THE PUBLIC HEARING WAS, OPENED.
Takeo Vehara, applicant, stated'through an interpreter that they had planned the landscaping to
focus on the -maims ntxatice afi'd;;as buffers to the residential area. He also stated that they would
be placing stop -sign at�th6; ttance to avoid pedestrian conflicts. Mr. Vehara stated that they
would comply with all othe'rbdi ditiolis suggested by staff.
Bonnie Banino, adjacent resident,. was present to speak on three (3) items of concern. Her first
concern was that dust that would accumulate due to the planned turn -around area for delivery
trucks. In addition, she voiced concern of;all low bushes surrounding the property (presently and
planned) that could invite the settling of vagrants. Lastly, Mrs. Banino questioned the existing
"junk pile" that was currently on the property and asked that it be removed or screened from
sight. j
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE
REQUEST AND THE PUBLIC HEARING WAS CLOSED.
Mike Strange, Zoning Administrator, asked the applicant, to respond to Ms. Banino's concerns.
Mr. Vehara stated that gravel and crushed rock would be used to keep the dust down in the turn-
around area. He also stated,that delivery would be limited to 8:00 AM - 4:00 PM with
approximately five (5) trips a day. Mike Strange stated that the applicant could move the
Junk/debris to the east side and enclose/screen from view. Mr. Strange asked the applicant what
types of fertilization would be used. The applicant stated that slow release granules would be
used.
CONDITIONAL USE 'PERMIT NO. 95-24 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. HE, STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION
WITHIN TEN (10) CALENDAR DAYS.
FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO.95-24:
The establishment, maintenance and operation of the wholesale nursery in an Edison
Right;,pl':Way will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity because the
nursery stock and proposed shade houses will be set back 15 feet from abutting
residential property.
b. Property and improvements in the vicinity of such use because the office trailer and
parking area will be located at least 80 feet from the nearest residential property.

2. The granting of Conditional Use Permit No. 95-24 will not adversely affect the General
Plan of the City of Huntington Beach. The proposed wholesale nursery is consistent with
the goals and objectives of the Land Use designation of the General Plan which
encourages using Edison right of ways for agriculture. The existing bike trail will be
separated from the wholesale nursery entrance which is consistent with the Recreation
Element.
3. The proposed wholesale nursery will provide 10 parking spaces on -site and access will be
restricted to Atlanta Avenue which reduce and minimize parking and circulation impacts.
SPECIAL CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 95-24:
The site plan dated March 10, 1995 shall be the conceptually approved layout with the
following modifications:
a. Provide 10 on -site parking spaces on the east side of the site.
b. The bike trail shall be separated from the access road. Stops signs shall be
provided on the access road where Atlanta Avenue and the bike trail intersect.
Final design shall be subject to the approval of the Traffic Engineer.
c. The shade houses shall be set back 15 feet from the residential properties to the
west of the site.
d. Provide a turn around area for large delivery trucks.
2. A revised site plan shall be submitted depicting the modifications described above.
3. The Zoning Administrator shall be notified in writing if any changes in building height, or
setbacks. Building permits shall not be issued until the Zoning Administrator has reviewed
and approved the proposed changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be processed if the proposed
changes are of a substantial nature.
4. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing
sets submitted for plan check.
5. Prior to issuance of building permits for the office trailer and shade houses, the applicant
shall provide the following:
a. Submit and obtain approval of a grading plan from the Department of Public
Works.
b. Landscape improvement/maintenance/operation and irrigation plan to the Public
Works Department for review and approval

6. Fire Department Requirements:
a. Provide one 2Al0BC fire extinguisher for the office trailer.
b. Service roads and fire lanes, as determined by the Fire Department, shall be posted
and marked.
c. Fire access lanes shall be maintained. If fire lane violations occur and the services
of the Fire Department are required, the applicant will be liable for expenses
incurred.
7. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable
material, shall be disposed of at an off -site facility equipped to handle them.
8. The total entry area from the north wall to the south wall (both sides of the access road
and bike trail) from the east end of Atlanta to the lease site shall be landscaped and
maintained.
9. Additional landscaping such as oleanders 10 foot on center and/or 20 inch nursery stock
shall be provided along the adjacent residential boundaries.
10. Access shall be restricted through Atlanta Avenue.
11. Loud speakers, amplified bells and outdoor lighting shall be prohibited.
12. Hours of operation shall be limited to:
Monday through Saturday 7 am to 4 pm
13. Deliveries shall be limited to:
Monday through Friday 8 am to 4 pm
14. Roads within the nursery shall be covered with crushed asphalt or gravel.
15. The applicant shall be responsible for the removal and disposal of any materials dumped
on the City right of way east of the chain link gate (immediately east of Surge Lane) on
Atlanta Avenue. This condition shall be continuous for the length of the operation. Failure
to perform this task shall be grounds for revocation of this conditional use permit.
INFORMATION ON SPECIFIC CODE REOUIREMENTS
1. The development shall comply with all applicable provisions of the Ordinance Code,
Building Division, and Fire Department.

2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances
and standards.
3. The Zoning Administrator reserves the right to revoke Conditional Use Permit No. 95-24
if any violation of these conditions of the Huntington Beach Zoning and Subdivision
Ordinance occurs.
ITEM 2: CONDITIONAL USE PERMIT NO. 95-52
Applicant: Susan Parto
Property Owner: Joel Mayer, 3340 Ocean Park Boulevard, Santa Monica, CA 90405
Request: To establish a 2,250 square foot "Deli" restaurant with beer and wine sales.
Location: 5942 Edinger Avenue, #106 (Marina Village Center)
Robert Franklin, staff planner, stated that this was a request to establish a 2,250 square foot
"Deli" restaurant with beer and wine sales at 5942 Edinger Avenue, #106 (Marina Village
Center), Staff presented site plans and explained that only interior modifications would be made.
It was also noted that the existing building was remodeled seven (7) years ago and that there is
surplus parking on -site. No negative comments were received from other departments and staff
recommended approval of this request with findings and conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Cyrus Parto, co -applicant, was present and stated they had no intention of serving wine and beer
at this time.
Mike Strange, Zoning Administrator, stated that since the beer and wine request was part of the
current request, the applicant would be wise to pursue approval to avoid re -submittal costs in the
future.
Kathy Fuller, property broker, stated this request would be a good addition to the City and
encouraged approval.
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE
REQUEST AND THE PUBLIC HEARING WAS CLOSED.

a. The general welfare of persons residing or working in the vicinity because the
building is properly designed for the use and ample parking is provided.
b. Property and improvements in the vicinity of such use because the restaurant will
be located in a building which is separated and is located at least 300 feet from
residential properties.
2. The granting of Conditional Use Permit No. 95-52 will not adversely affect the General
Plan of the City of Huntington Beach. The proposed restaurant is consistent with the
goals and objectives of the commercial Land Use designation of the General Plan.
SPECIAL CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 95-52:
The site plan and floor plans June 6, 1995 shall be the conceptually approved layout.
2. Prior to issuance of building permits for tenant improvements, check with the Building and
Fire Departments for technical requirements.
3. Submit a copy of the Alcohol Beverage Control permit for the file.
4. Traffic Impact Fees shall be paid at the time of final inspection or certificate of occupancy.

ITEM 3: USE PERMIT NO.94-85
Applicant: Donald L. DeLong

Request: To permit the installation of electronic sliding security gates at the
Huntington Highlander Apartments.
Location: 16162 Sher Lane (between Sher and Parkside, approximately 800 feet
south of Edinger)
Jane Madera, staff planner, recommended continuance on the grounds that only one-half (1/2) of
the area residents were sent the legal notification regarding this hearing (notification will be re -
mailed), as well as the applicant's request to submit additional plans/revisions.
THE PUBLIC HEARING WAS OPENED.
Gloria Herr, an adjacent property owner, was present to speak but will hold all comments until
the hearing has been rescheduled.
THE PUBLIC HEARING WAS CONTINUED TO THE AUGUST 23, 1995 ZONING
ADMINISTRATOR MEETING.
THE MEETING WAS ADJOURNED AT 2:30 P.M. BY THE ZONING
