ORAL COMMUNICATION: None ITEM 1: CONDITIONAL USE PERMIT NO.96-67 (ANTENNA) APPLICANT: JM Consulting Group, Inc, 9 Executive Circle, #275, Irvine, CA 92614 PROPERTY OWNER: Huntington Beach Union High School, 10251 Yorktown Avenue, Huntington Beach, CA 92648 REQUEST: To construct a 331 square foot cellular facility and to erect an 85 foot high cellular antenna monopole. LOCATION: 1905 Main Street (Huntington Beach Union High School at Yorktown Avenue) PROJECT PLANNER: Hannah B. Bowen Hannah Brondial Bowen, Staff Planner, stated the applicant JM Consulting Group is requesting to construct a 331 square foot cellular facility and to erect an 85 foot high cellular antenna monopole at 1905 Main Street (Huntington Beach High School). The cellular facility monopole would be located between the baseball and track and football stadium. The subject property is zoned Public -Semi -Public and the General Plan designation is Public -Residential Low. A conditional use permit is required because the monopole would exceed the maximum height standard for the PS zone by 25 feet. In addition to the monopole, the cellular facility would house six (6) equipment cabinets. Access to the site would be from Main Street. The applicant has indicated the facility will be unmanned, however, maintenance of the facility would occur once every three (3) months. Three (3) monopoles currently exist on the site, their heights range from 65 feet to 107 feet. This project was reviewed by the Design Review Board and they continued the item to a future date until the applicant has explored the possibility of co -locating the monopole, placing it on a light stand, placing it on a tall building nearby or relocating it. Staff is recommending a continuance of this item to a date uncertain with re -notification of the hearing. Herb Fauland, Zoning Administrator, stated that he would accept this recommendation and asked the applicant if he concurred. Ed Gala, JM Consulting, 9, Executive Circle, applicant, stated he concurred with the recommendation to continue this item to a date uncertain. CONDITIONAL USE PERMIT NO.96-67 WAS CONTINUED TO A DATE UNCERTAIN WITH RE -NOTIFICATION OF THE HEARING, BY THE ZONING ADMINISTRATOR. ITEM 2: TEMPORARY USE PERMIT NO.96-13 (FURNITURE SALE) APPLICANT: Lifetime Furniture, Truyen Le, 7672 Edinger Avenue, Huntington Beach, CA 92647 PROPERTY OWNER: Sherlane/Terranomics, 18593 Main Street, Huntington Beach, CA 92648 REQUEST: To allow a three (3) week home furnishings sidewalk sale in front of the furniture store. Days/hours of operations will be November 2, 1996 to November 23, 1996, 7 days a week during regular business hours. LOCATION: 7672 Edinger Avenue (southeast corner of Edinger Avenue and Sher Lane) PROJECT PLANNER: Lisa Mercurio Lisa Mercurio, Staff Planner, presented a site plan and stated the request is located at 7672 Edinger Avenue in the Sher Lane Shopping Center. The use is surrounded by retail to the east and west, Residential Medium -High Density to the south, and commercial to the north across from Edinger Avenue. The applicant was not present, but Ms. Mercurio stated that she had tried to contact him and he had not returned her call. Ms. Mercurio stated the request is for a three (3) week home furnishings sidewalk sale in front of the furniture store. The tentative start date is November 2, continuing through November 23, operating seven (7) days a week 10:00 AM to 9:00 PM. The applicant has held the sidewalk sale in previous years, as approved by the Zoning Administrator. The use complies with the General Plan and Zoning designations for the area and is compatible with the commercial nature of the center. The request will generate a need for six (6) parking spaces which will be adequately provided by the existing parking spaces. Standard comments received by the Building Division and Fire Department have been incorporated into the conditions. No comments have been received from the surrounding area business owners or residents. ZA Minutes - 10/23/96 2 (min1023) Staff is recommending approval as the temporary use will not be detrimental to the property. The suggested conditions of approval are consistent with the previous approvals, for a similar request. Herb Fauland, Zoning Administrator, asked Ms. Mercurio if she was able to relay the conditions to the applicant. Ms. Mercurio stated she had not as he had not returned her call, but that the conditions are consistent with those approved the previous year for a similar request. THE PUBLIC HEARING WAS OPENED. THERE WERE NO PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. TEMPORARY USE PERMIT NO.96-13 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL - TEMPORARY USE PERMIT NO.96-13: 1. Approval of the application for Temporary Use Permit No. 96-13 will not be detrimental to property or improvements in the surrounding area or to the public health, safety or general welfare. 2. Temporary Use Permit No. 96-13 for the establishment, maintenance and operation of the three week sidewalk sale will not be detrimental to the general welfare of persons residing or working in the vicinity nor detrimental to the value of the property and improvements in the neighborhood. The event in the parking lot will not block entrances or accessibility, and there is ample parking. The event is temporary in nature and security personnel will be present. The specific conditions of approval addressing hours of operation, noise levels and clean-up of the site have been applied to this request to insure the general welfare of adjacent residents. 3. The granting of Temporary Use Permit No. 96-13 will not adversely affect the General Plan of the City of Huntington Beach. The use is consistent with the General Plan goal to enrich the quality of life for all citizens of Huntington Beach by providing constructive and creative leisure opportunities. CONDITIONS OF APPROVAL - TEMPORARY USE PERMIT NO.96-13: 1. The site plan received and dated October 15, 1996, as modified by staff shall be the conceptually approved layout. ZA Minutes - 10/23/96 3 (min1023) 2. The event shall be held November 2, 1996 to November 24, 1996. Hours of Operation shall be between 10:00 AM and 9:00 PM daily. 3. A detailed site plan shall be submitted to the Huntington Beach Fire Department for approval (show table locations, canopy, barriers, etc.) 4. Fire access lanes of a minimum of 20 feet shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. (FD) 5. The applicant shall obtain all necessary Fire Department permits for canopy and comply with all provisions of Article 32 of the Uniform Code. (FD) 6. "No Smoking" signs shall be posted in conspicuous locations. 7. Fire extinguishers shall be provided in number and at locations specified by the Fire Department. 8. The 20' x 70' canopy shall be secured to the ground and be secure from collapse. The canopy shall be open on all sides or building permits will be required. (BD) 9. Exits from building shall not be blocked for any reason. (BD) 10. Access for the Disabled must be provided to all sales areas. (BD) 11. The applicant shall obtain permits for all electricity to the proposed canopy. All electrical extension cords shall be protected from foot and automobile traffic. 12. No open flame cooking devices for hot dogs or other refreshments shall be permitted. 13. An overnight security guard shall be provided to protect merchandise left overnight. The Huntington Beach Police Department shall be notified 24 hours prior to the event. 14. Temporary signs shall be permitted during the sales event pursuant to Chapter 233 of the Huntington Beach Zoning and Subdivision Ordinance. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. Temporary Use Permit No. 96-13 shall not become effective until the ten day appeal period has elapsed. 2. Temporary Use Permit No. 96-13 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Department of Community Development a minimum 30 days prior to the expiration date. The Zoning Administrator reserves the right to revoke Temporary Use Permit No. 96-13, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 4. The applicant shall submit a check in the amount of $38.00 for the posting of the Notice of Exemption/Determination at the County of Orange Clerk's Office. The check shall be made out to the County of Orange and submitted to the Department of Community Development within two (2) days of the Zoning Administrator's action.
