PUBLIC HEARING ITEMS B-1 APPEAL OF COASTAL DEVELOPMENT PERMIT NO. 95-2/USE PERMIT NO. 95-2/ VARIANCE NO. 95-7: APPLICANT: Jeff Bergsma APPELLANT: Planning Commissioner Ed Kerins LOCATION: 16600 Pacific Coast Highway (previously addressed as 3166 Admiralty Drive, at the southeast corner of Pacific Coast Highway and Admiralty Drive Transmitted for Planning Commission consideration is an appeal by Ed Kerins, Planning Commissioner, City of Huntington Beach, of the Zoning Administrator's approval of Use Permit No. 95-4, Variance No. 95-7, and Coastal Development Permit No. 95-2. The appeal letter notes concern with the lack of compliance with the parking standards and insufficient mitigation measures for the properties to the rear of the restaurant site. Use Permit No. 95-4 and Coastal Development Permit No. 95-2 are requests to establish a restaurant on a vacant commercial site within the coastal zone previously used as a bank. The proposed restaurant consists of 2;700 square feet with a 1,380 square feet outdoor dining area and will include the sale of beer and wine beverages. Hours of operation will be 6:30 am to 10:00 p.m. daily. Variance No. 95-7 requests 56 parking spaces in lieu of 68, an outdoor dining deck at an 18 feet front setback and 15 feet side setback in lieu of 50 feet, and to allow an existing planter at 3 feet 6 inches wide in lieu of 6 feet wide. STAFF RECOMMENDATION: Staff recommends the Planning Commission uphold the Zoning Administrator's action and approve Use Permit No. 95-4, Variance No. 95-7, and Coastal Development Permit No. 95-2 because: • The conditions of approval imposed for this project will ensure compatibility with the adjacent residential development. s The existing parking lot and Tiburon Place provide a buffer between the restaurant and the residential properties. • The site is adjacent to a bus route and a bicycle route which reduce the parking demand for vehicles. The Design Review Board has reviewed and approved the proposed elevations after determining they are compatible with surrounding structures. • A traffic study has been submitted supporting a parking ratio of 0.3 parking spaces per seat for a total of 56 parking spaces. PC Minutes - 8/8/95 2 (p=034) • The lot configuration is irregular in shape and restricts the addition of more parking on -site or maintaining minimum planter width. • The encroachments into front and exterior side setbacks are minor in nature; only corner portions of the outdoor dining area do not maintain the minimum fully landscaped setback. THE PUBLIC HEARING WAS OPENED. Jeff Bergsma, 924 Main Street, applicant, stated that the request was to utilize the existing area for a patio addition on Pacific Coast Highway, away from the residential area with a screening wall for noise. Mr. Bergsma stated the variance was requested because of the hardship caused by the triangular lot. Jay Buettner, 17182 Sandra Lee Street, property owner, presented a folder to the Planning Commission containing a Letter of Intent that had been sent to the neighbors. Mr. Buettner stated that they were making every effort to be good neighbors. Jay Nomura, 16622 Tiburon, adjacent resident, spoke in opposition to the request due to concerns regarding excessive noise that would be generated by a restaurant. Philip Lupton, 16021 Santa Barbara Lane, adjacent resident, spoke in support of the request, stating that currently the site is unmaintained and unsightly. Mr. Lupton felt the restaurant would be a good addition to the harbor area. Al Kile, 16618 Tiburon, adjacent resident, spoke in opposition to the request with concerns of excessive noise and increased traffic. Stan Sorensen, 16642 Tiburon, adjacent resident, strongly opposed the site being used as a restaurant. Bonnie Collins, 16626 Tiburon, adjacent resident, spoke in opposition to the request with concern for excessive noise, traffic and smells. Richard Collins, 16626 Tiburon, adjacent resident, spoke in opposition to the request. Diane Sorensen, 16642 Tiburon, spoke in opposition to the request with concerns regarding insufficient parking. Roy Thomas, 3311 Admiralty Drive, adjacent resident spoke in support of the proposed use. Paul V. Lindstrom, 16632 Tiburon, adjacent resident, requested that the statements made in the applicant's Letter of Intent be incorporated into the conditions of approval if this request were to be approved. PC Minutes - 8/8/95 3 (pcm034) Dianne Easterling, spoke in opposition to the request. John R. Buettner, 17202 Sims Street, applicant, stated that this was a family business and will make every effort to meet the concerns of the adjacent residents. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. Commissioner Kerins, appellant, stated that he appealed this project because it does not meet the parking standards of the City of Huntington Beach and the mitigation measures for the properties to the rear of the restaurant are inadequate. Commissioner Kerins stated that if this project were to be approved, he would like the following conditions incorporated: — The row of trees be extended the whole length of the fence along Tiburon, with repairs made to the existing fence. — The rear doors shall be closed at all times. — No outside music/speakers. — The parking lot will be chained when the restaurant is closed. — No sit-down bar area. — No truck deliveries prior to 7:00 AM and no deliveries on Saturday and Sunday. Commissioner Kerins suggested that this item be continued to allow the applicant to comply with City standards. Commissioner Biddle agreed with Commissioner Kerins regarding a continuance and made a motion to do so, Commissioner Kerins seconded. After further discussion the motion and the second were withdrawn. After further discussion the Commission agreed on approval if the above conditions were met, with the addition of adding the conditions in the Letter of Intent, a six (6) month review by the Commission and a 950 square foot outdoor dining area. The request to establish a 3,650 square foot restaurant, as modified, with outdoor dining and beer and wine sales conforms with the plans, policies, requirements and standards of the Coastal Element of the General Plan. 2. Coastal Development Permit No. 95-2 with variances granted for 56 parking spaces in lieu of 61 required parking spaces, encroachment into front and exterior side setback, and a three (3) foot, six and one-half (6-1/2) inch planter in lieu of six (6) foot is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Local Coastal Program applicable to the property. The proposed development will conform with all applicable City codes and is compatible with the single family homes in the neighborhood because of the conditions of approval imposed for this project. 3. At the time of occupancy, the proposed restaurant will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. All infrastructure currently exist to the site. 4. The proposed restaurant conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. The proposed restaurant will have no impact on public access to coastal areas and will have no effect on public recreation policies. FINDINGS FOR APPROVAL - USE PERMIT NO. 95-4: Use Permit No. 95-4 for a 3,650 square foot restaurant, as modified, with outdoor dining and beer and wine sales will not be detrimental to the general welfare of persons residing or working in the vicinity or property and improvements in the vicinity of such use or building because: The existing parking lot and Tiburon Place provide a buffer between the restaurant and the residential properties to the north. b. The site is adjacent to a bus route and a bicycle route which reduce the parking demand for vehicles. The Design Review Board has reviewed and approved the proposed elevations after determining they are compatible with surrounding structures. 2. The site is adjacent to a bus route and a bicycle route which reduce the parking demand for vehicles. b. A traffic study has been submitted supporting a parking reduction for a total of 56 parking spaces. 2. Because of special circumstances applicable to the subject property, including size, shape, location or surroundings, the strict application of the Zoning Ordinance is found to,deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. a. The lot configuration is irregular in shape and restricts the addition of more parking on -site or maintaining minimum planter width. b. The encroachments into front and exterior side setbacks are minor in nature; only corner portions of the outdoor dining area do not maintain the minimum fully landscaped 25 foot setback. 3. The granting of Variance No. 95-7 will not adversely ani ct t;;c General Plan of the City of Huntington Beach. The variances support visitor -serving commercial activity within the coastal zone. CONDITIONS OF APPROVAL: The site plan dated May 31, 1995, and floor plans and elevations received and dated April 20, 1995, shall be the conceptually approved layout with the following modifications: a. The outdoor dining area shall not exceed 950 square feet. b. The bar area shall be replaced with a dining area/counter. The "compact only" stalls shall be relocated to front Pacific Coast Highway to the maximum extent possible with no loss of parking spaces. PC Minutes - 8/8/95 6 (p=034) 2. Prior to submittal for building permits, the applicant/owner shall complete the following: a. A revised site plan and floor plan reflecting Condition No. 1 above shall be submitted to the Department of Community Development. b. Elevations shall depict colors and building materials as approved by the Design Review Board. C. All rooftop mechanical equipment shall be screened from any view. Said screening shall be architecturally compatible with the building in terms of materials and colors. If screening is not designed specifically into the building, a rooftop mechanical equipment plan must be submitted showing screening and must be approved. d. If outdoor lighting is included, high-pressure sodium vapor -lamps or similar energy savings lamps shall be used. All outside lighting shall be directed to prevent "spillage" onto adjacent properties and shall be noted on the site plan and elevations. e. The site plan shall include (or reference page) all conditions of approval imposed on the project printed verbatim. 3. Prior to issuance of building permits, the applicant/owner shall complete the following: a. A Landscape Construction Set must be submitted to the Departments of Community Development and Public Works and must be approved. The Landscape Construction Set shall include a landscape plan prepared and signed by a State Licensed Landscape Architect and which includes all proposed/existing plan materials (location, type, size, quantity), an irrigation plan, a grading plan, an approved site plan, and a copy of the entitlement conditions of approval. The landscape plans shall be in conformance with Chapter 233 of the Huntington Beach Zoning and Subdivision Ordinance. The set must be approved by both departments prior to issuance of building permits. Any existing mature trees that must be removed shall be replaced at a 2 to 1 ratio with minimum 36-inch box trees, which shall be incorporated into the project's landscape plan. The plans shall include a row of trees adjacent to the rear property line along the entire fence length on Tiburon Place and adjacent to the interior property line to provide a buffer between the restaurant site and the residential uses. PC Minutes - 8/8/95 7 (p=034) b. A grading plan shall be submitted to the Department of Public Works for review and it must be approved (by issuance of a grading permit). A plan for silt control for all water runoff from the property during construction and initial operation of the project may be required if deemed necessary by the Director of Public Works. C. All applicable Public Works fees shall be paid. 4. The Public Works Department Requirements are as follows: a. The water system shall conform to the City of Huntington Beach Water Division's design criteria, standards plans and specifications. b. Remove existing driveway on Admiralty Drive and construct curb, gutter and sidewalk. C. Construct radius type driveway on Admiralty Drive per Public Works Standards. d. An encroachment permit shall be re:�:::. c:u for an work within public right- of-way. e. Applicant shall obtain any necessary CalTrans permits. 5. Fire Department requirements are as follows: a. Fire extinguishers shall be placed in areas to comply with the Huntington Beach Fire Code Standards. b. Address numbers shall be installed to comply with City Specification 4428. The size of the numbers will be a minimum six (6) inches with a brush stroke of one and'one-half (1-1/2) inches. C. Exit signs and low level exit signs shall be provided in rmmnlisnce with Huntington Beach Fire code and 1 itie 24 of the California Administrative Code. 6. No flags, signs, banners, or pennants shall be attached to the steel cables or pipe columns. 7. Sale of alcoholic beverages shall be restricted to beer and wine only. Prior to the sale of alcoholic beverages, a copy of the Alcoholic Beverage Control Board (ABC) license, along with any special conditions imposed by ABC, shall be submitted to the Department of Community Development. Any conditions that are more restrictive than those set forth in this approval shall be adhered to. 9. Hours of operation shall be limited to between 6:30 AM to 10:00 PM daily. There shall be no use of trash area after 10:00 PM. 10. No live entertainment shall be permitted. 11. A maximum of two (2) speakers shall be permitted outside and shall be located on the deck area. Use of outside speakers shall be limited to 9:00 AM until 10:00 PM. 12. Rear doors shall remain closed at all times. 13. The parking lot shall be secured by cable/chain when the restaurant is closed. 14. No truck deliveries prior to 7:00 AM Monday -Friday. No truck deliveries shall be allowed on -site on Saturday or Sunday. 15. The applicant shall repair and paint the adjacent fence along Tiburon Place. 16. All signs shall comply with Chapter 233 of the Zoning and Subdivision Ordinance. 17. Landscape areas within the public right-of-way shall be maintained by the property owner along with the on -site landscaped area's: 18. The applicant/restaurant shall utilize the existing two (2) inch water meter for landscape use and provide another meter for the restaurant use. Both meters shall be backflow units grouped together and screened with screen walls. Existing screen walls may be extended. 19. Existing palm trees to remain on -site shall have the dead fronds removed and shall be "cleaned up." 20. The applicant shall remove litter from the street and site on a daily basis. PC Minutes - 8/8/95 0 (p=034) 21. Prior to final building permit approval or issuance of a Certificate of Occupancy, the following shall be completed: a. Traffic Impact Fees shall be paid. b. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District and submit a copy to Community Development Department. C. The applicant shall restripe the parking lot so that it conforms to provisions of Chapter 231 of the Zoning and Subdivision Ordinance and Title 24 of the California Administrative Code. d. All improvements (including landscaping) to the propci-ty shall be completed in accordance with the approved plans and conditions of approval specified herein. Bicycle racks shall be provided for a minimum of ten (10) bicycles. f. The restaurant shall comply wAh current disabled access standards. g. Exiting of both intcricr and exterior dining areas shall conform to the Uniform Building Code. h. Occupant loads shall be posted for both interior and exterior dining areas. The applicant shall submit a completed elevation certificate verifying compliance with Chapter 222. Compliance with all conditions of approval specified herein shall be accomplished. 22. A review of the use with public hearing by the Planning Commission shall be conducted within six (6) months of the issuance of Certificate of Occupancy or final building permit approval to evaluate compatimmy issues and parking, and to verify compliance with all conditions of approval, and applicable chapters of the Huntington Beach Municipal Code. If at that time, there is a violation of these conditions or code sections, or problems have surfaced, Coastal Development Permit No. 95-2, Use Permit No. 95-4 and Variance No. 95-7 may become null and void. The development shall comply with all applicable provisions of the Municipal Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. Construction shall be limited to Monday -Saturday 7:00 AM to 8:00 PM. Construction shall be prohibited Sundays and Federal holidays. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 5. Installation of required landscaping and irrigation systems shall be completed prior to final inspection/within 12 months. 6. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 95-2, Use Permit No. 95-4 and Variance No. 95-7 if any violation of these conditions of the Huntington Beach Local Coastal Program or applicable provisions of the Huntington Beach Zoning and Subdivision Ordinance occurs. 7. Coastal Development Permit No. 95-2, Use Permit No. 95-4 and Variance No. 95- 7 shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Director pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. He also stated that the Seabridge Homeowners' Association had voted unanimously in favor of the amendment. Robert Eberly, 8202 Racepoint Drive, #103, Seabridge Homeowners' Association, spoke in support of the request. Bob Courtney, 20271 Seal Point Circle, #101, spoke in support of the request. Teddi Penewell, 20152 Bayfront lane, #203, President Seabridge Homeowners' Association, spoke in support of the request. Chuck Beauregard, 15691 Sunburst Lane, stated his support for the request. The proposed zoning text amendment to allow (a) 422 residential units (an increase of 22 units) on the east side of the flood control channel; (b) medium density residential development on a portion of 3.38 acres within Area A currently designated for Resource Production (01); (c) reuse of properties designated Resource Production (0) for parking and/or open space use; and (d) to make minor corrections to the text is consistent with the objectives of the Seabridge Specific Plan and the Planned Unit Development concept of the code in allowing for a development that has an integrated design and adapts to the terrain and compatibility of the surrounding environment; and is consistent with the Housing Element of the General Plan because it provides new housing opportunities. PC Minutes - 8/8/95 13 (p=034) 2. The proposed zoning text amendment is compatible with the uses authorized in, and the standards prescribed for, the Seabridge Specific Plan. The proposed zoning text amendment is compatible with the surrounding residential land uses because the increase in maximum allowable dwelling units from 776 to 798 is within the maximum 800 units anticipated in the Seabridge Specific Plan pursuant to Policy No. 5 of the Purpose section of the document. The Seabridge development will maintain a medium density residential design on the east side of the flood control channel. 3. A community need has been demonstrated for the proposed zoning text amendment. It will provide an opportunity for the aesthetic improvement, proper maintenance and reuse of the vacant, resource production area. It will allow for the development which would enhance and integrate with the entire Seabridge planned community. 4. Adoption of the proposed zoning text amendment Niil be in conformity with public convenience, general welfare and good zoning practice because allowed uses will be subject to conditional use permit approval and density of all residential development will average 14.6 units per acre for the entire 54.5 acre Seabridge Specific Plan area (including the residential, commercial and resource production areas). B-3 ZONING TEXT AMENDMENT NO. 95-4: APPLICANT: City of Huntington Beach, D cpai"Lii,ent of Community Development LOCATION: Not applicable appeal of a decision filed by a City Council Member or a Planning Commissioner. The amendment will change the appeal procedures to require a minimum of two City Council members or two Planning Commissioners to file, without fee, an appeal to a decision of the Director, Design Review Board, Environmental Assessment Committee, Subdivision Committee, Planning Commission, or Zoning Administrator. ZTA No. 95-4 was continued from the August 8, 1995, Planning Commission meeting to allow finalization of the draft ordinance. STAFF RECOMMENDATION: Staff recommends continuance of the reauest to allnnu staff additional time to complete the draft ordinance. Since its adoption in December of 1976, the General Plan has undergone incremental updates to reflect the changing needs of the city; however no comprehensive update has occurred since the initial adoption. Due to changing community needs, population makeup, laws and development patterns, the General Plan is being updated to reflect current conditions. The Planning Commission at the meeting of July 25, 1995, continued the public hearing open to the meeting of August 8, 1995. PC Minutes - 8/8/95 15 (p=034) Planning staff will continue to present the draft General Plan to the Planning Commission over the next several meetings. The draft General Plan contains 13 elements; six of which have been approved by straw votes at their meetings of July 18 and 25, 1995. Three additional elements (Economic Development, Recreation and Community Services, Environmental Hazards) are presented for your review tonight. The remaining four elements will be presented over the next several Planning Commission meetings. -The review of the draft General Plan will not include the Housing, Coastal, and Growth Management Elements. These three elements will be updated at a later date. It is anticipated that the review of the entire draft General Plan will require a minimum six public hearings. Additional meetings may be scheduled as warranted. STAFF RECOMMENDATION: Staff recommends that the planning Commission hear public testimony, take straw votes on the draft elements and continue the public hearing opened to the next scheduled Planning Commission meeting of August 22, 1995. THE PUBLIC HEARING WAS OPENED. Recreation and Community Services Element Chuck Beauregard, 15691 Sunburst Lane, stated that he would like to see the Parks . Commission review the Recreation and Community Services Element and give a recommendation. He also stated that he thinks a Master Plan for sports fields should be created. Mike Shanley, 16412 Oakmont Lane, stated that he felt there has not been sufficient future planning for parks. Dona Ryan, 20871 Skimmer Lane, Community Service Commission, stated that she would like to see more emphasize and reference made to sports and sports facilities within this Element. Jeff Metzel, 19391 Shady Harbor Circle. President Holly-Seacliff Homeowners Association, stated that he wished to see green zones redesignateu ab Shirley Carey, 21192 Brookhurst, stated she would like to see more designations for sports fields. Economic Development Element Robert London Moor, Jr., 18090 Beach Blvd., #6, stated that the Economic Development Element did not promote existing and new business issues enough. He gave the Commission his recommendations for change. Jim Mclaughlin, representing the HB/FV Association of Realtors, submitted a letter to the Commission with their proposed changes. The Commission requested that the Recreation and Community Services Element and the Economic Development Element be tabled until staff can update and return with recommendations of the proposed changes. PLANNING COMMISSION ITEMS/INOUIRIES Commissioner Kerins - requested staff to re -analyze the process of having night Zoning Administrator meetings on an as needed bases. Commissioner Kerins feels that certain items have not been held appropriately at a night meeting. Staff stated that they would analyze past meeting information and return with a report.
