MINUTES: None
ORAL COMMUNICATON: Mary Beth Broeren stated that on September 6, 1995 the Zoning
Administrator took action and conditionally approved Conditional
Use Permit No. 95-71. Because the applicant was not able to
attend the Zoning Administrator meeting, the applicant has
requested that it be rescheduled for a reconsideration hearing.
Mary Beth Broeren stated that staff does not yet have a
recommendation on the reconsideration.
Mike Strange, Zoning Administrator, stated that Conditional Use
Permit No. 95-71 shall be rescheduled for public hearing and
reconsideration.
ITEM 1: CONDITIONAL USE PERMIT NO. 95-69
Applicant: Robert Hidey Architects
Property Owner: Honeybaked Hams, 29 Musick, Irvine, CA 92718
Request: To permit a 1,149 square foot restaurant in conjunction with the existing
3,200 square foot Honeybaked Hams retail store. The proposed dining
area will occupy a vacant suite adjacent to the retail store.
Location: 19022 Beach Boulevard (east side of Beach Boulevard, approximately 100
feet south of Garfield Avenue)
Wayne Carvalho, staff planner, stated that this was a request to establish a restaurant within an
existing 3,200 square foot Honeybaked Hams retail store. Mr. Carvalho noted that the 1,149

square foot restaurant would stand alone, occupying a vacant suite adjacent to the retail store.
Staff stated that there is surplus parking on site, having 39 parking spaces on the property. It was
noted that Building Division would require handicapped access to the suite, as well as provide an
additional restroom. Staff recommended that the tree that was removed from the front landscape
planter be replaced within the landscape planter along Beach Boulevard prior to final inspection.
Mr. Carvalho noted that staff recommended approval of this request.
THE PUBLIC HEARING WAS OPENED.
Darryl Cartozian, a representative of Robert Hidey Architects, was present and stated that they
would comply with all recommended conditions.
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE
REQUEST AND THE PUBLIC HEARING WAS CLOSED.
Mike Strange, Zoning Administrator, questioned staff as to what type of tree should be planted.
Mr. Carvalho noted that the applicant should speak with the Parks, Tree, and Landscape Division
as to the types of trees that would be acceptable.
CONDITIONAL USE PERMIT NO.95-69 WAS CONDITIONALLY APPROVED BY
THE ZONING ADMINISTRATOR. HE STATED THAT THE ACTION TAKEN BY
THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING
COMMISSION WITHIN TEN (10) CALENDAR DAYS.
FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO.95-69:
1. The establishment, maintenance and operation of the 1149 sq.ft. restaurant will not be
detrimental to the general welfare of persons residing or working in the vicinity nor
detrimental to the value of the property and improvements in the neighborhood. The
restaurant will occupy a vacant suite adjacent to two other retail businesses and will not
impact residences to the east.
2. The granting of Conditional Use Permit No. 95-69 will not adversely affect the General
Plan of the City of Huntington Beach. The restaurant use is consistent with the
Commercial General Land Use designation of the General Plan.
3. The proposed restaurant use will comply with the provisions of the base district
(Commercial General) and other applicable provisions in Titles 20-25 and any specific
condition required for the proposed use in the district in which it would be located.
CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 95-69:
1. The site plan, floor plans, and elevations received and dated July 28, 1995 shall be the
conceptually approved layout.

2, The Zoning Administrator shall be notified in writing if any changes in building height,
floor area, setbacks, building elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the Zoning Administrator has
reviewed and approved the proposed changes. The Zoning Administrator reserves the
right to require that an amendment to the original entitlement be processed if the proposed
changes are of a substantial nature.
3. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing
sets submitted for plancheck.
4. All rooftop mechanical equipment shall be screened. A rooftop mechanical equipment
plan shall be submitted depicting the method of screening.
5. All utility apparatuses such as but not limited to backflow devices and Edison
transformers, shall be prohibited in the front yard and exterior sideyards unless properly
screened by approved landscaping or any other method approved by the Director of
Planning. All such apparatuses shall be depicted on the site plan prior to issuance of
building permits.
6. A minimum 36 inch box tree shall be replaced along Beach Boulevard as required by the
Huntington Beach Zoning and Subdivision Ordinance. The type and location of the tree
shall be approved by the Departments of Public Works and Community Development
prior to installation.
7. Fire Department Requirements:
a. Exit signs and exit path markings shall be provided in compliance with the
Huntington Beach Fire Code and Title 24 of the California Administrative Code
including low level exit signs.
b. An automatic fire sprinkler system shall be required for all commercial cooking
equipment pursuant to Fire Department regulations.
Building Division requirements:
a. The restaurant shall comply with the State Handicapped Regulations. Access for
disabled is required from the public way to the entrance and within the building.
b. Two restrooms shall be required.
c. Access from the parking lot to the entry of the building shall be depicted on the
plan.

10. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable
material, shall be disposed of at an off -site facility equipped to handle them.
INFORMATION ON SPECIFIC CODE REQUIREMENTS
1. The development shall comply with all applicable provisions of the Huntington Beach
Zoning and Subdivision Ordinance, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances,
and standards.
3. The applicant shall obtain the necessary permits from the South Coast Air Quality
Management District.
4. All applicable Public Works fees shall be paid prior to issuance of building permits.
5. The Zoning Administrator reserves the right to revoke Conditional Use Permit No. 95-69
if any violation of these conditions of the Huntington Beach Zoning and Subdivision
Ordinance occurs.
ITEM 2: USE PERMIT NO.95-11
Applicant: Ruby's Diner, Inc.
Property Owner: City of Huntington Beach, 2000 Main Street, Huntington Beach, CA
92648
Request: To permit alcoholic beverage sales within a previously approved restaurant
(Ruby's Diner) to be located at the end of the Municipal Pier.
Location: 1 Main Street (end of Municipal Pier)
Wayne Carvalho, staff planner, stated that this request was to permit beer and wine sales within a
previously approved restaurant (Ruby's Diner) to be located at the end of the Municipal Pier, Mr.
Carvalho noted that there were no calls or letters in opposition of this request received and that
staff recommends approval.
THE PUBLIC HEARING WAS OPENED.

REQUEST AND THE PUBLIC HEARING WAS CLOSED.

Mike Strange, Zoning Administrator, questioned Mr. Carvalho as to the type of liquor license that
Ruby's Diner obtained. Mr. Carvalho stated that Ruby's Diner obtained a Type 41-Beer and
Wine License and that all alcoholic beverages must remain within the restaurant.
USE PERMIT NO. 95-11 WAS APPROVED BY THE ZONING ADMINISTRATOR
WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE
STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE
APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR
DAYS.
FINDINGS FOR APPROVAL - USE PERMIT NO. 95-11:
The sale of alcoholic beverages will not be detrimental to the general welfare of persons
residing or working in the vicinity nor detrimental to the value of the property and
improvements in the neighborhood. Alcohol sales and consumption will only occur within
the restaurant which has previously been approved for the site.
2. The granting of Use Permit No. 95-11 for alcohol sales will not adversely affect the
General Plan of the City of Huntington Beach. The restaurant use including sale and
consumption of alcohol is consistent with the Open Space -Recreation Land Use
designation of the General Plan by providing recreation and visitor serving facilities.
SPECIAL CONDITIONS OF APPROVAL - USE PERMIT NO. 95-11:
The site plan, floor plans, and elevations received and dated July 20, 1995 shall be the
conceptually approved layout.
2 Prior to alcohol sales, a copy of the approved Alcoholic Beverage Control (ABC) license
shall be submitted to the Department of Community Development for inclusion in the
entitlement file.
INFORMATION ON SPECIFIC CODE REQUIREMENTS
The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances,
and standards.
2. The Zoning Administrator reserves the right to revoke Use Permit No. 95-11 if any
violation of these conditions of the Huntington Beach Zoning and Subdivision Ordinance
occurs.
