ZONING ADMINISTRATOR: Herb Fauland STAFF MEMBER: Ricky Ramos, bob Goldin, Jane Madera, Peter Vanek, Kim Langel (recording secretary) MINUTES: None ORAL COMMUNICATION: None ITEM 1: CONDITIONAL USE PERMIT NO.98-2 (STORAGE USA) APPLICANT: David King, 1517 Rimrock Drive, Escondido, CA 92027 PROPERTY OWNER: Susa Partnership, LP, 10440 Little Patuxent Pkwy., Suite 1100, Columbia, MD 21044 REQUEST: To allow the conversion of approximately 1,570 square feet of existing self -storage units into a manager's living unit. LOCATION: 7531 McFadden Avenue (northwest corner at the 405 Freeway) PROJECT PLANNER: Ricky Ramos Ricky Ramos, Staff Planner, displayed site plan, vicinity map and photographs stating the request is located in an General Industrial zone and will be compatible with the surrounding uses. Staff stated that the conversion will not be an expansion and will provide more security for the site. Staff is recommending approval of the proposed request as it is consistent with the General Plan and complies with all zoning requirements. THE PUBLIC HEARING WAS OPENED. Inga Wickstrom, 7501 McFadden, stated that she was an adjacent business owner and wanted to make sure that adequate parking would be provided so as not to impact the other businesses in the area. Herb Fauland, Zoning Administrator, asked staff if there would be adequate parking. Staff stated there is adequate parking provided; however, in conversations with Ms. Wickstrom she had stated her concern was that the manager parking space be located in the rear of the building. John Hacker, 2115 Crescent, Anaheim, Storage USA, stated that the on -site manager will park on the side gated area, not in front, as they are designated customer parking only. Deliveries will be directed to the rear of the building. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. Herb Fauland, Zoning Administrator, stated he would be adding a condition to specify that the two required parking spaces for the on -site manager will be located within the gated parking area and marked accordingly on the site plan. CONDITIONAL USE PERMIT NO.98-2 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO.98-2: 1. Conditional Use Permit No. 98-2 for the establishment, maintenance and operation of the on - site manager's living unit for an existing self -storage facility will not be detrimental to the general welfare of persons working or residing in the vicinity or detrimental to the value of the property and improvements in the neighborhood. The on -site manager's living unit will benefit the vicinity by providing additional security to the existing facility. 2. The conditional use permit will be compatible with surrounding uses because it only involves the conversion of existing self -storage units into a living unit for the manager with no building expansion proposed. The proposed exterior modifications maintain the character of the existing building. 3. The proposed conversion of approximately 1,570 square feet of existing self -storage units into a manager's living unit will comply with the provisions of the base district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance and any specific condition required for the proposed -use in the district in which it would be located. Adequate parking is provided for the existing self -storage facility including the on -site manager's living unit. 4. The granting of the conditional use permit will not adversely affect the General Plan. It is consistent with the Land Use Element designation of Industrial on the subject property which permits self -storage facilities. CONDITIONS OF APPROVAL — CONDITIONAL USE PERMIT NO.98-2: 1. The site plan, floor plans, and elevation received and dated March 12, 1998 shall be the conceptually approved layout with the following modifications: a. The two required parking spaces for the on -site manager shall be located within the gated parking area and marked accordingly on the site plan. 2. Prior to submittal for building permits, the following shall be completed: a. Zoning entitlement conditions of approval shall be printed verbatim on the cover page of all the working drawing sets used for issuance of building permits (architectural, structural, electrical, mechanical and plumbing). The on -site manager's living unit shall be constructed in compliance with the State acoustical standards set forth for units that lie within the 60 CNEL contours of the property. Evidence of compliance shall consist of submittal of an acoustical analysis report and plans, prepared under the supervision of a person experienced in the field of acoustical engineering. (Code Requirement) c. All Fire Department requirements shall be noted on the building plans: (FD) 1) Fire extinguishers will be installed and located in areas to comply with Huntington Beach Fire Code Standards. 2) A fire alarm system will be installed to comply with Huntington Beach Fire Department and Uniform Fire Code Standards. Shop drawings will be submitted to and approved by the Fire Department prior to installation. The system will provide the following: a) manual pull stations; b) water flow, valve tamper and trouble detection; c) 24-hour supervision; d) smoke detectors; e) annunciation; f) audible alarms; g) graphic display; h) voice communication. 3) An automatic fire sprinkler system will be installed throughout. Shop drawings will be submitted and approved by the Fire Department prior to system installation. 3. Prior to issuance of building permits, the following shall be completed: a. A Landscape Construction Set must be submitted to the Department of Public Works and approved by the Departments of Public Works and Community Development. The Landscape Construction Set shall include a landscape plan prepared and signed by a State Licensed Landscape Architect which identifies the location, type, size and quantity of all existing plant materials to remain, existing plant materials to be removed and proposed plant materials; an irrigation plan; a grading plan; an approved site plan and a copy of the entitlement conditions of approval. The landscape plans shall be in conformance with Chapter 232 of the Zoning and Subdivision Ordinance and applicable Design Guidelines. It shall include the installation of at minimum two 36-inch box trees in the front landscape area (or the palm equivalent) to meet the current tree requirement. Any existing mature trees that must be removed shall be replaced at a two -to -one ratio (2:1) with minimum 36-inch box trees and shall be incorporated into the project's landscape plan.(PW) (Code Requirement) b. All water systems constructed within the City of Huntington Beach shall be designed, installed and inspected to meet minimum requirements of the City Water Division. (PW) ZA Minutes — 4/29/98 (98ZM0429) c. Backflow protection shall be installed per the City of Huntington Beach Water Division standards for domestic, fire and irrigation water services. Existing services shall be upgraded to meet present City standards or new backflow devices installed. All backflow devices shall be painted to match surrounding aesthetics, and be screened from view to the satisfaction of the City of Huntington Beach Fire Department, Landscape Architect and Water Division. The markings indicating the size, model number and serial number shall be affixed to the body of the backflow device and must remain visible after painting. (PW) d. A new domestic water service and meter shall be required (two inch minimum size for commercial). The existing one -inch domestic meter and service can be used for irrigation if desired by the developer, if properly sized, and in working condition. Any existing water services and meters not utilized for domestic or irrigation services, or deemed not suitable for use, shall be abandoned at the water main and the water meter returned to the Water Division. (PV) e. Submit a copy of the revised site plan pursuant to Condition No. 1 for review and approval and inclusion in the entitlement file. 4. Prior to final building permit inspection and approval, the following shall be completed: a. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District and submit a copy to Department of Community Development. b. All improvements to the property, including landscaping, shall be completed in accordance with the approved plans and conditions of approval specified herein. c. Compliance with all conditions of approval specified herein shall be accomplished and verified by the Community Development Department. d. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 5. The on -site manager and his/her household will park only in the designated parking spaces within the gated parking area at all times. 6. The Community Development Director ensures that all conditions of approval herein are complied with. The Community Development Director shall be notified in writing if any changes to the site plan, elevations and floor plans are proposed as a result of the plan check process. Building permits shall not be issued until the Community Development Director has reviewed and approved the proposed changes for conformance with the intent of the Zoning Administrator's action and the conditions herein. If the proposed changes are of a substantial nature, an amendment to the original entitlement reviewed by the Zoning Administrator may be required pursuant to the HBZSO. ZA Minutes — 4/29/98 4 (98ZM0429) INFORMATION ON SPECIFIC CODE REQUIREMENTS• 1. Conditional Use Permit No. 98-2 shall not become effective until the ten-day appeal period has elapsed. 2. Conditional Use Permit No. 98-2 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Department of Community Development a minimum 30 days prior to the expiration date. 3. The Zoning Administrator reserves the right to revoke Conditional Use Permit No. 98-2, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 4. All applicable Public Works fees shall be paid. The developer will be responsible for the payment of any additional fees adopted in the "upcoming" Water Division Financial Master Plan. (PW) 5. A Certificate of Occupancy must be issued by the Department of Community Development prior to occupying the building. 6. The development shall comply with all applicable provisions of the Municipal Code, Building Division, and Fire Department as well as applicable local, State and'Federal Fire Codes, Ordinances, and standards, except as noted herein. 7. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction shall be prohibited Sundays and Federal holidays. 8. The applicant shall submit a check in the amount of $38.00 for the posting of the Notice of Exemption at the County of Orange Clerk's Office. The check shall be made out to the County of Orange and submitted to the Department of Community Development within two (2) days of the Zoning Administrator's action. ITEM 2: COASTAL DEVELOPMENT PERMIT NO.98-9/ CONDITIONAL USE PERMIT NO.98-13 (GRANI RESIDENCE) APPLICANT Zachary Sham, 2600 Newport Blvd., #154, Newport Beach, CA 92663 PROPERTY OWNER: Gregory Grani, 3302 Gilbert Drive, Huntington Beach, CA 92649 REQUEST: To permit an 1,100 square feet addition and a third story open deck to an existing single family residence. LOCATION: 3302 Gilbert Drive (between Channel Lane and Somerset Lane) PROJECT PLANNER: Bob Goldin COASTAL STATUS: APPEALABLE Bob Goldin, Staff Planner, displayed site plan, plot plan and photographs, stating the subject site is locate in the RL-CZ, Low Density Residential -Coastal Zone. The use will comply with requirements for this zoning. Staff has received Homeowners Association approval. No comments, written or verbal, have been received from the public. ZA Minutes — 4/29/98 5 (98ZM0429) Staff is recommend approval of the proposed request as it will not impact public views or access to coastal resources and will conform will all applicable development standards including setbacks, parking and site coverage requirements Herb Fauland, Zoning Administrator, asked staff is the proposed materials and colors will be compatible with the original home. Staff stated that they would be compatible. THE PUBLIC HEARING WAS OPENED. Zachary Sham, 2545 Crestview, Newport Beach, applicant, concurred with staffs report and recommendation. Jim Andrews, Huntington Harbour Architectural Review Committee, stated that the Committee had reviewed and approved the plans. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. CONDITIONAL USE PERMIT NO.98-13 AND COASTAL DEVELOPMENT PERMIT NO.98-9 WERE APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO.98-9: 1. Coastal Development Permit No. 98-9 for the development project, as proposed or as modified by conditions of approval, conforms with the General Plan, including the Local Coastal Program. The proposed addition will not impact public�views or access to coastal resources. 2. The project is consistent with the requirements of the CZ Overlay District, the base zoning district, as well as other applicable provisions of the Municipal Code. The proposed development will conform with all applicable development standards including setbacks, parking and site coverage requirements. 3. At the time of occupancy the proposed development can be provided with infrastructure in a manner that is consistent with the Local Coastal Program. All infrastructure currently exists at the site. 4. The development conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. No public access will be affected as a result of the new construction. FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO.98-13: 1. Conditional Use Permit No. 98-13 for the establishment, maintenance and operation of the addition to the existing residence will not be detrimental to the general welfare of persons working or residing in the vicinity or detrimental to the value of the property and improvements in the neighborhood, in that the addition is designed to integrate with the existing neighborhood and will comply with all development standards. The proposed addition will be compatible with surrounding uses because the proposed colors, materials and design of the addition will be compatible with the existing dwelling and the surrounding neighborhood. 3. The proposed addition to the existing residence will comply with the provisions of the base district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance and any specific condition required for the proposed use in the district in which it would be located. No special considerations or variances are requested. 4. The granting of the conditional use permit will not adversely affect the General Plan. It is consistent with the Land Use Element designation of Residential Low Density — Coastal Zone (RL-CZ) on the subject property. In addition, it is consistent with the following goals and policies of the General Plan: a. Require that all new residential development within existing neighborhoods be compatible with existing structures (LU 9.1.2). b. Ensure that structures and sites are designed and constructed to maintain their long-term quality (LU 4.2). c. Identify and reinforce a distinctive architectural and environmental image of each district in Huntington Beach (UD 1.1). CONDITIONS OF APPROVAL - COASTAL_ DEVELOPMENT PERMIT NO.98-9 AND CONDITIONAL USE PERMIT NO.98-13: 1. The site plan, floor plans and elevations received and dated February 24, 1998, shall be the conceptually approved layout with the following modification: a. Elevations shall depict colors and building materials proposed. 2. Prior to submittal of building permits, submit a copy of the revised site plan, floor plans and elevations pursuant to Condition No. 1 for review and approval and inclusion in the entitlement file to the Department of Community Development. 3. Prior to final building permit inspection and approval, the following shall be completed: a. All improvements to the property shall be completed in accordance with the approved plans and conditions of approval specified herein, b. Compliance with all conditions of approval specified herein shall be accomplished and verified by the Community Development Department. c. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. d. Install a backflow device in accordance with the requirements of the Public Works Department. (PW) ZA Minutes — 4/29/98 7 (98ZM0429) 4. During construction, the applicant shall: a. Use water trucks or sprinkler systems in all areas where vehicles travel to keep damp enough to prevent dust raised when leaving the site: b. Wet down areas in the late morning and after work is completed for the day; c. Use low sulfur fuel (.05%) by weight for construction equipment; d. Attempt to phase and schedule construction activities to avoid high ozone days (first stage smog alerts); e. Discontinue construction during second stage smog alerts. 5. The Community Development Director ensures that all conditions of approval herein are complied with. The Community Development Director shall be notified in writing if any changes to the site plan, elevations and floor plans are proposed as a result of the plan check process. Building permits shall not be issued until the Community Development Director has reviewed and approved the proposed changes for conformance with the intent of the Zoning Administrator's action and the conditions herein. ITEM 4: ENTITLEMENT PLAN AMENDMENT NO.98-1 (COUNTY SANITATION DISTRICT OF ORANGE COUNTY) APPLICANT/ PROPERTY OWNER: County Sanitation District of Orange County, c/o Kathy Millea, PO Box 8127, Fountain Valley, CA 92728-8127 REQUEST: To permit a revision to a previously approved project and allow construction of a 20,000 square foot warehouse instead of the approved 45,000 square foot building. LOCATION: 22212 Brookhurst Street (OC Sanitation District, northeast of Brookhurst Street and Pacific Coast Highway) PROJECT PLANNER: Jane Madera Jane Madera, Staff Planner, displayed site plan and photographs, stating the original application had been approved in 1994. Because of the Orange County Bankruptcy the project had been put on hold and now the applicant is requesting a revision to the original request. The request will include a reduction and a relocation of the warehouse. No comments, written or verbal, have been received from the public. ZA Minutes — 4/29/98 9 (98ZM0429) Staff is recommending approval of the proposed request as the building construction will not infringe upon any public view of coastal waters and will not affect access to the shoreline. The project will be compatible with the residential neighborhood to the west of Brookhurst since the structure will be screened from view by substantial landscaping and an existing block wall. The proposed development will also conform to all applicable city codes and applicable Fire, Building and Public Works requirements. Herb Fauland, Zoning Administrator, asked staff if they feel the landscape screening will be adequate. Staff stated that it will be adequate and in addition some trees within the perimeter will be removed and replaced at a 2:1 ratio. THE PUBLIC HEARING WAS OPENED. ENTITLEMENT PLAN AMENDMENT NO.98-1 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) CALENDAR DAYS. FINDINGS FOR APPROVAL — ENTITLEMENT PLAN AMENDMENT NO.98-1: 1. Entitlement Plan Amendment No. 98-1 for the establishment, maintenance and operation of a 20,000 square foot warehouse for the Orange County Sanitation District will not be detrimental to the general welfare of persons working or residing in the vicinity or detrimental to the value of the property and improvements in the neighborhood. The 20,000 square foot warehouse is designed to integrate with the existing neighborhood and the site is physically suitable for the type of development. The construction will take place entirely within the Sanitation District compound. The buildings will be set well back from Brookhurst Street (approximately 80 feet) and screened from view with an existing eight to nine foot tall flood wall and substantial landscape buffers. The building construction will not infringe upon any public view of coastal waters and will not affect access to the shore line. No access to the beach through the plant currently exists and is not proposed as a result of this project. 2. The entitlement plan amendment will be compatible with the surrounding uses. The proposed 20,000 square foot warehouse is designed to be compatible with the existing Sanitation District structures. The project will also be compatible with the residential neighborhood to the west of Brookhurst since the structure will be screened from view by substantial landscaping and an existing block wall. 3. The proposed 20,000 square foot warehouse will comply with the provisions of the base district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance and any specific condition required for the proposed use in the district in which it would be located. The proposed development will conform with all applicable city codes, such as, parking, landscaping, building height, setbacks, floodplain standards, and applicable Fire, Building and Public Works requirements. It is consistent with the Land Use Element designation of P (Public) on the subject property. In addition, it is consistent with the following goals and policies of the General Plan: a. Goal LU 13: Achieve the development of a mix of governmental service, institutional, educational, and religious uses that support the needs of Huntington Beach's residents. b. Policy LU 13.1.1: Allow for the continuation of existing public and private institutional, cultural, educational, and health uses at their present locations and development of new uses in areas designated on the Land Use Plan Map in accordance with Policy LU 7.1.1. (I-L U 1, I-L U 4, and I-L U 7) CONDITIONS OF APPROVAL — ENTITLEMENT PLAN AMENDMENT NO.98-1: 1. The County Sanitation District shall designate a contact person for use by surrounding residents during construction. The name of the contact person and his/her telephone number shall be mailed to all residents within a 300 foot radius of the plant a minimum of one (1) week prior to construction. d. Automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations and Uniform Building Code Standards. Attempt to phase and schedule construction activities to avoid high ozone days (first stage smog alerts); e. Discontinue construction during second stage smog alerts. 5. Prior to final Building Inspection or Certificate of Occupancy all improvements to the property shall be completed in accordance with the approved plans and conditions of approval specified herein, including: a. Compliance with all conditions of approval specified herein shall be accomplished and verified by the Community Development Department. b. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 6. The Community Development Director ensures that all conditions of approval herein are complied with. LOCATION: 2000 Main Street (southeast corner of Main Street and Yorktown Avenue) PROJECT PLANNER: Peter Vanek Peter Vanek, Staff Planner, displayed elevations and a rendering, stating the request is part of a countywide system for emergency services. The system will include latticework to screen the antennas. The Design Review Board had reviewed the request and discussed relocating the antennas five (5) feet from the edge for additional screening purposes. Staff stated that the nine (9) foot high screen wall would be sufficient to screen the antennas. Staff is recommending approval of the proposed request as the antennas will be integrated into the design and architecture of the building, minimizing visual impacts from adjacent properties. The wireless communication facility will not generate noise, traffic or other impacts, which would be detrimental to surrounding commercial and residential uses. The proposed antennas will not be visible from neighboring residential developments. The use also conforms with zoning requirements and is consistent with the General Plan. THE PUBLIC HEARING WAS OPENED. Eric Charlonne, Public Works Department, concurred with staff s report and recommendation. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. Herb Fauland, Zoning Administrator, stated that he would approve the request with a screen wall of six (6) feet high in lieu of nine (9) feet high with the dishes and lattice/structure to be painted a light brown to match the existing building. The antennas will be integrated into the design and architecture of the building, minimizing visual impacts from adjacent properties. The wireless communication facility will not generate noise, traffic or other impacts which would be detrimental to surrounding commercial and residential uses. 2. The conditional use permit will be compatible with surrounding office and residential uses. The proposed antennas will be integrated into the design of the building and will not be visible from neighboring residential developments. 3. The proposed wireless communication facility will comply with the provisions of the base district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance and any specific condition required for the proposed use in the district in which it would be located. In addition, the operation of the wireless communication facility will provide enhanced, reliable mobile communication for police, fire public works and marine safety personnel. 4. The granting of the conditional use permit will not adversely affect the General Plan. It is consistent with the Land Use Element designation of Public on the subject property. The elevations and roof plan received and dated April 23, 1998" shall be the conceptually approved layout with the following modifications: a. A six foot high screen wall extending to the outer limits of the microwave dish antennas and/or the lattice structure (whichever extends furthest), shall be situated five (5) feet back from the building fagade and painted to match the building color. b. The microwave dish antennas, lattice structure and any other antennas mounted to the lattice structure shall be painted to match the building color. c. The Design Review Board action of April 9, 1998 shall be modified as noted in condition of approval No. 1 a and 1 b. 2.
