This meeting was held in the city of Santa Ana pursuant to Government Code Section
54954(b)(1) to comply with the court order of Orange County Superior Court Judge Francisco
Firmat.
The City Attorney had distributed a communication to the Mayor and City Councilmembers titled
Court Order Regarding Franks vs. City of Huntington Beach, OCSC Case No. 78 22 68 dated
September 30, 1998.
CALL TO ORDER
Mayor Dettloff called the adjourned regular meetings of the City Council and the Redevelopment
Agency of the City of Huntington Beach to order at 10:30 a.m. in the Orange County Superior
Court, Department 25, in the city of Santa Ana.
Judge Firmat asked the City Clerk if there was business that the City Council must conduct at
this time. The City Clerk stated that she wished to call the roll of the City Council and that she
would like to be informed of the time at which this meeting is not an open meeting so that she
could excuse herself from attendance.
Judge Firmat requested that the City Clerk call the roll.

Present: Julien, Green, Dettloff, Sauer
Absent: Harman, Sullivan, Garofalo
DISCUSSION REGARDING MATTER OF LITIGATION -- FRANKS V. CITY OF HUNTINGTON
BEACH — OCSCC NO.78 22 68
Judge Firmat stated that the meeting to commence would be a settlement conference and that a
settlement conference is not open to the public,
City Attorney Hutton referred to the Brown Act requirements. Judge Firmat cited cases which
he believed to be relevant and which would allow the City Council to meet in closed session.
City Attorney Hutton stated that this information would be studied; however, the city would defer
to the court.

PUBLIC COMMENTS REGARDING CLOSED SESSION AGENDA ITEM
There were no persons present to address Council regarding the closed session item scheduled
on the agenda.
MOTION TO RECESS TO CLOSED SESSION
A motion was made by Green, second Julien, to recess the City Council to closed session
pursuant to Government Code Section 54956.9(a) to confer with its attorney regarding pending
litigation which has been initiated formally and to which the city is a party. The title of the
litigation is Franks v. City of Huntington Beach — Orange County Superior Court Case
No. 78 22 68. The motion carried by the following roll call vote:
AYES: Julien, Green, Dettloff, Bauer
NOES: None
ABSENT: Harman, Sullivan, Garofalo
RECONVENE
The adjourned regular meetings of the City Council and the Redevelopment Agency of the City of
Huntington Beach were reconvened.
ADJOURNMENT
The adjourned regular meetings of the City Council and the Redevelopment Agency of the City
of Huntington Beach were adjourned at 12:30 p.m. to Monday, October 5, 1998 at 5:00 p.m. in
Room B-8, Civic Center, 2000 Main Street, Huntington Beach, California.
