REQUEST: Establish live entertainment (one person stage and karaoke
machine) in an existing night club.
LOCATION: 16391 Beach Blvd. (existing Alin night club located at the
southwest corner of Beach Blvd. and Glencoe Avenue)
The owner of the Alin night club is requesting limited live entertainment which will consist
of a one person stage and karaoke machine. The only proposed modification to the
building will be a 32 square foot stage inside the building. The site is legal non-
conforming where only nine (9) parking spaces are provided on -site instead of 20 parking
spaces. Since the proposed limited live entertainment is minor, staff feels the proposal will
not generate significant noise or traffic impacts. The request is consistent with the City's
General Plan designation of General Commercial and the proposed designation of Mixed
Use -Vertical.
STAFF RECOMMENDATION:
Staff supports the request because:
• The request does not represent a significant change to the existing use.
• It will not be detrimental to surrounding properties because it will not generate
significant noise impacts or result in additional traffic.
• It will be compatible with surrounding uses
• The Police, Fire and Economic Development Departments do not have any concerns.

FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 95-82:
1. The proposed live entertainment consisting of a one person stage and karaoke machine in an
existing 960 square foot nightclub will not be detrimental to the general welfare of persons
working or residing in the vicinity or detrimental to the value of the property and
improvements in the neighborhood. The proposed live entertainment will not generate
significant noise or traffic impacts.
2. Conditional Use Permit No. 95-82 for limited live entertainment in an existing night club will
be compatible with surrounding commercial uses because all modifications to the building will
occur inside the building. The proposed stage will be 36 square feet and will accommodate
one person at a time. The limited live entertainment will supplement the existing recorded
music currently offered.
3. The proposed live entertainment will comply with the provisions of the base district which is
Commercial General and other applicable provisions in Titles 20-25 of the Huntington Beach
Zoning and Subdivision Ordinance to the extent feasible. The site and 'building are legal non-
conforming and provide nine (9) on -site parking spaces.
4. The granting of Conditional Use Permit No. 95-82 for live entertainment will not adversely
affect the General Plan. It is consistent with the Land Use Element designation of General
Commercial on t M subject property. In addition, it is consistent with the following goals and
policies of the General Plan:
a. The General Commercial Land Use designation allows for entertainment and social
establishments.
b. The proposed limited live entertainment is consistent with the General Plan Advisory
Committee's recommendation of Mixed Use which includes General Commercial with
optional residential and the Auto Overlay.
CONDITIONS OF APPROVAL -CONDITIONAL USE PERMIT NO. 95-82:
1. The site plan and floor plan received and dated September 18, 1995 shall be the
conceptually approved layout.

2. Prior to commencing any live entertainment activities, the following shall be
completed:
a. A building permit shall be obtained for the stage.
b. A copy of an approved Entertainment Permit from the Police Department shall be
submitted to the Community Development Department.
The use shall conform to the Entertainment Permit as approved by the Police
Department.
INFORMATION ON SPECIFIC CODE REOUIREMENTS:
1. The development shall comply with all applicable provisions of the Municipal Code,
Building Division, and Fire Department as well as applicable local, State and Federal
Fire Codes, Ordinances, and standards.
2. The Planning Commission reserves the right to revoke Conditional Use Permit No.
95-82, pursuant to a public hearing, if any violation of these conditions or the
Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs.
3. Conditional Use Permit No. 95-82 shall become null and void unless exercised within
one year of the date of final approval or such extension of time as may be granted by
the Director pursuant to a written request submitted to the Department of
Community Development a minimum 30 days prior to the expiration date.

ENVIRONMENTAL IMPACT REPORT NO.94-1 - COMPREHENSIVE
UPDATE OF THE HUNTINGTON BEACH GENERAL PLAN
(CONTINUED FROM THE OCTOBER 10, 1995 PLANNING
COMMISSION MEETING):
APPLICANT: City of Huntington Beach, 2000 Main Street, Huntington Beach,

REQUEST: This element identifies the current and future transportation needs
for the City and sets policies that ensure a safe and efficient
transportation system.

General Plan Amendment No. 94-2/Environmental Impact Report No. 94-1 is the
comprehensive update of the city's General Plan. Since its adoption in December of 1976,
the General Plan has undergone incremental updates to reflect the changing needs of the
city; however no comprehensive update has occurred since the initial adoption. The public
hearings on the General Plan update began on July 18, 1995. The Planning Commission at
the meeting of October 10, 1995, continued the public hearings open to the meeting of
November 14, 1995.
At the last meeting, the Commission recommended continuance of this item to allow
further review of the alternative traffic model scenarios included as part of the preparation
of the Circulation Element. Staff recommends that the Planning Commission continue the
Circulation Element until all the land use map recommendations (excluding the White
Hole) have been completed. This will allow city staff to analyze the land use map
recommendations on the circulation system and formulate a recommendation on the traffic
model scenario to be used.
STAFF RECOMMENDATION:
Staff recommends that the Planning Commission continue the Circulation Element to the
meeting of November 28, 1995 and continue the Public Hearings on General Plan
Amendment No. 94-2/Environmental Impact Report No. 94-1 to the next scheduled
Planning Commission meeting of November 28, 1995."

Jim Lukash, 216 Walnut Avenue, spoke in regards to the Walnut Avenue extension and
widening. Mr. Lukash stated that Walnut Avenue does not meet the criteria for a four (4)
lane arterial.

Linda Niles, Senior Planner, asked the Commission if they would like O.C.T'.U. to make a
presentation at their next meeting to discuss circulation issues. The Commission stated
that they would prefer a brief presentation from Jim Otterson, Traffic Engineer from the
Public Works Department.

B-3 LAND USE ELEMENT (REVIEW LAND USE CHANGES) - GENERAL
PLAN AMENDMENT NO. 94-2 / ENVIRONMENTAL IMPACT REPORT
NO. 94-1 - COMPREHENSIVE UPDATE OF THE HUNTINGTON BEACH
GENERAL PLAN (CONTINUED FROM THE OCTOBER 24, 1995
PLANNING COMMISSION MEETING):
APPLICANT: City of Huntington Beach, 2000 Main Street, Huntington Beach,
CA 92648
REQUEST: This element identifies the location and distribution of land uses,
such as residential or commercial, and specifies the amount of
building intensity. The Land Use Element includes policies that
address design and development principles as well as policies that
address monitoring and managing growth in the City.
LOCATION: City Wide
General Plan Amendment No. 94-2/Environmental Impact Report No. 94-1 is the
comprehensive update of the city's General Plan. Since its adoption in December of 1976,
the General Plan has undergone incremental updates to reflect the changing needs of the
city; however no comprehensive update has occurred since the initial adoption. The public
hearings on the General Plan update began on July 18, 1995. The Planning Commission at
the meeting of October 24, 1995, continued the public hearings open to the meeting of
November 14, 1995.
At the meetings of September 26, October 10, and October 24, 1995, the Commission
received public testimony on the proposed land use map recommendations and took straw
votes on 86 of the proposed 96 recommended changes. Tonight, the Commission will
review eight of the remaining ten land use map recommendations. The eight sites are
identified as Nos. 6, 16, 23, 33, 61, 62, 78, & 83 in the Land Use Matrix. The two
remaining (Sites No. 90 & 93) are part of the "White Hole" area and will be reviewed at
the November 28, 1995 Planning Commission meeting.

In addition, the Commission through out this process has set aside some outstanding
issues for review and consideration. Staff has attached a matrix for the Commissions
review which includes revisions and staff s recommendations. It is recommended that the
Commission begin to take straw votes on the outstanding issues identified in the matrix.
Staff has also attached the revised language of the various General Plan Elements that the
school districts and staff have come to agreement on. Staff recommends that the
Commission begin to take straw votes on these agreed upon revisions.
STAFF RECOMMENDATION:
Staff recommends that the Planning Commission continue to take straw votes on the
proposed land use recommendations of the Land Use Element; take straw votes on the
Outstanding Issues Matrix; take straw votes on the agreed upon language of the school
districts and staff, and continue the Public Hearings on General Plan Amendment No. 94-
2/Environmental Impact Report No. 94-1 to the next scheduled Planning Commission
meeting of November 28, 1995.
THE PUBLIC HEARING WAS OPENED.
Randy Case, representing the Metropolitan Water District (MWD), map area 978, stated
that MWU would prefer this area be designated as RL in the General Plan. He stated that
they would preserve the Eucalyptus trees and would like to locate a water tank in this area
behind the Eucalyptus trees, have access through the property and underground all public
utilities.
Jeff Metzel, 19391 Shady Harbor Circle, President Seacliff Homeowners Association, map
area #23, stated that the homeowner's association does not want commercial along Palm
Avenue, wanting it to remain a primary arterial with limited access. He also stated that the
area along Palm between Seapoint and Goldenwest should be Low Density, Single Family
Residential, no more than two (2) stories high and if commercial were to be placed on
Pacific Coast Highway it should be separated by a frontage road.
Barbara Marshall, 6601 Morning Tide, map area#23, stated that she wants no commercial
on Palm Avenue, retaining it as a primary arterial.
Tim Marshall, 6601 Morning Tide, map area 423, stated that this neighborhood was
unique and in order to maintain its integrity there should be no access on Palm Avenue.
Jay Kreitz, 19781 Island Bay, vice-president Seacliff Homeowners Association, map area
#23, stated that Single Family Residence should form a corridor on Palm Avenue with no
commercial allowed.
Nick Tomaino, 6812 Scenic Bay Lane, map area #23, stated that no commercial should be
allowed along Palm Avenue, instead it should be Single Family Homes.

Richard Harlow, 211-B Main Street, representing Koll Real Estate Company, map area
478, stated that Koll Real Estate would prefer Medium Density Residential, and if that
was not possible they would favor the General Plan Advisory Committee recommendation
of changing from OS (Open Space) to Low Density Residential.
Janet May, 8471 Indianapolis, map area #6, stated that she would like to see the speed
limit lowered on Indianapolis as the noise negatively impacts the area.
Commissioner Holden asked staff to aid Ms. May in contacting the appropriate
Departments that would deal with this issue.
Bill Holman, 23 Corporate Plaza, Newport Beach, representing Huntington Beach
Company, map area #23, addressed the following issues as property owners of the subject
area: No commercial development is planned along Palm Avenue and they would not be
adverse to such a restriction in the General Plan; they agree with Palm Avenue to be
retained as a primary arterial; landscape setback along Palm Avenue is a specific plan
issue and widths and design should be addressed at that time; agreeable to de-
emphasizing or eliminating the westerly extension of Orange Avenue through Area 23 to
Palm Avenue; two (2) story, low density housing along Palm Avenue is acceptable in
concept with the two (2) story height limit be directed to the area across from the existing
Huntington Seacliff homes between Goldenwest Street and Seacliff Country Club; have
the ability to build a number of different housing products within Area 23, as permitted by
the Medium Density Residential designation; disagree with lot frontages having a
minimum frontage of 60 feet; would like the ability, at the time a specific plan is prepared,
to be able to suggest development standards appropriate for the type(s) of development
proposed; the need for additional parks in this area is dependent on the amount and type
of housing built; and the City's Local Coastal Plan includes overlays for potential visitor -
serving commercial development at Goldenwest Street and at Seapoint Street, although
both locations will be subject to oil production for the foreseeable future. Until a specific
development is proposed, it would be inappropriate to impose access constraints. Mr.
Holman also stated that they would like the Local Coastal Program's requirement of site
specific affordable housing be eliminated.

The Commission discussed with staff map area #23, in regards to commercial along Palm
Avenue. They asked staff how they can ensure that commercial is not allowed on Palm
Avenue. Staff stated that they could add to Table LU-6, Design and Development,
comments regarding future compatibility. The Commission discussed the possibility of
splitting this area and designating the area along Palm Avenue to Goldenwest residential
so no commercial would be allowed. It was decided to set aside this issue for further
review, in order to meet with representatives of the property owner and area residents in
an effort to work out concerns.
