_MINUTES: The November 2 and 9, 1994, Zoning Administrator Minutes were
approved.
ITEM NO. 1 - USE PERMIT NO. 94-87
Applicant: Frank Tahvildari, 21094 Beach Boulevard, Huntington Beach, CA 92646

Request: UP: To permit the expansion of an existing restaurant (Tumbleweed's) into an
adjacent suite which was previously used as a restaurant (Alfonso's) and to add
four (4) pool tables.
Location: 21094 Beach Boulevard
Jane Madera, staff planner stated that this was an application for an existing restaurant to expand
into an adjacent suite at an existing building located at the southeast corner of Beach and Atlanta.
Staff presented site plans of the project. The application includes a request to add four (4) pool
tables, they currently have one (1) existing , therefore, approval would create a total of five (5)
pool tables. The project was reviewed by other Departments and comments were received back
from Fire, Building and Police. The Fire Department stated that they would have to comply with
standard fire and safety issues, such as sprinkling the building, proper exiting and proper
addressing on the exterior building walls. The Building Department commented that proper
exiting would have to be met for the restaurant space. Staff stated that this issues have most
likely already been met as the previous use was a restaurant. The Police Department is
recommending a six (6) month review to ensure there are no problems with the pool table request.
Staff recommended that this review be conducted by staff and stated in the condition and also
include wording that if their is a Code Enforcement or Police problem after six (6) months then
we bring back to Zoning Administrator for review. Staff recommended approval of the project as
submitted with findings and conditions.
THE PUBLIC HEARING WAS OPENED.
.Frank Tahvildari, 21094 Beach Boulevard, applicant, was present and concurred with staff
recommendation.
THE PUBLIC HEARING WAS CLOSED.
USE PERMIT NO. 94-87 WAS APPROVED BY THE ZONING ADMINISTRATOR
WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE
STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE
APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR
DAYS.
FINDINGS FOR APPROVAL -USE PERMIT NO. 94-87:
Use Permit No. 94-87 for the establishment, maintenance and operation of the restaurant
expansion with five (5) total pool tables will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity. The restaurant
will be expanded into an adjacent suite which was previously utilized as a
restaurant. The new restaurant will be compatible with other restaurant and retail
uses within the shopping center.
b. Property and improvements in the vicinity of such use or building. With the
conditions of approval imposed, the use will be subject to a six (6) month review,
by staff, to insure compliance with all code requirements and conditions.
2. The granting of Use Permit No. 94-87 will not adversely affect the General Plan of the
City of Huntington Beach. The restaurant with five (5) pool tables is consistent with the
goals and objectives of the General Commercial Land Use designation of the General Plan.
SPECIAL CONDITIONS OF APPROVAL -USE PERMIT NO. 94-87:
The site plan, floor plans, and elevations received and dated November 14, 1994 shall be
the conceptually approved layout.
2. All building spoils, such a unusable lumber, wire, pipe, and other surplus or unusable
material, shall be disposed of at an off -site facility equipped to handle them.
Fire Department Requirements:
a. Automatic sprinkler systems will be installed throughout to comply with
Huntington Beach Fire Department and Uniform Building Code Standards. Shop
drawings will be submitted to and approved by the Fire Department prior to
installation.

b. A fire alarm system will be installed to comply with Huntington Beach Fire
Department and Uniform Fire Code Standards. Shop drawings will be submitted
to and approved by the Fire department prior to installation. The system will
provide the following:
1. Water flow, valve tamper and trouble detection.
2. 24 hour supervision.
C. Fire extinguishers will be installed and located in areas to comply with Huntington
Beach Fire Code Standards.
d. Address numbers will be installed to comply with City Specification #428. The
size of the numbers will be the following:
1. The number for the building will be sized a minimum of six (6) inches with
a brush stroke of one and one-half (1-1/2) inches.
e. Exit signs and exit path markings will be provided in compliance with the
Huntington Beach Fire Code and Title 24 of the California Administrative Code.
Include low level exit signs.
4. A review of the use shall be conducted by Community Development Staff within six (6)
months of the date of this approval to verify compliance with all conditions of approval
and applicable Articles of the Huntington Beach Ordinance Code. If, at that time, there is
a violation of these conditions or code sections, Use Permit No. 94-87 will be scheduled
for a public hearing by the Zoning Administrator and may become null and void.
5. The Zoning Administrator shall be notified in writing if any changes in floor area or
building elevations are proposed as a result of the plan check process. Building permits
shall not be issued until the Zoning Administrator has reviewed and approved the
proposed changes. The Zoning Administrator reserves the right to require that an
amendment to the original entitlement be processed if the proposed changes are of a
substantial nature.
6. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing
sets submitted for plancheck.
INFORMATION ON SPECIFIC CODE REQUIREMENTS
l . The development shall comply with all applicable provisions of the Ordinance Code,
Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances,
and standards.
3. The applicant shall obtain permits from the South Coast Air Quality Management District
if necessary.
4. The Zoning Administrator reserves the right to revoke Use Permit 94-87 if any violation
of these conditions of the Huntington Beach Ordinance Code occurs.

Request: CUP: To permit the establishment of a 4,230 square foot Boston Chicken
Restaurant at an existing retail shopping center pursuant to section 9220.1(c) of
the Huntington Beach Ordinance Code.
Location: 19720 Beach Boulevard
Jane Madera, staff planner, stated that the request was an application for an establishment of
4,230 square foot restaurant in an existing building in the Newland Center, located at the
northeast corner of Beach and Adams. Staff presented site plans and floor plans of the project.
The major issue for this project is parking and compatibility. The Newland Center currently has a
surplus of parking. The current use requires 898 parking spaces, with the addition of the
restaurant 919 are required and 921 are currently provided at the center, this leaves 2 surplus
parking spaces. They are provided all the proper Fire and Building requirements as required by
code. Exterior modifications are proposed and because it is on Beach Boulevard they were
submitted to the Design Review Board and were approved They recommended that a condition
be placed on the conditional use permit to write down or identify the building colors and materials
on all the working drawings as approved by the Design Review Board. No alcohol is proposed
with the restaurant. Staff feels that it is compatible with the other restaurants and uses within the
center and recommend approval of the request with findings and conditions.
Mike Strange, Zoning Administrator, asked staff if there were any issues or concerns regarding
signage. Staff stated that signage would come under a separate permit, but felt they would most
likely comply with the current sign code.

CONDITIONAL USE PERMIT NO.94-41 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION
WITHIN TEN (10) CALENDAR DAYS.

FINDINGS FOR APPROVAL -CONDITIONAL USE PERMIT NO. 94-41:
1. Conditional Use Permit No. 94-41 for the establishment, maintenance and operation of the
4,230 square foot restaurant will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity. The proposed
restaurant is compatible with the other retail and restaurants within the Newland
Center. The new restaurant meets all code requirements including providing
adequate parking. Newland Center previously required 898 parking spaces. The
Boston Chicken restaurant is required to provide an additional 43 spaces for a total
required parking count of 919 spaces. The Newland Center currently provides 921
spaces, therefore, the property now has a surplus of two (2) spaces.
b. Property and improvements in the vicinity of such use or building. Operation of
the restaurant in an existing building will have no adverse impacts to existing
improvements. The tenant will make some interior and exterior tenant
improvements that the Design Review Board has determined compatible with the
center.
2. The granting of Conditional Use Permit No. 94-41 will not adversely affect the General
Plan of the City of Huntington Beach. The 4,230 square foot restaurant is consistent with
the goals and objectives of the General Commercial Land Use designation of the General
Plan.
SPECIAL CONDITIONS OF APPROVAL -CONDITIONAL USE PERMIT NO. 94-41:
The site plan, floor plans, and elevations received and dated December 15, 1994 shall be
the conceptually approved layout.
2. The elevations in the working/construction drawings shall include colors and materials of
all exterior improvements as approved by the Design Review Board.
All signs are subject to a separate building permit and have not been reviewed under this
application.
4. All applicable Public Works fees shall be paid prior to issuance of building permits.
5. The applicant/owner shall be responsible for payment of Traffic Impact fees prior to
issuance of a Certificate of Occupancy and/or final building permit approval.
6. All building spoils, such a unusable lumber, wire, pipe, and other surplus or unusable
material, shall be disposed of at an off -site facility equipped to handle them.
7. Fire Department Requirements:
a. Fire extinguishers will be installed and located in areas to comply with Huntington
Beach Fire code Standards.
