Brondial Bowen, Mary Beth Broeren, Kim Langel (recording secretary) MINUTES: None ORAL COMMUNICATION: None ITEM 1: CONDITIONAL USE PERMIT NO.96-69 (HYDROSPIN OUTDOOR STORAGE) APPLICANT: Hydrospin, Inc, 5281 Research Drive, Huntington Beach, CA 92649 PROPERTY OWNER: Jens Jensen, 5992 Manorfield Drive, Huntington Beach, CA 92648 REQUEST: To permit outdoor storage and to approve a parking area plan. LOCATION: 5281 Research Drive (including parcels 145-461-9, -10, -11; 145-462-5; 145- 511-4) (west of Graham Street) PROJECT PLANNER: Hannah L. Brondial Bowen Hannah L. Brondial Bowen, Staff Planner, displayed site plans stating the request was to allow outdoor storage as designated on the site plan and off -site parking for five (5) parcels located at 5281 Research Drive. Staff stated that the subject properties have enough area to allow outdoor storage as well as meet the required parking for all five (5) parcels. The use requires 85 parking spaces and 94 parking spaces are provided. The off -site employee parking will be provided at a distance of less than 200 feet from the main building. Staff stated that they had received one (1) phone call from the adjacent property owner who had no opposition to the request. Staff is recommending approval with findings and conditions of approval as outlined in the staff report. Herb Fauland, Zoning Administrator, asked staff if the Kayline property parking plan could be combined with the applicants. Staff stated it could be combined. Mr. Fauland asked how tall the storage shed would be and would it comply with code required setbacks. Staff stated that it is 18 feet tall and complies with code required setbacks. Mr. Fauland suggested that the site plan show the dimensions of the setbacks and that parking spaces shown on the plan be kept clear and unobstructed at all time. Mr. Fauland asked if this request was due to Code Enforcement complaints. Staff stated that it was. Hannah L. Brondial Bowen, Staff Planner, displayed a site plan and stated that the subject property is a single family residence currently operating as a small family day care facility. The applicant is requested a conditional use permit for a large family day care facility to allow a maximum of 12 children. The subject property is located in the RL, Low Density Residential zone. Staff is recommending that the applicant obtain a building permit for the patio cover in the rear. There is also a shed that was not originally shown on the site plan and based on staff s site visit it appears to be located on the property line and within three (3) feet of the main residence. City code requires a minimum five (5) foot setback. Staff is recommending that the shed be relocated to the rear two-thirds of the lot and separated from the main dwelling by a distance of five (5) feet. Staff is recommending approval of the project based on the suggested findings and conditions of approval as outlined in the staff report. Herb Fauland, Zoning Administrator, asked staff if there is ample room in the rear yard to move the shed. Staff stated that there was. Mr. Fauland asked if the shed would be considered a minor accessory structure. Staff stated that based on the square footage it is, however, it does exceed the six (6) foot height limit at six (6) foot, ten (10) inches. Mr. Fauland asked staff if any complaints have been received in regards to the small day care center. Staff stated that there had been no Code Enforcement actions on this property. THE PUBLIC HEARING WAS OPENED. Sylvia Watson, 14331 Hammon Lane, applicant, stated that the shed in question is scheduled for demolition. Ms. Watson also questioned staff as to what requirements must be fulfilled to bring the patio cover into conformance. Staff stated that she would need to apply for a building permit. THE PUBLIC HEARING WAS CLOSED. Herb Fauland, Zoning Administrator, stated he would recommend eliminating Condition No. 4 under Code Requirements as there has been no previous history of any complaints regarding the small day care facility. CONDITIONAL USE PERMIT NO.96-82 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. ZA Minutes - 11/27/96 3 (MIN1'127) c. Provide fire alarm per the Huntington Beach Fire Code. d. No bars or grills shall be placed on any window. e. No flammable liquids storage except as allowed by the Huntington Beach Fire Code. 3. The use shall conform to the following: a. The maximum number of children enrolled in the large -family day care shall be 12, including the applicant's children under 10 years of age who reside in the home. b. The hours of operation shall be between 6:00 a.m. - 6:00 p.m., Monday through Friday. 4. The applicant shall obtain and provide evidence of a City business license and State Department of Social Services License permitting the applicant to operate a large family day care, prior to operation of the large family day care. INFORMATION ON SPECIFIC CODE REQUIREMENTS: The development shall comply with all applicable provisions of the Huntington Beach Zoning and Subdivision Ordinance, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant will be responsible for the payment of Traffic Impact fees prior to the operation of the large family day care. 4. The Zoning Administrator reserves the right to revoke Conditional Use Permit No. 96-82 if any violation of these conditions or of the Huntington Beach Zoning and Subdivision Ordinance occurs. 5. Conditional Use Permit No. 96-82 will become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Zoning Administrator pursuant to a written request submitted to the Planning Division a minimum of 30 days prior to the expiration date. ZA Minutes - 11/27/96 (MIN1127) f TEMPORARY USE PERMIT NO.96-15 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL - TEMPORARY USE PERMIT NO.96-15: 1. Temporary Use Permit No. 96-15 for the establishment, maintenance and operation of the model homes complex will not be detrimental to the general welfare of persons working or residing in the vicinity or detrimental to the value of the property and improvements in the neighborhood. Adequate parking and directional signage will be provided for the use. 2. The temporary use permit will be compatible with surrounding uses because the area is approved for detached single family residential units. 3. The proposed use will comply with the provisions of the base district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance and any specific condition required for the proposed use in the district in which it would be located. 4. The granting of the temporary use permit will not adversely affect the General Plan. It is consistent with the Land Use Element designation of Residential Low Density on the subject property. In addition, it furthers the General Plan to provide a mix of housing types within the City. CONDITIONS OF APPROVAL - TEMPORARY USE PERMIT NO.96-15: 1. The site plan, received and dated November 20, 1996, and sign plans received and dated October 29,1996, shall be the conceptually approved layout. 2. Prior to of submittal for building permits, the following shall be completed: a. Zoning entitlement conditions of approval shall be printed verbatim on the cover page of all the working drawing sets used for issuance of building permits (architectural, structural, electrical, mechanical and plumbing). 3. Prior to issuance of building permits, the following shall be completed: a. A $6,000 cash bond shall be posted with the City to guarantee compliance with the conditions of approval. 4. Prior to combustible construction asphalt roadways and fire hydrants serving the model homes shall be installed per Article 9 of the Huntington Beach Fire Code. ,ZA Minutes - 11/27/96 7 (MIN1127) INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. Temporary Use Permit No. 96-15 shall not become effective until the ten day appeal period has elapsed. 2. Temporary Use Permit No. 96-15 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Department of Community Development a minimum 30 days prior to the expiration date. 3. The Zoning Administrator reserves the right to revoke Temporary Use Permit No. 96-15, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 4. The development shall comply with all applicable provisions of the Municipal Code, Building Division, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein. 5. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction shall be prohibited Sundays and Federal holidays. 6. The applicant shall submit a check in the amount of $38.00 for the posting of the Notice of Exemption at the County of Orange Clerk's Office. The check shall be made out to the County of Orange and submitted to the Department of Community Development within two (2) days of the Zoning Administrator's action. ITEM 4: TEMPORARY USE PERMIT NO.96-16 (HILLCREST MODEL HOME COMPLEX) APPLICANT: Polygon Communities, Inc., 15751 Rockfield Blvd., Ste. 120, Newport Beach, CA 92660 PROPERTY OWNER: PLC, 23 Corporate Plaza, Ste. 250, Newport Beach, CA 92660 REQUEST: To permit a model home sales complex for a portion of the previously approved Tentative Tract No. 14700 (Peninsula II). LOCATION: 19431, 19435, 19436 Foxdale Circle (south of Summit Drive, east of Seapoint Avenue) PROJECT PLANNER: Mary Beth Broeren Mary Beth Broeren, Staff Planner, displayed a site plan and stated that this model home complex will be for the sale of 79 homes within the Peninsula II area, Tract 14700. Ms. Broeren stated the Building Division has reviewed the plans and is requiring the applicant to relocate the handicap parking stalls. The applicant will have a portable restroom which is shown on an adjacent lot in compliance with ADA requirements as the sales office restroom will not comply with these requirements. The parking lot has 12 spaces with additional on -street parking which staff feels is adequate. The applicant will have three (3) model homes and a sales office and will be required to post a $4,000 bond. ZA Minutes - 11/27/96 9 (MIN1127) CONDITIONS OF APPROVAL - TEMPORARY USE PERMIT NO.96-16: 1. The site plan received and dated November 26, 1996, shall be the conceptually approved layout, with the following modifications: a. The plan will be revised to show the new location of the handicapped parking space and portable restroom building. ' b. A maximum of six flags shall be shown on the site plan. c. The plan will identify that the cul-de-sac will be used for overflow parking. 2. Prior to of submittal for building permits, the following shall be completed: a. Zoning entitlement conditions of approval shall be printed verbatim on the cover page of all the working drawing sets used for issuance of building permits (architectural, structural, electrical, mechanical and plumbing). b. A revised site plan will be submitted to the Community Development Department for the inclusion in the entitlement file. 3. Prior to issuance of building permits, the following shall be completed: a. A $4,000 cash bond shall be posted with the City to guarantee compliance with the conditions of approval. 4. Prior to combustible construction asphalt roadways and fire hydrants serving the model homes shall be installed per Article 9 of the Huntington Beach Fire Code (FD). 5. During construction, the applicant shall: a. Use water trucks or sprinkler systems in all areas where vehicles travel to keep damp enough to prevent dust raised when leaving the site: b. Wet down areas in the late morning and after work is completed for the day; c. Use low sulfur fuel (.05%) by weight for construction equipment; d. Attempt to phase and schedule construction activities to avoid high ozone days (first stage smog alerts); e. Discontinue construction during second stage smog alerts. 6. Prior to final building permit inspection and approval of the first residential unit, the following shall be completed: a. Compliance with all conditions of approval specified herein shall be accomplished and verified by the Community Development Department. ZA Minutes - 11/27/96 11 (MINI 127) C 6.
