ZONING ADMINISTRATOR: Michael Strange STAFF MEMBERS: Jane Madera, Mary Beth Ormsby, Lisa Koch MINUTES: Minutes of July 26, 1995 Approved ITEM 1: USE PERMIT NO.94-85 (CONTINUED_ FROM DULY 26, 1995 ZONING ADMINISTRATOR MEETING) Applicant: Donald L. DeLong Property Owner: Western National Group, IPS Management Incorporated, c/o Jana Sunderland, 630 The City Drive, #250, Orange, CA 92668 Request: To permit the installation of electronic sliding security gates at the Huntington Highlander Apartments. .Location: 16162 Sher Lane (between Sher and Parkside, approximately 800 feet south of Edinger) Jane Madera, staff planner, stated that this request was continued from the July 26, 1995 Zoning Administrator Meeting due to an error in the public notification process. It was noted that the allowance in time provided an opportunity for all individuals in the vicinity of Huntington Highlander Apartments to be properly notified. Ms. Madera stated that this request was to permit the installation of electronic sliding security gates at the Huntington Highlander Apartments, located between Sher Lane and Parkside Lane. The site plans were presented. Staff noted that the site plans have been reviewed extensively by the Fire Department and Traffic Engineering, resulting in the applicant's proposal to designate the south-west driveway on Sher Lane as an entrance only and the north-west driveway as an exit only. On Parkside Lane, the proposal designated the south-east driveway as an entrance only and the north-east driveway as an exit only. It was noted that one (1) parking space per side will be lost due to the installation of the gates and that a telephone entry system will be provided for guests, as well as a striped Zoning Administrator Meeting Minutes Page No. 2 turn -around area for those vehicles needing to turn around and exit the property. Ms. Madera stated that to alleviate concerns about the gates being closed during peak traffic hours, Traffic Engineering recommended that the gates be opened from 7:00 a.m. to 7:00 p.m. and that they be closed during the nighttime hours only. In response, Ms. Madera stated that the applicant requested the exit gates be allowed to remain closed at all times and that Traffic Engineering and staff accepted this request. Ms. Madera stated that the Fire Department reviewed the request and recommended several conditions of approval, the most crucial being that an OptiCom System be located at each entrance and exit. Public Works recommended a strongly worded condition that the 7:00 a.m. to 7:00 p.m. hours be maintained and the entrance gates not be closed during those hours due to the potential conflicts that could result in traffic. Ms. Madera noted that one (1) telephone call from an adjacent property owner was received stating concern with the tone of the telephone system. Ms. Madera stated that the applicant does have the ability to turn the tone off and that doing so would not affect the gates from working properly. Staff recommended approval of this request with conditions. THE PUBLIC HEARING WAS OPENED. Donald DeLong, applicant, clarified that the entrance gates would be electronic with a battery backup timer. Mr. DeLong stated that he would comply with all conditions of approval. Gloria Herr, adjacent property owner, was present to express her concern of possible noise generated from the telephone system and/or traffic that could negatively impact her apartment complex located at 7671 Amazon Drive. Mrs. Herr stated that she was not against the security gates, but asked that the telephone tones be eliminated or turned down. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. Mike Strange, Zoning Administrator, questioned Ms. Madera regarding stacking at each of the gate locations. Ms. Madera stated that by having the security gates opened during peak traffic hours, the potential stacking problem would be eliminated. USE PERMIT NO.94-85 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL - USE PERMIT NO. 94-85: 1. Use Permit No. 94-85 for the establishment, maintenance and operation of the electronic sliding security gates will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. With the conditions of approval imposed, the entrance gates will be open during peak traffic hours to prevent problem stacking and avoid the possibility of vehicles backing (min0823) Zoning Administrator Meeting Minutes Page No. 3 into the public right-of-way. Although the telephone entry system will be equipped with an audible tone, the conditions of approval will require that the tone be turned off at all times. b. Property and improvements in the vicinity of such use or building. The gates will help to deter crime in the area. In addition, all parking stalls lost as a result of gate installation will be replaced on site so that no on -street parking is impacted. 2. The granting of Use Permit No. 94-85 will not adversely affect the General Plan of the City of Huntington Beach. The electronic sliding security gates are consistent with the goals and objectives of the Residential Medium -High Density Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL -USE PERMIT 94-85: The site plan, floor plans, and elevations received and dated August 10, 1995 shall be the conceptually approved layout. 2. The telephone entry system shall be equipped so that no audible tone is emitted at any time. 3. The entrance gates shall remain open from 7:00 a.m. to 7:00 p.m. The exit gates may remain closed at all times as long as they automatically open when a vehicle drives over the triggering mechanism. 4. The telephone entry system shall be fully functioning between the hours of 7:00 p.m. to 7:00 a.m. to facilitate the entrance of guests into the site. If the entry system malfunctions for any reason, the gates shall be propped open until it is repaired. 5. Fire Department requirements: a. Gates shall comply with City Fire Code Specification No. 403. b. Gates shall have an "opticom" receiver that will open the gate by means of strobe light on fire apparatus. C. No spikes shall be installed on any gate. 6. The Zoning Administrator shall be notified in writing if any changes in fence height, setbacks, or gate operation are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. INFORMATION ON SPECIFIC CODE REQUIREMENTS 1. The development shall comply with all applicable provisions of the Huntington Beach Zoning and Subdivision Ordinance, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 94-85 if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance occurs. ITEM 2: , COASTAL DEVELOPMENT PERMIT NO. 95-10 Applicant: Anthony Thibert Property Owner: Arthur Hochschild, III, 4841 Curtis Circle, Huntington Beach, CA 92649 Request: To permit the construction of a new 4,859 square foot single-family residence (square footage includes garage, first, and second levels). .Location: 3322 Devon Circle (Admiralty Island, Huntington Harbor) Mary Beth Ormsby, staff planner, presented the site plans and stated that this was a request to permit the construction of a new 4,859 square foot two-story, single-family home at 3322 Devon Circle. Ms. Ormsby stated that the location of the residence is adjacent to water, thus the necessity for a Coastal Development Permit. Staff presented a map showing existing adjacent homes that are two-story, as well as homes across the channel that are two-story. Ms. Ormsby stated that the subject property meets the development standards for Rl Zoning in terms of setback, parking, and height. Staff determined the garage to be side -entry, thus the setback required would be ten (10) feet. Staff recommended approval of this request with suggested conditions, as it does not impact public access to or view of coastal areas. It was suggested that a grading plan be reviewed and approved by the Department of Public Works, that a backflow device be installed prior to final inspection, and that one (1), 36-inch box tree (or a palm equivalent) be provided. THE PUBLIC HEARING WAS OPENED. Anthony Thibert, applicant, stated that he would comply with the suggested conditions. In addition, Mr. Thibert noted that he has received approval from the Huntington Harbor Homeowners' Association. COASTAL DEVELOPMENT PERMIT NO. 95-10 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO. 95-10: The request to permit the demolition of an existing one-story single family residence and construction of a new two-story home conforms with the plans, policies, requirements and standards of the Coastal Element of the General Plan. The proposed 4,859 square foot single family residence will not impact public views or access as none currently exist in the vicinity. 2. Coastal Development Permit No. 95-10 is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. The proposed development will conform with all applicable City codes, such as maximum height, site coverage, setbacks and parking. 3. At the time of occupancy, the proposed construction of a new two-story single family residence will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. All infrastructure currently exists for the site; however a backflow device will be provided with the conditions of approval imposed. 4. The proposed construction of the two-story single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. No public access or recreational opportunities will be affected by the new construction. SPECIAL CONDITIONS OF APPROVAL: The site plan, floor plans, and elevations received and dated July 28, 1995 shall be the conceptually approved layout. 2. Prior to issuance of building permits, a grading plan shall be reviewed and approved by the Department of Public Works. 3. Prior to final inspection, the following shall be completed by the applicant: a. One 36 inch box tree, or the palm equivalent, shall be required in the front yard area. b. A backflow device shall be installed pursuant to Department of Public Works standards. (:min0823) Zoning Administrator Meeting Minutes Page No. 6 c. Automatic sprinkler systems will be installed throughout to comply with Huntington Beach Fire Department and Uniform Building code standards, including a two-inch water service, should square footage of the house and garage exceed 5,000 square feet. 4. All proposed cantilevered deck, dock and ramp improvements shall require separate permits for the improvements located within the public waterways. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 6. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 7. Low -volume heads shall be used on all spigots and water faucets. 8. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 9. Conditions of approval shall be printed verbatim on the cover sheet of all working drawings submitted for plan check. INFORMATION ON SPECIFIC CODE REQUIREMENTS 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. The applicant shall pay all applicable Public Works fees. 4. An encroachment permit shall be required for any work within the public right-of-way. 5. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 95-10 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. (:min0823) I� Zoning Administrator Meeting Minutes Page No. 7 ITEM 3: CONDITIONAL USE PERMIT NO.95-61 Applicant/ Property Owner: Elise M. Novak, 19082 Hamden Lane, Huntington Beach, CA 92646 Request: To permit an existing 50-inch tall gate enclosure to remain within one (1) foot of the front property line (maximum 42 inch height permitted or 15 foot setback required). Location: 19082 Hamden (east side of Hamden, south of Garfield) Mary Beth Ormsby, staff planner, stated that this was a request to permit an existing 50-inch tall gate within one (1) foot of the front property line. It was noted that the maximum height permitted is 42 inches; the existing gate exceeds the maximum height by eight (8) inches, thus the necessity for the Conditional Use Permit. Ms. Ormsby presented the site plan and photographs of the subject property and stated that the staff recommended approval of the request. It was noted that the applicant cares for an elderly, mentally -disabled relative and the gate ensures security to prevent the individual from walking into the public right-of-way. Ms. Ormsby noted that the gate swings inward, therefore, when open it will not obstruct the public sidewalk. Ms. Ormsby also stated that one (1) phone call was received regarding this request but that the call was to gain knowledge of the code requirements only. Staff noted that Building has required, upon condition of approval, that a building permit be applied for within 30 days and that the applicant provide a physical calculation showing the gate is structurally sound. In addition, staff recommended that to avoid obstructing visibility, no solid matter or vegetation be allowed to cover the gate. THE PUBLIC HEARING WAS OPENED. Elise Novak, applicant, stated that she would comply with all recommended conditions. Niko Babic, adjacent resident, was present and stated that in the ten (10) years he has lived in the neighborhood, Mrs. Novak has maintained the gate and there have been no negative impacts made. Richard Lorenz, the individual who made the phone call to staff, was present and stated that he had no problem with the subject property. Kathryn Babic, adjacent resident, was present and stated that no negative impact has resulted. Mrs. Babic noted that she supports Elise Novak's request. (:min0823) Zoning Administrator Meeting Minutes Page No. 8 CONDITIONAL USE PERMIT NO.95-61 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 95-61: Conditional Use Permit No. 95-61 for the establishment, maintenance and operation of a four (4) foot, two (2) inch wrought iron gate within one (1) foot of the front property line will not be detrimental to the general welfare of persons working or residing in the vicinity nor detrimental to the value of the property and improvements in the neighborhood. Approval of this request will permit the existing gate to remain and will increase the resident's privacy and security. The gate is only eight (8) inches above that allowed by the Huntington Beach Zoning and Subdivision Ordinance. The gate swings inward, thereby not obstructing pedestrial/vehicular traffic on the sidewalk. 2. The granting of Conditional Use Permit No. 95-61 will not adversely affect the General Plan of the City of Huntington Beach. The gate is consistent with the goals and objectives of the Low Density Residential Land Use designation of the General Plan. 3. The proposed use will comply with the provisions of the base district and other applicable provisions in Titles 20-25 and any specific condition required for the proposed use in the district in which it would be located. Deviations in the height of walls and fences is allowed with the approval of a conditional use permit. SPECIAL CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO.95-61: The site plan, floor plans, and elevations received and dated July 10, 1995 shall be the conceptually approved layout. 2. The applicant shall submit for a building permit within 30 days of the end of the appeal period. The building permit shall be finaled within 90 days of the end of the appeal period. 3. Vegetation or solid materials shall not be placed on the wrought iron fence so as to not obstruct site visibility. 4. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing sets submitted for plancheck. 5. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature.
