REVIEW MINUTES: The minutes of August 24, September 7, and
December 7, 1994 (continued from the March 15, 1995 Zoning
Administrator meeting) were approved as submitted.

ITEM 1: TEMPORARY USE PERMIT NO.95-3

Request: To permit a temporary use permit for several sidewalk sales (a total of 30 days) at
Loehmann's Five Points Center.
Location: 18501-18691 Main Street
Jane Madera, staff planner, stated that this was request to permit a temporary use permit for
several sidewalk sales (a total of 30 days) at 18501-18691 Main Street in the Loehmann's Five
Points Center.
Staff stated that the request was for more tables and display racks than the code allows, therefore,
a temporary use permit is necessary. Staff stated that they have no problems with the dates
requested and all fire and health issues have been covered. Staff recommends approval with
findings and conditions.
THE PUBLIC HEARING WAS OPENED.
Sandra Lamperts, 18593 Main Street, applicant, stated she was in concurrence with staff
recommendations.
THE PUBLIC HEARING WAS CLOSED.
TEMPORARY USE PERMIT NO.95-3 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION
WITHIN TEN (10) CALENDAR DAYS.
FINDINGS FOR APPROVAL -TEMPORARY USE PERMIT NO. 95-3:
The temporary outdoor event will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity. Handicapped
access and fire lane clearance will be maintained throughout the site for the duration
of the event.
b. Property and improvements in the vicinity of such use of building. The event is a
temporary use.
2. The granting of Temporary Use Permit No. 95-3 will not adversely affect the General
Commercial Land Use designation of the General Plan of the City of Huntington Beach
which allows temporary outdoor events of this nature.
SPECIAL CONDITIONS OF APPROVAL:
The site plan received and dated February 8, 1995, shall be the conceptually approved
layout.

2.1 Outdoor display and sales may occur only on the following dates unless a change is
requested in writing and approved by the Community Development Director:
a. April 6, 7, and 8, 1995.
b. May 4, 5, and 6, 1995:
c. June 8, 9, and 10, 1995.
d. July 13, 14, and 15, 1995.
e. August 10, 11, and 12, 1995.
f. September 7, 8, and 9, 1995.
g. October 12, 13, and 14, 1995.
h. November 9, 10, and 11, 1995.
i. December 8, 9, and 10, 1995.
3. Fire access lanes shall be maintained. If fire lane violations occur and the services of the
Fire Department are required, the applicant will be liable for expenses incurred.
4. A minimum of 48 inches shall be maintained between the sales racks or displays and the
edge of sidewalk for handicapped access.
5. The applicant shall obtain all necessary Fire Department permits and comply with all
provisions of Article 32 of the Uniform Fire Code.
6. The applicant's request shall include necessary permits for temporary signs.
7. Fire extinguishers shall be provided in number and locations specified by the Fire
Department.
8. Stand by personnel shall be on site to safeguard premises.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
The event shall comply with all applicable provisions of the Ordinance Codes, Building
Division and Fire Department.
2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances
and standards.
The Zoning Administrator reserves the right to revoke Temporary Use Permit No. 95-3
if any violations of these conditions or the Huntington Beach Ordinance Code occurs.
4. The applicant shall submit all future temporary outdoor event applications a minimum of
ninety (90) days prior to the event. Failure to provide adequate notice shall result in
denial of the request.
