ZONING ADMINISTRATOR: Herb Fauland STAFF MEMBER: Wayne Carvalho, Peter Vanek, Kim Langel (recording secretary) MINUTES: August 20, August 27 and September 10, 1997 minutes were approved. ORAL COMMUNICATION: None ITEM 1: REVOCATION OF CONDITIONAL USE PERMIT NO.95-32/COASTAL DEVELOPMENT PERMIT NO.95-21 (PETE'S MEXICAN FOOD OUTDOOR DINING PERMIT) APPLICANT: Pete's Mexican Food, c/o Mary Aparicio, 213-5th Street, Huntington Beach, CA 92648 PROPERTY OWNER: Max E. Groussman, 421 Rolling Hills Pl., Anaheim, CA 92807 REQUEST: Revocation of Conditional Use Permit No. 95-32 and Coastal Development Permit No. 95-21 for the outdoor dining permit for Pete's Mexican Food for failure to comply with the conditions of approval. LOCATION: 213-5th Street (Pete's Mexican Food) PROJECT PLANNER: Wayne Carvalho Wayne Carvalho, Staff Planner, displayed site plan stating the request is for revocation of Conditional Use Permit No. 95-32 and Coastal Development Permit No. 95-21 for the outdoor dining permit for Pete's Mexican Food. The revocation hearing is for failure to comply with the conditions of approval. No comments, written or verbal, have been received from the public. Staff stated that the applicant needs to submit a signed, notarized copy of the license agreement and proof of insurance to comply with conditions of approval. Staff stated that they would recommend a continuance to allow the applicant adequate time to fulfill the conditions of approval. Staff also stated that Mike Fuentes, Code Enforcement Officer, was present to answer any questions. Herb Fauland, Zoning Administrator, asked Mike Fuentes to describe the history of the City's attempt to notify the property owner of their violation. Mr. Fuentes, Code Enforcement Officer, stated that he had previously hand delivered letters three (3) times. He made his last attempt with a letter sent on September 17, 1997 requiring compliance within 30 days. THE PUBLIC HEARING WAS OPENED. Mary Aparicio, 213-5`h Street, applicant, stated that she and her husband had taken the business over a year ago when her father had become ill. She stated that she thought everything was in order and requested a continuance to allow her to comply with the conditions. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. Herb Fauland, Zoning Administrator, stated that he would grant a two (2) week continuance to allow the applicant to comply with the conditions of approval. THE REVOCATION OF CONDITIONAL USE PERMIT NO.95-32 AND COASTAL DEVELOPMENT PERMIT NO.95-21 WAS CONTINUED BY THE ZONING ADMINISTRATOR TO THE FEBRUARY 18,1998 MEETING. ITEM 2: REVOCATION OF CONDITIONAL USE PERMIT NO.95-41/COASTAL DEVELOPMENT PERMIT NO 95-15 (LUIGI'S RESTAURANT OUTDOOR DINING) APPLICANT: Ghassan Dahabreh, 221 Main Street, Suite B, Huntington Beach, CA 92648 PROPERTY OWNER: Ben Trainer, 2364-3`d Street, San Francisco, CA 94107 REQUEST: Revocation of Conditional Use Permit No. 95-51 for the outdoor dining permit for Luigi's Restaurant for failure to comply with the conditions of approval. LOCATION: 221 Main Street, Suite B (Luigi's Restaurant) PROJECT PLANNER: Wayne Carvalho Wayne Carvalho, Staff Planner, displayed site plan stating the request is for revocation of Conditional Use Permit No. 95-51 for the outdoor dining permit for Luigi's Restaurant for failure to comply with the conditions of approval. No comments, written or verbal, have been received from the public. Ghassan Dahabreh, 221 Main Street, Suite B, applicant, stated he will comply with conditions of approval and requested a continuance to allow him to do so. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. 'THE REVOCATION OF CONDITIONAL USE PERMIT NO.95-51 WAS CONTINUED BY THE ZONING ADMINISTRATOR TO THE FEBRUARY 18, 1998 MEETING. THE MEETING WAS ADJOURNED AT 1:55 PM BY THE ZONING ADMINISTRATOR TO THE NEXT REGULARLY SCHEDULED MEETING OF THE ZONING ADMINISTRATOR ON WEDNESDAY, FEBRUARY 11,1998 AT 1:30 PM.
