ITEM 1: TEMPORARY USE PERMIT NO.98-8 (THE TRADING POST)
APPLICANT: Mark Miller
REQUEST: To permit temporary outdoor retail sales twice yearly for five
years.
LOCATION: 6946 Warner Avenue (south side, west of Goldenwest Street)
PROJECT PLANNER: Peter Vanek
Peter Vanek, Staff Planner, displayed a site plan stating that the request for the temporary
outdoor retail trailer complies with city zoning requirements. The Trailer will not block
entrances or accessibility to other businesses in the center and ample parking is provided.
Staff is recommending approval of the proposed request as outlined in the suggested
findings and conditions of approval.
Mike Strange, Acting Zoning Administrator, asked staff what the duration of the display
would be. Staff stated the trailer would be displayed for approximately two (2) weeks for
each duration. Mr. Strange asked if there are any current or past problems with parking
in the area. Staff stated there was not.
THE PUBLIC HEARING WAS OPENED.
Mark Miller, 6952 Warner Avenue, applicant, stated that he concurred with staff s
recommendation and conditions of approval.
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR
AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED.
TEMPORARY USE PERMIT NO.98-8 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS
OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION
WITHIN TEN (10) CALENDAR DAYS.
FINDINGS FOR APPROVAL - TEMPORARY USE PERMIT NO.98-8:
1. Temporary Use Permit No. 98-8 for the establishment, maintenance and operation of
the placement of a truck trailer in the parking lot from August 26, 1998 to September
9, 1998; June 24, 1999 to July 7, 1999; August 27, 1999 to September 9, 1999; June
23, 2000 to July 6, 2000; August 25, 2000 to September 8, 2000; June 27, 2001 to
July 9, 2001; August 24, 2001 to September 7, 2001; June 28, 2002 to July 8, 2002;
and August 23, 2002 to September 9, 2002 will not be detrimental to the general
welfare of persons residing or working in the vicinity nor detrimental to the value of
the property and improvements in the neighborhood. The truckload sale in the
parking lot will not block entrances or accessibility to the businesses in the center and
ample parking will be provided. In addition, there are no residences within the
vicinity.
2. The granting of Temporary Use Permit No. 98-8 will not adversely affect the General
Plan of the City of Huntington Beach because the General Commercial land use
designation promotes various types of retail activities.
3. The proposed use will comply with the provisions of the base district and other
applicable provisions in Titles 20-25 and any specific condition required for the
proposed use in the district in which it would be located.
CONDITIONS OF APPROVAL - TEMPORARY USE PERMIT NO.98-8:
1. The site plan, floor plans, and elevations received and dated June 26, 1998, shall be
the conceptually approved layout.
2. The use shall comply with the following:
a. Fire access lanes shall be maintained. If fire lane violations occur and the
services of the Fire Department are required, the applicant will be liable for
expenses incurred.
b. Should any electrical devices be involved, necessary permits shall be obtained
from the Building Department prior to the event.
c. This action will include necessary permits for temporary signs.

The Community Development Director ensures that all conditions of approval herein
are complied with. The Community Development Director shall be notified in
writing if any changes to the site plan, elevations and floor plans are proposed as a
result of the plan check process. Building permits shall not be issued until the
Community Development Director has reviewed and approved the proposed changes
for conformance with the intent of the Zoning Administrator's action and the
conditions herein. If the proposed changes are of a substantial nature, an amendment
to the original entitlement reviewed by the Zoning Administrator may be required
pursuant to the HBZSO.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1.
Temporary Use Permit No. 98-8 shall not become effective until the ten day appeal
period has elapsed.
2.
The development shall comply with all applicable provisions of the Huntington
Beach Zoning and Subdivision Ordinance, Building Division, and Fire Department.
3.
The applicant shall meet all applicable local, State, and Federal Fire Codes,
Ordinances, and standards.
4.
The Zoning Administrator reserves the right to revoke Temporary Use Permit No. 98-
8 if any violation of these conditions of the Huntington Beach Zoning and
Subdivision Ordinance occurs.
