ITEM 1: CONDITIONAL USE PERMIT NO. 98-47/COASTAL DEVELOPMENT PERMIT
® NO. 98-16 (CATERINA' S OUTDOOR DINING)

REQUEST: To permit outdoor dining with a maximum of five tables and twenty
seats on private property.
LOCATION: 300 Pacific Coast Highway, No. 107B
PROJECT PLANNER: Ricky Ramos
Ricky Ramos, Staff Planner, displayed project plans stating the purpose, location and zoning of the
requested project. Staff recommended approval of the request based upon the findings and subject to
the conditions as outlined in the staff report.
Herb Fauland, Zoning Administrator, confirmed with staff that no written or verbal comments were
received in response to the public notification.
THE PUBLIC HEARING WAS OPENED.
Josie Rietkerk, P. O. Box 5587, San Clemente, applicant, stated that she was present and had no
comments at this time.
Mr. Fauland confirmed with the applicant that they have read the suggested conditions of approval and
are willing to comply.

CONDITIONAL USE PERMIT NO. 98-47/COASTAL DEVELOPMENT PERMIT NO. 98-16
WERE APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING
FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION
TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING
COMMISSION WITHIN TEN (10) WORKING DAYS.
FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO. 98-16:
1. Coastal Development Permit No. 98-16 for outdoor dining in conjunction with an eating
establishment conforms with the General Plan, including the Local Coastal Program. The
proposed outdoor dining will not impact public views or access to coastal amenities and complies
with the clear passage area provisions of the Downtown Specific Plan.
2. The project is consistent with the requirements of the CZ Overlay District, the base zoning district,
as well as other applicable provisions of the Municipal Code. No additional parking is required
based on the number of tables and chairs proposed. The proposal includes eight (8) feet of clear
passage area for pedestrian access as required by the Downtown Specific Plan.
3. At the time of occupancy the proposed development can be provided with infrastructure in a
manner that is consistent with the Local Coastal Program. Infrastructure currently exist to the site
and will not be affected by the outdoor dining request. •
4. The development conforms with the public access and public recreation policies of Chapter 3 of
the California Coastal Act. No public access or recreation will be affected by the outdoor dining
request.
FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 98-47:
Conditional Use Permit No. 98-47 for the establishment, maintenance and operation of tables and
chairs for outdoor dining will not be detrimental to the general welfare of persons working or
residing in the vicinity or detrimental to the value of the property and improvements in the
neighborhood. Adequate pedestrian and handicap access is provided per code. The sidewalk's
public use, pedestrian, transit and business services including but not limited to loading zones, bus
stops, public phones, and benches, are not restricted. Building entryways are not obstructed.
Pedestrian traffic volumes are not inhibited.
2. The conditional use permit will be compatible with surrounding uses because there are several
establishments in the area with outdoor dining.
The proposed outdoor dining will comply with the provisions of the base district and other
applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance
and any specific condition required for the proposed use in the district in which it would be
located. A minimum eight (8) foot clear passage for pedestrian access is provided. No additional
parking is required based on the number of tables and chairs requested.

4. The granting of the conditional use permit will not adversely affect the General Plan. It is
• consistent with the Land Use Element designation of Mixed Use Vertical on the subject property.
CONDITIONS OF APPROVAL - COASTAL DEVELOPMENT PERMIT NO. 98-16/
CONDITIONAL USE PERMIT NO.98-47:
1. The site plan received and dated September 11, 1998 shall be the conceptually approved layout.
2. The outdoor dining shall comply with the following:
a. All features of the outdoor dining, including but not limited to tables and chairs shall be
removed after business hours.
b. Outdoor dining shall maintain a minimum eight (8) feet of clear passage area for pedestrian
access as well as a minimum four (4) feet of access for the handicap.
c. All features of the outdoor dining area shall be maintained in a neat and clean manner.
d. The outdoor dining area shall be available for use by the general public.
3. The Planning Director ensures that all conditions of approval herein are complied with. The
Planning Director shall be notified in writing if any changes to the site plan are proposed. The
Planning Director shall review and approve the proposed changes for conformance with the intent
® of the Zoning Administrator's action and the conditions herein. If the proposed changes are of a
substantial nature, an amendment to the original entitlement reviewed by the Zoning Administrator
may be required pursuant to the HBZSO.
INFORMATION ON SPECIFIC CODE REOUIREMENTS:
Conditional Use Permit No. 98-47 and Coastal Development Permit No. 98-16 shall not become
effective until the ten day appeal period has elapsed.
2. Conditional Use Permit No. 98-47 and Coastal Development Permit No. 98-16 shall become null
and void unless exercised within one year of the date of final approval or such extension of time
as may be granted by the Director pursuant to a written request submitted to the Department of
Planning a minimum 30 days prior to the expiration date.
The Zoning Administrator reserves the right to revoke Conditional Use Permit No. 98-47 and
Coastal Development Permit No. 98-16, pursuant to a public hearing for revocation, if any
violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or
Municipal Code occurs.
4. The development shall comply with all applicable provisions of the Municipal Code, Department
of Building, and Fire Department as well as applicable local, State and Federal Fire Codes,
Ordinances, and standards, except as noted herein.
5. The applicant shall submit a check in the amount of $38.00 for the posting of the Notice of
Exemption at the County of Orange Clerk's Office. The check shall be made out to the

County of Orange and submitted to the Department of Planning within two (2) days of the
Zoning Administrator's action.

ITEM 2: CONDITIONAL USE PERMIT NO 98-43 (BEACH VILLAS ENTRANCE GATE
APPLICANT:

To install a project entry gate at the main entry of the Beach Villas
residential development.

PROJECT PLANNER:

requested project. Staff recommended approval of the request based upon the findings and subject to
the conditions as outlined in

Herb Fauland, Zoning Administrator, and staff discussed the comments received from the Fire
Department.
THE PUBLIC HEARING WAS OPENED.
Joanna Bronowicka, 8072 Windy Sea Circle, neighboring property owner, stated that she supports the •
proposed project.
A representative from the homeowner's association stated that they support the proposed project.
Ms. Markman, 8091 Windy Sea Circle, neighboring property owner, stated that she supports the
proposed project.
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE
REQUEST AND THE PUBLIC HEARING WAS CLOSED.
CONDITIONAL USE PERMIT NO. 98-43 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN
TEN (10) CALENDAR DAYS.
FINDINGS FOR PROJECTS EXEMPT FROM CEOA:
The Zoning Administrator finds that the project will not have any significant effect on the environment
and is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to
Section 15311, Class 11 of the CEQA Guidelines, because the request is a minor accessory to an •
existing use.

FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 98-43 :
® 1. Conditional Use Permit No. 98-43 for the establishment, maintenance and operation of the security
gate system at the main entry will not be detrimental to the general welfare of persons working or
residing in the vicinity or detrimental to the value of the property and improvements in the
neighborhood. It will provide increased security and safety to residents of the Beach Villas
residential complex. Additionally, adequate vehicle stacking is provided.
2. The conditional use permit will be compatible with surrounding uses because it will not impact
access for the other residents in the neighborhood. The gate will enhance the image of the
development and be setback into the Beach Villas residential complex away from the public right-
of-way.
The proposed security gate system will comply with the provisions of the base district and other
applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance
and any specific condition required for the proposed use in the district in which it would be
located. The security gate system is adequately setback and will comply with Fire Department
specifications.
4. The granting of the conditional use permit will not adversely affect the General Plan. It is
consistent with the Land Use Element designation of Residential Low Density on the subject
property.
® CONDITIONS OF APPROVAL — CONDITIONAL USE PERMIT NO. 98-43:
1. The site plan and security gate elevation received and dated October 13, 1998 shall be the
conceptually approved layout.
2. Prior to submittal for building permits, the following shall be completed:
a. Zoning entitlement conditions of approval shall be printed verbatim on the second page of all
the working drawing sets used for issuance of building permits (architectural, structural,
electrical, mechanical and plumbing).
b. Add a strobe switch for emergency vehicle activation on the plans per Fire Department
Specification No. 403. (FD)
c. The applicant shall have the security gate plan approved (signed off) by the Fire Department,
before submission to the Planning and Building and Safety Departments for permit issuance.
3. Prior to final building permit inspection and approval, the following shall be completed:
a. Compliance with all conditions of approval specified herein shall be accomplished and verified
by the Department of Planning.
b. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material,
shall be disposed of at an off -site facility equipped to handle them.

c. The security gate must comply with Fire Department Specification No. 403. (FD)
4. The Planning Director ensures that all conditions of approval herein are complied with. The
Planning Director shall be notified in writing if any changes to the site plan, elevations and floor
plans are proposed as a result of the plan check process. Building permits shall not be issued until
the Planning Director has reviewed and approved the proposed changes for conformance with the
intent of the Zoning Administrator's action and the conditions herein. If the proposed changes are
of a substantial nature, an amendment to the original entitlement reviewed by the Zoning
Administrator may be required pursuant to the HBZSO.

County of Orange and submitted to the Department of Planning within two (2) days of the
Zoning Administrator's action.

® ITEM 3: VARIANCE NO.98-21 (ZENK ADDITION)

REQUEST:
To permit a covered carport with eaves a distance of five (5) feet from
the side property line in -lieu of the required ten (10) foot street side
yard setback, to permit a covered and uncovered porch with eaves a
distance of six (6) feet, six (6) inches from the front property line in -lieu
of the required 15 foot front yard setback, and to permit 14 square feet
of living area a distance of 13 feet 6 inches from the front property line
in lieu of the required 15 foot front yard setback.

PROJECT PLANNER:

Bob Goldin, Staff Planner, displayed project plans and photographs stating the purpose, location and
zoning of the requested project. Staff recommended denial of the request stating that, contrary to the
initial review, findings could not be developed and conditions could not be met to comply with code.
Staff stated that a letter was received from the applicant requesting the opportunity to present options
® in order to meet findings and conditions of approval. Staff stated that no adverse comments were
received as a result of the public notification. Staff presented pictures of properties in the surrounding
area with similar situations and presented a petition signed by surrounding property owners in support
of the proposed project. Staff stated that due to the uniqueness of the lot, approval was being
recommended with the findings and conditions of approval to be developed.
Herb Fauland, Zoning Administrator, reviewed the site plans with staff and discussed alternatives to
the request in order to meet code requirements and enhance the property. Mr. Fauland stated that he
did visit the site and surrounding properties. He asked staff to develop findings and conditions of
approval stating that a precedent has been set by other homes in the neighborhood, which can justify
approval of this request.
THE PUBLIC HEARING WAS OPENED.
Harry Monck, 303 Cleveland Drive, applicant, stated that they were not aware of any problems
leading to a denial of the request until one week prior to today's hearing. Mr. Monck stated that had
they been given timely notice, they could have made adjustments to satisfy a recommendation for
approval at today's hearing. He presented alternatives to the original application.
Jeanne Zenk, 304 Springfield Avenue, property owner, stated that they are willing to work with staff
in order to modify the request to obtain an approval.
Mr. Fauland stated that he did read the letter received from the property owner. He apologized for
any miscommunication on the part of the City that may have caused delays and stress.

Mr. Fauland stated that he was going to continue the item to the December 9, 1998 meeting to allow
staff and the applicant adequate time to draft findings and conditions of approval for the request. The
applicant agreed to the continuance.
VARIANCE NO. 98-21 WAS CONTINUED TO THE DECEMBER 9, 1998 MEETING.
ITEM 4 COASTAL DEVELOPMENT PERMIT NO 98-25 (PLC STOCK PILE)
APPLICANT/
PROPERTY OWNER: PLC Land Company, 23 Corporate Plaza, Suite 250, Newport Beach,
CA 92660
REQUEST: To import and stockpile approximately 60,000 cubic yards of soil.
LOCATION: 20031 Goldenwest (west side of Goldenwest, south of Palm)
PROJECT PLANNER: Victor Van Zandt
Victor Van Zandt, Staff Planner, displayed project plans stating the purpose, location and zoning of
the requested project. Staff presented a review of the suggested findings and conditions of approval.
Staff stated that one telephone call was received from Bob Mc Claire, 513 22"d Street, neighboring
property owner, concerning dust during and after the stockpiling and the number of truck trips. Staff
stated that the foregoing concerns would be mitigated by the suggested conditions of approval. is
Staff recommended approval of the request based upon the findings and subject to the conditions as
outlined in the staff report.
Herb Fauland, Zoning Administrator, and staff discussed the height of the stockpile as recommended
by Public Works and the number of truck trips.
THE PUBLIC HEARING WAS OPENED.
Bill Holman, PLC Land Company, 23 Corporate Plaza, Suite 250, Newport Beach, applicant, stated
that they have reviewed the suggested conditions of approval. Mr. Holman questioned the necessity
for Condition No. 2.d, and requested a maximum height requirement of 10 ft. for the stockpile. He
stated that all other suggested conditions of approval were acceptable.
Mr. Fauland and the applicant discussed the number of truck trips and the duration of the operation.
John Ouren, 304 Goldenwest Street, neighboring property owner, expressed concerns regarding the
number of truck trips, soil contamination, height of the stockpile, and the unsightly view of the site
from his home.
Staff and the applicant addressed the foregoing concerns citing the controls imposed in the suggested
conditions of approval. •

REQUEST AND THE PUBLIC HEARING WAS CLOSED.
Mr. Fauland stated that he was going to approve the request and asked staff to modify the conditions
as follows:

Water, hydroseeding, and other controls shall be used both during the stockpiling and shall
continue until such time as the stockpiling is eliminated to control the effects of the shore breeze
and wind from blowing the stockpiled material beyond the limits of the site. (PW)
COASTAL DEVELOPMENT PERMIT NO. 98-25 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND MODIFIED CONDITIONS
OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN
TEN (10) WORKING DAYS.
FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO.98-25:
1. Coastal Development Permit No. 98-25 for the development project, as modified by conditions of
approval, conforms with the General Plan, including the Local Coastal Program.
2. The project is consistent with the requirements of the CZ Overlay District, the base zoning district,
as well as other applicable provisions of the Municipal Code.
3. The development conforms with the public access and public recreation policies of Chapter 3 of
the California Coastal Act.
CONDITIONS OF APPROVAL - COASTAL DEVELOPMENT PERMIT NO. 98-25:
1. The grading plan dated September 29, 1998 shall be the conceptually approved layout.
2. Prior to issuance of grading permits, the following shall be completed:
a. A grading plan, prepared by a Registered Civil Engineer, shall be submitted to the Department
of Public Works for review and approval. (PW)
b. A plan for silt control for all water runoff from the property during construction and initial
operation of the project may be required if deemed necessary by the Director of Public Works.

c. An erosion control plan shall be submitted to the Department of Public Works. (PW)

3. During grading activities, the applicant shall: 0
a. Use water trucks or sprinkler systems in all areas where vehicles travel to keep damp enough
to prevent dust raised when leaving the site:
b. Wet down areas in the late morning and after work is completed for the day;
c. Use low sulfur fuel (.05%) by weight for construction equipment;
d. Attempt to phase and schedule construction activities to avoid high ozone days (first stage
smog alerts);
e. Discontinue construction during second stage smog alerts.
4. The use shall comply with the following:
a. Only the uses described in the narrative shall be permitted.
b. All imported soils shall meet city Specification 431-92 standards regarding soil contamination.

c. The stockpile height shall be kept to a maximum of 8 feet. (PW)
d. Water, hydroseeding, and other controls shall be used both during the stockpiling and shall
continue until such time as the stockpiling is eliminated to control the effects of the shore
breeze and wind from blowing the stockpiled material beyond the limits of the site. (PW)
e. No truck traffic shall be permitted on Palm Avenue. Access to the site shall be via Goldenwest
Street. (PW)
f. The developer shall coordinate with the City of Huntington Beach Traffic Engineering Division
in developing a truck and construction vehicle routing plan. This plan shall specify how
vehicles will access the site, the hours in which transport activities can occur, and methods to
minimize construction related impacts to adjacent streets. These plans must be approved by
the Department of Public Works. (PW)

REQUEST: Remediation of contaminated soil which includes the import and export
of 1,960 cubic yards.
LOCATION: 2200 Pacific Coast Highway (block between 22nd and Goldenwest)
PROJECT PLANNER: Peter Vanek
Peter Vanek, Staff Planner, displayed project plans stating the purpose, location and zoning of the
requested project. Staff stated that a coastal development permit is required because the import and
export of the soil exceeds 100 cubic yards. No written or verbal comments were received in response

Dean Gregg, 6942 Derby Circle, property owner, stated that they have reviewed the suggested
conditions of approval and questioned Condition No. 2.b.

COASTAL DEVELOPMENT PERMIT NO. 98-26 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN
TEN (10) WORKING DAYS.
FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO.98-26:
Coastal Development Permit No. 98-26 for the development project, as proposed or as modified
by conditions of approval, conforms with the General Plan, including the Local Coastal Program.
The proposed soil remediation is consistent with the land use designation of Mixed Use of the
subject property.
2. The project is consistent with the requirements of the CZ Overlay District, the base zoning district, •
as well as other applicable provisions of the Municipal Code. The proposed soil remediation will
conform with all applicable codes as allowed by the coastal development permit.
3. At the time of occupancy the proposed development can be provided with infrastructure in a
manner that is consistent with the Local Coastal Program. All infrastructure will be installed upon
commencement of any structures on the site.
4. The development conforms with the public access and public recreation policies of Chapter 3 of
the California Coastal Act. The proposed remediation will no impact public views or access to
coastal resources.
CONDITIONS OF APPROVAL - COASTAL DEVELOPMENT PERMIT NO. 98-26:
1. The soil remediation plan dated October 7, 1998 shall be the conceptually approved plan.
2. The use shall comply with the following:
a. The developer shall coordinate with the City of Huntington Beach Traffic Engineering Division
in developing a truck and construction vehicle routing plan. This plan shall specify how
vehicles will access the site, the hours in which transport activities can occur, and methods to
minimize construction related impacts to adjacent streets and shall be approved by the •
Department of Public Works.

b. All abandoned oil pipe lines within the alley shall be removed. (PW)
® c. An as -built grading/compaction plan and report shall be required. (PW)
d. All water shall drain directly into a desilting basin prior to release on to City streets. (PW)
e. All import soils must meet criteria as outlined in City Specification No. 431-92. (FD)
3. The Planning Director ensures that all conditions of approval herein are complied with. The
Planning Director shall be notified in writing if any changes to the soil remediation plan are
proposed as a result of the plan check process. Building permits shall not be issued until the
Planning Director has reviewed and approved the proposed changes for conformance with the
intent of the Zoning Administrator's action and the conditions herein. If the proposed changes are
of a substantial nature, an amendment to the original entitlement reviewed by the Zoning
Administrator may be required pursuant to the HBZSO.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
Coastal Development Permit No. 98-26 shall not become effective until the ten day appeal period
has elapsed.
2. Coastal Development Permit No. 98-26 shall become null and void unless exercised within one
year of the date of final approval or such extension of time as may be granted by the Director
pursuant to a written request submitted to the Planning Department a minimum 30 days prior to
the expiration date.
3. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 98-26,
pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington
Beach Zoning and Subdivision Ordinance or Municipal Code occurs.
4. All applicable Public Works fees shall be paid. (PW)
5. An encroachment permit shall be required for all work within the right-of-way. (PW)
6. The development shall comply with all applicable provisions of the Municipal Code, Department
of Building, and Fire Department as well as applicable local, State and Federal Fire Codes,
Ordinances, and standards, except as noted herein.
7. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction shall be
prohibited Sundays and Federal holidays.
8. The applicant shall submit a check in the amount of $38.00 for the posting of the Notice of
Exemption at the County of Orange Clerk's Office. The check shall be made out to the
County of Orange and submitted to the Department of Planning within two (2) days of the
Zoning Administrator's action.
