ITEM 1: CONDITIONAL USE PERMIT NO. 96-4
Applicant: William K. Vogt
Request: To construct two (2) single family units on two (2) lots. The square footage of the
units is approximately 2,500 square feet and 2,800 square feet. Each unit will have
three (3) stories and a third floor deck.
Location: 618 10th Street (approximately 100 feet south of Palm Avenue)
Mary Beth Broeren, project planner, stated that this was a request to construct two (2) single
family units on two (2) lots. The square footage of the units is approximately 2,500 square feet
and 2,800 square feet. Each unit will have three (3) stories and a third floor deck. Ms. Broeren
stated that the subject properties are located in the RMH-A Zoning District as well as the
Methane Overlay District. The Fire Department could not determine whether or not an oil well
once existed on the site, therefore a condition must be included that if any contaminated soils are
found the Fire Department is to be contacted. The applicant proposes to meet all aspects of the
Code with respect to site coverage, setbacks, and parking. Public Works recommended standard
conditions of approval, such as dedicating two and one-half (2 1/2) feet for the alley, providing
water service to each lot, and installing sidewalk, curb and gutter improvements. Staff received
one phone call from an adjacent property owner regarding this project. The property owner was
not opposed to the project. Ms. Broeren stated that the applicant is subject to the Residential
Infill Ordinance. Staff recommended approval of this request.

THE PUBLIC HEARING WAS OPENED,
William Vogt, applicant, was present and stated that there are no oil wells within 600 feet of this
project. Mr. Vogt requested clarification on the Infill requirements.
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE
REQUEST AND THE PUBLIC HEARING WAS CLOSED.
CONDITIONAL USE PERMIT NO. 96-4 WAS CONDITIONALLY APPROVED BY
THE ZONING ADMINISTRATOR HE STATED THAT THE ACTION TAKEN BY
THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING
COMMISSION WITHIN TEN (10) CALENDAR DAYS.
FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 96-4:
1. Conditional Use Permit No. 96-4 for the establishment, maintenance and operation of the
two (2) new, three (3) story single family residences will not be detrimental to the general
welfare of persons residing or working in the vicinity nor detrimental to the value of the
property and improvements in the neighborhood. The use is compatible with other
residences in the vicinity, many of which are multi -story, and will be required to comply
with the City of Huntington Beach Infill Ordinance. The property owner will be required
to construct infrastructure improvements and dedicate a portion of the property for alley
widening which will improve vehicle circulation.
2. The granting of Conditional Use Permit No. 96-4 will not adversely affect the General
Plan of the City of Huntington Beach. The use is consistent with the goals and objectives
of the Medium Density Residential land use designation of the General Plan.
3. The proposed use will comply with the provisions of the base district and other applicable
provisions in Titles 20-25 and any specific condition required for the proposed use in the
district in which it would be located. The structures will meet minimum setbacks, provide
sufficient on -site parking and meet all other aspects of the Code.
SPECIAL CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 96-4:
The site plan received and dated February 16, 1996 and floor plans and elevations received
and dated January 29, 1996 shall be the conceptually approved layout.
2. Prior to submittal for building permits, the following shall be completed:
a. Conditions of approval shall be printed verbatim on the cover sheet of all working
drawing sets submitted for plancheck.
b. Depict utility apparatuses, such as but not limited to backflow devices and Edison
transformers on the site plan. They shall be prohibited in the front yard and

exterior sideyards unless properly screened by approved landscaping or any other
method approved by the Community Development Director.
c. Submit three (3) copies of the site plan to the Planning Division for addressing
purposes.
3. Prior to issuance of building permits, the following plans and items shall be submitted
and/or completed by the applicant:
a. A grading plan shall be submitted to the Department of Public Works for review
and approval. This plan, in addition to grading, shall include all of the required
off -site improvements. (PW)
b. A Landscape Construction Set submitted to the Department of Public Works. The
landscape construction set shall include a landscape plan prepared and signed by a
State Licensed Landscape Architect which includes all proposed/existing plant .
materials (location, type, size, quantity), irrigation plan, grading plan and approved
site plan, and copy of conditions of approval. The landscape plan shall be in
conformance with Chapter 232 of the Huntington Beach Zoning and Subdivision
Ordinance. The set must be complete and approved by both Departments of
Community Development and Public Works prior to issuance of building permits.

c. The following dedication shall be required:
i. 2.50 feet off of the alley. (PW)
d. Note on plans (FD):
i. The project will comply with all provisions of the Huntington Beach Fire Code
and City Specification #422 and #431 for the abandonment of oil wells and site
restoration.
ii. The project will comply with all provisions of Huntington Beach Municipal
Code Title 17.04.085 and City Specification #429 for new construction within
the methane gas overlay districts.
e. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all
rooftop mechanical equipment and shall delineate the type of material proposed to
screen said equipment.
4. Prior to final inspection or Certificate of Occupancy (PW):
a. Remove one-half (1/2) of existing asphalt alley and replace with concrete half
alley.

b. Remove existing curb and replace with curb and gutter.
c. Remove and replace existing sidewalk.
d. Install new water service to each lot.
Prior to final building permit approval of the first unit, the following shall be completed:
a. All building spoils, such as unusable lumber, wire, pipe, and other surplus or
unusable material,shall be disposed of at an off -site facility equipped to handle
them.
b. Compliance with all conditions of approval specified herein shall be accomplished.
6. Natural Gas shall be stubbed in at the locations of cooking facilities, water heaters, and
central heating units.
7. Low -volume heads shall be used on all spigots and water faucets.
8. The Zoning Administrator shall be notified in writing if any changes in building height,
floor area, setbacks, building elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the Zoning Administrator has
reviewed and approved the proposed changes. The Zoning Administrator reserves the
right to require that an amendment to the original entitlement be processed if the proposed
changes are of a substantial nature.
INFORMATION ON SPECIFIC CODE REOUIREMENTS:
The development shall comply with all applicable provisions of the Huntington Beach
Zoning and Subdivision Ordinance, including the Residential Infill provisions, Building
Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances,
and standards.
The applicant shall obtain the necessary permits from the South Coast Air Quality
Management District.
4. All applicable Public Works fees shall be paid.
5. Traffic Impact fees shall be paid at the time of issuance of a Certificate of Occupancy or
final inspection.
6. An encroachment permit shall be required for all work within the City right-of-way.

7. Landscaping shall comply with Chapter 232 of the Huntington Beach Zoning and
Subdivision Ordinance.
8. Park and Recreation fees shall be paid at issuance of building permits.
9. Construction shall be limited to Monday through Saturday, 7:00 AM to 8:00 PM.
Construction shall be prohibited Sundays and federal holidays.
10. The Zoning Administrator reserves the right to revoke Conditional Use Permit No. 96-4 if
any violation of these conditions of the Huntington Beach Zoning and Subdivision
Ordinance occurs.
ITEM 2: COASTAL DEVELOPMENT PERMIT NO.96-1
USE PERMIT NO.96-2
Applicant: Richard L. Anderson
Request: To permit the construction of a new, three (3) story 8,495 square foot single
family home with 864 square feet of garage.
Location: 3832 Seascape (Trinidad Island, Huntington Harbor)
Mary Beth Broeren, project planner, stated that this was a request to permit the construction of a
new, three (3) story 8,495 square foot single family home with 864 square feet of garage. The
proposal meets site coverage and setbacks. Per the Fire Department, an automatic sprinkler
system must be installed, as well as a two (2) inch meter to provide ample water. It was noted
that the maximum height proposed for this structure is 30 feet. The Building Division stated that
because of the size of the structure, two (2) exits must be provided off of the second floor. No
calls in opposition of the project have been received. Ms. Broeren stated that the applicant will be
required to comply with standard conditions, such as grading and landscaping plans. Staff
recommended approval of this request.
THE PUBLIC HEARING WAS OPENED.
Richard Anderson, applicant, stated that he would comply with all conditions of approval.

COASTAL DEVELOPMENT PERMIT NO, 96-IIUSE PERMIT NO. 96-2 WAS
CONDITIONALLY APPROVED BY THE ZONING ADMINISTRATOR. HE STATED
THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE
APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR
DAYS.
FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO. 96-1:
The request for Coastal Development Permit No. 96-1 to permit the construction of a
three-story single family residence conforms with the plans, policies, requirements and
standards of the Coastal Element of the General Plan. The proposed 8,495 square foot
house with an 864 square foot garage will not impact public views or access as none exist
in the vicinity. The house will replace a previous residence which was demolished.
2. Coastal Development Permit No. 96-1 is consistent with the CZ suffix zoning
requirements, the RI Zoning District, as well as other provisions of the Huntington Beach
Ordinance Code applicable to the property. The proposed development will conform with
all applicable City Codes, including height, setbacks and parking.
3. At the time of occupancy, the proposed three-story single family residence will be
provided with infrastructure in a manner that is consistent with the Coastal Element of the
General Plan. All infrastructure currently exist to the site.
4. The proposed three-story single family residence conforms with the public access and
public recreation policies of Chapter 3 of the California Coastal Act. No public access or
recreational opportunities will be affected by the new construction.
FINDINGS FOR APPROVAL - USE PERMIT NO. 96-2:
Use Permit No. 96-2 for the establishment, maintenance and operation of the three-story
single family residence will not be detrimental to the general welfare of persons residing or
working in the vicinity nor detrimental to the value of the property and improvements in
the neighborhood. The use is compatible with other single family units in the vicinity.
2. The granting of Use Permit No. 96-2 will not adversely affect the General Plan of the City
of Huntington Beach. The use is consistent with the Residential Low Density land use
designation.
3. The proposed use will comply with the provisions of the base district and other applicable
provisions in Titles 20-25 and any specific condition required for the proposed use in the
district in which it would be located. The unit will meet minimum setbacks, provide
sufficient on -site parking and meet all other aspects of the Code.

SPECIAL CONDITIONS OF APPROVAL COASTAL DEVELOPMENT PERMIT NO.
96-1 / USE PERMIT NO. 96-2:
1. The site plan, floor plans, and elevations received and dated January 18, 1996 shall be the
conceptually approved layout.
2. Prior to submittal for building permits, the following shall be completed:
a. Conditions of approval shall be printed verbatim on the cover sheet of all working
drawing sets submitted for plancheck.
b. Depict utility apparatuses, such as but not limited to backflow devices and Edison
transformers on the site plan. They shall be prohibited in the front yard and
exterior sideyards unless properly screened by approved landscaping or any other
method approved by the Community Development Director.
c. Comply with the City of Huntington Beach Residential Infill Ordinance, as set
forth in Section 230.22 of the Huntington Beach Zoning and Subdivision
Ordinance.
3. Prior to issuance of building permits, the following shall be completed by the applicant:
a. A grading plan shall be submitted to the Department of Public Works for review and
approval. (PW)
b. A Landscape Construction Set submitted to the Department of Public Works. The
landscape construction set shall include a landscape plan prepared and signed by a

with Huntington Beach Fire Department and Uniform Building Code Standards. Shop
drawings will be submitted to and approved by the Fire Department prior to

4. Prior to final inspection, the following shall be completed by the applicant:

5. Prior to final building permit approval, the following shall be completed:
