ZONING ADMINISTRATOR: STAFF MEMBERS: MINUTES: Herb Fauland Mary Beth Broeren, Lisa Koch None ORAL COMMUNICATION: None ITEM 1: CONDITIONAL USE PERMIT NO. 95-98 Applicant: Robert Escobar Request: To permit construction of a new 2,784 square foot, three story single family residence with a roof deck. The proposed unit is 34 feet high. Location: 302 19th Street (northeast corner of Olive Avenue and 19th Street) Mary Beth Broeren, project planner, stated that this was a request to construct a new 2,784 square foot, three story single family dwelling with a roof deck located at the corner of 19th Street and Olive Avenue. The zoning for the subject property is RMH-A which permits the requested structure. It was noted that the project is consistent with the General Plan. Ms. Broeren stated that the request complies with the Huntington Beach Zoning and Subdivision Ordinance with respect to setbacks, parking and height. The applicant is proposing a two (2) car garage in addition to setting the house forward on the lot so as to permit two (2) unenclosed parking spaces on site. It was also noted that the proposed roof deck will be located towards the rear of the home. Ms. Broeren stated that the site coverage requirements will be met. One (1) letter in support of the request has been received from the property owner located to the north of 302 19th Street who has received approval to construct a three story home. The project is subject to the Residential Infill Ordinance; therefore, the applicant will be required to notify the surrounding property owners prior to submitting plans for plan check. One requirement of the Infill Ordinance is that the home be built on a grade that matches existing grade. Ms. Broeren stated that the subject property is elevated approximately three (3) feet above the street. February 21, 1996 Zoning Administrator Meeting Minutes Page 2 Public Works inspected the property and found that no conflicts would exist in regards to access and recommended that the current grade be retained. Due to the grade differential, the maximum height of the structure allowed by the Zoning Code is 34 feet. Ms. Broeren stated that the project is compatible with the surrounding area. Staff recommended approval of this request. THE PUBLIC HEARING WAS OPENED. Robert Escobar, applicant, was present and requested approval of this request. Tracy Gaglio, property owner to the north of the subject address, was present and stated that she was in support of this request. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. CONDITIONAL USE PERMIT NO. 95-98 WAS CONDITIONALLY APPROVED BY THE ZONING ADMINISTRATOR. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 95-98: 1. Conditional Use Permit No. 95-98 for the establishment, maintenance and operation of the new, three (3) story single family residence will not be detrimental to the general welfare of persons residing or working in the vicinity nor detrimental to the value of the property and improvements in the neighborhood. The use is compatible with other single family residences in the vicinity, many of which are multi -story, and will be required to comply with the City of Huntington Beach Infill Ordinance. The property owner will be required to construct infrastructure improvements and dedicate a portion of the property for alley widening which will improve vehicle circulation. 2. The granting of Conditional Use Permit No. 95-98 will not adversely affect the General Plan of the City of Huntington Beach. The use is consistent with the goals and objectives of the Medium Density Residential land use designation of the General Plan, 3. The proposed use will comply with the provisions of the base district and other applicable provisions in Titles 20-25 and any specific condition required for the proposed use in the district in which it would be located. The structure will meet minimum setbacks, provide sufficient on -site parking and meet all other aspects of the Code. SPECIAL CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 95-98: 1. The site plan, floor plans, and elevations received and dated January 29, 1996 shall be the conceptually approved layout with the following modifications. (g:za:min:0221) February 21, 1996 Zoning Administrator Meeting Minutes Page 3 a. Concrete sidewalk along curb at Olive Avenue shall be five (5) feet wide including curb. (PW) 2. Prior to submittal for building permits, the following shall be completed: a. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing sets submitted for plancheck. b. Depict utility apparatuses, such as but not limited to backflow devices and Edison transformers on the site plan. They shall be prohibited in the front yard and exterior sideyards unless properly screened by approved landscaping or any other method approved by the Community Development Director. 3. Prior to issuance of building permits, the following plans and items shall be submitted and/or completed by the applicant: a. A revised site plan shall be submitted depicting the modifications described above. b. The following dedications shall be required: i. 2.50 feet of alley. (PW) ii. 15.00 foot radius at the corner of 19th and Olive. (PW) c. A grading plan submitted to the Department of Public Works for review and approval. (PW) d. A Landscape Construction Set submitted to the Department of Public Works. The landscape construction set shall include a landscape plan prepared and signed by a State Licensed Landscape Architect which includes all proposed/existing plant materials (location, type, size, quantity), irrigation plan, grading plan and approved site plan, and copy of conditions of approval. The landscape plan shall be in conformance with Chapter 232 of the Huntington Beach Zoning and Subdivision Ordinance. The set must be complete and approved by both Departments of Community Development and Public Works prior to issuance of building permits. (PW) e. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 4. Prior to final inspection or Certificate of Occupancy: a. Construct 25.00 foot radius curb return at the corner of 19th Street and Olive Avenue. Remove and replace existing sidewalk on 19th Street and Olive Avenue. (PW) d. Construct full width concrete alley apron. (PW) e. Remove and replace one-half (1/2) alley. (PW) f. Install new sewer lateral. (PW) g. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. h. Compliance with all conditions of approval specified herein shall be accomplished. Fire Department Requirements: a. Note on plans: The project will comply with all provisions of the Huntington Beach Fire Code and City Specification #422 and #431 for the abandonment of oil wells and site restoration. b. Note on plans: The project will comply with all provisions of Huntington Beach Municipal Code Title 17.04.085 and City Specification #429 for new construction within the methane gas overlay districts. Note on plans: Address numbers shall be installed to comply with City Specification #428. 6. Natural Gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 7. Low -volume heads shall be used on all spigots and water faucets. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Huntington Beach Zoning and Subdivision Ordinance, Building Division, and Fire Department. (g:za:min:0221) February 21, 1996 Zoning Administrator Meeting Minutes Page 5 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 4. All applicable Public Works fees shall be paid. (PW) 5. Traffic Impact fees shall be paid at the time of issuance of a Certificate of Occupancy or final inspection. 6. An encroachment permit shall be required for all work within the City right-of-way. (PW) 7. Landscaping shall comply with Chapter 232 of the Huntington Beach Zoning and Subdivision Ordinance. Park and Recreation fees shall be paid at issuance of building permits. 9. Construction shall be limited to Monday through Saturday, 7:00 AM to 8:00 PM. Construction shall be prohibited Sundays and federal holidays. 10. The Zoning Administrator reserves the right to revoke Conditional Use Permit No. 95-98 if any violation of these conditions of the Huntington Beach Zoning and Subdivision Ordinance occurs.
