Administrator Meeting Minutes Continued.
ORAL COMMUNICATION: None
ITEM 1: CONDITIONAL USE PERMIT NO. 95-94
Applicant: Buddy Clark
Request: To establish a personal enrichment business for Judo instruction in an
existing 1,500 square foot suite.
Location: 9067 Adams Avenue (northeast corner of Adams Avenue and Magnolia
Street)
Robert Franklin, staff planner, stated that this was a request to establish a Judo studio in the Don
Jose Retail Center located at the northeast corner of Adams Avenue and Magnolia Street. Site
plans were shown. It was noted that classes would be held Tuesday nights, Thursday nights, and
Saturday mornings. Mr. Franklin stated that there are nine (9) parking spaces allotted to the retail
space. According to the Code, after calculating instruction area, the applicant would be required
to have five (5) parking spaces therefore there is adequate parking available. It was noted that
there have been no letters or phone calls received from adjacent property owners or commercial
tenants regarding this request. Public Works stated that a traffic impact fee would be imposed if
the proposed use generated more trips than the previous use. Staff recommended approval of this
application with conditions.

Mr. Gandale, a martial arts instructor from another location, was present and requested
information on the style of Judo Mr. Clark has studied as well as his rank. Mr. Gandale
questioned whether or not Mr. Clark's students would be trained for competitions.
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE
REQUEST AND THE PUBLIC HEARING WAS CLOSED.
Julie Osugi, Zoning Administrator, stated that she would like to have a condition added that
would require the applicant to keep the rear door closed during the hours of operation.
CONDITIONAL USE PERMIT NO. 95-94 WAS CONDITIONALLY APPROVED BY
THE ZONING ADMINISTRATOR. SHE STATED THAT THE ACTION TAKEN BY
THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING
COMMISSION WITHIN TEN (10) CALENDAR DAYS.
FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 95-94:
The establishment and operation of the 1,500 square foot judo studio will not be
detrimental to the general welfare of persons residing or working in the vicinity nor
detrimental to the value of the property and improvements in the neighborhood. Adequate
parking will be provided on -site.
2. The granting of conditional Use Permit No. 95-64 will not adversely affect the General
Plan of the City of Huntington Beach. Judo studios are permitted uses in commercial
zones subject approval by the City. Hours of operation will be consistent with the
previous use and existing businesses in the retail center.
3. The proposed use will comply with the provisions of the base district and other applicable
provisions in Titles 20-25 and any specific condition required for the proposed use in the
district in which it would be located. The zoning designation of general commercial
recognizes land uses of this nature and the Judo Studio will be compatible with existing
uses in the retail center. The rear door will remain closed during instruction which will
minimize noise impacts to the residential properties located to the east.
SPECIAL CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 95-94:
1. The site plan received and dated November 7, 1995 shall be the conceptually approved
layout.
2. A traffic impact fee will be imposed if the proposed use generates more trips per day than
the previous use.
3. The rear door shall remain closed during instruction.

INFORMATION ON SPECIFIC CODE REQUIREMENTS:
The development shall comply with all applicable provisions of the Huntington Beach
Zoning and Subdivision Ordinance, Building Division, and Fire Department,
2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances,
and standards.
3. The Zoning Administrator reserves the right to revoke Conditional Use Permit No. 95-94
if any violation of these conditions of the Huntington Beach Zoning Ordinance occurs.
ITEM 2: CONDITIONAL USE PERMIT NO. 95-100
COASTAL DEVELOPMENT PERMIT NO. 95-38
Applicant: TNR Development Corporation
Request: To permit limited use of a 40 foot wide abandoned railroad right-of-way by
homeowners at 502, 504, 506, 508, 510, 512, 514, 516, 518 and 520 Lake
Street.
Location: Between Pecan Avenue and Frankfort Avenue, east of Lake Street
Susan Pierce, staff planner, stated that the applicant has been trying for approximately three (3)
years to acquire the right to use the abandoned railroad right-of-way that runs between Frankfort
Avenue and Pecan Avenue, east of Lake Street. It was noted that at one time the applicant tried
to get the City to vacate the right-of-way so that he could incorporate the right-of-way into his
development. The City did not agree with the applicant's request because it was not consistent
with the General Plan to vacate property that is designated for future transit. Ms. Pierce stated
that the applicant then came to the conclusion that it may be possible to form a lease agreement
with the City so that he could have his prospective homeowners use the subject property. It was
noted that the applicant has suggested that the property be used for gardening, lawns,
playgrounds, parking and storage. Ms. Pierce stated that the subject property is located within
the Coastal Zone. The Planning Director advised staff that this application requires a decision
that should not be made at the Zoning Administrator's level, that this is a policy decision that
should be made by the policy makers (designated by authority as the Planning Commission). Staff
recommended that this application not be acted upon by the Zoning Administrator and that it be
referred to the Planning Commission with a new public hearing being advertised.
CONDITIONAL USE PERMIT NO. 95-100 / COASTAL DEVELOPMENT PERMIT NO.
95-38 WAS REFERRED TO THE PLANNING COMMISSION BY THE ZONING
ADMINISTRATOR.
