ITEM 1: COASTAL DEVELOPMENT PERMIT NO. 95-32
Applicant: Unocal
Request: Replace 190 feet of existing eight (8) inch oil pipeline to be installed, maintained
and owned by Unocal. 180 feet to be placed in public right-of-way of Warner
Avenue. Ten (10) feet to be placed on Unocal existing easement in sand area of
Bolsa Chica State Beach.
Location: 180 feet at the western terminus of Warner Avenue and ten (10) feet in the sand
area of Bolsa Chica State Beach
Cathy Johnson, staff planner, stated that this was a proposal by Unocal to replace 190 feet of existing
eight (8) inch oil pipeline. 180 feet of the pipeline would be placed in the public right-of-way of Warner
Avenue and ten (10) feet would be placed on Unocal's existing easement in the sand area of Bolsa
Chica State Beach. Site plans were shown. It was noted that the subject right-of-way is a bus turn-
around. Ms. Johnson stated that when the project plans were first submitted the applicant proposed to
dig up the bus turn -around area which staff determined would interfere with bus traffic. Since that time,
the applicant has decided to bore underneath the roadway starting from the sand area of Bolsa Chica
State Beach which mitigates staffs concern of bus traffic interference. Ms. Johnson stated that this
proposal is part of an on -going replacement project that has been previously approved with a Negative
Declaration. The project is estimated to take approximately two (2) weeks. Staff recommended
approval of this request.

David Pryor, representing State of California Department of Parks and Recreation, was present
and stated that public impact from the project should be minimal.
Sandra Briggs, representing Enersource Engineering, was present and stated that there will be no
lane closures and pedestrian traffic will not be disrupted. Ms. Briggs reiterated the fact that the
project will take les's than two (2) weeks.
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE
REQUEST AND THE PUBLIC HEARING WAS CLOSED.
COASTAL DEVELOPMENT PERMIT NO.95-32 WAS CONDITIONALLY APPROVED
BY THE ZONING ADMINISTRATOR. HE STATED THAT THE ACTION TAKEN BY
THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING
COMMISSION WITHIN TEN (10) CALENDAR DAYS.
FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO.95-32:
1. The request to construct an estimated 190 feet of eight (8) inch underground oil pipeline
beneath the public right-of-way of Warner Avenue and within an existing ten (10) foot
easement conforms with the plans, policies, requirements and standards of the Coastal
Element of the General Plan, During construction, the applicant will provide alternate
routes for pedestrian and bicycle traffic, construction vehicle routes and warning signage
for vehicles, bicyclists, and pedestrians per an approved construction plan. After
construction, the pipeline will be permanently underground and will have no impact on
coastal views or access.
2. Coastal Development Permit No. 95-32 is consistent with the Coastal Zone suffix zoning
requirements, the Open Space -Shoreline Subdistrict, as well as other provisions of the
Huntington Beach Ordinance Code. The proposed pipeline replacement project is
consistent with the provisions of the California Coastal Act and the provisions of the Open
Space Shoreline District in that the pipelines are to replace existing pipelines which are
underground and will therefore not impact any coastal resources. The proposed project
will conform with all applicable Fire and Public Works requirements.
3. The proposed project consists of the replacement of 190 feet of oil pipeline which will be
provided in a manner consistent with the Coastal Element of the General Plan because the
entire project will be underground and will not impact coastal resources.
4. The proposed replacement underground oil pipeline conforms with the public access and
public recreation policies of Chapter 3 of the California Coastal Act. Neither public access
nor public recreation opportunities within the coastal area will be impacted by the project
because it will be entirely underground.

SPECIAL CONDITIONS OF APPROVAL - COASTAL DEVELOPMENT PERMIT NO.
95-32:
1. The site plan, floor plans, and elevations received and dated December 6, 1995 shall be the
conceptually approved layout.
2. The Zoning Administrator shall be notified in writing if any changes in building height,
floor area, setbacks, building elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the Zoning Administrator has
reviewed and approved the proposed changes. The Zoning Administrator reserves the
right to require that an amendment to the original entitlement be processed if the proposed
changes are of a substantial nature.
3. Mitigation Measures:
a. Air: During pipeline installation, the applicant shall:
1) Use low sulfur fuel (.05% by weight) for construction equipment.
2) Phase and schedule construction activities to avoid high ozone days (first stage
smog alerts).
3) Discontinue installation activities during second stage smog alerts.
4) Maintain equipment engines in proper tune.
b. Noise: Equipment used in installing pipeline shall be equipped with double mufflers.
Noise: Construction activities shall be limited to Monday -Friday 7:00 a.m. to 5:00
p.m. Construction is prohibited on Saturdays, Sundays and Federal holidays.
d. Risk of Upset: A minimum of 30 days prior to installation of the pipeline, the
applicant shall submit the following for approval by the Fire Department:
1) A community risk assessment.
2) A health and safety plan for project employees.
3) An emergency response plan.
4) Project monitoring plan which utilizes independent site auditors.
5) A site security plan.
6) A hydrocarbon and hazardous materials management plan to include independent
site auditor for potential contamination.
e. Transportation/Circulation: A minimum of 30 days prior to installation of pipeline,
the applicant shall submit a construction plan for approval by the City's Traffic
Division. The plan shall include, at minimum, alternate routes for pedestrian and
bicycle traffic during pipeline installation, construction vehicle routes and proposed
warning signage and marking to provide adequate warning to bicyclists and
pedestrians. The plan shall be implemented during pipeline installation.

f. Transportation/Circulation: The bore pit and receiving pit shall not be left open at
the end of each day. Both the bore pit and receiving pit will be properly protected to
ensure the safety of all pedestrian and bicycle traffic.
g. Utilities: Prior to initiation of trenching activities, the applicant shall contact all utility
companies to identify where existing lines within the subject rights -of -way are located.
The applicant shall notify the companies of trenching activities so that impacts to
existing lines and disruption to existing service can be avoided.
h. Cultural Resources: A qualified professional archeologist shall be retained to
monitor all earth moving activities within the vicinity of recorded archaeological sites
unless the UCLA Institute of Archaeology determines that an on -site monitor is no
necessary.
4. The Public Works Department requirements are:
a. The applicant shall pay all applicable Public Works fees.
b. A pre job meeting and field review shall be conducted prior to beginning of
construction.
5. Conditions of approval shall be printed verbatim on the cover sheet of all working
drawings submitted for plan check.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of the Ordinance Code,
Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances,
and standards.
3. The applicant shall obtain the necessary permits from the South Coast Air Quality
Management District.
4. The Zoning Administrator reserves the right to revoke if any violation of these conditions
of the Huntington Beach Ordinance Code occurs.
ITEM 2: SPECIAL SIGN PERMIT NO.95-11
PLANNED SIGN PROGRAM NO.87-9(R)
Applicant: Promotional Signs, Inc.
Request: To permit an 83 square foot wall sign identifying Starbucks Coffee in
addition to two (2) existing 31 square foot wall signs. The request includes

exceeding the maximum sign area allowed and a wall sign on a building
wall not adjacent to the business suite.
Location: 7777 Edinger Avenue (Huntington Center)
Wayne Carvalho, staff planner, stated that this was a request to permit an 83 square foot wall sign
identifying Starbucks Coffee on the north elevation of the Barnes and Noble building in addition
to two (2) existing 31 square foot wall signs. The request includes exceeding the maximum sign
area allowed and a wall sign on a building wall not adjacent to the business suite. Mr. Carvalho
stated that the Design Review Board recommended approval of the application as submitted. The
subject wall sign does not obstruct any existing sign nor will it be detrimental to any property in
the area. No phone calls or letters were received for or against the subject application. Staff
recommended approval of this request.
THE PUBLIC HEARING WAS OPENED.
Dick Christie, representing Promotional Signs, stated that the 83 square foot wall sign will be on a
raceway and externally illuminated because there is no access behind the wall due to steel plates
that are existing.
Kely Davis, representing Starbucks Coffee, stated that the co -tenant situation has been beneficial
for Starbucks in other locations and has brought up activity levels. Mr. Davis believed that their
request was well balanced and that the building would acquire the identities of both tenants, not
just Starbucks Coffee.

SPECIAL SIGN PERMIT NO. 95-11 / PLANNED SIGN PROGRAM NO. 87-9(R) WAS
CONDITIONALLY APPROVED BY THE ZONING ADMINISTRATOR. HE STATED
THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE
APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR
DAYS.
FINDINGS FOR APPROVAL - SPECIAL SIGN PERMIT NO. 95-11:
1. Special Sign Permit No. 95-11 for a 83 square foot wall sign in addition to two (2) existing 31
square foot wall signs, which exceeds the maximum 135 square foot sign area allowed for the
Starbucks Coffee business, and a wall sign on a building wall not adjacent to the business suite
is compatible with the character of the area and is needed for special circumstances defined by
the applicant to and approved by the Zoning Administrator. The new sign is necessary to
provide exposure to the new Starbucks Coffee business as the suite is oriented toward the
freeway and Center Avenue. In addition, the proposed sign will be internally illuminated,
unlike the two existing signs which are not internally lit due to the building's construction
design.

2. The new 83 square foot wall sign which identifies Starbucks Coffee will not adversely affect
other signs in the area. The new wall sign will be placed on the building in a manner not to
obstruct the visibility of other signs in the area.
3. The new sign will not be detrimental to properties located in the vicinity because the sign is
located entirely on the building wall facing the freeway and Center Avenue.
4. The approval of Special Sign Permit No. 95-11 for the new wall sign will not obstruct
vehicular or pedestrian traffic visibility and will not be a hazardous distraction. The 83 square
foot wall sign will provide freeway exposure without obstructing traffic vision.
FINDINGS FOR APPROVAL - PLANNED SIGN PROGRAM NO. 87-9(R)•
1. The proposed 83 square foot wall sign which identifies Starbucks Coffee is compatible with
the style and character of existing improvements on the site and is well -related to other signs,
reflecting a common theme and design style.
CONDITIONS OF APPROVAL - SPECIAL SIGN PERMIT NO. 95-11:
The site plan and sign elevations received and dated October 13, 1995 shall be the
conceptually approved layout.
2. The Zoning Administrator reserves the right to rescind Special Sign Permit No. 95-11 in the
event of any violation of the terms of the applicable zoning laws. Any such decision shall be
preceded by notice to the applicant and a public hearing and shall be based on specific
findings.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
The development shall comply with all applicable provisions of the Ordinance Code,
Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances,
and standards.
3. The Zoning Administrator reserves the right to revoke if any violation of these conditions
of the Huntington Beach Zoning and Subdivision Ordinance occurs.
ITEM 3: NEGATIVE DECLARATION NO. 95-7
Applicant: City of Huntington Beach, Department of Public Works
Request: To permit the installation of approximately 400 linear feet of 30 inch storm
drain pipe within the Warner Avenue right-of-way, between Oak Lane and
Nichols Street, and approximately 650 linear feet of 54 inch pipe and 50

linear feet of 48 inch pipe within the Nichols Street right-of-way, between
Warner Avenue and the Oceanview Channel.
Location: 7661 Warner Avenue (Segment on Warner Avenue between Oak Lane and
Nichols Street, and segment on Nichols between Warner and the Ocean
View Channel)
Wayne Carvalho, staff planner, stated that this request does not consist of a public hearing. The
applicant proposes to permit the installation of approximately 400 linear feet of 30 inch storm
drain pipe within the Warner Avenue right-of-way, between Oak Lane and Nichols Street, and
approximately 650 linear feet of 54 inch pipe and 50 linear feet of 48 inch pipe within the Nichols
Street right-of-way, between Warner Avenue and the Oceanview Channel. Mr. Carvalho stated
that the Environmental Assessment Committee reviewed the application and recommended the
Negative Declaration. Staff recommended approval of this request with mitigation measures.
Staff recommended notification of the project by way of signs that indicate the length of
construction as well as a contact person and telephone number. Additionally, all utility companies
must be notified two (2) weeks prior to start date.
NEGATIVE DECLARATION NO. 95-7 WAS APPROVED WITH MITIGATION
MEASURES BY THE ZONING ADMINISTRATOR. HE STATED THAT THE ACTION
TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE
PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS.
MITIGATION MEASURES - NEGATIVE DECLARATION NO. 95-7:
1. During construction, the applicant shall comply with the following:
a. Use water trucks or sprinkler systems in all areas where vehicles travel to keep damp
enough to prevent dust raised when leaving the site.
b. Wet down areas in the late morning and after work is completed for the day.
c. Use low sulfur fuel (.05% by weight) for construction equipment.
d. Phase and schedule construction activities to avoid high ozone days (first stage smog
alerts).
e. Discontinue installation activities during second stage smog alerts.
f. Maintain equipment engines in proper tune.
2. The applicant shall notify the City of Huntington Beach Fire and Police Departments of the
duration and extent of any street lane closures a minimum of 24-hours prior to the initiation of
storm drain improvement activities so that they can identify alternative emergency routes for
the duration of the street closures, if necessary.

3. The applicant shall submit and implement a traffic circulation plan identifying the routes which
construction equipment and trucks will use to access and depart from the area for review and
approval to the Public Works Department 10 days prior to initiation of construction. The plan
shall use routes which will generate the minimum number of circulation conflicts with
residential, pedestrian, bicycle and vehicle traffic.
4. The applicant shall provide Construction Signs a minimum of 10 days prior to start of
construction activity. The signs shall indicate the nature of construction, its expected duration
and provide a contact name and phone number for the project. The signs shall be located on
Warner Avenue and at the entry to Nichols Street.
5. Prior to initiation of trenching activities, the applicant shall contact all utility providers to
identify the location of existing lines within the subject rights -of -way. The applicant shall
notify the companies of trenching activities so that impacts to existing lines and disruption to
existing service can be avoided.
