A. ORAL COMMUNICATIONS
Commissioner Biddle, upon advise from the City Attorney, disqualified himself from
participating and voting on the proposed Wal Mart project based upon conflict of interest
regulations due to owning property in the area.
Marvin Josephson, 18162 Pemberco, spoke in opposition to the proposed Wal Mart. He said the
revenue figures provided by the Redevelopment office do not take into account the loss of sales
of existing businesses. The site is inappropriate for the proposed use because of the surrounding
residential, church and cemetery.
Robert Cronk, 18312 Hartlund, said he had been advised by staff that action on theWal Mart
request would be continued and therefore, the residents were advised to attend the October 27,
1998 Planning Commission Meeting. He requested that the public hearing for the October 27,
1998 be open for public input.
Theresa Roberts, 18355 Gum Tree Lane, spoke in opposition to the proposed Wal Mart. She
said Beach Boulevard looks horrible and the City should look at improving the area.
Pat Evans spoke in opposition to the proposed Wal Mart. She said she would like to see the site
used for something for children and a use that would not create more pollution.

Conditional Use Permit No. 98-10 represents a request by Dr. Alison Naito to construct a new
single -story 4,600 square foot animal hospital within the Seabridge Commercial Center. This
application was continued from the August 25, 1998 Planning Commission Meeting to allow the
applicant additional time to obtain written approval from the abutting commercial property
owners regarding off -site improvements proposed on their property. The applicant was again
unable to obtain approval from the neighbors in time for the Planning Commission Meeting.

Staff recommended that Conditional Use Permit No. 98-10 to be continued indefinitely.

DECLARATION NO.98-9 (Fire Station No. 6 and Water Reservoir)
LOCATION: 18590 Edwards Street and 6401 Overlook Drive (West side of Edwards,
300 feet south of Ellis Ave.)

Conditional Use Permit No. 98-44 represents a request by the Fire Department to construct a
12,678 sq. ft. fire station and a request by the Public Works Department to construct a nine
million gallon water reservoir and associated facilities on a vacant four acre site. The facilities
will be owned and operated by the City of Huntington Beach and are requirements of the Holly
Seacliff Specific Plan and Development Agreement. The proposed facilities are necessary in
order to maintain adequate response times to emergency service calls and to provide adequate
water storage capacity.
The fire station is designed to accommodate six personnel and initially will be equipped with one
paramedic engine and staffed with four personnel. The building is one story and except for the
hose tower has a maximum height of 31 feet. Variance No. 98-13 represents a request for a 53
ft* high hose tower in lieu of a maximum 35 ft. building height. The water reservoir consists of a
215 foot diameter tank which will be partially buried below ground. The height of the tank
above ground varies from 13 to 22 feet due to variations in the grade. The pump house will
contain the machinery and equipment necessary to support domestic water service production
and is not permanently staffed.
STAFF RECOMMENDATION:
Staff recommends the Planning Commission approve Conditional Use Permit No. 98-48,
Variance No. 98-13 and Negative Declaration No. 98-9 for the following reasons:
♦ The proposed facilities are consistent with the goals and objectives of the General Plan and will
help to ensure adequate response times and water storage capacity.
♦ Construction of these facilities will fulfill two obligations of the Holly Seacliff Development
Agreement and are identified as required facilities in the Holly Seacliff Specific Plan.
♦ The project is designed to be compatible with the surrounding area in terms of architecture,
landscaping and site layout.
♦ The hose tower variance will not be detrimental to the surrounding area and is necessary due to
site constraints and functionality requirements.
♦ The potential environmental impacts have been evaluated in Negative Declaration No. 98-9 and
mitigation measures will reduce impacts to a level less than significant.
Staff Planner Broeren responded to Commission Tillotson's inquiry regarding the two
community meetings. She advised that twelve people attended the March meeting and the
comments dealt with the operation of the fire station. Five hundred residents were notified of the
July meeting and one person attended.

THE PUBLIC HEARING WAS OPENED.
Jeff Metzel, 19391 Shady Harbor Circle, spoke in support of the request. He said the reservoir
was needed in the event of an earthquake and that it was a requirement of the Holly Seacliff
Development Agreement. He complimented Planning and Fire Department staff for their
excellent work on this project.
Steve Israel, 6561 Horseshoe Lane, said the plan fits into the community; however, the
homeowner's association has concerns regarding the properties that abut Edwards Street. Their
concerns centered on strobe lights and sirens on the fire trucks. He said the environmental
analysisdid not adequately address noise and lights from the fire trucks.

The Commissioners were overall'very pleased with the project. They congratulated the Fire and
Public Works Department for their efforts to make this the best possible project and for
combining the fire station and the reservoir into one project.

FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO.98-48:
1. Conditional Use Permit No. 98-48 for the establishment, maintenance and operation of a
12,678 square foot fire station and a nine million gallon water reservoir and associated
facilities will not be detrimental to the general welfare of persons working or residing in the
vicinity or detrimental to the value of the property and improvements in the neighborhood.
The fire station architecture is designed to be compatible with single family homes in the
area and the station includes improvements that will minimize potential noise and light
impacts. The fire station will improve emergency response times to the area which is a
benefit to lives and property. The water reservoir will improve water storage capacity which
also benefits area residents. Less traffic will be generated by the two uses than if the
property were developed with single family homes.
2. The conditional use permit will be compatible with surrounding uses because the architecture
and site design are sensitive to the existing and planned single family homes in the area. The
fire station architecture is comparable to that of a single family home. A traffic signal will be
installed to generally eliminate the need for exiting fire engines to use sirens and other

mitigation measures have been included to minimize potential noise and light impacts. The
water reservoir is partially below ground and will therefore have a low profile. Targeted
planting areas will also be used to screen the reservoir. Both measures will help to
minimizing any visual impacts resulting from the structure. The pump house and related
equipment will use noise muffling features to minimize potential noise impacts.
3. The proposed fire station and water reservoir will comply with the provisions of the base
district and other applicable provisions in the Holly Seacliff Specific Plan and Titles 20-25 of
the Huntington Beach Zoning and Subdivision Ordinance and any specific condition required
for the proposed use in the district in which it would be located, except for any variances
approved concurrently. The project complies with all setback, landscaping and height
requirements with the exception of the variance for the height of the hose tower.
4. The granting of the conditional use permit will not adversely affect the General Plan. It is
consistent with the Land Use Element designation of Residential Low Density on the subject
property. In addition, it is consistent with the following goals and policies of the General
Plan:
A. Goal LU2: Ensure that development is adequately served by transportation
infrastructure, utility infrastructure, and public services.
B. Policv LU 2.1.1: Plan and construct public infrastructure and service improvements as
demand necessitates to support the land uses specified in the Land Use Plan as defined
in the Public Utilities Element of the General Plan,
C. Policv LU9.3.1: Permit the development of master -planned residential projects that
incorporate a mix of housing types, neighborhood -serving commercial, services,
schools, parks, open space, and other elements in areas designated for residential on the
Land Use Plan Map.
D. Goal PF 2: Ensure adequate protection from fire and medical emergencies for
Huntington Beach residents and property owners.
E. Policy PF 2.1.1: Locate fire stations in a manner which will enable emergency fire
response times to meet a five minute standard, 80 percent of the time.
F. Goal U 1: Provide a water supply system which is able to meet the projected water
demands; upgrade deficient systems and expand water treatment, supply, and
distribution facilities; and pursue funding sources to reduce the costs of water provision
in the City.
G. Obiective U 1.1: Maintain a system of water supply distribution facilities capable of
meeting existing and future daily and peak demands, including fire flow requirements in
a timely and cost efficient manner.
H. Policy U 1.1. S: Designate, preserve, and acquire land for water storage and
transmission facilities, as necessary.

FINDINGS FOR VARIANCE NO.98-13:
1. The granting of Variance No. 98-13 for 53 foot high hose tower in lieu of 35 feet will not
constitute a grant of special privilege inconsistent with limitations upon other properties in
the vicinity and under an identical zone classification. In single family residential zones,
similar to the subject property, chimneys, antennas, water tanks, fire towers, and similar
items are automatically permitted with a height of 45 feet, but additional height may also be
granted by the discretionary body upon approval of a conditional use permit. The variance is
requested because this exception is not explicitly included in the Holly Seacliff Specific Plan.
Due to the provisions for other single family residential zones, the variance request would
not constitute a grant of special privilege.
2. Because of special circumstances applicable to the subject property, including size,
topography, location or surroundings, the strict application of the zoning ordinance is found
to deprive the subject property of privileges enjoyed by other properties in the vicinity and
under identical zone classification. The subject property has a significant slope at the
western end and is surrounded by overhead and underground easements associated with the
Southern California Edison Substation due west of the subject property. In addition, a certain
amount of area is needed for access to the water reservoir and for maneuvering for fire
vehicles. As such, the construction of a shorter building long enough to dry the fire hose is
not feasible and results in the need for a vertical structure.
3. The granting of a variance is necessary to preserve the enjoyment of one or more substantial
property rights. The 53 foot height of the hose tower is necessary to provide adequate drying
area for the fire hose. The Fire Department now uses a five inch diameter hose to provide
better water flow for fighting fires, and this hose comes in 100 foot lengths. The fire hose
will be doubled in the proposed tower. Granting of the variance is necessary to ensure that
the hose tower is constructed which is integral to the Fire Department's operations.
4. The granting of the variance will not be materially detrimental to the public welfare or
injurious to property in the same zone classification. The proposed fire station facility is
necessary to provide adequate response times to protect life and property in the area, and the
height of the hose tower is necessary to properly dry the fire hose. The proposed tower will
assist in protecting the public welfare and is designed to be aesthetically pleasing with
architectural treatment similar to the fire station building and surrounding area.
5. The granting of the variance will not adversely affect the General Plan. It is consistent with
the Land Use Element designation of Residential Low Density on the subject property
because deviations from height may be allowed by discretionary bodies.
FINDINGS FOR APPROVAL FOR NEGATIVE DECLARATION NO.98-9:
1. The Negative Declaration No. 98-9 has been prepared in compliance with Article 6 of the
California Environmental Quality Act (CEQA) Guidelines. It was advertised and available
for a public comment period of thirty (30) days. Comments received during the comment
period were considered by the Planning Commission prior to action on the Negative
Declaration and Conditional Use Permit No. 98-48 and Variance No. 98-13.

2. Mitigation measures, incorporated into the attached conditions of approval, avoid or reduce
the project's effects to a point where clearly h6 significant effect on the environment will
occur.
3. There is no substantial evidence in light of the whole record before the Planning Commission
that the project, as mitigated through the conditions of approval for Conditional Use Permit
No. 98-48 and Variance No. 98-13 will have a significant effect on the environment.
CONDITIONS OF APPROVAL — CONDITIONAL USE PERMIT NO.98-48:
1. The site plan, floor plans, and elevations received and dated August 24, 1998 shall be the
conceptually approved layout.
2. Prior to submittal for building permits, the following shall be completed:
a. Zoning entitlement conditions of approval shall be printed verbatim on the cover page of
all the working drawing sets used for issuance of building permits (architectural,
structural, electrical, mechanical and plumbing).
b. All Fire Department requirements shall be noted on the building plans. (FD).
c. Depict all utility apparatus, such as but not limited to back flow devices and Edison
transformers on the site plan or grading plan. Utility meters shall be screened from view
from public rights -of -way. Electric transformers in a required front or street side yard
shall be enclosed in subsurface vaults. Backflow prevention devices shall be prohibited
in the front yard setback and shall be screened from view. (Code Requirement)
d. All exterior mechanical equipment shall be screened from view on all sides. Rooftop
mechanical equipment shall be setback 15 feet from the exterior edges of the building.
Equipment to be screened includes, but is not limited to, heating, air conditioning,
refrigeration equipment, plumbing lines, ductwork and transformers. Said screening shall
be architecturally compatible with the building in terms of materials and colors. If
screening is not designed specifically into the building, a rooftop mechanical equipment
plan showing screening must be submitted for review and approval with the application
for building permit(s). (Code Requirement)
e. If outdoor lighting is included, energy saving lamps shall be used. All outside lighting
shall be directed to prevent "spillage" onto adjacent properties and shall be shown on the
site plan and elevations.
3. Prior to issuance of grading permits, the following shall be completed:
a. A composite Grading and Site Improvement Plan, prepared by a Registered Civil
Engineer, shall be submitted to the Department of Public Works for review and approval.
This plan shall also include an erosion and silt control plan for all water runoff during
construction and site preparation work. Final grades and elevations on the Grading Plan
shall not vary from the approved site plan by more than one foot. (PW )

b. A detailed soils analysis shall be prepared by a registered engineer. This analysis shall
include on -site soil sampling and laboratory testing of materials to provide detailed
recommendations regarding: grading, retaining walls, streets, utilities, liquefaction and
chemical and fill properties. (PW) (Code Requirement)
c. In accordance with NPDES requirements, a "Water Quality Management Plan" shall be
prepared by a Civil or Environmental Engineer. The plan shall reduce the discharge of
pollutants to the maximum extent practical using management practices, control
techniques and systems, design and engineering methods, and such other provisions
which are appropriate. (PW) (Mitigation Measure)
d. The Contractor(s) shall coordinate with the City of Huntington Beach Traffic
Engineering Division in developing a truck and construction vehicle routing plan. This
plan shall specify the hours in which transport activities can occur and methods to
minimize construction related impacts to adjacent residents. These plans must be
approved by the Department of Public Works. (PW)
e. A Landscape and Irrigation Plan prepared and signed by a State Licensed Landscape
Architect must be submitted to the Department of Public Works and approved by the
Departments of Public Works and Community Development. The Plan shall include the
location, type, size and quantity of proposed plant materials; an irrigation plan; a grading
plan; an approved site plan and a copy of the entitlement conditions of approval. The
developer shall submit irrigation demands to ensure proper irrigation service sizing. The
plans shall include screen planting concentrated along the south, west and north sides of
the reservoir footprint. (PW) (Code Requirement) (Mitigation Measure)
f. Contractors shall produce evidence acceptable to the Department of Public Works that:
1. All construction vehicles or equipment, fixed or mobile, operated within 1,000 feet of
a dwelling shall be equipped with properly operating and maintained mufflers.
2. All construction operations shall comply with applicable City Noise Standards.
3. Stockpiling and/or vehicle staging areas shall be located as far as practicable from
dwellings.

g. The developer shall submit a composite utility plan showing water system improvements
and all other underground utilities (existing and proposed) to the proposed structures.

h. A hydrology and hydraulic study shall be submitted to the Department of Public Works
for review and approval. (PW)
i. Blockwall/fencing plans shall be submitted to and approved by the Department of
Community Development. The plans shall include section drawings, a site plan and
elevations. The plans shall identify materials, seep holes and drainage.

j. The site remediation work outlined in the Levine-Fricke-Recon study, dated February
1997, shall be fully implemented. Prior to commencing remedial work operations, the
responsible party (or parties) doing said work shall consult with the Department of
Conservation's Division of Oil, Gas and Geothermal Resources district office in Cypress
to coordinate the work and obtain written approval of said remedial work. All future
grading and site plans shall include the plotted locations of all existing and/or abandoned
wells. (Mitigation Measure)
4. During grading, the site shall be monitored on a full-time basis by a qualified archaeologist.
(Mitigation Measure)
5. Construction/grading hours shall be limited from 7 a.m. to 6 p.m., Monday through Friday
and shall not occur on weekends or holidays. (Mitigation Measure)
6. Prior to issuance of building permits, the following shall be completed:
a. No combustible construction shall occur until the approved water system has been
installed. (PW)
b. An interim parking and/or building materials storage plan shall be submitted to the
Department of Community Development to assure adequate parking and restroom
facilities are available for employees and contractors during the project's construction
phase and that adjacent properties will not be impacted by their location. The applicant
shall obtain any necessary encroachment permits from the Department of Public Works.
c. Submit gated entryway (access control devices) plans to the Department of Community
Development. The gated entryway shall comply with Fire Department Standard No. 403.
Prior to the installation of any gates, such plan shall be reviewed and approved by the
Community Development, Fire and Public Works Departments.
7. During construction, the applicant shall:
a. Use water trucks or sprinkler systems in all areas where vehicles travel to keep damp
enough to prevent dust raised when leaving the site:
b. Wet down areas in the late morning and after work is completed for the day;
c. Use low sulfur fuel (.05%) by weight for construction equipment;
d. Attempt to phase and schedule construction activities to avoid high ozone days (first
stage smog alerts);
e. Discontinue construction during second stage smog alerts.
8. Prior to final building permit inspection and approval, the following shall be completed:
a. All improvements to the property shall be completed in accordance with the approved
plans and conditions of approval specified herein, including:

1) On -site Landscaping.
2) A six inch (6") minimum VCP sewer lateral shall be designed and constructed. (PW)
3) A clarifier shall be installed in the storm drain. (PW)
4) All existing overhead utilities shall be installed underground in accordance with the
City's Underground Utility Ordinance. In addition, all electrical transformers shall be
installed underground. (PW)
5) Design and construct offsite drainage improvements to mitigate impacts to
downstream improvements due to increased runoff and/or reservoir overflow. (PW)
6) Design and construct all necessary street frontage improvements, i.e. curb, gutter,
sidewalk, etc., to Edwards Street and Overlook Drive. (PW)
7) A traffic signal shall be installed for the fire station at the exit driveway on Edwards
Street in a manner to be approved by the Department of Public Works. (Mitigation
Measure)
8) A pre-emptive fire system shall be interconnected with the two traffic signals at
Edwards Street/Ellis Avenue and Edwards Street/Garfield Avenue. (PW) (Mitigation

9) Design and install signal interconnect cable between Garfield Avenue/Edwards Street
and Ellis Avenue/Edwards Street per the City of Huntington Beach Traffic Signal
Plan and Preparation Guidelines. (PW) (Mitigation Measure)
10) A signing and striping plan shall be submitted for Edwards Street for review and
approval by the Department of Public Works. (PW)
11) Separate backflow protection shall be installed per the Huntington Beach Water
Division Standards for domestic, irrigation and fire water services. (PW)
12) A separate fire service lateral shall be installed to the proposed fire station building.
(PW)
13) The fire station building shall have separate domestic and irrigation meters (touch
read type) and service laterals, sized to meet the minimum requirements set by the
Uniform Plumbing Code (UPC) and Uniform Fire Code (UFC). The domestic water
service lateral size shall be a minimum of two inches. (PW)
14) Fire extinguishers will be installed and located in areas to comply with Huntington
Beach Fire Code Standards. (FD)
15) A fire alarm system will be installed to comply with Huntington Beach Fire
Department and Uniform Fire Code Standards. Shop drawings will be submitted to
and approved by the Fire Department prior to installation. The system will provide
the following:

a) annunciation;
b) water flow, valve tamper and trouble detection;
c) audible alarms; and
d) smoke detectors (FD)
16) Fire lanes shall be designated and posted to comply with City Specification No. 415.

17) Address numbers will be installed to comply with City Specification No. 428. (FD)
18) Exit signs and exit path markings will be provided in compliance with the
Huntington Beach Fire Code and Title 24 of the California Administrative Code.

19)Fire hydrants must be installed before combustible construction begins. Prior to
installation, shop drawings shall be submitted to the Public Works Department and
approve dby the Fire Department. The project requires three fire hydrants. (City
Specification No. 407) (FD)
20) An automatic fire sprinkler system shall be approved and installed pursuant to Fire
Department regulations. Shop drawings shall be submitted and approved prior to
installation. (FD)
21) The reservoir structure shall incorporate exterior elevation detailing in a manner to be
approved by the Department of Community Devleopment (including but not limited
to a contrasting color, raised reveal feature). (Mitigation Measure)
b. Vegetative screen planting shall be installed in conjunction with the fire station site
development within the existing parkway on the east side of Edwards Street. Placement
of plant materials shall be with the intent of closing gaps in existing vegetative materials
as shown in the Light Impact Site Plan of Negative Declaration No. 98-9 and shall be
done in a manner to be approved by the Departments of Public Works and Community
Development. (Mitigation Measure)
c. Compliance with all conditions of approval specified herein shall be accomplished and
verified by the Community Development Department.
d. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable
material, shall be disposed of at an off -site facility equipped to handle them.
e. The project will comply with all provisions of the Huntington Beach Fire Code and City
Specification No. 422 for the abandonment of oil wells. (FD)
f. The project will comply will all provisions of Huntington Beach Municipal Code Title
17.04.085 and City Specification No. 429, Methane District Building Permit

g. Installation and/or removal of underground flammable or combustible liquid storage
tanks shall comply with Orange County Environmental Health and HBFD requirements.

9. The use shall comply with the following:
a. The site shall be served from the Zone 2 Water Distribution System. (PW)
b. The Fire Department shall routinely utilize their ability to preempt the signal at their
driveway exit onto Edwards Street to enable emergency response without operating their
sirens until they are away from the project site. (Mitigation Measure)
c. The civil defense siren shall only be used for non -emergency situations during testing
which shall occur one weekday a month, between the hours of 12:00 p.m. and 5:00 p.m.
(Mitigation Measure)
d. The exterior public address system for the fire station shall be equipped with an automatic
reset button. The address system shall also be kept to an exterior volume which complies
with the City of Huntington Beach Noise Code. (Mitigation Measure)
10. The project shall comply with applicable mitigation measures of Environmental Impact
Report No. 89-1.
11. Future additions to the fire station shall be architecturally compatible with the proposed fire
station and shall be reviewed by the Design Review Board.
12. The Community Development Director ensures that all conditions of approval herein are
complied with. The Community Development Director shall be notified in writing if any
changes to the site plan, elevations and floor plans are proposed as a result of the plan check
process. Building permits shall not be issued until the Community Development Director has
reviewed and approved the proposed changes for conformance with the intent of the Planning
Commission's action and the conditions herein. If the proposed changes are of a substantial
nature, an amendment to the original entitlement reviewed by the Planning Commission may
be required pursuant to the HBZSO.
INFORMATION ON SPECIFIC CODE REOUIREMENTS:
1. Conditional Use Permit No. 9844Nariance No. 98-13 shall not become effective until the
ten day appeal period has elapsed.
2. Conditional Use Permit No. 9844Nariance No. 98-13 shall become null and void unless
exercised within one year of the date of final approval or such extension of time as may be
granted by the Director pursuant to a written request submitted to the Department of
Community Development a minimum 30 days prior to the expiration date.
3. The Planning Commission reserves the right to revoke Conditional Use Permit No. 98-
44Nariance No. 98-13 pursuant to a public hearing for revocation, if any violation of these
conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code
occurs.

4. All applicable Public Works fees shall be paid prior to certificate of occupancy. (PW)
5. A Certificate of Occupancy must be issued by the Department of Community Development

as shown on figures in the City's General Plan Circulation Element and is necessary to achieve
compliance with the Orange County Master Plan of Arterial Highways.
STAFF RECOMMENDATION:
Staff recommends approval of the amendment to the Circulation Plan of Arterial Streets and
Highways to include the segment of Indianapolis between Beach Boulevard and Lake Street as a

for street improvement projects. On July 20, 1998 the City Council approved Resolution No.
98-48B "Reaffirming the Circulation Plan of Arterial Streets and Highways, and Authorizing the
Initiation of a General Plan Amendment for its Inclusion in the Circulation Element of the
General Plan. The amendment is consistent with the City Council's action.

located on the south side of Talbert Avenue, approximately 300 feet east of Beach Boulevard.
The Wal Mart building is proposed as a 24-hour operation and includes a tire, lube, and battery
service facility in addition to the garden center and general retail sales. The project includes a
request to permit perimeter walls which exceed maximum wall height (up to 15 feet high in lieu
of the maximum 8 feet allowed by code), a variance to allow a driveway opening within the main
project entrance, and signs which exceed maximum height and sign area permitted by code. The
project also includes a request for a four lot subdivision. Uses for the three (3) ancillary
retail/restaurant pads are unknown at this time and depending upon the actual use proposed may
require subsequent discretionary review.
Arnel Retail Group has submitted a request for continuance of the October 27, 1998 Planning
Commission meeting. Arnel has stated that they request continuance for the following reasons:

Commissioner Kerins — asked if staff had responded to the letter from Doug Stewart.
Staff stated that there had been several telephone conversations with Mr. Stewart and the
letter was being prepared.
Commissioner Chapman — requested a study session prior to any public hearing on the
31 Acres project site on Pacific Coast Highway to discuss the ramifications if the City
