ITEM 1: CONDITIONAL EXCEPTION (VARIANCE) NO.94-28 CONTINUED FROM
OCTOBER 26, 1994 ZONING ADMINISTRATOR MEETING
Applicant: Larry Lawrence

Capistrano Beach, CA 92624
Request: To permit a forty-two (42) space parking reduction (84 parking spaces
required, 42 parking spaces provided) in conjunction with establishing a
Goodwill retail business pursuant to Section 9602.2 (R) of the Huntington
Beach Ordinance Code.
Location: 19431 Beach Boulevard
Jane Madera, staff planner, stated that this item was continued from a previous meeting in order
to allow the applicant time to contact a registered traffic engineer and prepare a parking study.
Staff reported that the applicant requested a further continuance in order to pursue a different
location for the business. Staff also stated that the applicant was made aware that the parking
study must be tenant specific. Staff recommended continuance to a date uncertain.
No one was present to speak for or against this item.
CONDITIONAL EXCEPTION (VARIANCE) NO.94-28 WAS CONTINUED TO A DATE
UNCERTAIN.
ITEM 2: USE PERMIT NO. 94-82 (TEMPORARY OUTDOOR EVENT)
Applicant: Linda Jessner

Request: To permit a temporary outdoor three (3) day book sale, with tent, on
November 30, December 1, and December 2, 1994 pursuant to Section
9730.64 of the Huntington Beach Ordinance Code.
Location: 15902 Springdale Street
Jane Madera, staff planner, stated that this was a request to permit a three day event for a book
sale with a tent on November 30, December 1 and 2 at the northeast corner of Springdale and
Edinger. Staff recommended approval with findings and conditions.
The applicant, Ron Buysse, was present and concurred with stars recommendation.
USE PERMIT NO. 94-82 (TEMPORARY OUTDOOR EVENT) WAS APPROVED BY
THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND
CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE
ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING
COMMISSION WITHIN TEN (10) CALENDAR DAYS.
FINDINGS FOR APPROVAL:
1. The temporary outdoor event will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity. The three (3) day
book sale will not impact on -site circulation nor access to existing businesses.
b. Property and improvements in the vicinity of such use of building. The event is a
temporary use.
2. The granting of Use Permit No. 93-25 will not adversely affect the General Commercial
Land Use designation of the General Plan of the City of Huntington Beach which allows
temporary outdoor events of this nature..
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan received and dated January 25, 1994 shall be the conceptually approved
layout.

2. Fire access lanes shall be maintained. If fire lane violations occur and the services of the
Fire Department are required, the applicant will be liable for expenses incurred.
3. Fire access lanes shall be a minimum with of (20) twenty feet.
4. A detailed site plan shall be submitted to the Huntington Beach Fire Department for
approval (show table locations, tents, barriers, etc.)
5. The applicant shall obtain all necessary Fire Department permits and comply with all
provisions of Article 32 of the Uniform Fire Code.
6. The applicant's request shall include necessary permits for temporary signs.
7. The proposed tent shall be of fire retardant material. Proof of Certification shall be
submitted to the Fire Department for approval prior to the tent's installation on the site.
8. The proposed tent shall be secured against collapsing to the satisfaction of the Fire
Department.
9. "No Smoking" signs shall be posted in conspicuous locations.
10. Fire extinguishers shall be provided in number and locations specified by the Fire
Department.
11. A minimum of two (2) exits shall be provided and maintained.
12. Stand by personnel shall be on site to safeguard premises.
13. An overnight security guard shall be provided to protect merchandise left overnight. The
Huntington Beach Police Department shall be notified 24 hours prior to the event.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
The event shall comply with all applicable provisions of the Ordinance Codes, Building
Division and Fire Department.
2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances
and standards.
3. The Zoning Administrator reserves the right to revoke Use Permit No. 94-82 if any
violations of these conditions or the Huntington Beach Ordinance Code occurs.
4. The applicant shall submit all future temporary outdoor event applications a minimum of
thirty (30) days prior to the event. Failure to provide adequate notice shall result in
denial of the request.

ITEM 3: USE PERMIT NO. 94-74
Applicant: Clifton Shigaki

Request: To permit the construction of a new outdoor playground in front of an
existing Burger King restaurant pursuant to Section 9220.1 (c) of the
Huntington Beach Ordinance Code.
Location: 19201 Brookhurst Street
Jane Madera, staff planner, stated that this was a request to permit construction of a new outdoor
playground in front of an existing Burger King restaurant on Brookhurst Street. Staff presented a
site plan and pictures of a playground at another location. Staff reported that parking around the
structure will not be affected and is sufficient for the business. Staff recommended that the height
of the playground be no taller than the existing restaurant building and that the playground roof be
painted to match the building's roof color. Staff recommended approval with findings and
conditions.
THE PUBLIC HEARING WAS OPENED.
The applicant, Clifton Shigaki, was present and concurred with staff recommendation.
THE PUBLIC HEARING WAS CLOSED.
USE PERMIT NO. 94-74 WAS APPROVED BY THE ZONING ADMINISTRATOR
WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE
STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE
APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR
DAYS.
FINDINGS FOR APPROVAL -USE PERMIT NO. 94-74:
Use Permit No. 94-74 for the establishment, maintenance and operation of the new
outdoor playground will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity. The new
playground will not conflict with traffic circulation on the site as the playground
will be placed on an existing sidewalk area. With the conditions of approval
imposed, the playground will be compatible with the existing building.

b. Property and improvements in the vicinity of such use or building. The new
playground will be constructed entirely on the subject site and will not affect
existing property and improvements in the area. In addition, the project already
has an existing irrevocable access agreement recorded between the subject site and
the adjacent property to the north.
2. The granting of Use Permit No. 94-74 will not adversely affect the General Plan of the
City of Huntington Beach. The new playground is consistent with the goals and
objectives of the General Commercial Land Use designation of the General Plan which
promotes and encourages this type of land use.
SPECIAL CONDITIONS OF APPROVAL -USE PERMIT NO. 94-74:
The site plan, floor plans, and elevations received and dated October 17, 1994 shall be the
conceptually approved layout with the following modifications:
a. The elevation drawing shall be revised so that no portion of the playground
structure exceeds the height of the existing Burger King building.
b. The elevations shall include all proposed colors on the playground structure and
the playground roof color shall match the existing brown restaurant roof color.
2. A revised elevation shall be submitted depicting the modifications described above.
3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable
material, shall be disposed of at an off -site facility equipped to handle them.
4. Proposed structures shall be architecturally compatible with existing structures.
The Zoning Administrator shall be notified in writing if any changes in building height,
floor area, setbacks or building elevations are proposed as a result of the plan check
process. Building permits shall not be issued until the Zoning Administrator has reviewed
and approved the proposed changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be processed if the proposed
changes are of a substantial nature.
6. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing
sets submitted for plancheck.
INFORMATION ON SPECIFIC CODE REQUIREMENTS
1. The development shall comply with all applicable provisions of the Ordinance Code,
Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances,
and standards.

3. Prior to final inspection of building permits the applicant shall restripe the parking lot so
that it conforms to provisions of Federal ADA requirements and Article 960 of the
Huntington Beach Ordinance Code.
4. The Zoning Administrator reserves the right to revoke Use Permit 94-74 if any violation
of these conditions of the Huntington Beach Ordinance Code occurs.
