ZONING ADMINISTRATOR: Michael Strange STAFF MEMBER: Jane Madera, Lois Paller MINUTES: Approved October 12 and 19, 1994 Minutes ITEM 1: CONDITIONAL EXCEPTION (VARIANCE) NO.94-30 Applicant/ Rick and Janette Mortimer Property Owner: 22101 Luau Lane Huntington Beach, CA 92646 Request: To permit the conversion of an existing side entry garage to a front entry garage with a reduction in the required minimum setback from twenty-two (22) feet to fifteen (15) feet, eight (8) inches pursuant to Section 9110.6 of the Huntington Beach Ordinance Code. Location: 9002 Christine Drive Jane Madera, staff planner, stated that this was a request to permit the conversion of an existing side entry garage to a front entry garage with a reduction in the required minimum setback. Staff stated that the home is located on an odd shaped lot because of the existing curve of the street. The variance request would also permit a greater majority of the front yard to be landscaped and used for open space area. All other requirements of the code are being met and staff recommended approval with findings and conditions. THE PUBLIC HEARING WAS OPENED. The applicants, Rick and Janette Mortimer, were present and concurred with staffs recommendation. There were no other persons present to speak for or against this project. THE PUBLIC HEARING WAS CLOSED. CONDITIONAL EXCEPTION (VARIANCE) NO. 94-30 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION NO. 94-30• 1. The granting of Conditional Exception No. 94-30 will not constitute a grant of special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. Other properties in the R-1 zone with similar circumstances have been granted variances for a reduced garage setback. 2. Because of special circumstances applicable to the subject property, including size and shape, the strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. The property is located on a corner and has both a unique shaped front yard and rear yard. The odd -shaped lot restricts the property owners from designing a normal room addition and still maintaining useable yard area around the structure. The front entry driveway will allow the existing driveway area to be landscaped for more yard. 3. The granting of Conditional Exception No. 94-30 is necessary in order to preserve the enjoyment of one or more substantial property rights. The variance request will permit the property owner to add several small room additions and convert the existing driveway into landscaped yard area. 4. The granting of Conditional Exception No. 94-30 will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. The variance for reduced garage setback will actually improve aesthetics of the subject property by reducing the amount of concrete visible from the street while still providing for two (2) vehicles to park on the driveway. 5. The granting of Conditional Exception No. 94-30 will not adversely affect the General Plan of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL -CONDITIONAL EXCEPTION NO. 94-30• The site plan, floor plans, and elevations received and dated September 28, 1994 shall be the conceptually approved layout with the following modifications: a. The site plan shall be revised so that the driveway is widened for a minimum width of eighteen (18) feet to facilitate the parking of two (2) vehicles on the driveway. b. The site plan and floor plan shall depict a roll -up type garage door. ZA Minutes 11/2/94 2 2. A revised site plan shall be submitted depicting the modifications described above for inclusion in the entitlement file. 3. Public Works Requirements: a. Remove and replace existing driveway. b. Construct new curb, gutter and sidewalk at driveway removal location. C. Construct new driveway per standard plan 209. d. Remove curb, gutter and sidewalk at new driveway location. e. All work within public right-of-way shall be done by a state licensed contractor. 4. All improvements as required in condition number 3 shall be completed prior to final building permit inspection. 5. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 6. Low -volume heads shall be used on all spigots and water faucets. 7. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. INFORMATION ON SPECIFIC CODE REQUIREMENTS The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. The Zoning Administrator reserves the right to revoke Conditional Exception 94-30 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. ITEM 2: USE PERMIT NO.94-73 Applicant: Bob Bradley Bob's Ornamental Design 22616 Killy Lake Forest, CA 92630 ZA Minutes 11/2/94 Request: To permit the installation of two (2) electronic sliding security gates at the Ocean Breeze Apartment complex pursuant to Section 9604.2 of the Huntington Beach Ordinance Code. Location: 6401 Warner Avenue Jane Madera, staff planner, stated that this was a request for the installation of two (2) electronic sliding security gates at the Ocean Breeze Apartment complex located on Warner Avenue. Staff presented a site plan and pictures of the project. The planning staff could not make findings that the proposed wall is compatible with other walls and structures in the vicinity. Staff recommended the wall height be reduced to eight (8) feet and that the materials to be used be more compatible with the complex. Staff also recommended that the ultimate location of the gate be subject to approval from Public Works Traffic Engineering Division after the applicant submits a study on vehicle stacking. THE PUBLIC HEARING WAS OPENED. The applicant's representative, Pat Orr, was present and presented a rendering of the project. She also stated that the size of the gate as proposed was compatible with the massive size and aesthetics of the apartment complex. The applicant, Bob Bradley, was present and disagreed with having the height of the gate lowered to 8 feet tall. Dean Shabbouri was present and reiterated that the height as proposed was compatible with the apartment complex. He also presented pictures of a similar wrought iron fence at 18 feet in height to show that the design is aesthetically pleasing. THE PUBLIC HEARING WAS CLOSED. USE PERMIT NO. 94-73 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL -USE PERMIT NO. 94-73: Use Permit No. 94-73 the establishment, maintenance and operation of the sliding electronic security gates will not be detrimental to: ZA Minutes 11/2/94 4 a. The general welfare of persons residing or working in the vicinity. The electronic security gate system as revised by the conditions of approval will be compatible . with the existing buildings, landscaping and surrounding structures. The gate system will provide increased security and safety benefits to the residents of the Ocean Breeze Apartments. b. Property and improvements in the vicinity of such use or building. With the conditions of approval imposed the gate and fence system will be placed in a location that provides a sufficient vehicle stacking area between the gates and the public right-of-way. 2. The granting of Use Permit No. 94-73 will not adversely affect the General Plan of the City of Huntington Beach. The sliding electronic security gate system is consistent with the goals and objectives of the High Density Residential Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL -USE PERMIT NO. 94-73: The site plan, floor plans, and elevations received and dated September 16, 1994 shall be the conceptually approved layout with the following modifications: a. The elevations shall be revised so that the proposed ornamental wrought iron fencing is a maximum of thirteen (13) feet, six (6) inches tall at the arc of the auto court at the entrance to the project on Warner Avenue. b. One (1) parking stall adjacent to the entrance gate on Warner Avenue shall be striped for turn -around only. c. All parking adjacent to the proposed gates shall be depicted on the site plan and shall be twelve (12) feet in width. 2. A revised site plan and elevation drawing shall be submitted depicting the modifications described above. Prior to issuance of building permits, the following plans and items shall be submitted and/or completed by the applicant: a. Submit stacking calculations as required by the Public Works Department. Final fence and gate location and layout will be subject to Traffic Engineering approval. The calculations shall be completed by a registered Traffic Engineer and any alterations to the conceptually approved plan dated September 16, 1994 shall be subject to Condition of Approval No. 5. The equipment and mechanism of the gates for the ultimate approved plan shall be in place and in good operating condition for the life of the sliding electronic security gates. No alterations to the approved mechanisms shall be permitted unless prior approval by the City (Community Development and Public Works) is obtained. ZA Minutes 11/2/94 5 4. Fire Department Requirements: a. Gates must comply to City Specification number 403. b. A minimum width of twenty-four (24) feet is required. c. Each pedestrian gate must have a knox box installed. d. Each vehicle gate must have a knox switch for emergency vehicle access. 5. The Zoning Administrator shall be notified in writing if any changes in fence height, elevation, design, or location are proposed as a result of the plan check and Traffic Engineering approval process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 6. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing sets submitted for plancheck. INFORMATION ON SPECIFIC CODE REQUIREMENTS 1.
