerly driveway on Goldenwest Street with a radius type per Public Works Standard Plan No. 211 A & B. k. Install street lights per Public Works Standard Plan No. 411 (sheet 3 of 3). 1. Remove the existing tree well along Goldenwest Street. m. Traffic Impact fees shall be paid at the time of final inspection or Certificate of Occupancy. n. The proposed new driveways will require an 8 foot radius transition which may not encroach on the frontage of adjacent property unless a letter of permission is provided by the adjacent property owner. 10. ITEM 5: COASTAL DEVELOPMENT PERMIT NO.93-14 Applicant/ County Sanitation Districts of Orange County Property Owner: Bob Chenowith, Engineering Department 10844 Ellis Avenue Fountain Valley, CA 92728-8127 Request: To permit the relocation of existing management/office trailer complex on - site and to construct a new 45,000 square foot warehouse building and a 32,430 square foot maintenance building at the County Sanitation District's Wastewater Treatment Plant No. 2. Location: 22212 Brookhurst Street Jane Madera, staff planner, reported that this was a request to permit the relocation of an existing management/office trailer complex on -site, to construct a 45,000 square foot warehouse building and a 32,430 square foot maintenance building at the County Sanitation District's Wastewater Treatment Plant No. 2. Staff presented a site plan of the project and stated that one (1) telephone call regarding the project was received from a neighboring property owner. The caller stated concerns with the hours of operation allowed by the Municipal Code and also suggested that the Sanitation District be required to notify residents prior to construction and to supply adjacent property owners with a contact person and telephone number at the plant. Staff recommended the applicant supply a contact and phone number to the residents as suggested. Staff recommended approval with findings and conditions. THE PUBLIC HEARING WAS OPENED. The applicant, Bob Chenowith, was present and stated that the Sanitation District did not plan construction on Saturdays except in an unusual instance. He concurred with staff recommendation. There were no other persons present to speak for or against this project. THE PUBLIC HEARING WAS CLOSED. ZA Minutes 10/26/94 12 COASTAL DEVELOPMENT PERMIT NO. 0-14 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO 93-14• The request to permit the relocation of existing management/office trailer complex on -site and to construct a new 45,000 square foot warehouse building and a 32,430 square foot maintenance building conforms with the plans, policies, requirements and standards of the Coastal Element of the General Plan. The proposed construction projects will not impact public views or access. The construction will take place entirely within the Sanitation District compound. The buildings will be set well back from Brookhurst Street and screened from view with an eight to nine foot tall flood wall and substantial landscape buffers. The building construction will not infringe upon any public view of coastal waters and will not affect access to the shore line. No access to the beach through the plant currently exists and is not proposed as a result of this project. 2. Coastal Development Permit No. 93-14 is consistent with the CZ suffix zoning requirements, the MI -A, Restricted Manufacturing and FP-2, Floodplain Zoning Districts, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. The proposed development will conform with all applicable City codes, such as, parking, landscaping, building height, setbacks, floodplain standards, and applicable Fire, Building and Public Works requirements. 3. At the time of occupancy, the proposed relocation of existing management/office trailer complex on -site and construction of a new 45,000 square foot warehouse building and a 32,430 square foot maintenance building will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. All infrastructure currently exists to the site. The project itself consists of upgrades to infrastructure necessary for the City and County sanitary sewer function. The office trailer relocation and maintenance and warehouse building construction will permit the Sanitation District to operate more efficiently and effectively with the proposed upgrades to the complex. 4. The proposed relocation of existing management/office trailer complex on -site and to construct a new 45,000 square foot warehouse building and a 32,430 square foot maintenance building conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. The proposed project will have no impact on public access and public recreation as none currently exists in the area and will not be necessary at project completion. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated June 29, 1993 shall be the conceptually approved layout with the following modifications: ZA Minutes 10/26/94 13 a. All parking stalls shall be labeled as "typical" and be sized nine (9) feet wide by nineteen (19) feet deep. 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. The County Sanitation District shall designate a contact person for use by surrounding residents during construction. The name of the contact person and his/her telephone number shall be mailed to all residents within a 300 foot radius of the plant a minimum of one (1) week prior to construction. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 5. Proposed structures shall be architecturally compatible with existing structures. 6. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 7. Low -volume heads shall be used on all spigots and water faucets. 8. The applicant shall pay all applicable Public Works fees. 9. The Fire Department requirements are: a. Automatic sprinkler systems will be installed throughout to comply with Huntington Beach Fire Department and Uniform Building code standards. INFORMATION OF SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3.
