ZONING ADMINISTRATOR: Michael Strange STAFF MEMBER: Jane Madera, Kelli Klan, Kim Langel REVIEW OF MINUTES: The August 24, September 7, and December 7, 1994 Minutes were continued to the March 15, 1995 Zoning Administrator Meeting. ITEM 1: SPECIAL SIGN PERMIT NO. 95-1/DESIGN REVIEW BOARD NO. 95-2 (CONTINUED FROM THE MARCH 1,1995 ZONING ADMINISTRATOR MEETING) Applicant: Salvation Army 1300 South Lewis Street Anaheim, CA 92805 Property Owner: Susan Sandleman as Trustee of Fundamentals Company Trust c/o Kin Properties, Inc. 77 Tarrytown, Suite 100 White Plains, NY 10607 Request: A request to maintain an existing non conforming 18 foot high, 98 square foot freestanding pole sign for "The Salvation Army" in lieu of the Code Requirement of a seven (7) foot high, 50 square foot sign, pursuant to Section 233.08(C) of the Huntington Beach Zoning and Subdivision Ordinance. Location: 17362 Beach Boulevard Jane Madera, staff planner, stated that this was a request to maintain an existing non conforming 18 foot high, 98 square foot freestanding pole sign for "The Salvation Army" in lieu of the Code Requirement of a seven (7) foot high, 50 square foot sign, pursuant to Section 233.08(C) of the Huntington Beach Zoning and Subdivision Ordinance. The project site is located at 17362 Beach Boulevard. Staff stated that this item had been continued due to lack of notification to the applicant regarding the public hearing. Staff stated that in order for the Zoning Administrator to approve this special sign permit as proposed he must make findings of economic hardship or special circumstances, that the proposed sign is consistent with other signs in the immediate vicinity and the it will not cause a traffic hazard. Staffs recommendation is for a ten (10) foot high, 50 square foot sign. Staff feels this will be ample signage for the size of the property and it will be visibly to vehicular traffic. This application must be submitted to the Design Review Board for approval of color and design. Staff stated that Building and Fire Departments had no significant concerns and suggested approval with findings and conditions. THE PUBLIC HEARING WAS OPENED. Oliver Stenvick, 1300 So. Lewis, Anaheim, representing applicant, stated that the proposed sign was not an unreasonable request as it would be consistent with other signs in the immediate vicinity. He requested that the Zoning Administrator consider approving the proposed request for a three (3) year period, at which time they would replace it with a 12 feet tall, 60 square foot sign. Bill Wenke, 10200 Pioneer Road, Tustin, representing applicant, spoke in support of the sign as proposed by the applicant. THE PUBLIC HEARING WAS CLOSED. The Zoning Administrator agreed to permit the existing 18 foot tall, 98 square foot pole sign with the stipulation that it shall be removed and replaced within three (3) years of this approval. At that time the sign may be replaced with a new pole sign no more than 12 feet tall and 60 square feet in size. The new sign shall comply with the criteria for bonus signs (opaque background and internal illumination for letters only) and shall be reviewed by the Design Review Board prior to approval. SPECIAL SIGN PERMIT NO. 95-1 AND DESIGN REVIEW BOARD NO. 95-2 WERE APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS FOR APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL - SPECIAL SIGN PERMIT NO. 95-1: Due to the unique circumstances applicable to the sign, immediate alteration, removal or replacement of the sign and strict compliance with Chapter 233 will result in a substantial economic hardship to the applicant. The applicant has invested a substantial amount of funds in the existing sign and it would be a hardship to remove the sign at this time. With the conditions of approval imposed, the existing sign may remain for a maximum three (3) year period in order to allow the applicant to recoup their investment. The proposed non conforming 18 foot high, 98 square foot freestanding pole sign for "The Salvation Army" will not adversely affect other signs in the area as it does not hinder visibility of any other sign. 3. The proposed non conforming 18 foot high, 98 square foot freestanding pole sign for "The Salvation Army" will not be detrimental to property located in the vicinity of such sign and will be compatible with the surrounding area. This sign is compatible with other non conforming signs in the vicinity. In addition, this sign will be removed after three (3) years. 4. The proposed sign at the southeast corner of Holland and Beach Boulevard will not obstruct pedestrian or vehicular traffic vision because the sign is setback at least 15 feet from the public sidewalk. 6. The sign will be in keeping with the character of the surrounding neighborhood. Other signs in the area are also non conforming due to size and height. CONDITIONS OF APPROVAL - SPECIAL SIGN PERMIT NO. 95-1: 1. The site plan and sign elevations received and dated January 25, 1995, shall be the approved layout. 2. The 18 foot tall, 98 square foot pole sign shall be subject to review by the Design Review Board. The existing 18 foot tall, 98 square foot pole sign shall be removed and replaced within three (3) years of this approval (by March 8, 1998). At that time the sign may be replaced with a new pole sign no more than 12 feet tall and 60 square feet in size. The new sign shall comply with the criteria for bonus signs (opaque background and internal illumination for letters only) and shall be reviewed by the Design Review Board prior to approval. 4. The Zoning Administrator reserves the right to rescind this special sign permit approval in the event of any violation of the terms of the applicable zoning laws. Any such decision shall be preceded by notice to the applicant and a public hearing and shall be based on specific findings. Blum PO Box 1400 Huntington Beach, CA 92647 Property Owner: Richard Nerio Bolsa Realty 9340 Bolsa Avenue Westminster, CA 92683 Request: To allow a game center consisting of a maximum of seven (7) video games, in conjunction with an existing restaurant known as "Classic Pizza" pursuant to Section 23 0.3 8 of the Huntington Beach Zoning and Subdivision Ordinance Code. Location: 5205 Warner Kelli Klan, staff planner, stated that this was a request to allow a game center consisting of a maximum of seven (7) video games, in conjunction with an existing restaurant known as "Classic Pizza" pursuant to Section 230.38 of the Huntington Beach Zoning and Subdivision Ordinance Code. The subject site is located at 5205 Warner. Staff is recommending continuance to the March 15, 1995 Zoning Administrator meeting as the applicant had not been adequately notified of the public hearing. CONDITIONAL USE PERMIT NO. 95-10 WAS CONTINUED BY THE ZONING ADMINISTRATOR TO THE MARCH 15, 1995, ZONING ADMINISTRATOR MEETING. THE MEETING WAS ADJOURNED AT PM BY THE ZONING ADMINISTRATOR TO THE NEXT REGULARLY SCHEDULED MEETING OF THE ZONING ADMINISTRATOR ON WEDNESDAY, MARCH 15, 1995, AT 6:00 PM.
