ITEM 1: WAIVER OF PARCEL MAP NO, 94-204
(CONTINUED FROM JANUARY 3, 1996)
Applicant: G&M Oil Company
Request: Waiver of parcel map requirements for consolidation of three (3) lots into
one (1) lot for commercial development.
Location: 16862 "A" Street (southeast corner of "A" Street and Rubidoux)
Catherine Johnson, project planner, stated that this application was withdrawn by the applicant.
WAIVER OF PARCEL MAP NO. 94-204 WAS WITHDRAWN BY THE APPLICANT.
ITEM 2: VARIANCE NO. 95-36
(CONTINUED FROM JANUARY 17, 1996)
Applicant: Martin Jaconi
Request: To convert an existing storage area to a 267 square foot garage with a one
(1) foot side yard setback (five [5] foot setback required by Code). The
garage will have a second story deck.

Location: 4051 Humboldt Drive, Huntington Harbor (northwest corner of Humboldt
Drive and Wayfarer Lane)
Mary Beth Broeren, project planner, stated that this was a request to enclose an existing storage
area for use as a one -car garage. The request also includes a second story deck above the garage
addition. The applicant is proposing that the garage be at a one (1) foot sideyard setback. Staff
recommended that the proposed setback be either three (3) feet or zero (0) feet with a
maintenance easement. It was noted that this application was continued in order to research other
homes in the area that have had similar conversions. Ms. Broeren stated that a review of the
records indicated that zero (0) of the homes with the conversion were done so with the benefit of
a building permit that clearly reflected the work that had been done. Therefore, no variances were
granted on any of the homes in question.
THE PUBLIC HEARING WAS OPENED.
Martin Jaconi, applicant, stated that he could accept a zero (0) foot sideyard setback. Mr. Jaconi
requested approval of this application based on the fact that other homes in the subject
neighborhood have had similar conversions.
Gerald Urner, representative of the Huntington Harbor Property Owner's Association, requested
that the Zoning Administrator uphold the Zoning Code that requires a five (5) foot sideyard
setback.
W. Henry Walker, property owner, stated that he believes the conversion would not be a
hindrance to Huntington Beach or the Huntington Harbor area.
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE
REQUEST AND THE PUBLIC HEARING WAS CLOSED.
VARIANCE NO. 95-36 WAS DENIED BY THE ZONING ADMINISTRATOR. HE
STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE
APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR
DAYS.
FINDINGS FOR DENIAL - VARIANCE NO. 95-36:
The granting of a variance is not necessary to preserve the enjoyment of one or more
substantial property rights. The existing home has a two (2) car enclosed garage and
meets the parking requirements of the City of Huntington Beach.
2. The granting of a variance for a reduced side yard setback for a garage with a second
story deck will constitute a grant of special privilege inconsistent with limitations upon
other properties in the vicinity and under an identical zone classification. The required
side yard setback for the zone is five (5) feet with which the existing garage on the
property is in compliance and all other RL (Low Density Residential) properties must
comply with.

ITEM 3: COASTAL DEVELOPMENT PERMIT NO. 95-41
CONDITIONAL USE PERMIT NO. 95-101
Applicant: Richard L. Anderson
Request: To permit a 2,499 square foot addition to an existing 3,635 square foot
two-story residence. The improvements include a 495 square foot third
floor including a new roof line, a 1,195 square foot addition to the second
story, a 345 square foot addition to the first floor and a 464 square foot
addition to the garage.
Location: 3562 Courtside Lane (west of Coral Cay, Huntington Harbor)
Cathy Johnson, project planner, stated that this was a request to permit a 2,499 square foot
addition to an existing 3,635 square foot two-story residence. The improvements include a 495
square foot third floor including a new roof line, a 1,195 square foot addition to the second story,
a 345 square foot addition to the first floor and a 464 square foot addition to the garage. Ms.
Johnson stated that all regulations have been met. A letter from the homeowner's association has
been received stating no opposition to this request. Staff recommended approval of the
application

COASTAL DEVELOPMENT PERMIT NO.95-41 / CONDITIONAL USE PERMIT NO.
95-101 WAS CONDITIONALLY APPROVED BY THE ZONING ADMINISTRATOR.
HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN
BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR
DAYS.
]FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO. 95-41:
The request to permit the remodel and addition to an existing two-story single family
residence conforms with the plans, policies, requirements and standards of the Coastal
Element of the General Plan. The proposed third story addition will not impact public
views or access, as none currently exist in the vicinity.
2. Coastal Development Permit No. 95-41 is consistent with the CZ suffix zoning
requirements, the Rl Zoning District, as well as other provisions of the Huntington Beach
Ordinance Code applicable to the property. The proposed development will conform with
all applicable City Codes, in terms of the height, setbacks and lot coverage.

3. At the time of occupancy, the proposed remodel and addition to an existing two-story
single family residence will be provided with infrastructure in a manner that is consistent
with the Coastal Element of the General Plan. All infrastructure currently exist to the site.
4. The proposed remodel and 2,035 square foot addition to an existing two story single
family residence conforms with the public access and public recreation policies of Chapter
3 of the California Coastal Act. No public access or recreational opportunities will be
affected by the new construction because none exist on this site.
FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 95-101:
Conditional Use Permit No. 95-101 for the establishment, maintenance and operation of
the third story addition and remodel will not be detrimental to the general welfare of
persons residing or working in the vicinity nor detrimental to the value of the property and
improvements in the neighborhood because it will not change the character or appearance
of the existing neighborhood and is similar in size and height to other residences within the
vicinity.
2. The granting of Conditional Use Permit No. 95-101 will not adversely affect the General
Plan of the City of Huntington Beach. The proposed addition and remodel of an existing
single family home is consistent with the goals and policies of the General Plan for
residential development.
3. The proposed use will comply with the provisions of the base district and other applicable
provisions in the Huntington Beach Ordinance Code and any specific condition required
for the proposed use in the district in which it would be located.
SPECIAL CONDITIONS OF APPROVAL:
The site plan, floor plans, and elevations received and dated December 5, 1995 shall be the
conceptually approved layout.
2. Prior to final inspection, the following shall be completed by the applicant:
a. One (1) 36 inch box tree, or the palm equivalent shall be required in the front yard
area. An existing tree or palm in the front yard that is to remain will meet the Code
requirement.
b. Automatic sprinkler systems shall be installed throughout to comply with Huntington
Beach Fire Department and Uniform Building Code Standards. Shop drawings will be
submitted to and approved by the Fire Depratment prior to installation. This will
require a two (2) inch water meter service.
3. All proposed dock and ramp improvements shall require separate permits for the
improvements located within the public waterways.

4. All proposed cantilevered deck improvements require separate permits for the
improvements.
5. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable
material, shall be disposed of at an off -site facility equipped to handle them.
6. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and
central heating units.
7. Low -volume heads shall be used on all spigots and water faucets.
The Zoning Administrator shall be notified in writing if any changes in building height,
floor area, setbacks, building elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the Zoning Administrator has
reviewed and approved the proposed changes. The Zoning Administrator reserves the
right to require that an amendment to the original entitlement be processed if the proposed
changes are of a substantial nature.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of the Ordinance Code,
Building Division, and Fire Department,
2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances,
and standards.
The Zoning Administrator reserves the right to revoke Coastal Development Permit No.
95-41 and Conditional Use Permit No. 95-101 if any violation of these conditions of the
Huntington Beach Ordinance Code occurs.
