ITEM 1: USE PERMIT NO. 95-10
Applicant: Lawson Landscape Service
Property Owner: Southern California Edison, 14803 Chestnut Street, Westminster, CA
92683
Request: To establish a landscape maintenance operation at an existing wholesale
nursery site.
]Location: 8260 Hamilton Avenue (south side of Hamilton approximately 1,000 feet
east of Newland Street)
Robert Franklin, staff planner, stated that this was a request to establish a landscape maintenance
operation at an existing wholesale nursery site. The site plans were shown and Mr. Franklin
stated that the request includes the provision of 33 additional parking spaces and landscaping.
Mr. Franklin noted that the Building Division reviewed the site plans and requires that if any
structures are to be added/constructed, the applicant must comply with handicapped standards.
Additionally, the Fire Department requires that fire extinguishers be provided with any added
structures and that all fire lanes be maintained. Lastly, it was noted that the Parks, Tree and
Landscape Division requires the frontage of the property line along Hamilton Avenue to be
landscaped. Mr. Franklin stated that the request is compatible with the General Plan and staff
recommends approval of the request with suggested conditions. Mr. Franklin noted that a revised
site plan, showing the parking spaces at nine (9) feet by 19 feet, must be submitted prior to final
inspection.

THE PUBLIC HEARING WAS OPENED,
Rod Hans was present to speak on behalf of Lawson Landscape Service. Mr. Hans stated that
there are no plans for additional trailers to be put on site. It was also noted that Lawson
Landscape Service would comply with all suggested conditions.
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE
REQUEST AND THE PUBLIC HEARING WAS CLOSED.
Mike Strange, Zoning Administrator, stated that an additional condition shall be added which
states that all employees must park on site.
USE PERMIT NO. 95-10 WAS APPROVED BY THE ZONING ADMINISTRATOR
WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE
STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE
APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR
DAYS.
FINDINGS FOR APPROVAL - USE PERMIT NO. 95-10:
1. The establishment, maintenance and operation of the landscaping service will not be
detrimental to the general welfare of persons residing or working in the vicinity nor
detrimental to the value of the property and improvements in the neighborhood because 33
on -site parking spaces will be provided which will eliminate the need for street parking.
2. The approval of Use Permit No. 95-10 will not adversely affect the General Plan of the
City of Huntington Beach because agricultural uses are encouraged in Edison utility areas.
3. The proposed use will complies with the provisions of the General Industrial zoning
designation and other applicable provisions in Titles 20-25 and any specific condition
required for the proposed use in the district in which it would be located.
SPECIAL CONDITIONS OF APPROVAL - USE PERMIT NO. 95-10:
The site plan, floor plans, and elevations received and dated June 28, 1995 shall be the
conceptually approved layout except of the following modifications:
Resubmit a site plan which depicts all parking spaces 9 feet by 19 feet.
b. Comply with State handicap requirements.
2. A landscape and irrigation plan for the Hamilton Avenue frontage shall be submitted to the
Department of Public Works for review and approval.
3. Installation of required landscaping and irrigation systems shall be completed within three
(3) months from the approval date of the landscape plans.

4. Fire Department Requirements:
a. Service roads and fire lanes, as determined by the Fire Department, shall be posted
and marked.
b. Fire access lanes shall be maintained. If fire lane violations occur and the services
of the Fire Department are required, the applicant will be liable for expenses
incurred.
c. Provide fire extinguishers for all buildings per the Huntington Beach Fire Code.
All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable
material, shall be disposed of properly.
INFORMATION ON SPECIFIC CODE REQUIREMENTS
The proposed use shall comply with all applicable provisions of the Huntington Beach
Zoning and Subdivision Ordinance, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances,
and standards.
3. The Zoning Administrator reserves the right to revoke Use Permit No. 95-10 if any
violation of these conditions of the Huntington Beach Zoning and Subdivision Ordinance
occurs.
ITEM 2: COASTAL DEVELOPMENT PERMIT NO. 95-11 / USE PERMIT NO. 95-12
Applicant: The Louie Group
Property Owner: Ed Evans, Trustee, 1055-B Ortega Way, Placentia, CA 92670
Request: To permit the construction of a new 3,130 square foot single family home
(square footage includes garage, first, second and third levels and a 230
square foot deck on the third level).
Location: 3372 Gilbert Drive (Gilbert Island, Huntington Harbor)
Mary Beth Ormsby, staff planner, stated that this request was to permit the construction of a new
3,130 square foot single family home. Ms. Ormsby noted that the subject property is located in a
coastal zone, thus requiring a coastal development permit. In addition, the proposed third story
and elevation of the home result in the need for a use permit. Site plans were shown and it was
noted that the request conforms with the zoning code. Ms. Ormsby stated that the requested plan
has not yet been approved by the Huntington Homeowners' Association due to concern over the

32 foot height of the tower but that the height is less than that allowed by code. Ms. Ormsby also
noted that the pad height is 1.5 to 2 feet lower than the street. Thus, the height of the structure
from top of curb will be approximately 30 feet. Ms. Ormsby stated that staff recommends
approval of this request with suggested conditions because the project will not block coastal
views or access. Staff suggested that a backflow device be installed pursuant to the Department
of Public Works standards, that prior to issuance of building permits a grading plan be reviewed
and approved by the Department of Public Works, that one (1) 36 inch box tree be required in the
front yard area, and that an encroachment permit be required for any work done within the public
right-of-way.

Louie Hernandez was present to speak on behalf of the Louie Group. Mr. Hernandez stated that
he would comply with the staffs suggested conditions.

COASTAL DEVELOPMENT PERMIT NO.95-11 / USE PERMIT NO. 95-12 WAS
APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING
FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION
TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE
PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS.
FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO. 95-11:
1. The request to permit the construction of a three-story single family residence conforms
with the plans, policies, requirements and standards of the Coastal Element of the General
Plan. The proposed 3,130 square foot residence will not impact public views or access, as
none currently exist in the vicinity.
2. Coastal Development Permit No. 95-11 is consistent with the CZ suffix zoning
requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach
Ordinance Code applicable to the property. The proposed development will conform with
all applicable City codes, such as maximum height, site coverage, setbacks and parking.
3. At the time of occupancy, the proposed construction of a three-story single family
residence will be provided with infrastructure in a manner that is consistent with the
Coastal Element of the General Plan. All infrastructure currently exist to the site,
however, a backflow device will be provided with the Conditions of Approval imposed.
4. The proposed construction of a three-story single family residence conforms with the
public access and public recreation policies of Chapter 3 of the California Coastal Act. No
public access or recreational opportunities will be affected by the new construction.

FINDINGS FOR APPROVAL - USE PERMIT NO.95-12:
1. The establishment, maintenance and operation of the single-family residence will not be
detrimental to the general welfare of persons residing or working in the vicinity nor
detrimental to the value of the property and improvements in the neighborhood. The use
is compatible with other single-family residences in the vicinity. The third story deck is
situated in the center of the structure and will not impact the houses on either side of the
subject property.
2. The granting of Use Permit No. 95-12 will not adversely affect the General Plan of the
City of Huntington Beach. The use is consistent with the Residential Low Density land
use designation.
3. The proposed use will comply with the provisions of the base district and other applicable
provisions in the Huntington Beach Ordinance Code and any specific condition required
for the proposed use in the district in which it would be located.
SPECIAL CONDITIONS OF APPROVAL - COASTAL DEVELOPMENT PERMIT NO.
95-11 / USE PERMIT NO.95-12:
1. The site plan, floor plans, and elevations received and dated August 3, 1995 shall be the
conceptually approved layout.
2. Prior to issuance of building permits, a grading plan shall be reviewed and approved by the
Department of Public Works.
Prior to final inspection, the following shall be completed by the applicant:
a. One 36 inch box tree, or the palm equivalent, shall be required in the front yard area.
b. A backflow device shall be installed pursuant to Department of Public Works
standards.
c. Automatic sprinkler systems will be installed throughout to comply with Huntington
Beach Fire Department and Uniform Building code standards, including a two-inch water
service, should square footage of the house and garage exceed 5,000 square feet.
4. All proposed cantilevered deck, dock and ramp improvements shall require separate
permits for the improvements located within the public waterways.
5. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable
material, shall be disposed of at an off -site facility equipped to handle them.
6. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and
central heating units.

7. Low -volume heads shall be used on all spigots and water faucets.
8. The Zoning Administrator shall be notified in writing if any changes in building height,
floor area, setbacks, building elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the Zoning Administrator has
reviewed and approved the proposed changes. The Zoning Administrator reserves the
right to require that an amendment to the original entitlement be processed if the proposed
changes are of a substantial nature.
9. Conditions of approval shall be printed verbatim on the cover sheet of all working
drawings submitted for plan check.
INFORMATION ON SPECIFIC CODE REQUIREMENTS
The development shall comply with all applicable provisions of the Ordinance Code,
Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances,
and standards.
3. The applicant shall pay all applicable Public Works fees.
4. An encroachment permit shall be required for any work within the public right-of-way.
5. The Zoning Administrator reserves the right to revoke Coastal Development Permit No.
95-11/Use Permit No. 95-12 if any violation of these conditions of the Huntington Beach
Ordinance Code occurs.
